Issuing National Technical Regulations on Water Conservancy Works, Disaster Prevention and Mitigation - Part I. Water Conservancy Works - Main Provisions on Design
Based on Decree No. 105/2022/NĐ-CP dated November 22, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

PURSUANTBased on the Law on Legislative Regulatory Documents dated June 22, 2005;Based on Decree No. 127/2007/NĐ-CP dated August 1, 2007 of the Government detailing the implementation of certain provisions of the Law on Standards and Technical Regulations, and Decree No. 78/2018/NĐ-CP dated May 16, 2018 of the Government amending and supplementing certain provisions of Decree No. 127/2007/NĐ-CP dated August 1, 2007 of the Government detailing the implementation of certain provisions of the Law on Standards and Technical Regulations;

Pursuant to the Law on Standards and Technical Regulations dated June 29, 2006;

Based on Decree No. 34/2016/NĐ-CP dated May 14, 2016 of the Government detailing certain provisions and measures to implement the Law on Legislative Regulatory Documents, and Decree No. 154/2020/NĐ-CP dated December 31, 2020 of the Government amending and supplementing certain provisions of Decree No. 34/2016/NĐ-CP dated May 14, 2016 of the Government detailing certain provisions and measures to implement the Law on Legislative Regulatory Documents; 2015;

Based on the Law Amending and Supplementing Certain Provisions of the Law on Enactment of Legislative Acts dated June 18, 2020;

At the proposal of the Director of the Construction Management Agency for Projects;The Minister of Agriculture and Rural Development issues this Circular on National Technical Regulations on Water Conservancy Works, Disaster Prevention and Mitigation - Part I. Water Conservancy Works - Main Provisions on Design.This Circular hereby promulgates National Technical Regulations on Water Conservancy Works, Disaster Prevention and Mitigation - Part I. Water Conservancy Works - Main Provisions on Design. Code: QCVN 04-05:2022/TT-BNNPTNT.

Article 1. This Circular takes effect from July 1, 2023. Article 2. Repeal Circular No. 27/2012/TT-BNNPTNT dated June 26, 2012 of the Ministry of Agriculture and Rural Development on National Technical Regulations on Water Conservancy Works.Clause 1. For water conservancy works construction projects approved for investment before the effective date of this Circular, continue to apply QCVN 04-05:2012/TT-BNNPTNT until completion of construction.

Clause 2. For water conservancy and hydropower works that have commenced construction prior to the effective date of these technical regulations, they must apply these regulations when undergoing renovation, upgrading, or demolition.Article 3. Ministries, ministerial-level agencies, agencies under the Government, People's Committees of provinces and centrally-administered cities, and related organizations and individuals shall be responsible for implementing this Circular.Article 4. In the course of implementation, if there are difficulties, agencies, organizations, and individuals shall promptly report to the Ministry of Agriculture and Rural Development for review and amendment./.

Article 1. This Circular promulgates the National Technical Regulations on Water Conservancy Works - Disaster Prevention and Mitigation - Part I. Water Conservancy Works - Main Provisions on Design. Code: QCVN 04-05:2022/TT-BNNPTNT.

Article 2. Effectiveness

1. This Circular takes effect from July 1, 2023.

2. Repeal Circular No. 27/2012/TT-BNNPTNT dated June 26, 2012, of the Ministry of Agriculture and Rural Development on National Technical Regulations on Water Conservancy Works.

Article 3. Investment projects related to the provisions at Amendment 1:2025 QCVN 07:2023/BXD issued accompanying this Circular that have been approved before this Circular takes effect shall continue to be implemented according to the regulations at the time of approval; the investment decision maker has the right to choose to apply Amendment 1:2025 QCVN 07:2023/BXD issued accompanying this Circular.

1. For water conservancy works construction projects approved for investment before this Circular takes effect, continue to apply QCVN 04-05:2012/TT-BNNPTNT until completion of construction.

2. For water conservancy and hydropower works that have commenced construction prior to the effective date of these technical regulations, must apply these regulations when undergoing renovation, upgrading, or demolition.

Article 4. Implementation

1. Ministries, ministerial-level agencies, government agencies, provincial People's Committees, centrally governed cities, and related organizations and individuals are responsible for implementation.

2. During implementation, if there are difficulties, relevant agencies, organizations, and individuals shall promptly report to the Ministry of Agriculture and Rural Development for review and amendment./.
