Pursuant to the Law on the Organization of the Government No. 63/2025/QH15;

Pursuant to the Law on Legislative Regulatory Documents No. 64/2025/QH15 amended and supplemented by Law No. 87/2025/QH15;

Pursuant to the Law on National Border No. 06/2003/QH11;

Pursuant to the Law on Electronic Transactions No. 20/2023/QH15;

Pursuant to the Law on Entry into, Exit from, Transit through, and Residence of Foreigners in Vietnam No. 47/2014/QH13 amended and supplemented by Law No. 51/2019/QH14 and Law No. 23/2023/QH15;

Pursuant to the Law on Exit from and Entry into Vietnam for Vietnamese Citizens No. 49/2019/QH14 amended and supplemented by Law No. 23/2023/QH15;

Pursuant to the Law on Vietnam Border Defense No. 66/2020/QH14 amended and supplemented by Law No. 98/2025/QH15;

Pursuant to Resolution No. 176/2025/QH15 of the National Assembly on the organizational structure of the Government during the 15th National Assembly term;

Pursuant to Resolution No. 190/2025/QH15 of the National Assembly on handling some issues related to the restructuring of state administrative bodies;

Pursuant to Decree No. 58/2017/NĐ-CP of the Government detailing certain provisions of the Vietnam Maritime Code on maritime activity management, amended and supplemented by Decree No. 34/2025/NĐ-CP;

Pursuant to Decree No. 77/2017/NĐ-CP of the Government on managing and protecting security and order at port gateways;

Pursuant to Decree No. 112/2014/NĐ-CP of the Government on managing land border gates, amended and supplemented by Decree No. 34/2023/NĐ-CP;

Pursuant to Decree No. 69/2024/NĐ-CP of the Government on digital identity and authentication;

"Based on the proposal of the Minister of National Defense;"

The Prime Minister promulgates this Decision amending and supplementing certain provisions of Decrees of the Prime Minister on implementing electronic border procedures at border gates managed by the Ministry of National Defense.

PART I
AMENDING AND SUPPLEMENTING CERTAIN PROVISIONS OF DECREE NO.
10/2016/QĐ-TTG OF THE PRIME MINISTER ON IMPLEMENTING
ELECTRONIC BORDER PROCEDURES FOR SEAPORTS

Article 1. Amending and supplementing Point c Clause 1 of Article 2

"c) Vietnamese ships entering and exiting; foreign ships, crew members entering and exiting, transiting, changing ports (including exploration, exploitation, service oil vessels operating offshore; foreign ships granted domestic transportation permits by the Ministry of Construction; ships and boats owned by Vietnam flying foreign flags);".

Article 2. Amending, Supplementing, and Repealing Certain Provisions of Article 3

2. Amending and supplementing Clause 5 as follows:

"1. Electronic border procedure for seaports (hereinafter referred to as electronic border procedure), including entry procedure, exit procedure, transit procedure, change of port procedure, is a seaport border procedure in which the person handling the procedure and the border guard at the seaport gateway report, receive, process, exchange information, and confirm completion of the border procedure for ships, boats, and crew members entering, exiting, transiting, and changing ports through the National Single Window Portal or the Electronic Border Procedure Seaport Portal (in case the National Single Window Portal has technical issues).".

2. Amend and supplement Clause 6 as follows:

"6. Electronic declaration of border procedure is the act of the person handling the procedure using the Internet to submit electronic declarations and send electronic files to the border guard at the seaport gateway through the National Single Window Portal or the Portal (in case the National Single Window Portal has technical issues).".

3. Amend and supplement Clause 7 as follows:

"7. Confirmation of completion of electronic border procedure is the act of the border guard at the seaport gateway using the Internet and internal network to receive, check, process information, and send notification of completion of the border procedure for ships, boats, and crew members entering, exiting, transiting, and changing ports to the person handling the procedure through the National Single Window Portal or the Portal (in case the National Single Window Portal has technical issues).".

4. Amending and supplementing Clause 9 as follows:

"9. Refusal to implement electronic border procedure is the act of the border guard at the seaport gateway sending notification through the National Single Window Portal or the Portal (in case the National Single Window Portal has technical issues) to the person handling the procedure about transferring the method of implementing the electronic border procedure to direct inspection and implementation of the border procedure onboard the ship.".

5. Repealing Clause 8.

Article 3. Amend and supplement some points and clauses of Article 6

1. Amend and supplement Point b Clause 3 as follows:

"b) Crew members of that ship or vessel are permitted to go ashore immediately after the ship or vessel safely docks at the port. The crew members' shore leave shall be carried out in accordance with the provisions set forth in Point d Clause 1 of Article 44 of the Law on Entry into, Exit from, Transit through, and Temporary Stay of Foreigners in Vietnam No. 47/2014/QH13 and Article 29 of Decree No. 77/2017/NĐ-CP dated July 3, 2017 of the Government on management and security protection at port gateways."

Article 4. Amending and supplementing Clause 1, Clause 2, and Clause 3 of Article 17 of Decree No. 81/2018/NĐ-CP which has been amended and supplemented by Clause 3 of Article 1 of Decree No. 128/2024/NĐ-CP

"5. After completing the electronic border procedures for ships and vessels entering, exiting, or transiting, the person handling the procedures must present the following documents: passports or international travel documents of crew members and passengers or crew books for foreign crew members under the circumstances specified in Clause 3 of Article 13 of Decree No. 77/2017/NĐ-CP dated July 3, 2017 of the Government on management and security protection at port gateways."

3. Amend and supplement Clause 7 as follows:

"7. In cases where electronic border procedures cannot be completed due to technical issues with the Portal: The port border guard must notify the person handling the procedures in writing, by telephone, or by email to complete the border procedures for ships and vessels entering, exiting, or transiting, changing ports manually according to the provisions of Articles 13 and 14 of Decree No. 77/2017/NĐ-CP dated July 3, 2017 of the Government on management and security protection at port gateways."

Article 4. Amend, supplement, and abolish some points and clauses of Article 7

1. Amending and supplementing Point a of Clause 2 of Article 7 as follows:

"a) Time limit for declaration and confirmation of completion of electronic border procedures; presentation of passports or international travel documents or crew books:

At least four hours before the expected arrival at the port and two hours before the expected departure from the port, the person handling the procedures must declare the electronic border procedures. The time for initiating the electronic border procedures is determined from the moment the port border guard receives the complete electronic dossier through the Portal.

Within one hour from receiving the complete electronic dossier, the port border guard must confirm the completion of the electronic border procedures. The time of completion of the electronic border procedures is determined when the person handling the procedures receives the confirmation of completion of the electronic border procedures through the National Single Window Portal.

For ships and vessels arriving; ships and vessels transiting to the port, within ten hours after the ships and vessels safely dock at the port, the person handling the procedures must present the required documents as stipulated in Clause 5 of Article 6 of this Decision to the port border guard;

For ships and vessels departing; ships and vessels transiting from the port, immediately before the ships and vessels depart from the port, the person handling the procedures must present the required documents as stipulated in Clause 5 of Article 6 of this Decision to the port border guard.

For ships and vessels staying at the port for less than 24 hours without changes in crew or passengers, the person handling the procedures may declare the departure procedures immediately after declaring the arrival procedures; present once the required documents as stipulated in Clause 5 of Article 6 of this Decision to the port border guard."

2. Abolish Point c Clause 2 of Article 7.

Article 5. Amend and supplement Point b Clause 2 of Article 8

"b) The Ministry of Science and Technology, the Ministry of Construction, the Ministry of Health, and the Ministry of Agriculture and Rural Development

Within their scope of duties and authority, they are responsible for directing and guiding specialized state management agencies under their jurisdiction to coordinate with the Border Guard in implementing electronic border procedures."

Chapter II
AMENDMENTS AND SUPPLEMENTS TO CERTAIN ARTICLES OF DECREE NO.
15/2019/TT-CP OF THE GOVERNMENT ON THE IMPLEMENTATION OF ELECTRONIC BORDER PROCEDURES AT PORTS UNDER THE MANAGEMENT OF THE MINISTRY OF NATIONAL DEFENSE
WHICH HAVE BEEN AMENDED AND COMPLEMENTED
BY DECREE NO. 03/2025/TT-CP OF THE GOVERNMENT
Article 6. Amend and supplement Point a Clause 4 of Article 2

"a) The person in charge of the vehicle, passengers on board foreign motor vehicles entering or exiting the country to participate in traffic in Vietnam in accordance with Decree No. 151/2024/NĐ-CP dated November 15, 2024 of the Government detailing certain provisions and measures to implement the Road Traffic Safety Law;"

Article 7. Amend and supplement Point a Clause 3 of Article 13

"a) Documents to be presented:

Seaman's passport; passport or international travel document or Citizen Identity Card or Citizen Identity Card of passengers (if applicable);

Documents required by the port border guard upon request: Logbook; documents related to goods (if there are goods on board the ship), including: Goods transportation contract; goods purchase and sale contract and value-added tax invoice or internal shipment and transport note; permit for the transport of goods subject to conditions issued by competent authorities of Vietnam;"

Article 8. Amend Clause 1 and Clause 3 of Article 16

1. Amend Clause 1 of Article 16 as follows:

"1. At least 12 hours before the person receiving the visa at the border gate is expected to arrive at the land border international gate or at the port gate, the person handling the procedure must declare the Application for Visa Issuance at the Gate according to Form No. 03 stipulated in the Appendix attached hereto and send it through the Electronic Border Procedure Portal to the Land Border Gate Border Guard (in case of requesting a visa at the land border international gate) or send it to the Port Gate Border Guard (in case of requesting a visa at the port gate).

At least 2 hours before the expected departure from the port where the ship is moored, the person handling the procedure must declare the Application for Visa Issuance at the Gate according to Form No. 03 stipulated in the Appendix attached hereto and send it through the Electronic Border Procedure Portal to the Port Gate Border Guard in cases where foreign seafarers not exempted from entry visas wish to depart the country via another gate;

The time for initiating the electronic border procedure for visa issuance at the gate starts from the moment the Land Border Gate Border Guard or the Port Gate Border Guard receives the Application for Visa Issuance at the Gate through the Electronic Border Procedure Portal."

2. Amend Clause 3 of Article 16 as follows:

"3. When the person receiving the visa arrives at the land border international gate or the port gate to enter Vietnam or when the foreign seafarer referred to in Clause 1 of this Article departs the port gate, the person handling the procedure must present the passport or international travel document and pay the visa issuance fee as prescribed to the Land Border Gate Border Guard or the Port Gate Border Guard;

Immediately upon receipt of the passport or international travel document and the visa issuance fee, the Land Border Gate Border Guard or the Port Gate Border Guard shall issue the visa in accordance with the regulations."

Ngay sau khi nhận được đầy đủ hộ chiếu hoặc giấy tờ có giá trị đi lại quốc tế và phí cấp thị thực, Biên phòng cửa khẩu biên giới đất liền hoặc Biên phòng cửa khẩu cảng sẽ thực hiện cấp thị thực theo quy định.

Article 9. Amending and supplementing certain points and clauses of Article 18

1. Amend and supplement Clause 2 as follows:

"2. Coordinate with the Government Office to organize the connection of the Electronic Border Procedures Information Portal with the National Public Service Portal in accordance with the provisions of Government Decree No. 118/2025/NĐ-CP dated June 9, 2025 on implementing administrative procedures under the one-stop shop mechanism at the one-stop shop counter and the National Public Service Portal."

2. Supplement Point g to Clause 8 as follows:

"g) Proactively exploit information and data online from information systems, national databases, databases of ministries, sectors, and localities that have been connected to resolve exit, entry, and transit procedures at border gates managed by the Ministry of National Defense."

Article 10. Amending and supplementing Article 19

"Article 19. Responsibilities of relevant ministries, sectors, and provincial People's Committees

1. The Ministry of National Defense shall take the lead and coordinate with the Ministry of Public Security to unify the plan for connecting and sharing data to use electronic identity accounts to log in to the Electronic Border Procedures Information Portal in accordance with the provisions of Government Decree No. 69/2024/NĐ-CP dated June 25, 2024 on electronic identification and authentication and this Decision.

2. Ministry of Finance

a) Within its assigned tasks and powers, it is responsible for directing and guiding specialized state management agencies under its jurisdiction to cooperate with the Border Guard Force in implementing electronic border procedures; coordinating with the Ministry of National Defense to guide related enterprises, organizations, and individuals in implementing electronic border procedures under the national one-stop shop mechanism;

b) Direct the integration of electronic identity accounts on the National One-Stop Shop Portal, connecting with specialized systems to implement electronic procedures under the national one-stop shop mechanism;

c) Annually, take the lead and coordinate with the Ministry of National Defense to ensure budget allocation for investment in building, managing, and operating the Electronic Border Procedures Information Portal within the medium-term public investment plan to ensure the implementation of this Decision.

3. Relevant ministries and sectors within their assigned tasks and powers are responsible for cooperating with the Ministry of National Defense in implementing electronic border procedures and deploying the use of electronic identity accounts to log in to the Electronic Border Procedures Information Portal in accordance with the provisions of Government Decree No. 69/2024/NĐ-CP dated June 25, 2024 on electronic identification and authentication.

4. Provincial People's Committees

Within their assigned tasks and powers, provincial People's Committees are responsible for directing the promotion and guidance of functional departments, People's Committees of communes, and local residents where electronic border procedures are implemented to cooperate and create favorable conditions for border guards to implement electronic border procedures locally."

Article 11. Replacing forms

Replace Forms No. 11, 12, and 16 attached to Decision No. 15/2019/QĐ-TTg, which has been amended and supplemented in 2025, with Forms No. 01, 02, and 03 attached to this Decision.

Chapter III
IMPLEMENTING PROVISIONS

Article 12. Implementation Provisions

This Decision takes effect from the date of issuance.
