On the land use planning until 2020 and the five-year land use plan for the first term (2011 - 2015) of Ha Nam province

Pursuant to the Law on the Organization of the Government dated December 25, 2001;

Pursuant to the Land Law dated November 26, 2003;

Considering the proposal of the People's Committee of Ha Nam province (Report No. 2065/TTr-UBND dated November 26, 2012) and the Ministry of Natural Resources and Environment (Report No. 85/TTr-BTNMT dated December 6, 2012),

RESOLUTION:

Article 1. Approves the land use planning until 2020 for Ha Nam province with the following indicators:

Article 3. On the basis of this Resolution, the People's Committee of Ha Nam province shall be responsible for:

1. Organizing the implementation of the land use planning and plan; reviewing the planning of sectors and fields that use land to ensure consistency with the approved land use planning and plan; the development and implementation of land use planning and plans must be strictly consistent from the provincial level to the commune level, meeting the requirements for economic and social development, ensuring national defense and security within the province; taking specific measures to mobilize capital and other resources to implement the provincial land use planning scheme;

2. Reclaiming to expand the area of agricultural production land, forestry land, aquaculture land to compensate for the agricultural land area lost due to change of land use purpose;

3. Determining boundaries and publicly announcing the areas of rice cultivation land and protective forests that need strict protection; ensuring the interests between areas suitable for industrial, urban, and service development and those retaining large areas of rice cultivation land; increasing investment in social infrastructure, technical infrastructure, building storage, processing, and consumption facilities for commercial rice at the local level;

4. Proactively reclaiming land according to the planning and land use plan, including reclaiming adjacent land around infrastructure projects and surrounding areas to generate funds for development and create a land fund for technical and social infrastructure projects. At the same time, prioritizing resettlement for people whose land has been reclaimed by allocating them land or selling them houses on the reclaimed land (in-place relocation) in accordance with the law. Promoting the auction of land use rights and bidding for projects using land;

5. Managing land use in accordance with the approved land use planning and plan, especially in areas intended for change of land use purpose; organizing strict management and supervision of the development planning of urban areas, industrial zones, industrial clusters, non-agricultural production and business land in accordance with the plan, being economical and effective; strengthening inspection and supervision of land management and use according to the plan to promptly prevent and strictly handle violations of land use planning and plan, cases where land has been allocated or leased but not used;

6. Annually, the People's Committee of the province shall report on the results of implementing the land use planning and plan to the Government for consolidation and reporting to the National Assembly.

Article 4. The Chairman of the People's Committee of Ha Nam province, heads of relevant ministries and sectors shall be responsible for enforcing this Resolution./.
