Based on the Law on Public Officials dated November 15, 2010; the Law Amending and Supplementing Certain Provisions of the Law on Civil Servants and the Law on Public Officials dated November 25, 2019; number of Articles of the Civil Servants Law and the Public Officer Law on November 25, 2019;

On the basis of Law on Education June 14, 2019;

Pursuant to Decree No. 69/2017/NĐ-CP dated May 25, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;

Based on the proposal of the Director of the Cadre and Civil Servant Department;

At the proposal of the Director of the Department of Teachers and Educational Management Staff;

The Minister of Education and Training issues this Circular to stipulate standards, conditions for examination or promotion review; content, form, and determination of successful candidates in the promotion review period for the teaching profession titles of kindergarten and general education teachers in public schools.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

1. This Circular stipulates standards, conditions for examination or promotion review; content, form, and determination of successful candidates in the promotion review period for the teaching profession titles of kindergarten and general education teachers in public schools.

2. This Circular applies to officials engaged in management and teaching of preschool and general education programs (hereinafter referred to collectively as teachers) in preschool educational institutions, general educational institutions, centers for continuing education, centers for vocational training and continuing education, specialized public schools (hereinafter referred to collectively as educational institutions) who have been appointed to the rank of teacher's occupational title and registered to take the examination or promotion review for the teacher's occupational title, and other related organizations and individuals.

3. Pre-service university teachers may apply this Circular to participate in the promotion review for the teacher's occupational title after being appointed to the rank of pre-service university teacher until specific regulations are issued by the competent authority.

Article 2. Principles of organizing examinations or promotion reviews for teachers' occupational titles

1. The principles of organizing examinations or promotion reviews for teachers' occupational titles shall be implemented according to the provisions of Article 31 of Decree No. 115/2020/ND-CP dated September 25, 2020 of the Government on recruitment, use, and management of public officials.

2. For promotion reviews, teachers registering for the promotion review must have complete files and evidence as prescribed. Chapter II

Article 3. Standards and conditions for examination or promotion review

Teachers may register for examination or promotion review to a higher occupational title when meeting the following standards and conditions:

1. The educational institution has a need and is authorized by the head of the competent management agency to attend the examination or promotion review for the occupational title.

2. They have been rated as having fulfilled their duties satisfactorily or better in the most recent work year before the examination or promotion review; they have good political qualities and professional ethics; they are not within the disciplinary action period and are not subject to any relevant regulations concerning disciplinary actions for public officials as stipulated in Article 56 of the Law on Public Officials amended and supplemented at Clause 8 of Article 2 of the Law Amending and Supplementing Certain Provisions of the Law on Civil Servants and the Law on Public Officials.

3. They have been appointed to the occupational title of kindergarten, primary school, lower secondary school, or upper secondary school teacher corresponding to their current position.

4. They meet the standards regarding educational qualifications, training, and professional competence criteria of the occupational title they are applying for according to the current regulations on occupational title standards for teachers issued by the Ministry of Education and Training. In cases where teachers are exempt from taking foreign language and information technology subjects according to Clause 6 and Clause 7 of Article 39 of Decree No. 115/2020/ND-CP dated September 25, 2020 of the Government on recruitment, use, and management of public officials, they are considered to meet the foreign language and information technology standards of the occupational title they are applying for.

Pre-service university teachers applying this Circular for promotion review must meet the standards regarding educational qualifications, training, and professional competence criteria of the occupational title they are applying for according to the regulations on occupational title standards for pre-service university teachers issued by the competent authority.

Article 4. Registration dossier for examination or promotion to higher rank of occupational title

1. The registration dossier for examination or promotion to higher rank of occupational title shall be implemented in accordance with the provisions of Article 36 of Decree No. 115/2020/NĐ-CP dated September 25, 2020 of the Government on recruitment, use, and management of civil servants.

2. In cases of registering for examination to promote to a higher rank of occupational title, in addition to the dossiers prescribed in Clause 1 of this Article, it is necessary to submit evidence of meeting the criteria of the rank of occupational title being applied for, in accordance with the guidance attached to this Circular.

Chapter III

CONTENT, FORM AND DETERMINATION OF THE SUCCESSFUL CANDIDATE IN THE PROMOTION PERIOD OF OCCUPATIONAL TITLE RANK

Article 5. Content and form of examination for promotion to higher rank of occupational title

1. Examination for promotion from Grade II teacher to Grade I teacher:

a) Promotion from Grade II teacher to Grade I teacher shall be carried out through the examination and scoring of the registration dossier for promotion and testing and examination according to the standards of the Grade I teacher occupational title for each level of education;

b) Grade II teachers applying for promotion to Grade I must participate in testing and examination when their dossier score reaches 100 points according to the scale specified in Article 6 of this Circular;

c) Testing and examination will be conducted in the form of multiple-choice tests or interviews:

For the multiple-choice test format: The duration of the multiple-choice test is 60 minutes, including questions related to the Party's policies, State laws on education, and the duties of teachers as stipulated in the occupational title rank standards (for each occupational title rank of each level of education), with a maximum of 60 questions. The multiple-choice test is scored out of 30 points and can be conducted either on paper or on computer.

For the interview format: The duration of the interview does not exceed 15 minutes per candidate, covering questions related to the Party's policies, State laws on education, and the duties of teachers as stipulated in the occupational title rank standards (for each occupational title rank of each level of education). The interview is scored out of 30 points and is conducted directly with each individual.

2. Examination for promotion from Grade III teacher to Grade II teacher: Shall be carried out through the examination and scoring of the registration dossier for promotion according to the standards of the Grade II teacher occupational title for each level of education.

Article 6. Calculation of scores for the dossier for promotion to higher rank of occupational title

1. The dossier for promotion shall be scored out of 100 points, without rounding off when adding up component scores, specifically:

a) Score for the group of criteria regarding educational qualification and training standards: 20 points;

b) Score for the group of criteria regarding professional competence and vocational standards: 80 points.

2. Guidance on evidence and scoring of the groups of criteria is provided in the annex attached to this Circular.

Article 7. Determination of Successful Candidates in the Period of Promotion Examination for Professional Title

1. A person determined to be successful in the period of examination for promotion to higher rank of occupational title must meet the following conditions:

a) Having complete dossiers with accompanying evidence as prescribed;

b) For cases applying for promotion from Grade II to Grade I: The dossier score according to the provisions of Clause 1 of Article 6 of this Circular must reach 100 points and the testing and examination score must be at least 15 points.

For cases applying for promotion from Grade III to Grade II: The dossier score according to the provisions of Clause 1 of Article 6 of this Circular must reach 100 points.

2. If the number of dossiers for promotion that meet the requirements of Clause 1 of this Article exceeds the number of promotion quotas assigned by the competent authority, the following measures shall be taken:

a) For cases applying for promotion from Grade II to Grade I: Select candidates based on the testing and examination scores in descending order until all promotion quotas assigned by the competent authority are filled;

b) For cases applying for promotion from Grade III to Grade II: Use the duties of Grade II as the basis for promotion. Select candidates based on the scores of evidence of Grade II duties performed by Grade III teachers over the six consecutive years immediately preceding the deadline for submitting the registration dossier for promotion, in descending order until all promotion quotas assigned by the competent authority are filled. Guidance on evidence and scoring is provided in the annex attached to this Circular;

c) If two or more candidates have the same score at the last promotion quota, the determination of the successful candidate shall be made in the following priority order: female teachers, ethnic minority teachers, older teachers (based on date of birth), and teachers with longer tenure. If still unable to determine, the head of the organization authorized to organize the promotion examination shall exchange opinions with the head of the organization authorized to manage civil servants and decide on the successful candidate based on the recommendation of the head of the organization authorized to manage civil servants.

3. Teachers who are not successful in the period of examination for promotion to higher rank of occupational title as prescribed in Clauses 1 and 2 of this Article shall not retain their results for subsequent promotion examinations.

4. Notification of the results of the examination for promotion to higher rank of teacher occupational title:

a) Within ten days from the completion of the promotion examination, the Promotion Examination Council must report to the head of the organization authorized to organize the promotion examination about the results of the promotion examination; simultaneously, publicly announce the results on the organization’s website or electronic portal and send a written notification to the organizations that nominated the teachers for promotion to inform them of the results.

b) Within fifteen days from the date of notification of the examination results for promotion, the teacher under examination has the right to submit a request for a re-examination of the scoring results of the application dossier for promotion examination and the examination scores (in cases where the test is conducted on paper). The Promotion Examination Council is responsible for establishing a Re-examination Board and organizing the re-examination, and announcing the re-examination results no later than fifteen days from the deadline for submitting re-examination requests as stipulated in this clause;

c) No later than five working days from the date of announcement of the re-examination results, the Promotion Examination Council shall report to the head of the agency or unit authorized to organize the promotion examination for approval of the examination results and the list of successful teachers;

d) No later than five working days from the date of the decision approving the promotion examination results, the Promotion Examination Council is responsible for notifying the examination results and the list of successful teachers in writing to the agencies or units that have nominated teachers to participate in the examination;

Chapter IV

IMPLEMENTING PROVISIONS

Article 8Article 1. This Circular takes effect from February 15, 2026; Circular No. 24/2013/TT-BKHCN dated September 30, 2013 of the Minister of Science and Technology on activities related to calibration, verification, testing of measuring instruments, and measurement standards shall cease to be effective from the date this Circular takes effect.

1. This Circular takes effect from January 15, 2022.

2. The Director of the Office, the Director General of the Department of Teachers and Educational Management, the Heads of relevant units under the Ministry of Education and Training; the Chairmen of the People's Committees of provinces and centrally governed cities; the Directors of Departments of Education and Training, and the Directors of Departments of Education, Science and Technology of Bac Lieu Province are responsible for implementing this Circular.

3. In case the referenced documents in this Circular are amended, supplemented, or replaced, they shall be implemented according to the new documents.

4. This Circular replaces the following Circulars: Circular No. 20/2017/TT-BGDĐT dated August 18, 2017 of the Ministry of Education and Training on standards, conditions, contents, and forms of examination for promotion of teaching positions for public kindergarten and primary-secondary school teachers; Circular No. 28/2017/TT-BGDĐT dated November 30, 2017 of the Ministry of Education and Training on standards, conditions, contents, and forms of examination for promotion of teaching positions for public kindergarten and primary-secondary school teachers.

5. The Regulation on Examination for Promotion of Teaching Positions for Public Kindergarten and Primary-Secondary School Teachers issued together with Circular No. 29/2017/TT-BGDĐT dated November 30, 2017 of the Ministry of Education and Training is hereby abolished./.
