CIRCULAR
Regulations on standards for training institutions and research organizations conducting vocational qualification career title training for education professionals

Pursuant to the Law on Vocational Education dated November 27, 2014;

Pursuant to the Civil Servant Law dated November 15, 2010;

Pursuant to Decree No. 101/2017/NĐ-CP dated September 1, 2017 of the Government on cadre, civil servant, and public official training;

Pursuant to Decree No. 15/2019/NĐ-CP dated February 1, 2019, of the Government detailing certain provisions and measures to implement the Law on Vocational Education;

Pursuant to Decree No. 14/2017/NĐ-CP dated February 17, 2017, of the Government, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor, Invalids, and Social Affairs;

Based on the proposal of the Director General of the General Department of Vocational Education;

The Minister of Labor - Invalids and Social Affairs issues this Circular to regulate the standards for training institutions and research organizations conducting vocational qualification career title training for education professionals.

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

1. This Circular stipulates the standards for training institutions and research organizations conducting vocational qualification career title training for education professionals; training programs and forms; allocation of training organizations; printing, issuing, and managing training certificates.

2. This Circular applies to:

a) Training institutions and research organizations include: academies, research institutes, universities, colleges; secondary vocational schools;

b) Relevant agencies, organizations, and individuals.

Article 2. Training Programs and Forms

1. Training program: Implemented according to the vocational qualification career title training program for education professionals issued by the Minister of Labor - Invalids and Social Affairs.

2. Based on actual conditions and learner needs, training institutions and research organizations may independently choose one of the following training forms: Concentrated, Semi-concentrated, Distance.

Article 3. Allocation of Training Organizations

1. Academies, research institutes, and universities meeting the criteria set forth in Articles 5 and 6 of this Circular shall organize and implement the training program according to the vocational qualification career titles for senior vocational education lecturers (Class I); principal vocational education lecturers (Class II); Class I vocational education teachers; Class II vocational education teachers.

2. Colleges meeting the criteria set forth in Articles 5 and 6 of this Circular shall organize and implement the training program according to the vocational qualification career titles for principal vocational education lecturers (Class II); Class II vocational education teachers; theoretical vocational education lecturers (Class III); practical vocational education lecturers (Class III); theoretical vocational education teachers (Class III); practical vocational education teachers (Class III); Class IV vocational education teachers.

3. Secondary vocational schools meeting the criteria set forth in Articles 5 and 6 of this Circular shall organize and implement the training program according to the vocational qualification career titles for Class IV vocational education teachers.

Article 4. Printing, Issuing, and Managing Training Certificates

1. The printing, issuance, and management of vocational qualification career title training certificates for education professionals shall be carried out in accordance with Article 4 of Circular No. 01/2018/TT-BNV dated January 8, 2018, issued by the Minister of Home Affairs guiding certain provisions of Government Decree No. 101/2017/NĐ-CP dated September 1, 2017, on training and upgrading skills for civil servants, public officials, and employees.

2. Training institutions and research organizations must publicly announce and update data on vocational qualification career title training certificates on their websites and the Vocational Education General Department's website. Public information includes the contents recorded on the certificate and must match the issuance record; it must be regularly updated and stored on the websites of the training institutions and research organizations, and the Vocational Education General Department; ensuring easy management, access, and search.

STANDARDS FOR TRAINING INSTITUTIONS AND RESEARCH ORGANIZATIONS CONDUCTING
VOCATIONAL QUALIFICATION CAREER TITLE TRAINING

Article 5. Experience and capacity of training and research institutions

1. Having at least three years of experience in training and professional development for vocational education teachers.

2. Having training materials that are compiled or selected and issued based on the training programs prescribed by the Minister of Labor, Invalids, and Social Affairs.

3. Having physical facilities and equipment in accordance with the training program standards for occupational titles of specialized vocational education staff as prescribed by the Minister of Labor, Invalids, and Social Affairs.

Article 6. Faculty

1. Having a faculty consisting of permanent and visiting lecturers who meet the criteria stipulated in Clause 1, Article 34 and Article 35 of Decree No. 101/2017/NĐ-CP dated September 1, 2017 of the Government on training and professional development for civil servants and public officials, and also meeting the criteria prescribed in the training programs issued by the Minister of Labor, Invalids, and Social Affairs.

2. The permanent faculty of the training and research institution must be sufficient to deliver at least seventy percent of the assigned training program volume.

Chapter III

IMPLEMENTATION

Article 7. Responsibilities of the General Department of Vocational Education

1. Compiling a list of training and research institutions under the management authority of the Ministry of Labor, Invalids, and Social Affairs that meet the criteria prescribed in this Circular, submitting it to the Minister of Labor, Invalids, and Social Affairs for consideration and decision to assign tasks to organize the implementation of training programs for occupational titles of specialized vocational education staff.

2. Compiling a list of training and research institutions tasked with organizing the training for occupational titles of specialized vocational education staff under the management authority of ministries, ministerial-level agencies, government agencies, central political-social organizations, provincial People's Committees, and centrally-administered municipal People's Committees, reporting to the Ministry of Labor, Invalids, and Social Affairs for management.

3. Compiling the results of training and issuing certificates for training according to the occupational titles of specialized vocational education staff from ministries, ministerial-level agencies, government agencies, central political-social organizations, provincial People's Committees, and centrally-administered municipal People's Committees, reporting to the Ministry of Labor, Invalids, and Social Affairs for management.

4. Organizing inspections and audits to ensure that training and research institutions comply with the criteria prescribed in this Circular.

Article 8. Responsibilities of Ministries, Ministerial-Level Agencies, Government Agencies, Central Political-Social Organizations, Provincial People's Committees, and Centrally-Administered Municipal People's Committees

1. Assigning tasks to training and research institutions under their management authority to implement specific training programs according to the occupational titles of specialized vocational education staff based on the provisions of this Circular, and submitting lists to the Ministry of Labor, Invalids, and Social Affairs (through the General Department of Vocational Education) and the Ministry of Home Affairs for compilation and management.

2. Annually compiling and submitting reports on the results of training and issuing certificates for training according to the occupational titles of specialized vocational education staff to the Ministry of Labor, Invalids, and Social Affairs (through the General Department of Vocational Education) and the Ministry of Home Affairs before January 31 of the following year (in the format prescribed by this Circular).

Article 9. Responsibilities of agencies and units with trainees participating in training

1. Annually, develop a plan for training occupational standards for vocational education teachers of the agency or unit; report to the direct management authority and coordinate with educational and research institutions to organize training according to the plan.

2. Manage files and ensure the standards of trainees assigned to participate in training as prescribed.

Article 10. Responsibilities of Educational and Research Institutions Assigned to Implement Upgrading

1. Compile or select and issue training materials for occupational standards for specialized vocational education officials based on the training program issued by the Ministry of Labor, Invalids and Social Affairs, ensuring suitability for each training target; provide reference materials to serve teaching and learning.

2. Develop plans and organize training for occupational standards for specialized vocational education officials for each target group in accordance with current regulations.

3. Decide the list of students admitted; manage the learning process, evaluate learning outcomes, and recognize learning results of students.

4. Collect, manage, and use training funds; issue and manage the issuance of certificates for training occupational standards for specialized vocational education officials for each target group in accordance with current regulations.

5. Implement management and evaluation of training results according to occupational standards for specialized vocational education officials as stipulated in Circular No. 10/2017/TT-BNV dated December 29, 2017 of the Minister of Home Affairs on quality assessment of cadre, civil servant, and official training.

6. Annually, compile and submit reports on training results and issuance of training certificates according to occupational standards for specialized vocational education officials to the direct management authority.

Article 11. Effective Date

1. This Circular takes effect from June 1, 2020.

2. During implementation, if there are difficulties, please reflect them to the Ministry of Labor, Invalids and Social Affairs for guidance.
