CIRCULAR

Amending and supplementing some articles of Circular No. 21/2019/TT-BNNPTNT dated November 28, 2019 of the Minister of Agriculture and Rural Development guiding some provisions of the Livestock Law regarding livestock feed concerning livestock feed

Based on Decree No. 105/2022/NĐ-CP dated 22 the 12, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to the Livestock Breeding Law on November 19, 2018;

At the proposal of the Director of the Livestock Production Department;

amending and supplementing certain provisions of Circular No. 22/2019/TT-BNNPTNT dated November 30, 2019 of the Minister of Agriculture and Rural Development guiding certain provisions of the Livestock Law on the management of breeds and breeding products of livestock. "7. A flexible power plant is a thermal power plant using reciprocating internal combustion engines (RICE) or aeroderivative gas turbines (Aero-GT) with fast start-up capabilities, designed in modular form to generate electricity for balancing capacity and maintaining power system stability."Amending and supplementing some articles of Circular No. 21/2019/TT-BNNPTNT dated November 28, 2019 of the Minister of Agriculture and Rural Development guiding some provisions of the Livestock Law regarding livestock feed.

Article 1. Amending and supplementing some articles of Circular No. 21/2019/TT-BNNPTNT dated November 28, 2019 of the Minister of Agriculture and Rural Development guiding some provisions of the Livestock Law regarding livestock feed (hereinafter referred to as Circular No. 21/2019/TT-BNNPTNT)

1. Amend and supplement Clause 4 of Article 4 as follows:

"4. Livestock feed containing veterinary drugs for disease prevention and treatment of animals

a) Complete mixed feed for ruminants and poultry and concentrate feed for grazing ruminants containing veterinary drugs with antibiotic components for disease prevention and treatment of animals must include the following information on the product label or accompanying documentation when circulating: Name and concentration of antibiotics, purpose of using antibiotics, instructions for use, withdrawal period, name and address of the farm or breeding facility (in case of treatment or preventive treatment) in accordance with the content recorded in the prescription of the veterinarian according to the regulations of the Livestock Law and Veterinary Law;

b) Complete mixed feed for ruminants and poultry and concentrate feed for grazing ruminants containing non-prescription veterinary drugs according to veterinary regulations for disease prevention and treatment of animals must include the following information on the product label or accompanying documentation when circulating: Name and concentration of active ingredients with preventive and therapeutic effects; purpose of use; instructions for use; withdrawal period in accordance with the instructions for use of the drug manufacturer and the regulations on veterinary drug management."

2. Supplement Clause 5 after Clause 4 of Article 4 as follows:

"5. Livestock feed that has been declared compliant before circulation on the market must display the compliance mark as follows:

a) Livestock feed subject to the provisions of Clauses 2 and 3 of this Article: The compliance mark must be displayed in the accompanying documentation as specified in Appendix III issued together with this Circular;

b) Livestock feed not subject to the provisions of point a of this clause: The compliance mark must be displayed on the product label or packaging or in the technical documentation accompanying the batch when circulating. Technical documentation includes at least the following information: Name of the entity responsible for the goods, production address ensuring traceability of the origin and source of the product; product name; standard application number."

3. Amend and supplement Article 5 as follows:

"Article 5. Reporting on the situation of production and quality inspection of livestock feed

1. Commercial livestock feed producers and custom-made livestock feed producers report on the situation of livestock feed production according to the form prescribed in Appendix IV issued together with this Circular to the Livestock Production Department, Department of Agriculture and Rural Development in their locality through the Livestock Industry Database System of the Ministry of Agriculture and Rural Development or postal service or fax or email or direct submission monthly before the 7th day of the month following the reporting period; report promptly when required by competent authorities.

2. Departments of Agriculture and Rural Development report on the results of inspections, examinations, and supervision of livestock feed quality according to the form prescribed in Appendix IVa issued together with this Circular to the Livestock Production Department, Inspectorate of the Ministry of Agriculture and Rural Development through the Livestock Industry Database System of the Ministry of Agriculture and Rural Development or the National Document Transmission Network or postal service or fax or email or direct submission quarterly before the 7th day of the month following the reporting period; report promptly when required by competent authorities.

The Livestock Production Department shall take the lead and coordinate with the Inspectorate of the Ministry of Agriculture and Rural Development to compile the results of inspections, examinations, and supervision of livestock feed quality nationwide."

Article 2. Amend, supplement, replace, and abolish certain contents and Appendices of Circular No. 21/2019/TT-BNNPTNT.

1. Abolish the live insect index at item number 13 Section 1 Appendix I.

2. Amend and supplement the note section of Section 1 Appendix I as follows:

- "It is not mandatory to test the Metabolizable Energy (ME) index in state management work;

- Including methionine substitutes."

3. Amend and supplement the note section of Section 3 Appendix I as follows:

"- The moisture content or water content index does not apply to liquid products;

- *Select the appropriate index and declaration format based on the product (Example: For vitamin and amino acid indexes, the declaration format must be "not less than");

- **The moisture content or water content index does not apply to liquid products."

4. Replace the phrase "Quality Index Determining the Nature and Function of the Product" with the phrase "Quality Index" at item number 3 Section 3 Appendix I and item number 3 Section 4 Appendix I.

5. Amend and supplement the note section of Section 4 Appendix I as follows:

"- Single raw materials may contain technical substances (not carriers) added during production and completion to maintain technical characteristics without changing the nature of the raw material; the name and quantity of technical substances must be declared in the ingredient list of the standard and product label;

- The moisture content or water content index does not apply to liquid products;

- *Select the appropriate index and declaration format based on the product (Example: For vitamin and amino acid indexes, the declaration format must be "not less than");

- **The moisture content or water content index does not apply to liquid products."

6. Amend and supplement Point e Section 5 Appendix I as follows:

"e) Quality Index

The quality index includes main components and other components. Complete mixed feed for livestock and poultry; concentrated feed for grazing animals containing veterinary drugs with antibiotic ingredients; active ingredients of non-prescription animal health products regulated by veterinary laws do not need to declare antibiotic information; however, the active ingredient information of veterinary drugs must be included in the quality index table of the declared standard and must be marked on the label or accompanying technical documentation according to the provisions of Clause 4, Article 4 of this Circular.

Domestic animal feed with quality indices that have no designated or recognized testing methods do not need to declare the content of such indices in the quality index table of the declared standard and product label but must record the quantitative composition of raw materials containing such indices."

7. Replace the phrase "Antibiotic Information" with the phrase "Antibiotic Information; Active Ingredients for Prevention and Treatment" on the label model at Section 1, Section 2 Appendix II; Section 6 Appendix III.

8. Replace the phrase "- For imported animal feed, the labeling must comply with the provisions of Decree No. 43/2017/NĐ-CP dated April 14, 2017 of the Government on product labels and the provisions of this Circular" with the phrase "- For imported animal feed: original label according to the law on product labels, supplementary label according to the law on product labels and this Circular" at the third bullet point from the top in the note section of Section 1, Section 2, and Section 3 Appendix II.

9. Replace Appendix IV with Appendix IV issued together with this Circular.

10. Supplement Appendix IVa issued together with this Circular.

11. Amend and supplement some contents in Appendix VI as follows:

a) Add the phrase "CaCO3" after the phrase "crushed stone" at item number 5 Section I.

b) Add the following ingredients at item number 6 Section I:

Inactivated yeast: irradiated yeast; hydrolyzed yeast; dry Torula yeast or dry Candida yeast; yeast cultured on molasses fermentation residue; dried yeast; by-products from amino acid feed production; other traditional feed ingredients.

c) Add the following active ingredients at item number 2.1 Clause 1 Section II:

Acetate cobalt; sulfate cobalt; copper carbonate; copper chelate; copper chloride hydroxide; copper polysaccharide; chromium nicotinate; chromium chelate; sodium iodide; potassium iodate; potassium iodine; calcium periodate; iodine chelate; zinc chelate; zinc gluconate; zinc polysaccharide; manganese chelate; magnesium acetate; magnesium polysaccharide; iron chelate; iron polysaccharide; selenium chelate; selenium polysaccharide; potassium chelate.

d) Abolish the phrase "Calcium carbonate (limestone), calcareous marine shells, (Gizzard) Redstone" at item number 2.2 Clause 1 Section II.

đ) Add the following active ingredients at item number 2.2 Clause 1 Section II:

Ammonium sulfate; calcium chelate; calcium diphosphate; calcium bentonite; calcium hydrogen phosphorus; bentonite calcium montmorillonite; hydrous aluminum phyllosilicates; clay mica; saponite; sodium aluminum bentonite; zeolite; sodium lignosulfonate; kaolin; kaolinite; quartz; plagioclase; rutile; silica; biotite; calcium magnesium carbonate.

e) Add the following microorganisms at item number 2 Clause 2 Section II:

g) Add the following active ingredients at item number 3 Clause 2 Section II:

- Beneficial microorganisms inactivated form (excluding inactivated yeast); Ethyl alcohol; Alcohols; Benzyl alcohol; Aldehyde C18; Ammonium hydroxide; Formic acid ammonium; Amorphous; Amyl acetate; Aspartame; Inulin; Yeast cell wall.

h) Add the following active substances to item number 12, Clause 3, Section II:

i) Add the following active substances to item number 1, Clause 4, Section II:

Blue aluminum lake; Lucantin pink; Titanium dioxide; Edible carmoisine; Green pigment; Indigo carmine; Brown iron oxide; Orange iron oxide; Red iron oxide; Carmoisine lake; Sunset yellow lake; Tartrazine lake; Natracol titanium dioxide; Radish red pigment.

k) Add the following active substances to Clause 5, Section II:

Beta-sinensal; Phenethyl alcohol; Delta-decalactone; Trans-anethole; D-decalactone; 2-undecanone; Isoamyl acetate; 3-methylthio propanol; Isoamyl isovalerate; 3-phenyl-2-propenal; Natural terpenes; 4-methyl-5-thiazoleethanol.

Article 3. Transitional Provisions

1. Labels of animal feed products containing veterinary drugs printed before this Circular takes effect are permitted to be used until December 31, 2024, if they do not comply with the labeling requirements set forth in this Circular.

2. Animal feed products with labels as prescribed in Clause 1 of this Article produced before this Circular takes effect may continue to circulate on the market until the expiration date of the product.

3. For animal feed products with labels as prescribed in Clause 1 of this Article that are produced after this Circular takes effect, when circulating on the market, they must be accompanied by documentation providing information about antibiotics and active substances for disease prevention and treatment in accordance with Clause 4, Article 4 of Circular No. 21/2019/TT-BNNPTNT amended and supplemented by Clause 1, Article 1 of this Circular.

4. In cases where there is a change in the headquarters address or production address due to administrative boundary changes, animal feed production facilities are allowed to use up all pre-change printed labels bearing the headquarters and production addresses.

Article 4. Implementation provisions

1. This Circular takes effect from February 20, 2023.

2. The Director of the Livestock Production Department, heads of units under the Ministry, and related organizations and individuals are responsible for implementing this Circular. During the implementation of this Circular, if there are any difficulties or need for amendments or supplements, please promptly report to the Ministry of Agriculture and Rural Development (through the Livestock Production Department) for consideration and resolution./.
