DIRECTIVE
On Strengthening Measures to Combat Illegal Logging in Areas Along the Ho Chi Minh Road
In recent times, localities along the Ho Chi Minh Road have not only conducted extensive propaganda and mobilization efforts to encourage people's active participation in forest management and protection but also strengthened guidance and implementation of the project to plant five million hectares of new forests, thus restoring many forest areas and reducing illegal logging activities. As a result, forest coverage has increased. However, illegal logging remains unresolved in some places, particularly recently becoming severe and complex in construction zones along the Ho Chi Minh Road.
To address this situation, the Prime Minister requests relevant ministries, sectors, and local authorities along the Ho Chi Minh Road construction route to immediately implement the following urgent measures:
1. Provincial People's Committees under the Central Government must strengthen their responsibility for state management of forests and forestry land according to Decision No. 245/1998/QĐ-TTg dated December 21, 1998 of the Prime Minister, and at the same time inspect the responsibility of state management of forests and forestry land of subordinate levels within their jurisdiction.
Direct functional agencies to coordinate with local authorities to strictly implement Directive No. 286/TTg dated May 2, 1997 of the Prime Minister on strengthening urgent measures to protect and develop forests, and Directive No. 287/TTg dated May 2, 1997 of the Prime Minister on organizing inspections to track down individuals and organizations destroying forests; in the short term, focus on directing relevant departments and levels to closely monitor the implementation of current state regulations on forest management and protection by forest owners in areas along the Ho Chi Minh Road and construction units.
Based on approved road design documents, direct competent agencies to proactively organize the handover of boundary lines on-site according to Decision No. 18/2000/QĐ-TTg dated February 3, 2000 of the Prime Minister regarding investment in the Ho Chi Minh Road construction project.
Direct the exploitation and utilization of timber on forest areas that have been handed over for construction site clearance according to the guidelines of the Ministry of Agriculture and Rural Development. Strictly prohibit the misuse of forest products during construction to illegally cut down and log forests beyond permitted areas.
Promptly handle individuals and organizations violating forest management and protection regulations during the organization of road construction strictly in accordance with the law.
The Ministry of Agriculture and Rural Development shall immediately develop a plan to combat illegal logging during the construction of the Ho Chi Minh Road; direct the implementation of a protective forest planting project along both sides of the road to protect forests and the environment.
The Ministry of Transport shall strengthen supervision, direction, and management of construction units along the Ho Chi Minh Road to take preventive measures against the misuse of road construction to illegally log forests. All cases of clearing forests for road construction must comply with state regulations. Organize the marking of road boundaries and green belts, and cooperate with the Ministry of Agriculture and Rural Development to implement measures to protect forests and plant trees along the road.
Relevant ministries and sectors, within their functions and responsibilities, are responsible for coordinating with the Ministry of Agriculture and Rural Development and the Ministry of Transport to organize forces to combat illegal logging and direct units under their ministries and sectors to effectively implement this directive./.
