CIRCULAR

Issuing National Technical Regulations for Non-Alcoholic Beverages

Pursuant to the Law on Standards and Technical Regulations dated June 29, 2006, and Decree No. 127/2007/NĐ-CP dated August 1, 2007 of the Government detailing implementation of certain provisions of the Law on Standards and Technical Regulations;

Pursuant to the Ordinance on Food Safety and Hygiene dated August 7, 2003, and Decree No. 163/2004/NĐ-CP dated September 7, 2004 of the Government detailing implementation of certain provisions of the Ordinance on Food Safety and Hygiene;

Pursuant to Decree No. 188/2007/NĐ-CP dated December 27, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Health;

At the proposal of the Director of the Food Safety Agency, the Head of the Science and Training Department, and the Head of the Legal Affairs Department,

NATIONAL TECHNICAL REGULATION FOR NON-ALCOHOLIC BEVERAGES

National technical regulation for soft drinks

This technical regulation sets out technical requirements, testing methods, sampling procedures; management requirements; responsibilities of organizations and individuals producing, trading, and importing cigarettes.

This regulation sets forth food safety criteria and management requirements for non-alcoholic beverages, including fruit and vegetable juices, fruit nectars, and ready-to-drink non-alcoholic beverages.

This regulation does not apply to functional foods.

This Regulation applies to:

a) Organizations and individuals importing, producing, and trading non-alcoholic beverages in Vietnam;

b) Relevant organizations and individuals.

In this technical regulation, the following terms are understood as follows:

3.1. Fruit and Vegetable Juices

A product whose main component is fruit or vegetable juice, which may contain some fruit or vegetable pulp, and which may be concentrated to form concentrated fruit and vegetable juice or fermented to form fermented fruit and vegetable juice.

3.2. Fruit Nectars

A product processed by blending fruit or vegetable tissue with juice extract, sugar, and other additives. The product must meet the requirements specified in the Appendix of TCVN 7946:2008 Fruit Juice and Nectar.

3.3. Ready-to-Drink Non-Alcoholic Beverages

A product prepared from water and natural or synthetic ingredients, which may contain CO2.

1. Quality Requirements for Water Used in the Production of Non-Alcoholic Beverages

Water used in the production of non-alcoholic beverages must comply with the quality requirements set forth in QCVN 01:2009/BYT on drinking water quality issued together with Circular No. 04/2009/TT-BYT dated June 17, 2009 of the Minister of Health.

2. Food Safety Requirements for Non-Alcoholic Beverages

2.1. Maximum limits for contaminants as specified in Appendix I of this Regulation.

2.2. Microbiological indicators as specified in Appendix II of this Regulation.

2.3. List of permitted food additives in accordance with current regulations.

2.4. Equivalent testing methods may be used if they have the same accuracy as those specified in Appendices I and II of this Regulation.

2.5. Sample collection and testing method numbers and full names as specified in Appendix III of this Regulation.

2.6. In cases where testing indicators not covered by this Regulation need to be checked, the Ministry of Health will decide on the testing method based on currently recognized domestic or international methods.

3. Labeling

The labeling of non-alcoholic beverage products must comply with the provisions of Decree No. 89/2006/NĐ-CP dated August 30, 2006 of the Government on Product Labels and related guiding documents.

8.2. Domestic-produced TNP1 explosive must declare compliance according to Circular No. 28/2012/TT-BKHCN dated December 12, 2012, issued by the Minister of Science and Technology regarding declaration of conformity to standards and technical regulations and methods of conformity assessment (hereinafter referred to as Circular No. 28/2012/TT-BKHCN) and Circular No. 02/2017/TT-BKHCN dated March 31, 2017, issued by the Minister of Science and Technology amending and supplementing certain provisions of Circular No. 28/2012/TT-BKHCN dated December 12, 2012, issued by the Minister of Science and Technology regarding declaration of conformity to standards and technical regulations and methods of conformity assessment (hereinafter referred to as Circular No. 02/2017/TT-BKHCN).

1. Declaration of Conformity

1.1. Non-alcoholic beverage products imported, produced, and traded domestically must be declared compliant in accordance with the provisions of this Regulation.

The procedures, sequence, and formalities for declaring compliance are carried out according to the provisions on certification and declaration of compliance issued together with Decision No. 24/2007/QĐ-BKHCN dated September 28, 2007 of the Minister of Science and Technology and relevant laws.

2. Inspection of Non-Alcoholic Beverage Products

Quality and hygiene inspections of non-alcoholic beverage products must be conducted in accordance with legal provisions.

IV. RESPONSIBILITIES OF ORGANIZATIONS AND INDIVIDUALS

1. Organizations and individuals importing and producing non-alcoholic beverages must declare compliance in accordance with the technical provisions of this Regulation, register the declaration of compliance with the competent state management agency according to the classification of the Ministry of Health, and ensure that the quality and hygiene standards comply with the declared content.

2. Organizations and individuals may only import, produce, and trade non-alcoholic beverages after completing the registration of the declaration of compliance and ensuring that the quality, hygiene standards, and labeling comply with legal provisions.

V. IMPLEMENTATION

1. The Food Safety Agency shall take the lead and coordinate with relevant agencies to guide the implementation and organization of this Regulation.

2. Based on management requirements, the Food Safety Agency shall be responsible for proposing amendments and supplements to this Regulation to the Ministry of Health.

3. In case the standards and legal provisions cited in this Regulation are changed, supplemented, or replaced, the new provisions shall apply.
