JOINT CIRCULAR

Guidelines for implementing certain contents of Decision No. 71/2009/QD-TTg

dated April 29, 2009 of the Prime Minister approving the project "Supporting poor districts to promote labor export

contributing to sustainable poverty reduction during the period 2009-2020" Pursuant to the State Budget Law on December 16, 2002 and Decree No. 60/2003/NĐ-CP of June 10, 2003 of the Government detailing and guiding the implementation of the State Budget Law;

Pursuant to Decision No. 71/2009/QD-TTg of April 29, 2009 of the Prime Minister approving the Project Supporting Poor Districts to Promote Labor Export Contributing to Sustainable Poverty Reduction during the Period 2009-2020;

The Ministry of Labor, Invalids and Social Affairs and the Ministry of Finance issue guidelines for implementing certain contents of Decision No. 71/2009/QD-TTg of April 29, 2009 of the Prime Minister approving the Project "Supporting Poor Districts to Promote Labor Export Contributing to Sustainable Poverty Reduction during the Period 2009-2020" (hereinafter referred to as the Project) as follows:

Pursuant to the Law on Vietnamese Workers Going to Work Abroad Under Contracts dated November 29, 2006;

PART I. GENERAL PROVISIONS

1. Scope: This Circular guides the sources of funds for implementing the Project; establishment, allocation, and decision-making on budget estimates; management, use, and settlement of accounts for funds; contents, levels of expenditure, procedures, and formalities for support under the policies and activities of the Project.

a) Workers residing in poor districts with permanent residence registration or temporary residence registration for at least twelve months from the date of legal residence confirmation by competent authorities.

Article 1. Scope and Applicability

b) Organizations and enterprises operating under the Law on Vietnamese Workers going to work abroad under contracts (hereinafter referred to as enterprises) participating in the Project.

c) Agencies, units, and organizations assigned tasks to implement the policies and activities of the Project.

1. The source of funds for implementing the policy of supporting workers to improve their cultural level to participate in labor export; activities for communication and enhancing capacity and awareness about labor export; counseling and job introduction after workers return home; supervision and evaluation by local agencies shall be allocated from the central budget supplemented with specific purposes for the provincial budgets of provinces with poor districts.

2. The source of funds for implementing the policy of supporting workers to learn trades, foreign languages, necessary knowledge enhancement; supporting costs for health check-ups, passports, visas, criminal records, and activities for communication and enhancing capacity and awareness about labor export; building training programs and materials for exporting workers; counseling and job introduction after workers return home; supervision and evaluation at the central level shall be arranged within the annual budget estimate of the Ministry of Labor, Invalids and Social Affairs.

Article 2. Sources of Funds for Implementing the Project

3. The source of funds for developing supplementary cultural knowledge programs suitable for the characteristics of the poor and ethnic minorities shall be arranged within the annual budget estimate for educational and training services of the Ministry of Education and Training.

4. The source of funds for implementing the policy of supporting risk for workers who are subjects of the Project shall come from the Employment Outside the Country Support Fund.

5. Sources of funds for implementing preferential credit policies

a) The central budget transfers capital to the Vietnam Social Policy Bank for workers going abroad to borrow according to point a, Clause 2, Section III, Article 1 of Decision No. 71/2009/QD-TTg. The state budget will cover management fees according to regulations.

b) The Vietnam Development Bank raises capital to lend to vocational training institutions for exporting workers according to point b, Clause 2, Section III, Article 1 of Decision No. 71/2009/QD-TTg. The state budget will cover interest rate differences and management fees according to regulations.

6. The source of funds from contributions by workers and other legitimate financial sources.

b) The Vietnam Development Bank mobilizes capital to provide loans to vocational training institutions for labor export in accordance with point b, Clause 2, Section III, Article 1 of Decision No. 71/2009/QĐ-TTg. The state budget subsidizes the interest rate differential and management fees as prescribed.

6. The funding contributions from workers and other legitimate financial sources.

Article 3. The work of drafting, allocating, assigning budgets, managing, using, and settling accounts for funds

The drafting, allocation, assignment, management, use, and settlement of accounts for funds under the Project shall be carried out in accordance with the provisions of the State Budget Law and guiding documents. In addition, this Circular supplements certain specific points as follows:

1. Preparing budgets

a) Annually, based on the directive to establish economic and social plans and budget estimates,

b) The Ministry of Education and Training will aggregate into the annual state budget estimate of the Ministry the funds for implementing the construction of programs and materials for supplementary cultural knowledge as stipulated in Clause 3, Article 2 of this Circular.

c) The Ministry of Labor, Invalids and Social Affairs will aggregate into the annual state budget estimate of the Ministry the funds for implementing tasks directly carried out by the Ministry of Labor, Invalids and Social Affairs and aggregate the funds for implementation by localities submitted to the Ministry of Finance and the Ministry of Planning and Investment for consolidation.

d) The Vietnam Policy Bank and the Vietnam Development Bank will cooperate with the Ministry of Labor, Invalids and Social Affairs to draft the state budget expenditure estimates for tasks implemented by the Banks and submit them to the Ministry of Finance and the Ministry of Planning and Investment for consolidation.

2. Allocation and transfer of the budget

a) Annually, based on the total amount of funds for the Project communicated by the competent authority, the Ministry of Labor, Invalids and Social Affairs will take the lead in coordinating with relevant agencies to allocate funds to provinces with poor districts in line with the objectives and tasks to be implemented in the year. The results of the allocation will be sent to the Ministry of Finance and the Ministry of Planning and Investment for consolidation into the annual state budget estimates of localities to be submitted to the Prime Minister for submission to the National Assembly in accordance with the State Budget Law.

b) For the Ministry of Labor, Invalids and Social Affairs: based on the budget estimates assigned by the competent authority, implement the allocation of budget estimates to subordinate units to implement policies and activities of the Project.

c) For provinces with poor districts: Based on the state budget estimates assigned by the Prime Minister, local government budget sources, integrated funds from Programs, projects, goals, tasks, and legally raised funds to implement systems and policies as stipulated in Decision No. 71/2009/QĐ-TTg at the local level, the Department of Finance will take the lead in coordinating with the Department of Planning and Investment and the Department of Labor, Invalids and Social Affairs and other relevant agencies to allocate funds for the implementation of the Project to each poor district, report to the People's Committee of the province for decision by the Provincial People's Council in the annual local state budget estimate.

Based on the Resolution of the Provincial People's Council, the provincial People's Committee assigns the state budget to the districts, the District People's Committees (if not yet piloting the abolition of the District People's Councils) decide in the district state budget estimate and the plan for allocating the budget to each agency and unit implementing the Project.

d) After receiving the decision to assign the budget estimate, the budget-using units proceed to detail the allocated budget estimate to the items and sub-items of the State Budget Classification and send it to the financial agency at the same level, simultaneously sending it to the State Treasury where transactions are conducted for coordination and execution and withdrawal of the budget estimate.

3. Execution of the budget

a) Based on the state budget expenditure estimates of the units assigned by the competent authority, the units implementing the Project withdraw the budget estimates at the State Treasury where transactions are conducted.

b) The State Treasury implements control, disbursement, and payment according to the current regulations of the Ministry of Finance regarding guidance on the management, disbursement, and payment of state budget expenditures through the State Treasury; spending regulations, and the provisions of this Circular.

c) Units directly using the Project's budget have the responsibility to manage and use funds for their intended purpose, target, and effectively.

4. Accounting and Settlement Work

a) Units using the Project's budget have the responsibility to account for and settle accounts for funds used to implement the Project's policies and activities according to the corresponding types, items, and sub-items of the State Budget Classification, the Accounting Law, and current guiding documents.

b) For policies and activities of the Project directly implemented by agencies, units, organizations, enterprises through contracts with the Project's leading agency, the vouchers serving as the basis for settlement are kept at the Project's leading agency including: Contract for performing tasks (accompanied by detailed budget estimates approved by the Project's leading agency), acceptance record, contract termination record, authorization to pay or payment voucher, and related documents. Specific expenditure vouchers are retained by the agencies, units, organizations, and enterprises directly implementing the Project according to current regulations.

5. Reporting System and Inspection, Supervision

a) Reporting System

- Annually, after completing the allocation and assignment of the state budget estimates to local levels, the Department of Finance will take the lead in coordinating with relevant agencies to compile the results of the allocation and assignment of funds for implementing Decision No. 71/2009/QĐ-TTg at the local level, report to the Provincial People's Committee, and send to the Ministry of Finance, the Ministry of Planning and Investment, and the Ministry of Labor, Invalids and Social Affairs as prescribed.

- Periodically, every six months (before July 15) and annually (before January 15 of the following year), the People's Committees of provinces, participating ministries, and sectors are responsible for reporting the situation and results of implementing the Project to the Ministry of Labor, Invalids and Social Affairs and the Ministry of Planning and Investment.

- The Ministry of Labor, Invalids and Social Affairs has the responsibility to consolidate, evaluate, and report to the Government on the implementation of the Project's objectives, contents, and the results of fund usage.

b) Inspection and Supervision

- The Ministry of Labor, Invalids and Social Affairs will take the lead in coordinating with the Ministry of Finance and the Ministry of Planning and Investment to inspect and consolidate evaluations of the use of Project funds to ensure they are used for their intended purposes, economically, and effectively.

- In cases where agencies, units, organizations, and enterprises allocate and use funds incorrectly, or fail to comply with the reporting system regulations, the Project's leading agency will issue a document to the financial agency and the State Treasury where the unit has its transaction account requesting the suspension of payments, and depending on the severity of the violation, report to the competent authority for consideration and decision-making according to regulations and consider removing them from the list of entities implementing the Project.

PART II. SPECIFIC PROVISIONS

Article 4. Supporting workers to improve their cultural level for participation in labor export (as stipulated in Point a, Clause 1, Section III, Article 1 of Decision No. 71/2009/QĐ-TTg)

1. Recipients

Workers belonging to poor households and ethnic minority people as provided for in Point a, Clause 2, Article 1 of this Circular who have completed primary school or higher may be selected to participate in labor export but whose cultural levels do not meet the requirements and need additional cultural education.

2. Form and duration of study: To be examined and decided by the Chairman of the People's Committee of the district in accordance with the needs and level of the subjects and the maximum study period shall not exceed 12 months.

3. Content and amount of support

a) Full payment of tuition fees, learning materials, textbooks, notebooks, and learning tools. The amount of support is based on the budget for organizing cultural classes approved by the People's Committee of the district.

b) Support for food and living expenses during the study period, travel expenses, and initial supplies like students in boarding schools for ethnic minorities, specifically:

- Food and living expenses: The support level is equivalent to 80% of the national minimum wage according to the actual number of study months.

- Initial supplies: When workers enter the cultural class, they will be supported to purchase personal items such as quilts, mosquito nets, cotton coats, mats, raincoats, and uniforms. The provincial People's Committee specifies the level of initial supply support according to the training period, up to a maximum of VND 400,000 per student for the entire course lasting from three to twelve months.

- Travel expenses: Workers will be provided with travel expenses once (for both the trip to and return from the place of study) if the distance between the study location and their home exceeds 15 kilometers, at the regular fare of public transportation at the time of payment.

4. Procedures and forms of support

a) The People's Committee of communes and towns establish a list of workers selected to participate in labor export but whose cultural levels do not meet the requirements and need additional cultural education, accompanied by the workers' application for cultural studies (according to Forms No. 1 and No. 2 attached to this Circular), and submit it to the Department of Labor, Invalids, and Social Affairs for examination and consolidation to be submitted to the Chairman of the People's Committee of the district for approval by the Provincial People's Committee of the number and list of workers to be supported in cultural studies.

b) The Department of Education and Training bases on the training plan, curriculum, supplementary knowledge materials for workers' cultural education, and the approved budget, the approved list of workers for cultural studies, and the content and amount of support specified in Clause 3, Article 4 of this Circular, prepares a detailed budget along with the list of workers for cultural studies to be submitted for approval by the Chairman of the People's Committee of the district. After the detailed budget is approved by the district People's Committee, the Department of Education and Training signs a contract with educational institutions to organize cultural classes for workers as prescribed.

The Department of Education and Training bases on the training plan, curriculum, supplementary knowledge materials for workers' cultural education, and the approved budget, the approved list of workers for cultural studies, and the content and amount of support specified in Clause 3, Article 4 of this Circular, prepares a detailed budget along with the list of workers for cultural studies to be submitted for approval by the Chairman of the People's Committee of the district. After the detailed budget is approved by the district People's Committee, the Department of Education and Training signs a contract with educational institutions to implement the organization of cultural classes for workers as prescribed.

Educational institutions organize classes, purchase and distribute learning materials, textbooks, notebooks, and learning tools; provide food and living expenses, initial supplies, and travel expenses for workers according to the approved amount and list.

5. Costs for building programs and supplementary knowledge materials for cultural education: The content and amount of costs are implemented according to the provisions of Joint Circular No. 125/2008/TTLT-BTC-BGDĐT dated December 22, 2008, of the Ministry of Finance and the Ministry of Education and Training guiding the management and use of funds for implementing the National Target Program on Education and Training until 2010.

Article 5. Support for workers to learn trades, foreign languages, and necessary knowledge; support for medical examination costs, passport, visa, and criminal record (as stipulated in Point b, Clause 1, Section III, Article 1 of Decision No. 71/2009/QĐ-TTg).

1. Support Objectives

Workers as prescribed in Point a, Clause 2, Article 1 of this Circular may choose to participate in trade training, language learning, and knowledge enhancement for labor export.

2. Duration of study: based on the vocational training profession and the requirements of the labor export market, the Minister of Labor, Invalids, and Social Affairs shall consider and specify the duration of study, but not exceeding 12 months at maximum. After completing the course, workers will be issued a basic vocational certificate and a certificate of necessary knowledge enhancement as prescribed.

3. Content and level of support

a) For workers from poor households and ethnic minorities:

- Support 100% of tuition fees for trade training, language learning, and necessary knowledge enhancement according to the approved tuition fee levels by the Minister of Labor, Invalids, and Social Affairs based on the procurement contract for training as stipulated in Point a, Clause 4 of this Article;

- Living expenses during the study period: VND 40,000 per person per day;

- Accommodation expenses: VND 200,000 per person per month;

- Personal equipment expenses (uniforms, blankets, mosquito nets, shoes, etc.): VND 400,000 per person;

- Transportation expenses (round trip) from place of residence to training location: supported at the public transport fare rate at the time of payment;

- Pre-departure processing costs for working abroad including passport fees, visa fees (if applicable), health examination fees (pre-selection and before labor export), and criminal record fees according to current regulations.

b) For other workers: Support 50% of tuition fees for trade training, language learning, and necessary knowledge enhancement according to the approved tuition fee levels by the Minister of Labor, Invalids, and Social Affairs based on the procurement contract for training as stipulated in Point a, Clause 4 of this Article.

4. Forms of support:

a) Support for trade training, language learning, and necessary knowledge enhancement through procurement contracts with vocational training institutions or labor export enterprises under the procurement mechanism for public services as prescribed in Decision No. 39/2008/QĐ-TTg dated March 14, 2008, issued by the Prime Minister regarding bidding, procurement, and assignment of tasks for public service provision funded by the state budget.

The unit price for procurement training shall be determined by the Minister of Labor, Invalids, and Social Affairs after consulting the Ministry of Finance and must be based on economic and technical norms; current cost standards issued by competent authorities; implementation time and location; quantity and quality of vocational training.

Procurement training contracts must clearly reflect the specific bases of the procurement training results signed and the indicators regarding the number and quality of trainees, unit price per trainee; training location, completion time, responsibilities and obligations between the procuring agency, provider, and other relevant contents consistent with legal provisions.

b) Support for living expenses, accommodation expenses, personal equipment expenses, and transportation expenses for workers through participating enterprises or vocational training institutions in the Project;

c) Support for health examination, passport, visa (if applicable), and criminal record for workers through participating enterprises in the Project.

5. Procedures and formalities for support

a) For support of trade training, language learning, and necessary knowledge enhancement:

- Based on the list of workers selected by the People's Committee of the district, the Ministry of Labor, Invalids, and Social Affairs introduces enterprises and vocational training institutions participating in the Project for preliminary selection.

- Enterprises and vocational training institutions submit a letter (attached with the list of workers who have passed the preliminary selection and the worker's application for support according to Model No. 3 and No. 4 attached to this Circular) to the Ministry of Labor, Invalids, and Social Affairs for consideration to sign a procurement contract as stipulated in Point a, Clause 4, of this Article.

b) For direct support to workers: - The Ministry of Labor, Invalids, and Social Affairs, based on signed procurement training contracts and lists of workers participating in training, transfers support funds to vocational training institutions or enterprises for payment to workers;

- Vocational training institutions or enterprises are responsible for paying living expenses, accommodation expenses, personal equipment expenses, and transportation expenses for workers according to the levels specified in Clause 3 of this Article;

- Enterprises are responsible for paying health examination fees, passport fees, visa fees, and criminal record fees for workers according to the levels specified in Point a, Clause 3, of this Article.

6. Documentation and settlement vouchers retained by participating vocational training institutions or enterprises include:

a) Contracts between vocational training institutions, enterprises, and agencies implementing the Project under the Ministry of Labor, Invalids, and Social Affairs, acceptance certificates, and contract termination documents regarding vocational training, language learning, and necessary knowledge enhancement; direct payment vouchers to workers and related invoices and receipts... for passports, visas (if applicable), and criminal records according to current regulations;

b) Health examination contracts between enterprises and authorized healthcare facilities, acceptance certificates, and contract termination documents, lists of workers examined for preliminary selection and pre-departure health examinations, and payment invoices; for individual cases, there must be a receipt from the authorized healthcare facility (costs according to current regulations).

7. Costs for developing training programs and materials for exporting workers:

The content and level of expenditure are implemented according to Circular Joint No. 90/2008/TTLT-BTC-BLĐTBXH dated October 16, 2008, issued by the Ministry of Finance and the Ministry of Labor, Invalids, and Social Affairs guiding the management and use of funds for implementing the Project to enhance vocational training capacity under the National Target Program on Education and Training until 2010.

Article 6. Risk Support for Workers (in accordance with Point c, Clause 1, Section III, Article 1 of Decision No. 71/2009/QD-TTg)

1. The subjects eligible for support: Workers who are part of the Project when participating in labor export and encounter risks.

2. Content of support:

- Risk support for workers shall be implemented in accordance with Clause 3, Section II of Circular Joint Circular No. 11/2008/TTLT-BLDTBXH-BTC dated July 21, 2008 issued by the Ministry of Labor, Invalids and Social Affairs and the Ministry of Finance guiding the management and utilization of the Fund for Overseas Employment under Decision No. 144/2007/QD-TTg dated August 31, 2007 of the Prime Minister.

- Support for workers who have worked for less than 12 months and must return to Vietnam due to one of the following reasons:

+ Due to health conditions unsuitable for job requirements;

+ Due to difficulties faced by the employer in production and business leading to unemployment;

+ Due to unilateral termination of the labor contract by the employer.

- Level of support: Equivalent to one round-trip economy class air ticket from the country where they worked back to Vietnam.

3. Procedures and formalities for disbursing support

a) The worker or a person authorized by the worker to submit a request for risk support, confirmed by the People's Committee of the commune/township (according to Model 6b in Circular No. 11/2008/TTLT-BLDTBXH-BTC) to the Overseas Employment Support Fund through the enterprise that sent them abroad. Accompanying the application should be medical certificates from local health authorities or confirmation from Vietnamese diplomatic missions abroad or confirmation from the sending enterprise.

b) The enterprise that sends workers abroad prepares a list of workers eligible for support (according to Model 8 in Circular No. 11/2008/TTLT-BLDTBXH-BTC) along with the application and other required documents as stipulated in Point a, Clause 3, Article 6 and submits it to the Overseas Employment Support Fund to request support for the workers.

Article 7. Expenditure on Communication Activities and Capacity Building and Awareness Raising on Labor Export (Point a, Clause 3, Section III, Article 1 of Decision No. 71/2009/QD-TTg)

1. Expenditure for communication activities

a) To disseminate and provide comprehensive information about policies and support systems for workers participating in labor export under the Project, participation conditions, selection criteria, working conditions, living standards, income levels, customs and traditions of receiving countries, and the benefits of participating in labor export... through mass media at central and local levels (radio, television, press). The expenditure level will be carried out according to contracts between communication units/information media and the implementing agencies of the Project.

b) Expenditure on building, producing, duplicating, and distributing various types of communication materials to localities. The expenditure level will be carried out according to contracts.

c) Expenditure on organizing awareness-raising competitions on labor export approved by competent authorities. The content and expenditure level are as follows:

- Preparing examination questions and answers (including scoring criteria): up to a maximum of VND 500,000 per examination;

- Training allowance for marking examinations, members of the competition jury, and announcing results: up to a maximum of VND 200,000 per person per day;

- Training allowance for members of the organizing committee: up to a maximum of VND 150,000 per person per day;

- Renting venues, conference halls, equipment, and machinery (if applicable);

- Prizes: Teams: from VND 200,000 per prize to VND 2,000,000 per prize; Individuals: from VND 100,000 per prize to VND 1,000,000 per prize.

Depending on the scale of the competition (central, provincial, grassroots level), the head of the agency or unit organizing the competition decides on specific prize expenditures within the aforementioned expenditure range within the allocated budget estimate approved by the competent authority;

- Summarizing and reporting competition results: VND 500,000 per report.

d) Expenditure on conducting surveys on demand for labor export participation and post-export employment needs: the content and expenditure level are implemented according to Circular No. 120/2007/TT-BTC dated October 15, 2007 of the Ministry of Finance guiding the management, use, and settlement of funds for conducting surveys from state budget sources.

đ) In addition to the above expenditures, at the district and commune levels, expenditures for promoting labor export can be made as follows:

- Expenditure on supporting the establishment of special sections and programs to promote labor export on mass media: VND 20,000,000 per district per year.

- Expenditure on building and broadcasting news: VND 4,000,000 per commune per year (at least ten broadcasts per month about labor export work on the commune radio system).

- Expenditure on supporting those directly involved in mobilizing and counseling workers going abroad: VND 20,000 per person per counseling session, but not exceeding VND 300,000 per person per month.

e) Expenditure on organizing policy promotion sessions on labor export including: material costs, training allowances for speakers, renting conference halls, audiovisual equipment (if applicable), drinking water... The content and expenditure level follow current regulations on the dissemination and promotion of laws.

2. Expenditure on enhancing capacity for officials engaged in labor export work and grassroots communicators

a) Target group for capacity enhancement: Officials engaged in labor export work and grassroots communicators at the provincial level and below (province, district, commune, village, hamlet) in provinces with poor districts.

b) Organizational forms and training materials for capacity enhancement are guided and implemented by the managing agency of the Project to ensure suitability with the level of officials at each level and region (especially for ethnic minority officials).

c) Content and expenditure level:

- Payment for lecturers and speakers, support for meals, accommodation, and travel expenses for trainees during training according to the provisions of Circular No. 51/2008/TT-BTC dated June 16, 2008 of the Ministry of Finance guiding the management and use of training and capacity-building funds for civil servants.

For dedicated officials, commune-level civil servants, and non-dedicated officials in communes belonging to poor districts, all training-related expenses, including accommodation and travel, are fully covered according to Article 8 of Decree No. 121/2003/NĐ-CP dated October 21, 2003 of the Government regarding policies and benefits for civil servants at the commune, ward, and town level.

- Expenses for organizing classes include: renting conference halls, classrooms; equipment for learning activities; office supplies, materials, teaching textbooks; expenses for organizing students to conduct practical surveys; food, accommodation, and travel expenses for lecturers and class management staff of the training institution when it is necessary to organize classes away from the training institution.

- Expenses for printing materials, compiling lecture notes to serve the class, shall be implemented according to the current regulations on guiding the content and level of expenditure for compiling framework programs and subject textbooks.

- Expenses for managing the class shall not exceed 5% of the total budget for the training class.

Article 8. Expenses for consulting and job placement services after workers return to their home country (point b, Clause 3, Section III, Article 1 Decision No. 71/2009/QĐ-TTg).

1. The target group for consulting and job placement services: Workers and families of workers who have completed their labor contracts and returned to their home country under the Project.

2. Contents and Expenditure Rates:

a) Building a database on workers from poor districts working abroad for management and assistance: The content and level of expenditure shall be applied according to Circular No. 137/2007/TT-BTC dated November 28, 2007, issued by the Ministry of Finance guiding the level of expenditure for establishing electronic information.

b) Consulting and placing jobs for workers suitable with their professions and experiences gained during their time working abroad; guiding workers and their families on how to use income from labor export to invest in household economic development and farm economy. The level of expenditure for supporting consulting and job placement services shall be carried out according to the level of expenditure prescribed in Joint Circular No. 95/2007/TTLT/BTC-BLDTBXH dated August 7, 2007, issued by the Ministry of Finance and the Ministry of Labor, Invalids and Social Affairs guiding job placement fees. Based on the consulting and job placement service contract between the Department of Labor, Invalids and Social Affairs and the Job Placement Center, the Department of Labor, Invalids and Social Affairs shall settle the consulting and job placement service costs for the Job Placement Center.

c) Organizing entrepreneurship training courses: Paying remuneration to lecturers and speakers, providing financial support for meals, accommodation, and travel expenses for trainees during the training period according to the provisions stipulated in Circular No. 51/2008/TT-BTC dated June 16, 2008, issued by the Ministry of Finance guiding the management and utilization of training and capacity building funds for state officials and civil servants.

Article 9. Expenses for monitoring and evaluation activities (point c, Clause 3, Section III, Article 1 Decision No. 71/2009/QĐ-TTg).

1. For the Ministry of Labor, Invalids and Social Affairs: based on the approved supervision and evaluation plan by the Minister to allocate the budget for monitoring and evaluation activities.

2. For provinces: the maximum level of support for monitoring and evaluation activities shall be 5% of the total central budget allocated for the provincial budget to implement the Project.

3. The content of monitoring and evaluation activities includes:

a) Establishing a monitoring and evaluation index system for the Project for poor districts at four levels (from the central level to the commune level);

b) Setting up methods for collecting and processing information at all levels;

c) Developing software to manage participants in the Project at the district, provincial, and central levels;

d) Organizing periodic annual, mid-term, and final evaluations;

e) Inspecting, monitoring, and evaluating the implementation of policies and activities of the Project;

g) Compiling comprehensive reports, analyzing, and evaluating the implementation of the Project at all levels;

h) Supporting districts in conducting Project monitoring work, the level of support shall be decided by the Provincial People's Committee;

i) Summarizing and reviewing the implementation of the Project at all levels;

The content and level of expenditure for monitoring and evaluation activities shall be implemented according to the current regulations of the State.

Article 10. Preferential credit policy (Clause 2, Section III, Article 1 of Decision No. 71/2009/QĐ-TTg)

1. Preferential credit for workers:

a) Objectives, loan amount, interest rate, implementation mechanism: Implemented according to the provisions set out in point a, Clause 2, Section III, Article 1 of Decision No. 71/2009/QĐ-TTg.

b) Regarding procedures and loan application documents: Implemented according to the regulations and guidelines of the Vietnam Social Policy Bank.

2. Preferential credit for vocational training institutions for export labor:

a) Objectives: Vocational training institutions and export labor enterprises participating in the project selected by the Ministry of Labor, Invalids and Social Affairs pursuant to Decision No. 39/2008/QĐ-TTg dated March 14, 2008 of the Prime Minister on the bidding, ordering, and assigning tasks for the provision of public services using state budget funds.

b) Conditions for obtaining preferential credit for vocational training institutions for export labor are that the institution must be included in the list of types, scale criteria, and standards as prescribed in Decree No. 69/2008/NĐ-CP dated May 30, 2008 of the Government on policies encouraging socialization in education, vocational training, healthcare, culture, sports, and environment activities, and Decision No. 1466/QĐ-TTg dated October 10, 2008 of the Prime Minister on detailed lists of types, scale criteria, and standards of institutions implementing socialization in education, vocational training, healthcare, culture, sports, and environment activities.

c) Content: Borrowing capital to invest in increasing classroom size, dormitories, vocational training equipment, and teaching aids serving the training of export labor.

d) Loan amount, interest rate, conditions, procedures, and application documents for borrowing are implemented according to the preferential lending mechanism of the State as currently prescribed and guided by the Vietnam Development Bank.

SECTION III. IMPLEMENTATION ORGANIZATION

Article 11. Responsibilities of agencies

1. Departments of Labor, Invalids, and Social Affairs of provinces with poor districts

a) Take the lead and coordinate with relevant agencies to promote and disseminate policies and benefits for workers and implement tasks as stipulated in this Circular;

b) Direct district-level Labor, Invalids, and Social Affairs offices and employment service centers to effectively provide counseling and job placement for workers participating in export labor;

c) Summarize the activity plan of the project and the labor plan of poor districts participating in export labor, and prepare a budget estimate for implementing policies and activities as stipulated in this Circular to submit to the provincial People's Committee for approval and submission to the Ministry of Labor, Invalids, and Social Affairs;

d) Inspect and supervise the implementation of the project in poor districts; compile and report results every six months to the provincial People's Committee.

2. Departments of Education and Training of provinces with poor districts

a) Based on the actual cultural level of workers in the locality and guidance from the Ministry of Education and Training, direct district-level Education and Training offices to organize supplementary cultural knowledge training for workers;

b) Guide district-level Education and Training offices and educational institutions participating in the project to prepare a budget estimate for supporting workers in supplementary cultural knowledge training to participate in export labor for approval by competent authorities.

3. Responsibilities of the Vietnam Social Policy Bank

a) Provide guidance on borrowing procedures and organize lending as prescribed.

b) Report periodically every six months (before July 15) and annually (before January 15 of the following year) to the Ministry of Labor, Invalids, and Social Affairs and the Ministry of Finance, Ministry of Planning and Investment on the implementation of lending (according to Model No. 5 attached to this Circular).

4. Responsibilities of the Vietnam Development Bank

Guide enterprises and vocational training institutions on borrowing procedures; mobilize and organize lending, debt collection, and debt resolution as prescribed in this Circular and the lending regulations of the Vietnam Development Bank. Report periodically every six months (before July 15) and annually (before January 15 of the following year) to the Ministry of Labor, Invalids, and Social Affairs and the Ministry of Finance, Ministry of Planning and Investment on the implementation of lending.

Article 12. Implementation Provisions

1. This Circular takes effect 45 days from the date of issuance; the provisions of this Circular shall be implemented from the date Decision No. 71/2009/QĐ-TTg dated April 29, 2009 of the Prime Minister takes effect.

2. In the process of implementation, if any issues arise, units are requested to promptly reflect them to the Joint Ministries for research and resolution./.
