Article 24etermining on fire prevention, firefighting, rescue, and search and rescue tasks of the People's Public Security Forces

Pursuant to the Government Organization Law on February 18, 2025;
Pursuant to the Law on the Public Security Organs dated November 20, 2018; the Law Amending and Supplementing Certain Articles of the Law on the Public Security Organs dated June 22, 2023;
Pursuant to the Law on Fire Prevention, Firefighting, Rescue, and Search and Rescue dated November 29, 2024;
BASED ON DECREE NO. 02/2025/ND-CP DATED FEBRUARY 18, 2025 OF THE GOVERNMENT ON FUNCTIONS, TASKS, POWERS, AND ORGANIZATIONAL STRUCTURE OF THE MINISTRY OF PUBLIC SECURITY;
Pursuant to Decree No. 105/2025/NĐ-CP dated May 15, 2025 of the Government detailing certain provisions and measures to implement the Law on Fire Prevention, Firefighting, and Rescue;
Pursuant to the proposal of the Director of the Fire Prevention, Firefighting, and Rescue Police Department;
The Minister of Public Security issues this Circular qetermining the tasks of fire prevention, firefighting, rescue, and search and rescue of the People's Public Security Forces.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Circular details certain provisions of the Law on Fire Prevention, Firefighting, Rescue, and Search and Rescue regarding the tasks of fire prevention, firefighting, rescue, and search and rescue of the People's Public Security Forces, including:
1. Clause 7, Article 25 on firefighting standby work and firefighting organization of the Police Force for Fire Prevention, Firefighting, Rescue, and Search and Rescue and other forces within the People's Public Security Forces.
2. Clause 6, Article 33 on rescue and search and rescue standby work and rescue and search and rescue organization of the Police Force for Fire Prevention, Firefighting, Rescue, and Search and Rescue and other forces within the People's Public Security Forces.
3. Clause 6, Article 41 on guidance for building fire prevention, firefighting, rescue, and search and rescue forces; implementation of fire prevention, firefighting, rescue, and search and rescue work; management of fire prevention, firefighting, rescue, and search and rescue equipment.
4. Clause 4, Article 45 on training and improving professional skills in fire prevention, firefighting, rescue, and search and rescue for the Police Force for Fire Prevention, Firefighting, Rescue, and Search and Rescue and other forces within the People's Public Security Forces.
5. Point b, Clause 2, Article 47 on allowances when implementing training and improving professional skills in fire prevention, firefighting, rescue, and search and rescue; practicing firefighting plans, rescue and search and rescue plans; during firefighting, rescue, and search and rescue operations.
Article 2. Applicability
This Circular applies to public security units and localities and organizations and individuals related thereto.
Article 3. Appendices
The appendices attached to this Circular include:
1. Appendix I: Documents for signing regarding fire prevention, firefighting, rescue, and search and rescue.
2. Appendix II: Forms used in performing the tasks of fire prevention, firefighting, rescue, and search and rescue of the People's Public Security Forces.
Chapter II
STAND-BY AND ORGANIZATION OF FIREFIGHTING, RESCUE, AND SEARCH AND RESCUE
Article 4. Command Stand-by for Firefighting, Rescue, and Search and Rescue
1. The Fire Prevention, Firefighting, Rescue, and Search and Rescue Police Department assigns one leader from the Firefighting and Rescue Operations Division and one officer to stand-by at the Command Center of the Fire Prevention, Firefighting, Rescue, and Search and Rescue Police Department.
2. The Fire Prevention, Firefighting, Rescue, and Search and Rescue Police Division of provincial-level public security organs (hereinafter referred to as the Fire Prevention, Firefighting, Rescue, and Search and Rescue Police Division) assigns one division leader and one team commander of the Firefighting and Rescue Operations Team to stand-by at their unit's headquarters.
3. The Firefighting and Rescue Teams in regions, River Fire Prevention, Firefighting, Rescue, and Search and Rescue Police Teams assign one team commander to stand-by at their unit's headquarters.
Article 5. Directly Receiving and Processing Fire Alarm and Rescue Situation Information
1. Directly receiving and processing fire alarm and rescue situation information 24/7 and divided into shifts. The Provincial Public Security Director decides on the shift schedule for receiving and processing fire alarms and rescue situation information based on the actual force situation, ensuring that each shift at the fire alarm and rescue situation information reception and processing department has a minimum of two officers and soldiers.
2. The fire alarm and rescue situation information reception and processing department is located at:
a) The Provincial Public Security Command Center (if available);
b) The Fire Prevention, Firefighting, Rescue, and Search and Rescue Police Division;
c) The Firefighting and Rescue Teams in regions, River Fire Prevention, Firefighting, Rescue, and Search and Rescue Police Teams;
d) Other locations determined by the competent authority.
3. Fire alarm and rescue situation information is received through: the call center system from telephone numbers 113, 114, 115; telephone numbers of Fire Prevention, Firefighting, Rescue, and Search and Rescue Police Units; the Fire Prevention, Firefighting, Rescue, and Search and Rescue Database and fire alarm transmission system; fire reporting applications; direct reports from citizens; other cases as prescribed by law.
4. Content of fire alarm and rescue situation information to be received:
a) Name, telephone number, or address of the person reporting the fire or rescue situation;
b) Address, time of discovery of the fire, accident, or incident;
c) Type of fire, accident, or incident; scale of the fire, accident, or incident; number and condition of people trapped in the fire, accident, or incident; risk of fire spread and other relevant information about the fire, accident, or incident.
5. In case the fire, accident, or incident information does not fall within the assigned area for firefighting, rescue, and search and rescue tasks, the officers and soldiers directly receiving and processing fire alarm and rescue situation information:
a) Immediately report to the unit assigned to perform firefighting, rescue, and search and rescue tasks in that area;
b) Report to the unit commander to mobilize forces and equipment to go to the scene if the distance from the location of the fire, accident, or incident to their unit is closer than the unit assigned to perform firefighting, rescue, and search and rescue tasks, or be ready to participate in firefighting, rescue, and search and rescue upon request for support.
6. Responsibilities of officers and soldiers directly receiving and processing fire alarm and rescue situation information:
a) Manage and skillfully operate communication devices, the Fire Prevention, Firefighting, Rescue, and Search and Rescue Database, and fire alarm transmission systems;
b) Receive and record fire alarm and rescue situation information fully in the Fire Alarm and Rescue Situation Information Reception and Processing Logbook according to Form No. 08 in Appendix II attached to this Circular.
7. Officers and soldiers directly receiving and processing fire alarm and rescue situation information shall implement the provisions of Article 6 of this Circular when receiving information.
Article 6. Receiving and Processing Information on Fire Reports and Rescue Situations
1. Staff and soldiers on duty at the Command and Control Information Center of the Provincial Public Security shall perform the following when receiving information on fire reports and rescue situations:
a) In cases where the Command and Control Information Center of the Provincial Public Security has been equipped with a database system for fire prevention, firefighting, rescue operations, and fire reporting communication systems:
When receiving through the database system for fire prevention, firefighting, rescue operations, and fire reporting communication systems: operate the system to immediately mobilize the nearest fire prevention, firefighting, and rescue unit to carry out firefighting, rescue operations; notify the Fire Prevention, Firefighting, and Rescue Police Department, the public security agency of the commune where the fire, accident, or incident occurred, and related units to participate in firefighting, rescue operations, ensure security and order, traffic regulation, protect the scene, investigate the cause of the fire, medical agencies to provide emergency care to victims (if any), power agencies to cut off electricity at the location of the fire, water supply units to support firefighting, and other agencies and units participating and supporting firefighting, rescue operations according to the requirements of those authorized.
When receiving through the call center system from telephone numbers 113, 114, 115: operate the database system for fire prevention, firefighting, rescue operations, and fire reporting communication systems to determine the location of the fire, accident, or incident and implement the above contents;
b) In cases where the Command and Control Information Center of the Provincial Public Security has not been equipped with a database system for fire prevention, firefighting, rescue operations, and fire reporting communication systems, when receiving fire reports through the call center system from telephone numbers 113, 114, 115:
Clearly identify the address and location of the fire, accident, or incident, report to the direct commander of the unit, mobilize the nearest fire prevention, firefighting, and rescue unit to carry out firefighting, rescue operations according to the commander's orders; notify the Fire Prevention, Firefighting, and Rescue Police Department, the public security agency of the commune where the fire, accident, or incident occurred, and related units to participate in firefighting, rescue operations, ensure security and order, traffic regulation, protect the scene, investigate the cause of the fire, medical agencies to provide emergency care to victims (if any), power agencies to cut off electricity at the location of the fire, water supply units to support firefighting, and other agencies and units participating and supporting firefighting, rescue operations according to the requirements of those authorized.
2. Staff and soldiers on duty at the Fire Prevention, Firefighting, and Rescue Police Department when receiving information on fire reports and rescue situations shall perform the following:
a) In cases where information is received from the Command and Control Information Center of the Provincial Public Security: report to the shift commander; monitor and grasp the situation, receive and convey orders to mobilize forces and equipment to carry out firefighting, rescue operations when requested by the shift commander;
b) In cases where information is received through the database system for fire prevention, firefighting, rescue operations, and fire reporting communication systems (if the Command and Control Information Center of the Provincial Public Security has not been equipped with such a system): report to the direct commander of the unit, receive and convey orders to mobilize forces and equipment to carry out firefighting, rescue operations; notify the public security agency of the commune where the fire, accident, or incident occurred, and related units to participate in firefighting, rescue operations, ensure security and order, traffic regulation, protect the scene, investigate the cause of the fire, medical agencies to provide emergency care to victims (if any), power agencies to cut off electricity at the location of the fire, water supply units to support firefighting, and other agencies and units participating and supporting firefighting, rescue operations according to the requirements of those authorized;
c) Receive information through telephone number 114 or through telephone numbers from the Fire Fighting and Rescue Team in the area, River Fire Prevention, Firefighting, and Rescue Police Team:
In cases where there is a database system for fire prevention, firefighting, rescue operations, and fire reporting communication systems: operate the system to determine the location of the fire, accident, or incident and implement the contents prescribed in point b, Clause 2 of this Article.
In cases where there is no database system for fire prevention, firefighting, rescue operations, and fire reporting communication systems: report to the shift commander; monitor and grasp the situation, receive and convey orders to mobilize forces and equipment to carry out firefighting, rescue operations when requested by the unit commander;
d) Receive fire reports and rescue situation reports directly reported by citizens:
In cases where there is a database system for fire prevention, firefighting, rescue operations, and fire reporting communication systems: operate the system to determine the location of the fire, accident, or incident and implement the contents prescribed in point b, Clause 2 of this Article.
In cases where there is no database system for fire prevention, firefighting, rescue operations, and fire reporting communication systems: report to the shift commander; monitor and grasp the situation, receive and convey orders to mobilize forces and equipment to carry out firefighting, rescue operations when requested by the unit commander;
đ) Transfer tactical firefighting and rescue operation sheets to the firefighting and rescue commanders to carry out firefighting and rescue tasks (when the unit carrying out firefighting and rescue tasks is located together with the information reception and processing unit of the Fire Prevention, Firefighting, and Rescue Police Department).
3. Staff and soldiers on duty at the Fire Fighting and Rescue Team in the area, River Fire Prevention, Firefighting, and Rescue Police Team when receiving information on fire reports and rescue situations shall perform the following:
a) Receive through the unit's telephone number or directly reported by citizens:
In cases where there is a database system for fire prevention, firefighting, rescue operations, and fire reporting communication systems: operate the system to determine the location of the fire, accident, or incident; promptly report to the unit commander, simultaneously issue an alarm to mobilize the unit's forces and equipment to carry out firefighting, rescue operations; report to the Fire Prevention, Firefighting, and Rescue Police Department.
In the absence of a Fire Prevention, Firefighting, Rescue, and Fire Alarm Transmission Database System: promptly report to the unit commander, simultaneously issue orders for the unit's forces and equipment to proceed with firefighting, rescue, and emergency response tasks; report to the Fire Prevention, Firefighting, and Rescue Police Department.
b) Upon receiving information through the Fire Prevention, Firefighting, Rescue, and Fire Alarm Transmission Database System and fire alarm application: issue orders for the unit's forces and equipment to proceed with firefighting, rescue, and emergency response tasks, while simultaneously reporting to the Fire Prevention, Firefighting, and Rescue Police Department.
c) Transfer the tactical firefighting, rescue, and emergency response plan to the firefighting, rescue, and emergency response commander to carry out firefighting, rescue, and emergency response tasks.
4. Personnel directly receiving fire alarm and rescue situation reports as stipulated in Clauses 1, 2, and 3 of this Article shall be responsible for maintaining the reception and processing of information, and keeping regular communication with the firefighting, rescue, and emergency response commanders at the scene; compile the situation and report according to regulations.
Article 7. Readiness for Firefighting, Rescue, and Emergency Response
1. Firefighting, rescue, and emergency response equipment must be arranged for immediate readiness for firefighting, rescue, and emergency response. For equipment stored in warehouses, there must be plans for immediate use upon mobilization orders.
Firefighting, rescue, and emergency response equipment arranged for immediate readiness for firefighting, rescue, and emergency response must ensure normal operation, neat arrangement, safety, and convenience for timely deployment for firefighting, rescue, and emergency response; devices arranged with firefighting, rescue, and emergency response equipment must be complete in number and properly positioned according to the manufacturer's design.
2. Personnel arranged for immediate readiness for firefighting, rescue, and emergency response must be organized into a minimum of 02 duty shifts corresponding to basic firefighting, rescue, and emergency response formations to operate and use firefighting, rescue, and emergency response equipment on duty, specifically:
a) Fire trucks are arranged with 01 duty shift consisting of 06 personnel, including 01 commander, 01 personnel to control and operate the equipment;
b) Firefighting and rescue boats are arranged with 01 duty shift consisting of 07 personnel, including 01 commander, 01 personnel to control and operate the equipment;
c) Firefighting and rescue inflatable boats are arranged with 01 duty shift consisting of 04 personnel, including 01 commander, 01 personnel to control and operate the equipment;
d) Firefighting ships and specialized vehicles for firefighting, rescue, and emergency response, based on the functions, effects of the equipment, and the manufacturer's design, are arranged with 01 duty shift consisting of 01 commander, 01 personnel to control and operate the equipment, and an appropriate number of personnel.
3. Responsibilities of the duty commander for firefighting, rescue, and emergency response:
a) Master the duties and authorities of the firefighting, rescue, and emergency response commander as prescribed by law, principles, methods, measures, tactics, techniques for firefighting, rescue, and emergency response, plans for mobilizing forces and equipment to participate in firefighting, rescue, and emergency response, headcount on duty, capabilities of personnel to perform tasks, quantity, types, functions, and effects of firefighting, rescue, and emergency response equipment;
b) Organize handover of duty shifts and inspect the readiness for firefighting, rescue, and emergency response of forces and equipment during the duty shift;
c) Organize other activities of the unit according to the work program and plan.
4. Responsibilities of personnel arranged for immediate readiness for firefighting, rescue, and emergency response:
a) Must always be present at the unit's headquarters, wear uniform attire during administrative working hours; when an alarm is issued, quickly put on full firefighting, rescue, and emergency response gear and personal protective equipment, board the assigned vehicle, sit in the designated position, and start the engine ready to depart, awaiting the commander's order.
The time from receiving the alarm to personnel boarding the vehicle and starting the engine ready to depart: for fire trucks and specialized vehicles for firefighting, rescue, and emergency response not exceeding 90 seconds; for firefighting ships, inflatable boats, and firefighting rescue boats (excluding firefighting ships at sea) not exceeding 180 seconds;
b) Master the duties and authorities assigned during the duty shift; proficient in individual and team firefighting, rescue, and emergency response techniques; skillfully use firefighting, rescue, and emergency response equipment managed during the duty shift; personnel controlling firefighting, rescue, and emergency response equipment must strictly comply with traffic laws and ensure the safety of personnel on the way to perform tasks;
c) Check the operational status and maintenance of firefighting, rescue, and emergency response equipment daily, before, during, and after each use of the equipment managed, used, maintained, and serviced;
If equipment is found to be unusable or requires supplementation or replacement, immediately report to the duty shift commander to address it promptly or propose to the competent authority to address it promptly;
d) During participation in firefighting, rescue, and emergency response training activities, firefighting plan drills, and rescue plan drills, ensure readiness to respond to firefighting, rescue, and emergency response tasks upon command;
đ) Fully participate in the handover of duty shifts as prescribed and perform other tasks assigned by superiors.
5. The Director of the Provincial Public Security Department, based on the actual situation regarding forces and equipment, decides to divide duty shifts for immediate readiness for firefighting, rescue, and emergency response to meet the requirements of firefighting, rescue, and emergency response tasks according to the principle that officers and non-commissioned officers in technical and professional positions work one day and rest the next.
Article 8. Organizing activities during standby shifts for firefighting, rescue, and emergency response
1. The duration of the standby shift runs from the start of work on the previous day to the start of work on the following day. The handover of the standby shift shall be carried out at the end of each daily shift, specifically as follows:
a) The commander of the outgoing shift shall gather, check the number of personnel, report, comment on the situation and results of all aspects of work during the standby shift; hand over the shift to the incoming shift commander;
b) The commander of the incoming shift shall accept the shift, assign specific tasks to officers and soldiers in the standby shift;
c) Officers and soldiers in the standby shift shall check the quantity, position, and operational status of firefighting, rescue, and emergency response equipment assigned by the shift commander;
d) The handover between two shifts must be recorded in the Logbook for Shift Handover for Firefighting, Rescue, and Emergency Response according to Model No. 07 attached as Appendix II to this Circular;
đ) During the time of handing over the shift, if receiving information about a fire or rescue emergency situation: the outgoing shift shall carry out firefighting, rescue, and emergency response tasks, while the incoming shift shall take over the standby duty at the unit. After completing the firefighting, rescue, and emergency response tasks, continue organizing the shift handover as stipulated in points a, b, c, and point d of this clause.
2. During the standby period for firefighting, rescue, and emergency response, regular training in firefighting, rescue, and emergency response skills or meetings to review lessons learned from fires, rescue emergencies, or drills of firefighting, rescue, and emergency response plans must be organized for officers and soldiers according to programs and plans approved by competent authorities.
3. In cases where regular training in firefighting, rescue, and emergency response skills or drills of firefighting, rescue, and emergency response plans are conducted outside the unit, it is necessary to maintain uninterrupted communication with the department directly responsible for receiving and processing fire and rescue emergency situation reports to promptly mobilize forces and equipment for firefighting, rescue, and emergency response.
4. After regular training in firefighting, rescue, and emergency response skills, drills of firefighting, rescue, and emergency response plans, or after returning to the unit from firefighting, rescue, and emergency response missions, the unit commander must organize inspections, maintenance, and replenishment of fuel, water, and firefighting agents to ensure that equipment is always in a state of readiness for firefighting, rescue, and emergency response as prescribed.
Article 9. Mobilizing forces and equipment for firefighting, rescue, and emergency response
1. Upon receiving information about a fire or rescue emergency situation, the shift commander must assess the fire, accident, or incident situation and issue orders to mobilize the unit's forces and equipment for firefighting, rescue, and emergency response, ensuring prompt and timely handling of the situation; when mobilizing fire trucks for firefighting tasks, there must be no fewer than two vehicles.
If it is deemed necessary to mobilize forces and equipment from other agencies, organizations, and units to participate in firefighting, rescue, and emergency response, the shift commander must report to the competent authority for implementation in accordance with regulations.
2. While en route to the location of the fire, accident, or incident, the commander leading the firefighting, rescue, and emergency response team has the responsibility:
a) To maintain continuous communication to update information and developments of the fire, accident, or incident from the department responsible for receiving and processing fire and rescue emergency situation reports within their own unit, the Fire Prevention, Firefighting, and Rescue Department, and the Provincial Public Security Command Information Center (if available);
b) To promptly report difficulties encountered to the immediate superior commander; simultaneously, find ways to overcome difficulties to bring forces and equipment to the location of the fire, accident, or incident safely and as quickly as possible;
c) When encountering a fire or another emergency situation, the commander leading the firefighting, rescue, and emergency response team may, based on the nature and severity of the incident, decide to leave part of the forces and equipment to carry out firefighting, rescue, and emergency response tasks but must report to the immediate superior commander or inform the department responsible for receiving and processing fire and rescue emergency situation reports within their own unit to mobilize additional forces and equipment for firefighting, rescue, and emergency response;
d) Upon receiving information that the fire has been extinguished or the accident or incident has been resolved from officers and soldiers on duty at the department responsible for receiving and processing fire and rescue emergency situation reports within their own unit, the commander leading the firefighting, rescue, and emergency response team must report to the immediate superior commander and continue to dispatch appropriate forces and equipment to the scene to gather information about the incident as prescribed.
Article 10. Reconnaissance of fire scenes, accidents, and incidents
1. Upon arriving at the location of a fire, accident, or incident, if the situation is not complex, the commander may directly observe to decide on appropriate firefighting, rescue, and evacuation measures, tactics, and techniques. In cases where the fire, accident, or incident is deemed to have a complex development, the commander must establish a reconnaissance team with a minimum of three officers or soldiers to organize the reconnaissance of the fire scene, accident, or incident. When multiple directions or areas require reconnaissance, the commander should establish several reconnaissance teams to grasp the situation. If necessary, the commander may request individuals familiar with the area to participate in assisting the reconnaissance team in performing their duties.
2. Tasks of the reconnaissance team:
a) At the fire scene, it is necessary to determine: the number, position, and condition of victims; rescue methods and capabilities for saving victims; dangerous factors from the fire that could threaten the lives and health of victims as well as the firefighting, rescue, and evacuation forces; primary combustible materials, fire spread risks, and potential fire development; positions and areas where forces and equipment should be deployed to save people and property, prevent fire spread; the ability to use existing firefighting equipment of the premises and water sources within and outside the premises that can serve firefighting purposes; relevant evidence related to the fire (if any) to assist in determining the cause of the fire;
b) At the accident or incident site, it is necessary to determine: the number, position, and condition of victims, vehicles, and assets threatened by dangerous factors; entry and exit routes to the accident or incident site; dangerous factors that could threaten the lives and health of victims and rescue forces; suitable locations to deploy rescue equipment and devices; rescue methods and safety measures during the execution of tasks; relevant evidence related to the accident or incident (if any) to assist in determining the cause of the accident or incident.
3. Based on the situation, development of the fire, accident, or incident, and the available firefighting, rescue, and evacuation forces and equipment, the commander may simultaneously decide on organizing reconnaissance and deploying forces and equipment to save people and property, control, and extinguish the fire.
4. The organization of reconnaissance of fire scenes and accident sites must be carried out continuously from the moment of arrival at the fire, accident, or incident site until the completion of firefighting, rescue, and evacuation tasks.
5. Officers and soldiers tasked with reconnaissance of fire scenes and accident sites are responsible for thoroughly understanding and fully implementing the contents stipulated in Clause 2 of this Article; they must carry personal protective equipment and specialized tools; promptly implement emergency measures to save people and property, control, and extinguish fires if conditions permit; report the results of their tasks throughout the reconnaissance process to the commander.
Article 11. Deployment of Firefighting, Rescue, and Evacuation Operations
1. Deployment of firefighting, rescue, and evacuation operations at the fire scene:
a) Based on the situation, development of the fire, and the results of reconnaissance, the commander organizes the deployment of forces and equipment to predetermined positions to save victims, decides on the movement and demolition of obstacles and assets within the rescue and evacuation range to save people and property; applies firefighting measures, tactics, and techniques to prevent fire spread, control, and extinguish the fire;
b) The arrangement and deployment of firefighting, rescue, and evacuation forces and equipment must ensure: maximizing the capacity and effectiveness of equipment; quickly concentrating on the main attack direction and other necessary places; having mobility to avoid being surrounded by flames and not affecting the operation of other firefighting, rescue, and evacuation equipment.
2. Deployment of rescue and evacuation operations at the accident or incident site:
a) Based on actual conditions and the results of reconnaissance at the site, the commander must quickly deploy formations, arrange rescue and evacuation equipment and devices to predetermined positions, decide on methods and measures to quickly remove people and vehicles from dangerous areas;
b) Depending on the situation, development, characteristics of the accident or incident site, and the operational capability of rescue and evacuation equipment, the commander decides on the application of rescue and evacuation methods and techniques, the movement and demolition of obstacles and assets (if any) to rescue and evacuate.
3. Officers and soldiers tasked with firefighting, rescue, and evacuation operations are responsible for: deploying firefighting, rescue, and evacuation equipment and tools to positions according to the commander's orders; implementing measures to save people and property, prevent fire spread, control, and extinguish the fire; strictly adhering to safety measures during the execution of tasks.
4. When organizing the deployment of firefighting, rescue, and evacuation operations and a higher-ranking officer assigned to command firefighting, rescue, and evacuation operations arrives, the transfer of command authority is conducted as follows:
a) The commander currently executing the task must report the situation, development of the fire, accident, or incident, the results of deployment, and transfer command authority for firefighting, rescue, and evacuation operations to the higher-ranking officer or accept delegation to continue commanding;
b) The higher-ranking commander may delegate the current commander to continue performing command tasks for firefighting, rescue, and evacuation operations but still bear responsibility for the results of firefighting, rescue, and evacuation operations;
c) In cases where it is necessary to leave the fire, accident, or incident site to perform other tasks as required by the competent authority, the current commander must transfer command authority for firefighting, rescue, and evacuation operations to a suitable authorized person and must notify the information reception and processing unit.
Article 12. Termination of firefighting, rescue, and emergency response operations
1. After the fire has been extinguished or the accident or incident has been handled, the firefighting, rescue, and emergency response commander shall be responsible for:
a) Organizing a re-inspection of the fire scene, accident site, or incident location before deciding to terminate firefighting, rescue, and emergency response activities;
b) Reporting immediately the situation and results of organizing firefighting, rescue, and emergency response to the superior commander directly managing them;
c) Organizing the handover of rescued victims and salvaged property (if any);
d) Assigning officers and soldiers to participate in cooperating with the protection, investigation, and examination of the scene, and investigating the cause of the fire, accident, or incident according to regulations;
đ) Deciding to terminate firefighting, rescue, and emergency response activities, organizing a headcount, retrieving equipment, and returning to the unit on standby for firefighting, rescue, and emergency response.
2. Upon returning to the unit, the commander of the unit that went out for firefighting, rescue, and emergency response shall be responsible for organizing the preservation and maintenance of firefighting, rescue, and emergency response equipment, and arranging for standby readiness for firefighting, rescue, and emergency response according to regulations.
3. Organizing lessons learned from fires, accidents, and incidents according to Article 13 of this Circular.
Article 13. Organization of Lessons Learned from Fires, Accidents, and Incidents
1. The organization of meetings to draw lessons from Level I fires must be completed no later than three days after the termination of firefighting activities. The lessons learned will be conducted by the firefighting commander during daily unit meetings and can combine lessons learned from multiple Level I fires in one meeting but must ensure comprehensive content for each individual case.
2. The organization of specialized meetings to draw lessons from complex accidents, incidents involving casualties, mobilization of forces and equipment from multiple agencies, organizations, units, Level II, III, IV, and V fires must be completed no later than twelve days after the termination of firefighting and rescue activities at the unit's headquarters or at a location determined by the firefighting and rescue commander or the superior commander directly managing them, specifically as follows:
a) The leader of the Fire Prevention, Firefighting, Rescue, and Emergency Response Police Department shall host the organization of lessons learned: Level IV and V fires; fires, accidents, and incidents requiring mobilization of three or more Fire Prevention, Firefighting, Rescue, and Emergency Response Police Units.
b) The commander of the Firefighting and Rescue Task Force (assigned to perform firefighting and rescue tasks), the Firefighting and Rescue Team in the area, and the River Fire Prevention, Firefighting, Rescue, and Emergency Response Police Unit shall host meetings to draw lessons from Level II and III fires, accidents, and incidents within their assigned areas, except for cases specified in point a of this clause.
3. The organization of specialized meetings to draw lessons shall be carried out as follows:
a) Within three working days from the end of firefighting and rescue activities, the person hosting the lesson-drawing meeting as stipulated in Clause 2 of this Article must organize the development of a plan and notify relevant agencies, units, organizations, and individuals about the time and place of the lesson-drawing meeting;
b) The content of drawing lessons from fires, accidents, and incidents includes: evaluating the performance of heads of agencies, organizations, household owners, vehicle owners, and individuals in firefighting, rescue, and emergency response activities; the responsibility of agencies, units, and individuals tasked with managing state affairs regarding firefighting, rescue, and emergency response in the affected areas; the responsibility of firefighting, rescue, and emergency response by agencies, organizations, and individuals mobilized to participate in firefighting, rescue, and emergency response; implementation of firefighting, rescue, and emergency response activities;
c) No later than three working days after the conclusion of the meeting, the Fire Prevention, Firefighting, Rescue, and Emergency Response Police Department shall evaluate and score the firefighting, rescue, and emergency response work and report the comprehensive results of drawing lessons from the fire, accident, or incident according to Model No. 03 and Model No. 04 in Appendix II of this Circular to the Fire Prevention, Firefighting, Rescue, and Emergency Response Police Bureau.
4. The organization of lessons learned from fires and accidents must be recorded in the Logbook for Tracking Lessons Learned from Fires and the Logbook for Tracking Lessons Learned from Accidents and Incidents according to Model No. 11 and Model No. 12 in Appendix II of this Circular.
Article 14. Ensuring Material and Technical Means for Directly Receiving and Processing Fire and Rescue Information, and Being Ready to Extinguish Fires and Provide Rescue Services
1. The place directly receiving and processing fire and rescue situation information must meet the following basic requirements:
a) Communication equipment and devices serving the reception and processing of fire and rescue situation information must ensure smooth and continuous operation;
b) The database system on fire prevention, extinguishing, and rescue operations and fire reporting transmission must be connected to managed facilities as prescribed (if applicable); printers; computers for accessing necessary information related to the facility, area where the fire, accident, or incident occurred, and organizations with forces and means that can be mobilized to participate in firefighting and rescue operations;
c) There must be a telephone directory of leaders and commanders at all levels and relevant units needed for command and control information work and mobilizing forces to participate in firefighting and rescue operations;
d) There must be a Logbook for Receiving and Processing Fire and Rescue Situation Information according to Model No. 08 attached as Appendix II to this Circular;
đ) There must be signaling equipment or devices for alerting firefighting and rescue operations;
e) There must be a place for storing equipment and materials for command work, firefighting and rescue plans, and rescue plans of the police agency, tactical firefighting and rescue plans;
g) There must be backup lighting equipment and other means and devices serving the reception and processing of fire and rescue situation information.
2. The location and rest areas for officers and soldiers on standby for firefighting and rescue operations must be arranged in positions easily accessible to alarm signals, with common living rooms, lockers for hanging specialized firefighting and rescue uniforms, and appropriate washing and drying equipment for firefighting and rescue uniforms; the arrangement must ensure that officers and soldiers can quickly and safely board firefighting and rescue vehicles.
3. Houses, warehouses, docks, and ports for firefighting and rescue vehicles must facilitate access and boarding by officers and soldiers for firefighting and rescue operations.
Article 15. Ensuring Conditions for Organizing Firefighting and Rescue Operations
1. Ensuring communication for firefighting and rescue operations:
a) Communication serving command and control of firefighting and rescue activities at the scene must ensure smooth connection to the following units, departments, and areas: units directly performing firefighting and rescue tasks; units participating in supporting firefighting and rescue operations and ensuring security and order in the affected area; firefighting and rescue areas; Provincial Public Security Command Center (if applicable); the unit's fire report reception and processing information department, Fire Prevention, Firefighting, and Rescue Team, Regional Firefighting and Rescue Team, River Fire Prevention, Firefighting, and Rescue Police Unit;
b) Officers and soldiers assigned to communication tasks are responsible for accurately and promptly conveying commands from the commander to the commanders of participating firefighting and rescue units; summarizing, monitoring, and reporting the results of unit tasks to the commander.
2. Ensuring logistics and medical support for firefighting and rescue operations:
a) Logistics support for firefighting and rescue operations includes: fuel, materials, firefighting agents, firefighting and rescue equipment; personal protective equipment and essential supplies for officers and soldiers throughout the firefighting and rescue process;
b) Medical support for firefighting and rescue operations includes: medicines and necessary medical supplies; conditions for providing initial and emergency care to victims, and health care for officers and soldiers during participation in firefighting and rescue operations.
3. Ensuring security and order at the site of the fire, accident, or incident:
a) The public security agency of the commune where the fire, accident, or incident occurs is responsible for: participating in ensuring security and order, traffic regulation around the affected area; protecting the fire scene immediately after firefighting and rescue operations end;
b) Other public security units are responsible for participating in ensuring security and order, traffic regulation around the affected area, and supporting firefighting and rescue operations when requested.
Article 16. Inspection of readiness for firefighting, rescue, and emergency response
1. The inspection of readiness for firefighting, rescue, and emergency response shall be conducted regularly, periodically, and unexpectedly as follows:
a) Regular inspection of personnel and equipment on duty shall be carried out daily during the shift.
b) Periodic inspection shall be conducted according to the contents prescribed in Clause 3 of this Article. When conducting periodic inspections, prior notice must be given three working days in advance to the inspected unit regarding the time, content, and composition of the inspection team.
c) Unexpected inspection may cover all or some of the contents prescribed in Clause 3 of this Article. Unexpected inspections do not require prior notification.
2. Authority for inspecting readiness for firefighting, rescue, and emergency response:
a) The Fire Prevention and Fighting Police Department organizes unexpected inspections of readiness for firefighting, rescue, and emergency response for fire prevention and fighting police units nationwide when necessary.
b) Provincial Public Security organs organize unexpected inspections of readiness for firefighting, rescue, and emergency response for fire prevention and fighting police units under their management when necessary.
c) Fire Prevention and Fighting Police Departments organize periodic inspections of readiness for firefighting, rescue, and emergency response every three months; they also organize unexpected inspections of readiness for firefighting, rescue, and emergency response for fire prevention and fighting police units under their management when necessary.
d) Firefighting and Rescue Teams (assigned to perform firefighting, rescue, and emergency response tasks), Regional Firefighting and Rescue Teams, River Fire Prevention and Fighting Police Teams organize regular inspections of readiness for firefighting, rescue, and emergency response within their jurisdiction.
đ) Authorities with inspection powers as stipulated in points a, b, and c of this clause, when conducting periodic and unexpected inspections, must issue and publicize decisions on inspecting readiness for firefighting, rescue, and emergency response according to Model No. 05 Appendix II attached to this Circular.
3. Contents of inspection of readiness for firefighting, rescue, and emergency response:
a) Inspect the time it takes for officers and soldiers to board vehicles and start engines ready for departure from the moment the alarm is sounded as prescribed in point a, Clause 4, Article 7 of this Circular.
b) Inspect the performance of duties by officers and soldiers as prescribed in point b, Clause 3, and points a and b, Clause 4, Article 7 of this Circular; deploy firefighting formations and rescue formations according to hypothetical scenarios.
c) Inspect the quantity and operational status of firefighting, rescue, and emergency response equipment on standby; fuel levels, water levels, and quantities of firefighting agents of mechanical firefighting, rescue, and emergency response equipment; compliance with regulations on managing, storing, and maintaining firefighting, rescue, and emergency response equipment as prescribed in Article 31 of this Circular.
d) Inspect conditions ensuring service for directly receiving and processing information, readiness for firefighting, rescue, and emergency response as prescribed in Article 14 of this Circular.
4. The inspected unit must prepare fully according to the inspection requirements and arrange authorized and responsible persons to work with the inspection team.
5. Evaluation and reporting of inspection results shall be conducted as follows:
a) After completing periodic or unexpected inspections, the inspection team shall: convene a meeting to evaluate strengths and weaknesses, draw lessons from the organization of readiness for firefighting, rescue, and emergency response of the inspected unit; draft an inspection record of readiness for firefighting, rescue, and emergency response according to Model No. 06 Appendix II attached to this Circular; report the inspection results to the inspected unit and related units for implementation and report to the direct superior management authority. The inspected unit is responsible for retaining the inspection record in accordance with regulations.
b) After completing regular inspections, the shift commander records the content and results of the inspection in the Shift Handover Book for Readiness for Firefighting, Rescue, and Emergency Response according to Model No. 07 Appendix II attached to this Circular and reports directly to the superior command.
Chapter III
GUIDELINES FOR BUILDING FIRE PREVENTION AND FIGHTING FORCES AND RESCUE IN THE PEOPLE'S POLICE; TRAINING AND STAFF DEVELOPMENT ON FIRE PREVENTION, FIRE FIGHTING, RESCUE, AND EMERGENCY RESPONSE
Article 17. Building Fire Prevention, Firefighting, and Rescue Forces in the People's Public Security
1. The Fire Prevention, Firefighting, and Rescue Police Department shall coordinate with relevant units to advise the Ministry of Public Security on building regular, elite, modern Fire Prevention, Firefighting, and Rescue Police forces that meet the requirements for fire prevention, firefighting, rescue in all situations.
2. Professional requirements for officers assigned to perform design review and acceptance inspection work related to fire prevention and firefighting:
Heads of Departments, Deputy Heads of Departments, officers under the Fire Prevention, Firefighting, and Rescue Police Department, Heads of Departments, Deputy Heads of Departments, Team Leaders, Deputy Team Leaders, officers under the Fire Prevention, Firefighting, and Rescue Police Department who are responsible for and carry out design review and acceptance inspection work related to fire prevention and firefighting must have a bachelor’s degree or higher in fire prevention, firefighting, and rescue; have at least three years of experience in fire prevention, firefighting, and rescue work within the Public Security; and have passed the professional qualification examination for design review and acceptance inspection work related to fire prevention and firefighting, which remains valid.
3. Professional requirements for officers assigned to perform fire prevention and firefighting inspection work:
a) Heads of Departments, Deputy Heads of Departments, officers under the Fire Prevention, Firefighting, and Rescue Police Department, Heads of Departments, Deputy Heads of Departments under the Fire Prevention, Firefighting, and Rescue Police Department who are responsible for and carry out fire prevention and firefighting inspection work must have a bachelor’s degree or higher in fire prevention, firefighting, and rescue; have at least three years of experience in fire prevention, firefighting, and rescue work within the Public Security; and have passed the professional qualification examination for fire prevention and firefighting inspection work, which remains valid;
b) Team Leaders, Deputy Team Leaders, officers under the Fire Prevention, Firefighting, and Rescue Police Department who are responsible for and carry out fire prevention and firefighting inspection work must have a college diploma or higher in fire prevention, firefighting, and rescue or a bachelor’s degree or higher in engineering technology fields and have completed legal and public security professional training; have at least one year of experience in fire prevention, firefighting, and rescue work within the Public Security; and have passed the professional qualification examination for fire prevention and firefighting inspection work, which remains valid;
c) Chiefs of Public Security, Deputy Chiefs of Public Security, Public Security officers at the commune level who are responsible for and carry out advisory work for the People's Committee at the commune level to implement state management work related to fire prevention, firefighting, and rescue must undergo annual professional training on fire prevention and firefighting inspection work.
4. Professional requirements for officers assigned to perform firefighting, rescue training work:
a) Officers assigned to perform firefighting, rescue training work under the Fire Prevention, Firefighting, and Rescue Police Department must be Deputy Heads of Departments or equivalent positions or officers who have at least three years of experience in research, advisory, and guidance work related to firefighting, rescue operations;
b) Officers assigned to perform firefighting, rescue training work under the University of Fire Prevention and Firefighting must be Heads of Departments, Deputy Heads of Departments, or lecturers in specialized firefighting, rescue departments;
c) Officers assigned to perform firefighting, rescue training work under the provincial-level Public Security must be Deputy Team Leaders or higher in charge of firefighting, rescue operations or officers entrusted with the responsibility of training who have at least three years of experience in advisory, guidance, and implementation work related to firefighting, rescue operations.
Article 18. Subjects for professional training in design review work, inspection of fire prevention and firefighting acceptance work, inspection of fire prevention and firefighting, and firefighting business training, rescue, and emergency response
Clause 1. Subjects for professional training in design review work and inspection of fire prevention and firefighting acceptance work:
Point a) Heads and Deputy Heads of the Fire Prevention, Firefighting, and Rescue Police Department under the Fire Prevention, Firefighting, and Rescue General Police Department who are assigned or expected to be assigned to oversee design review work and inspection of fire prevention and firefighting acceptance work;
Point b) Officers under the Fire Prevention, Firefighting, and Rescue General Police Department who are assigned or expected to be assigned to perform design review work and inspection of fire prevention and firefighting acceptance work;
Point c) Team Leaders and Deputy Team Leaders, officers under the Fire Prevention, Firefighting, and Rescue Police Department who are assigned or expected to be assigned to perform design review work and inspection of fire prevention and firefighting acceptance work.
Clause 2. Subjects for professional training in fire prevention and firefighting inspection work:
Point a) Heads and Deputy Heads of the Fire Prevention, Firefighting, and Rescue Police Department under the Fire Prevention, Firefighting, and Rescue General Police Department who are assigned or expected to be assigned to oversee fire prevention and firefighting inspection work;
Point b) Officers under the Fire Prevention, Firefighting, and Rescue General Police Department who are assigned or expected to be assigned to perform fire prevention and firefighting inspection work;
Point c) Team Leaders and Deputy Team Leaders, officers under the Fire Prevention, Firefighting, and Rescue Police Department who are assigned or expected to be assigned to oversee and perform fire prevention and firefighting inspection work;
Point d) Chiefs and Deputy Chiefs of Public Security, Public Security officers at commune level who are assigned or expected to be assigned to oversee and perform advisory work for People's Committees at all levels to implement state management over fire prevention and firefighting, rescue operations.
Clause 3. Subjects for firefighting, rescue, and emergency response business training:
Point a) Heads and Deputy Heads of the Fire Prevention, Firefighting, and Rescue Police Department;
Point b) Team Leaders and Deputy Team Leaders of teams: Firefighting and Rescue Operations Team; Regional Firefighting and Rescue Team; River Fire Prevention, Firefighting, and Rescue Police Team;
Point c) Officers assigned to perform firefighting, rescue, and emergency response business training work;
Point d) Firefighters and rescue personnel;
Point đ) Officers and firefighters responsible for operating firefighting vehicles, specialized equipment for firefighting, rescue, and emergency response, firefighting boats, rescue boats, and firefighting speedboats.
Clause 4. Cases exempted or deferred from professional training in design review work, inspection of fire prevention and firefighting acceptance work, inspection of fire prevention and firefighting, and firefighting business training, rescue, and emergency response:
Point a) Exempted cases: officers and firefighters during treatment for serious illnesses; diseases listed in the long-term treatment directory according to the law; during temporary assignment; studying full-time at academies or schools inside and outside the Public Security system for 12 months or more; pregnant women or those nursing children under 12 months old;
Point b) Deferred cases: officers and firefighters suffering from illness, pain, sudden leave, or on official duty with confirmation from unit leaders or granted leave by unit leadership during training or professional development. Deferred cases must participate in supplementary training and development in the next period for uncompleted contents;
Point c) Officers and firefighters who have participated in advanced firefighting, rescue, and emergency response business training are exempted from participating in regular training that year.
Article 19. Contents of professional training for design review work, inspection of fire prevention and fighting acceptance work, inspection of fire prevention and fighting, firefighting business training, rescue and emergency response
1. The contents of professional training for design review work and inspection of fire prevention and fighting acceptance work include:
a) Legal provisions related to fire prevention and fighting work in construction investment;
b) Technical standards and regulations on fire prevention and fighting equipment and systems, electrical systems serving fire prevention and fighting;
c) Basic professional work tasks and professional work files serving design review work and inspection of fire prevention and fighting acceptance work;
d) Procedures and contents of design review work and inspection of fire prevention and fighting acceptance work;
đ) Administrative violation handling in the field of fire prevention and fighting in construction investment;
e) Other relevant legal provisions concerning design review work and inspection of fire prevention and fighting acceptance work.
2. The contents of professional training for fire prevention and fighting inspection work include:
a) Legal provisions on fire prevention and fighting and rescue operations;
b) Technical standards and regulations on fire prevention and fighting equipment and systems, electrical systems serving fire prevention and fighting;
c) Propaganda, dissemination, education on fire prevention and fighting knowledge and laws, rescue operations; building mass movements participating in fire prevention and fighting, rescue operations; training and professional development on fire prevention and fighting knowledge and skills, rescue operations;
d) Basic professional work tasks; professional work file management serving fire prevention and fighting control over areas and facilities;
đ) Inspection procedures and contents on fire prevention and fighting; administrative violation handling in the field of fire prevention and fighting and rescue operations; fire investigation and resolution;
e) Other relevant legal provisions concerning fire prevention and fighting inspection work.
3. The contents of firefighting and rescue operations training include:
a) Theory: individual techniques, formations, firefighting tactics, rescue operations; disseminating firefighting and rescue operation plans, rescue operation plans; management, storage, maintenance of firefighting and rescue equipment and devices;
b) Theory on firefighting and rescue operations command work;
c) Physical training practice;
d) Individual firefighting and rescue technique practice;
đ) Firefighting and rescue formation practice;
e) Firefighting and rescue tactics practice;
g) Practice on using, storing, maintaining firefighting and rescue equipment and devices;
h) Driving skill enhancement for personnel operating firefighting vehicles, specialized firefighting vehicles, firefighting boats, canoes, and motorboats.
4. Local public security units shall base on materials compiled and issued by the Fire Prevention, Fighting, and Rescue Police Bureau to develop programs and materials for professional training in design review work, inspection of fire prevention and fighting acceptance work, inspection of fire prevention and fighting, and firefighting and rescue operations training suitable to the actual conditions of their units and localities.
Article 20. Duration of professional training for design review work, inspection of fire prevention and firefighting acceptance work, inspection of fire prevention and firefighting, and firefighting business training, rescue, and emergency response
1. Annual professional training for design review work and inspection of fire prevention and firefighting acceptance work for the subjects specified in point a, Clause 1, Article 18 of this Circular shall be at least eight hours; for the subjects specified in points b and c, Clause 1, Article 18 of this Circular, it shall be at least sixteen hours.
2. Annual professional training for fire prevention and firefighting inspection work for the subjects specified in points a and d, Clause 2, Article 18 of this Circular shall be at least eight hours; for the subjects specified in points b and c, Clause 2, Article 18 of this Circular, it shall be at least sixteen hours.
3. Firefighting business training, rescue, and emergency response:
a) Continuous training is conducted daily during the on-duty shift for firefighting, rescue, and emergency response (excluding public holidays and Tet) at the headquarters of the Fire Prevention, Firefighting, Rescue, and Emergency Response Police for the subjects specified in points b, d, and đ, Clause 3, Article 18 of this Circular according to the contents prescribed in points c, d, and g, Clause 3, Article 19 of this Circular.
The results of the training are recorded in the Logbook for continuous firefighting business training, rescue, and emergency response activities according to Model No. 09 in Appendix II attached to this Circular. In cases where officers and soldiers have performed firefighting, rescue, and emergency response duties for two hours or more at night (from 22:00 PM of the previous day to 06:00 AM of the following day), they are exempted from participating in firefighting business training, rescue, and emergency response activities on the following day;
b) Periodic training is conducted centrally at the headquarters of the Fire Prevention, Firefighting, Rescue, and Emergency Response Police or the provincial police training center (in cases where the Fire Prevention, Firefighting, Rescue, and Emergency Response Police cannot meet the necessary training conditions):
Once a year for the subjects specified in point a, Clause 3, Article 18 of this Circular with a minimum duration of twenty-four hours (eight hours theoretical, sixteen hours practical) according to the contents prescribed in points a, b, and e, Clause 3, Article 19 of this Circular; for the subjects specified in point b, Clause 3, Article 18 of this Circular with a minimum duration of fifty-six hours (sixteen hours theoretical, forty hours practical) according to the contents prescribed in points a, b, đ, e, and g, Clause 3, Article 19 of this Circular;
Every six months for the subjects specified in point d, Clause 3, Article 18 of this Circular with a minimum duration of one hundred and twenty hours (sixteen hours theoretical, one hundred and four hours practical) according to the contents prescribed in points a, đ, e, and g, Clause 3, Article 19 of this Circular; for the subjects specified in point đ, Clause 3, Article 18 of this Circular with a minimum duration of one hundred and twenty hours (eight hours theoretical, eight hours supplementary driving practice, one hundred and four hours practical) according to the contents prescribed in points a, đ, e, g, and h, Clause 3, Article 19 of this Circular;
c) Advanced training is conducted centrally at the training centers of units under the Ministry of Public Security:
Once a year for the subjects specified in point c, Clause 3, Article 18 of this Circular with a minimum duration of fifty-six hours according to the contents prescribed in points a, c, d, e, and g, Clause 3, Article 19 of this Circular.
Every two years for the subjects specified in point a, Clause 3, Article 18 of this Circular with a minimum duration of twenty-four hours according to the contents prescribed in points a, b, and e, Clause 3, Article 19 of this Circular; for the subjects specified in point b, Clause 3, Article 18 of this Circular with a minimum duration of forty hours according to the contents prescribed in points a, b, e, and g, Clause 3, Article 19 of this Circular.
Article 21. Competence for Professional Training in Design Review and Acceptance Inspection Work on Fire Prevention and Fighting
1. The General Bureau of Fire Prevention, Firefighting, and Rescue:
a) Organize annual professional training for design review and acceptance inspection work on fire prevention and firefighting for subjects specified in points a and b of Clause 1, Article 18 of this Circular;
b) Organize annual professional training for inspection work on fire prevention and firefighting for subjects specified in points a and b of Clause 2, Article 18 of this Circular;
c) Organize regular professional training to enhance firefighting, rescue, and emergency response skills for subjects specified in points a, b, and c of Clause 3, Article 18 of this Circular.
2. Provincial Public Security Departments:
a) Organize annual professional training for design review and acceptance inspection work on fire prevention and firefighting for subjects specified in point c of Clause 1, Article 18 of this Circular within their jurisdiction;
b) Organize annual professional training for inspection work on fire prevention and firefighting for subjects specified in points c and d of Clause 2, Article 18 of this Circular within their jurisdiction;
c) Organize regular professional training for firefighting, rescue, and emergency response skills for subjects specified in points a, b, d, and đ of Clause 3, Article 18 of this Circular within their jurisdiction.
3. Fire Prevention, Firefighting, and Rescue Police Departments organize regular professional training for firefighting, rescue, and emergency response skills for subjects specified in points b, d, and đ of Clause 3, Article 18 of this Circular within their jurisdiction.
Article 22. Professional Inspection of Design Review and Acceptance Inspection Work on Fire Prevention and Fighting
1. Subjects specified in Clause 1, Article 18 who have been trained according to Clause 1, Article 20 of this Circular may participate in professional inspections of design review and acceptance inspection work on fire prevention and firefighting.
2. The General Bureau of Fire Prevention, Firefighting, and Rescue:
a) Establish a Professional Inspection Board for design review and acceptance inspection work on fire prevention and firefighting. The Chairman of the Board is the Director of the General Bureau of Fire Prevention, Firefighting, and Rescue, the Vice-Chairman is the Deputy Director of the General Bureau of Fire Prevention, Firefighting, and Rescue, and members of the Board are representatives from leadership and staff of relevant units under the General Bureau of Fire Prevention, Firefighting, and Rescue.
The Inspection Board is responsible for organizing the development of regulations and examination questions suitable for the subjects and content of the training; conducting inspections; grading examination papers;
b) Conduct inspections for subjects specified in points a and b of Clause 1, Article 18 of this Circular after they have been trained according to regulations; conduct inspections for subjects specified in point c of Clause 1, Article 18 of this Circular after receiving requests from provincial public security departments; notify in writing the time, location, and list of officers participating in the inspection;
c) Notify in writing the results of the inspection no later than fifteen days from the date of the inspection. The results of the inspection that meet the requirements of the officers are valid for five years from the date of notification;
d) Based on the Notification of the Inspection Results, the Director of the General Bureau of Fire Prevention, Firefighting, and Rescue will consider and decide to assign or continue assigning Heads of Departments, Deputy Heads of Departments, and officers to perform design review and acceptance inspection work on fire prevention and firefighting within their jurisdiction in accordance with Clause 2, Article 17 of this Circular. Do not assign responsibility or perform design review and acceptance inspection work on fire prevention and firefighting for cases where the inspection results do not meet the requirements.
3. Provincial Public Security Departments:
a) Annually review and compile lists of subjects specified in point c of Clause 1, Article 18 of this Circular who have been trained, and request the General Bureau of Fire Prevention, Firefighting, and Rescue to inspect professional work on design review and acceptance inspection on fire prevention and firefighting;
b) Based on the Notification of Inspection Results from the General Bureau of Fire Prevention, Firefighting, and Rescue, consider and decide to assign or continue assigning Heads of Departments, Deputy Heads of Departments, Team Leaders, Deputy Team Leaders, and officers to perform design review and acceptance inspection work on fire prevention and firefighting within their jurisdiction in accordance with Clause 2, Article 17 of this Circular. Do not assign responsibility or perform design review and acceptance inspection work on fire prevention and firefighting for cases where the inspection results do not meet the requirements.
Article 23. Professional inspection work on fire prevention and firefighting
1. The subjects specified in points a, b, and point c Clause 2 Article 18 of this Circular who have been trained according to Clause 2 Article 20 of this Circular shall participate in the professional inspection work on fire prevention and firefighting.
2. The General Bureau of Fire Prevention, Firefighting, and Rescue:
a) Establish a Professional Inspection Council for the inspection work on fire prevention and firefighting. The Chairman of the Council is the Director of the Fire Prevention and Fighting and Rescue Police Department, the Vice-Chairman of the Council is the Deputy Director of the Fire Prevention and Fighting and Rescue Police Department, and members of the Council are representatives of leaders and officers from units under the Fire Prevention and Fighting and Rescue Police Department.
The Inspection Board is responsible for organizing the development of regulations and examination questions suitable for the subjects and content of the training; conducting inspections; grading examination papers;
b) Organize inspections for the subjects specified in points a and b Clause 2 Article 18 of this Circular after they have been trained according to regulations; organize inspections for the subjects specified in point c Clause 2 Article 18 of this Circular after receiving requests from provincial police departments; notify in writing about the time, location, and list of officers participating in the inspection.
c) Notify in writing the results of the inspection no later than fifteen days from the date of the inspection. The results of the inspection that meet the requirements of the officers are valid for five years from the date of notification;
d) Based on the notification of the inspection results, the Director of the Fire Prevention and Fighting and Rescue Police Department will consider and decide to assign or continue to assign Heads of Departments, Deputy Heads responsible, and officers implementing the inspection work on fire prevention and firefighting within the scope of management to ensure the professional requirements stipulated in point a Clause 3 Article 17 of this Circular. Do not assign responsibility or implement the inspection work on fire prevention and firefighting for cases where the inspection results do not meet the requirements.
3. Provincial Public Security Departments:
a) Annually, review and establish a list of subjects specified in point c Clause 2 Article 18 of this Circular who have been trained, and request the Fire Prevention and Fighting and Rescue Police Department to organize professional inspections on the inspection work on fire prevention and firefighting.
b) Based on the notification of the inspection results from the Fire Prevention and Fighting and Rescue Police Department, consider and decide to assign or continue to assign Heads of Departments, Deputy Heads, Team Leaders, Deputy Team Leaders responsible, and officers implementing the inspection work on fire prevention and firefighting within the scope of management to ensure the professional requirements stipulated in points a and b Clause 3 Article 17 of this Circular. Do not assign responsibility or implement the inspection work on fire prevention and firefighting for cases where the inspection results do not meet the requirements.
Article 24. Inspection and evaluation of training results on firefighting, rescue operations
1. The subjects specified in Clause 3 Article 18 of this Circular must participate in the inspection of the training results on firefighting and rescue operations after completing the training according to Clause 3 Article 20 of this Circular.
2. The General Bureau of Fire Prevention, Firefighting, and Rescue:
a) Establish a Council for inspecting the enhanced training results on firefighting and rescue operations. The Chairman of the Council is the Director of the Fire Prevention and Fighting and Rescue Police Department, the Vice-Chairman of the Council is the Deputy Director of the Fire Prevention and Fighting and Rescue Police Department, and members of the Council are representatives of leaders and officers from units under the Fire Prevention and Fighting and Rescue Police Department.
The Council for inspection has the responsibility to organize the establishment of rules and examination questions suitable for the subjects and contents of the training; organize inspections; score examination papers.
b) Organize inspections for the subjects specified in points a, b, and point c Clause 3 Article 18 of this Circular after completing the enhanced training according to regulations.
c) Notify in writing the inspection results no later than five working days from the date of inspection. The inspection results are one of the criteria for evaluating and classifying officers annually.
3. Provincial Public Security Departments:
a) Establish a Council for inspecting the regular training results on firefighting and rescue operations for units under the scope of management. The Chairman of the Council is a representative of the General Directorate, the Vice-Chairman of the Council is the Head of the Fire Prevention and Fighting and Rescue Police Department, and members of the Council are representatives of leaders and officers from related functional units under the provincial police department.
The Council for inspection has the responsibility to organize the establishment of rules and examination questions suitable for the subjects and contents of the training; organize inspections; score examination papers.
b) Organize inspections for the subjects specified in points a, b, d, and point e Clause 3 Article 18 of this Circular after completing the regular training according to regulations.
c) Notify in writing the inspection results no later than five working days from the date of inspection. The inspection results are one of the criteria for evaluating and classifying individuals annually.
d) Summarize the training results on firefighting and rescue operations and report according to Model No. 02 Appendix II attached to this Circular to the Fire Prevention and Fighting and Rescue Police Department.
4. Fire Prevention and Fighting and Rescue Police Department:
a) Organize the evaluation of the regular training results on firefighting and rescue operations for the subjects specified in points b, d, and point e Clause 3 Article 18 of this Circular within the scope of management.
b) Summarize the results of the regular training work on firefighting and rescue operations and report according to regulations.
Article 25. Funding for organizing professional training and inspection activities related to design review, acceptance work on fire prevention and firefighting, fire prevention and firefighting inspections, and firefighting skills training, rescue operations
1. The funding for organizing professional training and inspection activities related to design review and acceptance work on fire prevention and firefighting shall be allocated from the regular budget estimate of the Fire Prevention and Fighting Police Department, Provincial Public Security Force, or other legitimate sources (if any).
2. The funding for organizing professional training and inspection activities related to fire prevention and firefighting inspections, firefighting skills training, rescue operations shall be allocated from the regular budget estimate of the Fire Prevention and Fighting Police Department, Provincial Public Security Force, or revenue from mandatory fire and explosion insurance used for fire prevention and firefighting activities in accordance with the law, or other legitimate sources (if any).
3. Annually, based on the plan for professional training and inspection activities related to design review, acceptance work on fire prevention and firefighting, fire prevention and firefighting inspections, firefighting skills training, rescue operations, current state budget expenditure standards, local public security units shall prepare the budget estimate and consolidate it into the annual budget estimate of local public security units.
Chapter IV
IMPLEMENTING TASKS OF FIRE PREVENTION, FIREFIGHTING, RESCUE OPERATIONS; MANAGING FIRE PREVENTION AND FIREFIGHTING EQUIPMENT, RESCUE EQUIPMENT
Article 26. Procedure for Design Review on Fire Prevention and Firefighting
The design review on fire prevention and firefighting by the public security agency shall be carried out in accordance with Article 9 of Decree No. 105/2025/NĐ-CP dated May 15, 2025 of the Government detailing certain provisions and measures to implement the Law on Fire Prevention, Firefighting, and Rescue Operations. The specific implementation process is as follows:
1. The department responsible for receiving files shall be responsible for checking the completeness and validity of the files and shall act according to the following regulations:
a) In case of direct submission of files:
If the file is complete and valid according to the regulations, it will be accepted, information recorded on the File Acceptance Certificate Form No. 01 attached to Circular No. 01/2018/TT-VPCP dated November 23, 2018 of the Government Office guiding the implementation of certain provisions of Decree No. 61/2018/NĐ-CP dated April 23, 2018 of the Government on implementing the one-stop-shop mechanism and return the File Acceptance Certificate and result notification to the agency, organization, or individual.
If the file is incomplete or invalid, it will not be accepted, information recorded on the Supplementary and Completion Request Form Form No. 02 attached to Circular No. 01/2018/TT-VPCP, and return the file to the agency, organization, or individual.
If the file does not fall within the jurisdiction for resolution, it will not be accepted, information recorded on the Refusal to Accept and Resolve File Form Form No. 03 attached to Circular No. 01/2018/TT-VPCP, and return the file to the agency, organization, or individual;
b) In case of submission of files through postal services:
If the file is complete and valid according to the regulations, it will be accepted, information recorded on the File Acceptance Certificate Form No. 01 attached to Circular No. 01/2018/TT-VPCP, and send the File Acceptance Certificate to the agency, organization, or individual through postal services.
If the file is incomplete or invalid, it will not be accepted, information recorded on the Supplementary and Completion Request Form Form No. 02 attached to Circular No. 01/2018/TT-VPCP, and return the file to the agency, organization, or individual through postal services.
If the file does not fall within the jurisdiction for resolution, it will not be accepted, information recorded on the Refusal to Accept and Resolve File Form Form No. 03 attached to Circular No. 01/2018/TT-VPCP, and return the file to the agency, organization, or individual through postal services;
c) In case of submission of files online through the public service portal:
If the file is complete and valid according to the regulations, it will be accepted, and the acceptance of the file will be notified to the agency, organization, or individual through the email sending function or message sending function of the public service portal.
If the file is incomplete or invalid or does not fall within the jurisdiction for resolution, it will not be accepted, supplementary and completion requests or refusal to accept the file will be notified to the agency, organization, or individual through the email sending function or message sending function of the public service portal.
2. Handover of Files:
a) For files received directly or through postal services as prescribed, the staff receiving the files shall fill out and record all necessary information on the Process Control Sheet Form No. 05 attached to Circular No. 01/2018/TT-VPCP, report, and hand over the files to the authorized person for receipt and processing according to the procedure;
b) For files received through the public service portal, the staff receiving the files shall transfer the files to the authorized person for receipt and processing according to the procedure.
3. Assignment of Task Execution:
The person assigned to oversee the design review on fire prevention and firefighting shall assign the task to the direct staff member using the Process Control Sheet Form No. 05 attached to Circular No. 01/2018/TT-VPCP in cases where the files are received directly or through postal services or directly assign tasks through the public service portal.
4. Execution of File Processing:
a) The staff member directly assigned to process the file shall be responsible for researching and comparing the received file with the legal provisions, technical standards, and fire prevention and extinguishing regulations, the draft document for design review on fire prevention and extinguishing according to Model number PC12 attached to Decree No. 105/2025/NĐ-CP, the notification of payment for design review on fire prevention and extinguishing fees (if applicable), reporting to the competent leadership for examination and approval if the file meets the requirements. The components of the file to be signed are specified in points a, b, c, d, đ, and g of Section 1 of Appendix I attached to this Circular; in case of online submission, the components of the file to be signed are specified in points b, c, d, and đ of Section 1 of Appendix I attached to this Circular.
In case the requirements are not met, the draft reply document shall clearly state the reasons, report to the competent leadership for examination and approval. The components of the file to be signed are specified in points a, b, c, e, and g of Section 1 of Appendix I attached to this Circular; in case of online submission, the components of the file to be signed are specified in points b, c, and e of Section 1 of Appendix I attached to this Circular;
b) The leadership assigned to process the file shall submit it to the authorized person for examination, approval, and signing of the documents mentioned in point a of this Clause;
c) After the design review document on fire prevention and extinguishing has been approved, the department assigned the task shall assign a number, stamp the document, and stamp "HAS BEEN REVIEWED FOR DESIGN ON FIRE PREVENTION AND EXTINGUISHING" according to Model number PC14 attached to Decree No. 105/2025/NĐ-CP onto the design file and hand over the reviewed design document on fire prevention and extinguishing along with the stamped file and the notification of payment for design review on fire prevention and extinguishing fees (if applicable) or the reply document along with the previously submitted file to the single window department in case of direct receipt or through postal service. In case of implementation on the public service portal, transfer to the single window department.
d) The single window department shall deliver the results to the agency, organization, or individual in person or through postal service.
In case of receiving results on the public service portal, the single window department shall send the result notification of the file to the agency, organization, or individual who submitted the file through the email sending function or message sending function of the public service portal. Send the paper result document through postal service to the address registered by the agency, organization, or individual who submitted the file beforehand (in case of registering to receive the paper result document through postal service, the cost of sending the document will be borne by the agency, organization, or individual requesting it).
5. The staff member directly assigned to process the file shall perform the following tasks:
a) Coordinate with relevant departments to digitize the administrative procedure file in accordance with Circular No. 01/2023/TT-VPCP dated April 5, 2023, issued by the Government Office on certain contents and measures for implementing digitization of files, results of administrative procedures, and conducting administrative procedures in the electronic environment (for files received directly or through postal service, the digitized file includes the description, design drawings stamped "HAS BEEN REVIEWED FOR DESIGN ON FIRE PREVENTION AND EXTINGUISHING").
b) Establish and store the fire prevention and extinguishing design review file in accordance with the business file regulations of the People's Public Security.
Article 27. Procedure for inspecting fire prevention and fighting acceptance work
The inspection of fire prevention and fighting acceptance work by the Public Security agency shall be carried out in accordance with the provisions of Article 10 of Decree No. 105/2025/NĐ-CP. The specific procedure is as follows:
1. The department responsible for receiving files shall be responsible for checking the completeness and validity of the files and shall act according to the following regulations:
a) In case of direct submission of files:
If the file is complete and valid according to regulations, it will be accepted, information recorded on the Receipt Form, and a result return date set according to Model No. 01 attached to Circular No. 01/2018/TT-VPCP, and the Receipt Form and result return date will be returned to the agency, organization, or individual.
If the file is incomplete or invalid, it will not be accepted, information recorded on the Supplementary and Completion Request Form Form No. 02 attached to Circular No. 01/2018/TT-VPCP, and return the file to the agency, organization, or individual.
If the file does not fall within the jurisdiction for resolution, it will not be accepted, information recorded on the Refusal to Accept and Resolve File Form Form No. 03 attached to Circular No. 01/2018/TT-VPCP, and return the file to the agency, organization, or individual;
b) In case of submission of files through postal services:
If the file is complete and valid according to regulations, it will be accepted, information recorded on the Receipt Form, and a result return date set according to Model No. 01 attached to Circular No. 01/2018/TT-VPCP, and the Receipt Form and result return date will be sent to the agency, organization, or individual through postal service.
If the file is incomplete or invalid, it will not be accepted, information recorded on the Supplementary and Completion Request Form Form No. 02 attached to Circular No. 01/2018/TT-VPCP, and return the file to the agency, organization, or individual through postal services.
If the file does not fall within the jurisdiction for resolution, it will not be accepted, information recorded on the Refusal to Accept and Resolve File Form Form No. 03 attached to Circular No. 01/2018/TT-VPCP, and return the file to the agency, organization, or individual through postal services;
c) In case of submission of files online through the public service portal:
If the file is complete and valid according to the regulations, it will be accepted, and the acceptance of the file will be notified to the agency, organization, or individual through the email sending function or message sending function of the public service portal.
If the file is incomplete or invalid or does not fall within the jurisdiction for resolution, it will not be accepted, supplementary and completion requests or refusal to accept the file will be notified to the agency, organization, or individual through the email sending function or message sending function of the public service portal.
2. Handover of Files:
a) For files received directly or through postal services as prescribed, the staff receiving the files shall fill out and record all necessary information on the Process Control Sheet Form No. 05 attached to Circular No. 01/2018/TT-VPCP, report, and hand over the files to the authorized person for receipt and processing according to the procedure;
b) For files received through the public service portal, the staff receiving the files shall transfer the files to the authorized person for receipt and processing according to the procedure.
3. Assignment of Task Execution:
The person assigned to oversee the inspection of fire prevention and fighting acceptance work will assign staff directly to perform the task using the Process Control Sheet according to Model No. 05 attached to Circular No. 01/2018/TT-VPCP in cases where the file is received directly or through postal service, or directly assigned on the public service portal.
4. Execution of File Processing:
a) Staff assigned to directly process the file shall be responsible for proposing the content, time, composition of the inspection team, draft inspection plan for fire prevention and fighting acceptance work, draft notification document for the project investor, owner of the construction, owner of the transportation vehicle, and related units, report to the competent leader for review and approval.
In case the project investor, owner of the construction, owner of the transportation vehicle requests the specialized management agency to simultaneously inspect the fire prevention and fighting acceptance work as stipulated in Clause 2, Article 11 of Decree No. 105/2025/NĐ-CP, it shall be carried out according to the inspection plan of the main agency. Staff assigned to directly process the file shall be responsible for proposing the participating components and draft notification document for the specialized construction department or inspection agency and related units, report to the competent leader for review and approval;
b) Leaders assigned to process the file shall submit to the competent authority for review and approval, sign the documents specified in point a of this clause;
c) After the inspection plan and notification document have been approved, the assigned unit will take the number, stamp the document, hand over to the one-stop service unit, and notify the project investor, owner of the construction, owner of the transportation vehicle, and related agencies;
d) When conducting the inspection of fire prevention and fighting acceptance work, staff will perform the following tasks: introduce the inspection team members, announce the content and plan related to the fire prevention and fighting acceptance work of the construction and transportation vehicle requiring fire safety assurance; conduct inspections according to regulations and prepare the inspection record for fire prevention and fighting acceptance work according to Model No. PC16 attached to Decree No. 105/2025/NĐ-CP;
đ) Based on the inspection record for fire prevention and fighting acceptance work, staff assigned to directly process the file will draft the approval document for the fire prevention and fighting acceptance results according to Model No. PC17 attached to Decree No. 105/2025/NĐ-CP, report to the competent leader for review and approval if requirements are met. The file components for signature are specified at points a, b, c, d, and e of Item 2 of Appendix I attached to this Circular; in case the file is submitted online, the file components for signature are specified at points b, c, and d of Item 2 of Appendix I attached to this Circular.
In case requirements are not met, a draft reply document specifying the reasons will be prepared, reported to the competent leader for review and approval. The file components for signature are specified at points a, b, c, đ, and e of Item 2 of Appendix I attached to this Circular; in case the file is submitted online, the file components for signature are specified at points b, c, and đ of Item 2 of Appendix I attached to this Circular;
e) Leaders assigned to process the file shall submit to the competent authority for review and approval, sign the documents specified in point đ of this clause;
g) After the approval document for the fire prevention and fighting acceptance results or the reply document has been signed and approved, the assigned unit will take the number, stamp the document, and hand over to the one-stop service unit;
h) The one-stop service unit will deliver the results to the agency, organization, or individual in person or through postal service.
In case of receiving results on the public service portal, the single window department shall send the result notification of the file to the agency, organization, or individual who submitted the file through the email sending function or message sending function of the public service portal. Send the paper result document through postal service to the address registered by the agency, organization, or individual who submitted the file beforehand (in case of registering to receive the paper result document through postal service, the cost of sending the document will be borne by the agency, organization, or individual requesting it).
5. The staff member directly assigned to process the file shall perform the following tasks:
a) Coordinate with relevant units to digitize administrative procedure files in accordance with Circular No. 01/2023/TT-VPCP;
b) Prepare and store the inspection file for fire prevention and fighting acceptance work in accordance with the Public Security Police business file regulations.
Article 28. Fire Prevention and Fighting Inspection Procedures
The inspection for fire prevention and fighting by the Public Security agency shall be carried out by the Fire Prevention and Fighting Police Department according to the provisions at point a Clause 2 Article 13, Clause 3 and Clause 5 Article 14 of Decree No. 105/2025/NĐ-CP. The specific implementation procedures are as follows:
1. Regular inspection for facilities with fire and explosion hazards:
a) Organize a review, compile a list of facilities under Appendix II attached to Decree No. 105/2025/NĐ-CP within the management scope that are planned to be subject to regular inspections in the following year; develop and issue an inspection plan before December 15 each year;
b) Send notification to the competent authority on construction to unify the time, content, method, and composition of the inspection team on a monthly or quarterly basis;
c) Issue a decision to establish the inspection team, and notify in writing about the time, content, and composition of the inspection team;
d) Send a notification letter to the inspected entity and members of the inspection team as prescribed;
đ) Conduct the inspection:
The team leader introduces the composition, content, and method of inspection, assigns members of the team to conduct fire prevention and fighting inspections according to their respective authorities.
Team members carry out inspections according to their assignments; upon completion of the inspection, they consolidate the results and prepare an inspection record according to Form No. PC03 in Appendix VIII attached to Decree No. 105/2025/NĐ-CP.
During the inspection process, if violations related to fire prevention, firefighting, rescue, and evacuation are discovered, the team leader will determine responsibility for administrative offenses according to the authority stipulated in Decree No. 106/2025/NĐ-CP of the Government dated May 15, 2025, concerning administrative penalties in the field of fire prevention, firefighting, and rescue.
2. Regular inspection for inland waterway passenger vessels and tourist ships with a capacity of 50 people or more:
a) Organize a review, compile a list of inland waterway passenger vessels and tourist ships with a capacity of 50 people or more within the management scope that are planned to be subject to regular inspections in the following year; develop and issue an inspection plan before December 15 each year;
b) Issue a decision to establish the inspection team or assign staff to conduct inspections, and notify in writing about the time, content, and composition of the inspection;
c) Send a notification letter to the inspected entity;
d) The team leader or assigned staff introduce the composition, content, and method of inspection; assign team members to conduct fire prevention and fighting inspections (if applicable);
đ) Team members or assigned staff carry out inspections according to their assignments; upon completion of the inspection, they consolidate the results and prepare an inspection record according to Form No. PC03 in Appendix VIII attached to Decree No. 105/2025/NĐ-CP.
During the inspection process, if violations related to fire prevention, firefighting, rescue, and evacuation are discovered, administrative offenses will be handled according to the authority stipulated in Decree No. 106/2025/NĐ-CP.
3. Regular inspection for construction projects during construction that must undergo design review and determination for fire prevention and firefighting:
a) Organize a review, compile a list of construction projects during construction that must undergo design review and determination for fire prevention and firefighting within the management scope;
b) Carry out tasks as prescribed in points b, c, d, and đ Clause 2 of this Article.
4. Surprise inspections:
a) Issue a decision to establish the inspection team or sign an introduction letter assigning staff to conduct inspections;
b) The team leader or assigned staff introduce the composition, clearly state the reasons, time, content, and form of inspection to the inspected entity or its representative;
c) The inspection team or assigned staff conduct inspections on compliance with laws and regulations regarding fire prevention and firefighting for contents showing signs of violation, complaints, or reports, or as required to ensure security and public order by authorized agencies;
d) Carry out tasks as prescribed in point đ Clause 2 of this Article.
5. Tasks after completing regular and surprise inspections:
a) The team leader or assigned staff report to direct leadership and command on the results of fire prevention and firefighting inspections in writing according to Form No. 01 in Appendix II attached to this Circular, including: inspection records; decisions on administrative penalties for cases where penalties are imposed without preparing an inspection record, administrative violation records (if applicable);
b) Direct leadership and command have the responsibility to review the inspection results and instruct units and staff to handle administrative penalty procedures according to regulations, issue a document recommending the inspected entity to rectify weaknesses, deficiencies, and violations related to fire prevention, firefighting, rescue, and evacuation (if applicable);
c) Assigned staff update and supplement documents into the management file on fire prevention, firefighting, rescue, and evacuation for facilities as prescribed in point b Clause 3 Article 4 of Decree No. 105/2025/NĐ-CP.
Article 29. Procedure for Issuing Fire Prevention and Control Equipment Inspection Certificates
The issuance of fire prevention and control equipment inspection certificates by public security agencies shall be carried out in accordance with the provisions stipulated in Clause 13, Article 1 of Decree No. 50/2024/NĐ-CP dated May 10, 2024 of the Government and Article 38 of Decree No. 136/2020/NĐ-CP dated November 24, 2020 of the Government detailing certain provisions and measures to implement the Law on Fire Prevention and Fighting and the Law Amending and Supplementing Certain Provisions of the Law on Fire Prevention and Fighting, and Decree No. 83/2017/NĐ-CP dated July 18, 2017 of the Government regarding rescue operations of fire prevention and fighting forces. The specific implementation process is as follows:
1. The department responsible for receiving files shall be responsible for checking the completeness and validity of the files and shall act according to the following regulations:
a) In case of direct submission of files:
If the file is complete and valid according to regulations, it will be accepted, information recorded on the File Acceptance Certificate, and a result delivery date agreed upon using Form No. 01 attached to Circular No. 01/2018/TT-VPCP.
If the file is incomplete or invalid, it will not be accepted, information recorded on the Supplementary and Completion Request Form Form No. 02 attached to Circular No. 01/2018/TT-VPCP, and return the file to the agency, organization, or individual.
If the file does not fall within the jurisdiction for resolution, it will not be accepted, information recorded on the Refusal to Accept and Resolve File Form Form No. 03 attached to Circular No. 01/2018/TT-VPCP, and return the file to the agency, organization, or individual;
b) In case of submission of files through postal services:
If the file is complete and valid according to the regulations, it will be accepted, information recorded on the File Acceptance Certificate Form No. 01 attached to Circular No. 01/2018/TT-VPCP, and send the File Acceptance Certificate to the agency, organization, or individual through postal services.
If the file is incomplete or invalid, it will not be accepted, information recorded on the Supplementary and Completion Request Form Form No. 02 attached to Circular No. 01/2018/TT-VPCP, and return the file to the agency, organization, or individual through postal services.
If the file does not fall within the jurisdiction for resolution, it will not be accepted, information recorded on the Refusal to Accept and Resolve File Form Form No. 03 attached to Circular No. 01/2018/TT-VPCP, and return the file to the agency, organization, or individual through postal services;
c) In case of submission of files online through the public service portal:
If the file is complete and valid according to regulations, it will be accepted and the acceptance notification will be sent to the agency, organization, or individual through the electronic mail function or message sending function of the public service portal.
If the file is incomplete or invalid or does not fall within the jurisdiction for resolution, it will not be accepted, supplementary and completion requests or refusal to accept the file will be notified to the agency, organization, or individual through the email sending function or message sending function of the public service portal.
2. Handover of Files:
a) For files received directly or via postal services as prescribed, the staff receiving the file will fill out and record all necessary information on the Process Control Sheet for File Handling according to Form No. 05 Appendix attached to Circular No. 01/2018/TT-VPCP, report and hand over the file to the authorized person responsible for receiving and processing the file according to the procedure.
b) For files received through the public service portal, the staff receiving the files shall transfer the files to the authorized person for receipt and processing according to the procedure.
3. Assignment of Task Execution:
The person assigned to manage the issuance of fire prevention and control equipment inspection certificates will assign the direct staff to perform the task using the Process Control Sheet for File Handling according to Form No. 05 Appendix attached to Circular No. 01/2018/TT-VPCP in cases where the file is received directly or via postal services, or directly assign on the public service portal.
4. Execution of File Processing:
a) The staff directly assigned to handle the file is responsible for studying and comparing the received file with legal regulations, technical standards and norms on fire prevention and fighting, and the draft fire prevention and control equipment inspection certificate according to Form No. PC29 attached to Decree No. 50/2024/NĐ-CP dated May 10, 2024 of the Government amending and supplementing certain provisions of Decree No. 136/2020/NĐ-CP dated November 24, 2020 of the Government detailing certain provisions and measures to implement the Law on Fire Prevention and Fighting and the Law Amending and Supplementing Certain Provisions of the Law on Fire Prevention and Fighting, and Decree No. 83/2017/NĐ-CP dated July 18, 2017 of the Government regarding rescue operations of fire prevention and fighting forces, the notice of costs for printing fire prevention and control equipment inspection labels, report to the competent leadership for review and approval if the file meets requirements. The components of the file for signature are specified at points a, b, c, d, and point e of Section 3 Appendix I attached to this Circular; in case of online submission, the components of the file for signature are specified at points b, c, and point d of Section 3 Appendix I attached to this Circular.
In case the file does not meet requirements, a draft reply document will be prepared, clearly stating the reasons, reported to the competent leadership for review and approval. The components of the file for signature are specified at points a, b, d, and point e of Section 3 Appendix I attached to this Circular; in case of online submission, the components of the file for signature are specified at points b and point d of Section 3 Appendix I attached to this Circular;
b) The leadership assigned to process the file shall submit it to the authorized person for examination, approval, and signing of the documents mentioned in point a of this Clause;
c) After the fire prevention and control equipment inspection certificate, the notice of costs for printing fire prevention and control equipment inspection labels, or the reply document has been signed and approved, they will be handed over to the document office for numbering, stamping according to regulations, and transferred to the one-stop service department.
d) The single window department shall deliver the results to the agency, organization, or individual in person or through postal service.
In case of receiving results on the public service portal, the single window department shall send the result notification of the file to the agency, organization, or individual who submitted the file through the email sending function or message sending function of the public service portal. Send the paper result document through postal service to the address registered by the agency, organization, or individual who submitted the file beforehand (in case of registering to receive the paper result document through postal service, the cost of sending the document will be borne by the agency, organization, or individual requesting it).
5. The staff member directly assigned to process the file shall perform the following tasks:
a) Coordinate with relevant units to digitize administrative procedure files in accordance with Circular No. 01/2023/TT-VPCP;
b) Establish and store the file for issuing fire prevention and control equipment inspection certificates according to the regulations on file handling of the People's Public Security.
Article 30. Procedure for Issuing Permits for Fire Prevention, Firefighting, Rescue, and Emergency Response Vehicles
The issuance of permits for fire prevention, firefighting, rescue, and emergency response vehicles shall be carried out in accordance with the provisions of Article 23 of Decree No. 105/2025/NĐ-CP. The specific procedure is as follows:
1. The department responsible for receiving files shall be responsible for checking the completeness and validity of the files and shall act according to the following regulations:
a) In case of direct submission of files:
If the file is complete and valid according to the regulations, it will be accepted and the information recorded on the Receipt of Application Form and the result delivery date will be specified according to Model No. 01 attached to Circular No. 01/2018/TT-VPCP.
If the file is incomplete or invalid, it will not be accepted, information recorded on the Supplementary and Completion Request Form Form No. 02 attached to Circular No. 01/2018/TT-VPCP, and return the file to the agency, organization, or individual.
If the file does not fall within the jurisdiction for resolution, it will not be accepted, information recorded on the Refusal to Accept and Resolve File Form Form No. 03 attached to Circular No. 01/2018/TT-VPCP, and return the file to the agency, organization, or individual;
b) In case of submission of files through postal services:
If the file is complete and valid according to the regulations, it will be accepted, information recorded on the File Acceptance Certificate Form No. 01 attached to Circular No. 01/2018/TT-VPCP, and send the File Acceptance Certificate to the agency, organization, or individual through postal services.
If the file is incomplete or invalid, it will not be accepted, information recorded on the Supplementary and Completion Request Form Form No. 02 attached to Circular No. 01/2018/TT-VPCP, and return the file to the agency, organization, or individual through postal services.
If the file does not fall within the jurisdiction for resolution, it will not be accepted, information recorded on the Refusal to Accept and Resolve File Form Form No. 03 attached to Circular No. 01/2018/TT-VPCP, and return the file to the agency, organization, or individual through postal services;
c) In case of submission of files online through the public service portal:
If the file is complete and valid according to the regulations, it will be accepted, and the acceptance of the file will be notified to the agency, organization, or individual through the email sending function or message sending function of the public service portal.
If the file is incomplete or invalid or does not fall within the jurisdiction for resolution, it will not be accepted, supplementary and completion requests or refusal to accept the file will be notified to the agency, organization, or individual through the email sending function or message sending function of the public service portal.
2. Handover of Files:
a) For files received directly or via postal services as prescribed, the staff receiving the file will fill out and record all necessary information on the Process Control Sheet for File Handling according to Form No. 05 Appendix attached to Circular No. 01/2018/TT-VPCP, report and hand over the file to the authorized person responsible for receiving and processing the file according to the procedure.
b) For files received through the public service portal, the staff receiving the files shall transfer the files to the authorized person for receipt and processing according to the procedure.
3. Assignment of Task Execution:
The person assigned to manage the issuance of permits for fire prevention, firefighting, rescue, and emergency response vehicles shall assign staff directly responsible for implementing the task using the Process Control Sheet according to Model No. 05 Appendix attached to Circular No. 01/2018/TT-VPCP in cases where the file is received directly or through postal services or directly assigned on the public service portal.
4. Execution of File Processing:
a) Staff directly responsible for processing the file shall have the responsibility to study and compare the content of the test results of fire prevention, firefighting, rescue, and emergency response vehicles and the documents in the file with the relevant technical standards and regulations; report to the competent leadership for review and approval if the file meets the requirements. The components of the file for signature are stipulated at points a, b, c, and point d of item 4 Appendix I attached to this Circular; in case of online submission, the components of the file for signature are stipulated at points b and point c of item 4 Appendix I attached to this Circular.
In case the requirements are not met, draft the reply document clearly stating the reasons, report to the competent leadership for review and approval. The components of the file for signature are stipulated at points a, b, d, and point d of item 4 Appendix I attached to this Circular; in case of online submission, the components of the file for signature are stipulated at points b and point d of item 4 Appendix I attached to this Circular;
b) The assigned leadership shall submit the file for review and approval by the competent authority as stipulated at point a of this clause;
c) After the permit for fire prevention, firefighting, rescue, and emergency response vehicles or the reply document has been signed and approved, it shall be numbered, stamped according to the regulations, and handed over to the one-stop service department.
d) The single window department shall deliver the results to the agency, organization, or individual in person or through postal service.
In case of receiving results on the public service portal, the single window department shall send the result notification of the file to the agency, organization, or individual who submitted the file through the email sending function or message sending function of the public service portal. Send the paper result document through postal service to the address registered by the agency, organization, or individual who submitted the file beforehand (in case of registering to receive the paper result document through postal service, the cost of sending the document will be borne by the agency, organization, or individual requesting it).
5. The staff member directly assigned to process the file shall perform the following tasks:
a) Coordinate with relevant units to digitize administrative procedure files in accordance with Circular No. 01/2023/TT-VPCP;
b) Establish and store the file for issuing permits for fire prevention, firefighting, rescue, and emergency response vehicles in accordance with the regulations on files of the People's Public Security.
Article 31. Management of Fire Prevention, Firefighting, Rescue, and Emergency Response Vehicles of the Fire Prevention, Firefighting, and Rescue Police Force
1. Fire prevention, firefighting, rescue, and emergency response vehicles must be managed, stored, and maintained to ensure readiness for use.
2. The system, content, location, management, storage, and maintenance of fire prevention, firefighting, rescue, and emergency response vehicles shall be implemented in accordance with the provisions of Article 5 and Article 6 of Circular No. 36/2025/TT-BCA dated May 15, 2025, issued by the Minister of Public Security detailing certain provisions of the Law on Fire Prevention, Firefighting, and Rescue and Decree No. 105/2025/NĐ-CP dated May 15, 2025, issued by the Government detailing certain provisions and measures to implement the Law on Fire Prevention, Firefighting, and Rescue and the following provisions:
a) Mechanized firefighting, rescue, and emergency response equipment, isolated gas masks, people detection devices, chemical concentration analyzers, radiation intensity meters, walkie-talkies shall be regularly maintained daily and performed by officers and soldiers assigned to manage and use them.
b) At the end of the maintenance of mechanized firefighting, rescue, and emergency response equipment, all contents must be fully recorded in the Vehicle Activity Logbook according to Model No. 10 Appendix II attached to this Circular.
3. Annually, before June 15 and December 15, the provincial police shall report to the Fire Prevention, Firefighting, and Rescue Police Department on the situation of managing, storing, and maintaining fire prevention, firefighting, rescue, and emergency response vehicles according to the following basic contents:
a) Current status of management, storage, and maintenance (quantity, quality, types, content of storage and maintenance of fire prevention, firefighting, rescue, and emergency response vehicles equipped);
b) Results of implementing inspection and supervision conclusions and recommendations of authorized agencies (if any);
c) Proposals and recommendations (if any).
Chapter V
REGIME OF SUBSISTENCE ALLOWANCE WHEN IMPLEMENTING TRAINING AND SKILL ENHANCEMENT IN FIRE PREVENTION, FIREFIGHTING, RESCUE, AND EMERGENCY RESPONSE; PRACTICING FIREFIGHTING, RESCUE, AND EMERGENCY RESPONSE PLANS AND RESCUE PLANS; AND WHEN ENGAGING IN FIREFIGHTING, RESCUE, AND EMERGENCY RESPONSE OPERATIONS
Article 32. Principles for Applying the Subsidy System
1. When applying the subsidy system to officers and soldiers belonging to the Fire Prevention, Firefighting, Rescue, and Emergency Response Force, it must be based on the following documents:
a) The plan approved by the competent authority regarding the organization of training and professional development in fire prevention, firefighting, rescue, and emergency response; the practice of firefighting and rescue plans and rescue plans;
b) The confirmation document from the competent authority for officers and soldiers regarding the time spent on firefighting, rescue, and emergency response.
2. The subsidy system when firefighting, rescuing, and emergency response, during training and professional development in fire prevention, firefighting, rescue, and emergency response, and during the practice of firefighting and rescue plans and rescue plans shall not be used to calculate contributions or benefits under social insurance and health insurance schemes.
Article 33. Recipients of the Subsidy System
1. Officers and soldiers specified in Clauses 1, 2, and Clause 3 of Article 18 of this Circular when participating in training and professional development in fire prevention, firefighting, rescue, and emergency response.
2. Officers and soldiers belonging to the Fire Prevention, Firefighting, Rescue, and Emergency Response Force when practicing firefighting and rescue plans and rescue plans of public security agencies that mobilize many forces and means from agencies and organizations.
3. Officers and soldiers belonging to the Fire Prevention, Firefighting, Rescue, and Emergency Response Force when firefighting, rescuing, and emergency response.
Article 34. Time for Enjoying the Subsidy System
1. Officers and soldiers belonging to the Fire Prevention, Firefighting, Rescue, and Emergency Response Force when participating in regular training, advanced training, and professional development in fire prevention, firefighting, rescue, and emergency response as stipulated in Clause 1, Clause 2, Point b and Point c of Clause 3 of Article 20 of this Circular shall enjoy the subsidy system according to the actual number of days of training and development but not exceeding thirty days in a year.
2. Officers and soldiers belonging to the Fire Prevention, Firefighting, Rescue, and Emergency Response Force when practicing firefighting and rescue plans and rescue plans of public security agencies that mobilize many forces and means from agencies and organizations shall enjoy the subsidy system according to the actual number of days of practice.
3. Officers and soldiers belonging to the Fire Prevention, Firefighting, Rescue, and Emergency Response Force when firefighting, rescuing, and emergency response shall enjoy the subsidy system according to the actual time spent on firefighting, rescuing, and emergency response. The time for calculating the subsidy system is as follows:
a) Continuous firefighting, rescue, and emergency response time under four hours is counted as half a day;
b) Continuous firefighting, rescue, and emergency response time from four to less than eight hours is counted as one day;
c) Continuous firefighting, rescue, and emergency response time of eight hours or more, the subsequent firefighting, rescue, and emergency response time is counted accordingly as provided in Point a and Point b of this clause.
Article 35. Calculation of the Subsidy System
1. The amount of subsidy received when participating in training and professional development in fire prevention, firefighting, rescue, and emergency response is calculated according to the following formula:

Basic salary level implemented in accordance with Decree No. 73/2024/NĐ-CP dated June 30, 2024, stipulating the basic salary level and bonus system for civil servants, public officials, civil servants, and armed forces personnel. When the basic salary level changes, the new salary level regulations shall apply.
Example: Comrade Nguyen Van A, belonging to the Fire Prevention, Firefighting, Rescue, and Emergency Response Force, when participating in firefighting and rescue training for thirty days, the amount of subsidy received is as follows:
Subsidy received = 0.1 x 2,340,000 x 30 = 7,020,000 VND;
2. The amount of subsidy received when practicing firefighting and rescue plans and rescue plans of public security agencies that mobilize many forces and means from agencies and organizations is calculated according to the following formula:

Example: Comrade Nguyen Van A, belonging to the Fire Prevention, Firefighting, Rescue, and Emergency Response Force, when practicing firefighting and rescue plans for five days, the amount of subsidy received is as follows:
Subsidy received = 0.2 x 2,340,000 x 5 = 2,340,000 VND.
3. The amount of subsidy received when firefighting, rescuing, and emergency response is calculated according to the following formula:

Example: Comrade Nguyen Van A, belonging to the Fire Prevention, Firefighting, Rescue, and Emergency Response Force, when firefighting, rescuing, and emergency response for two hours, the amount of subsidy received is as follows:
Subsidy received = 0.3 x 2,340,000 x 0.5 = 351,000 VND.
Article 36. Sources of funds for the allowance payment system
1. The funds for the allowance payment system stipulated in this Circular shall be allocated from the regular budget of local police units or other lawful sources (if any).
2. Annually, local police units shall have the responsibility to prepare the budget estimate for implementing the allowance system as prescribed in this Circular, consolidate it into the annual operational expenditure budget of their unit or locality, and report to the Ministry of Public Security (through the Department of Planning and Finance). The Department of Planning and Finance shall have the responsibility to consolidate it into the annual operational expenditure budget of the Ministry of Public Security and submit it to the Ministry of Finance in accordance with the laws on state budget.
Chapter VI
IMPLEMENTATION
Article 37. Effective Date
1. This Circular takes effect from July 1, 2025.
2. The following Circulars shall cease to be effective from the date this Circular comes into force:
a) Circular No. 139/2020/TT-BCA dated December 23, 2020 issued by the Minister of Public Security regarding the standing readiness work for firefighting and rescue operations of the People's Police force;
b) Circular No. 140/2020/TT-BCA dated December 23, 2020 issued by the Minister of Public Security regarding the implementation of firefighting and rescue activities of the People's Police force;
c) Circular No. 141/2020/TT-BCA dated December 23, 2020 issued by the Minister of Public Security regarding inspection work on fire prevention, firefighting, and rescue operations of the People's Police force;
d) Circular No. 82/2021/TT-BCA dated August 6, 2021 issued by the Minister of Public Security regarding standards, tasks, training, and inspection procedures for design review and acceptance of fire prevention and firefighting operations of the Fire Prevention and Fighting Police force;
đ) Circular No. 06/2022/TT-BCA dated January 17, 2022 issued by the Minister of Public Security regarding the procedures for performing fire prevention, firefighting, and rescue tasks within the People's Police force;
e) Circular No. 02/2023/TT-BCA dated January 13, 2023 issued by the Minister of Public Security regarding the training of firefighting and rescue operations within the People's Police force;
g) Circular No. 55/2024/TT-BCA dated October 31, 2024 issued by the Minister of Public Security amending and supplementing certain provisions of Circular No. 141/2020/TT-BCA dated December 23, 2020 issued by the Minister of Public Security regarding inspection work on fire prevention, firefighting, and rescue operations of the People's Police force; Circular No. 150/2020/TT-BCA dated December 31, 2020 issued by the Minister of Public Security regarding the provision of equipment for firefighting, rescue operations for civilian defense forces, grassroots firefighting forces, and specialized firefighting forces; Circular No. 82/2021/TT-BCA dated August 6, 2021 issued by the Minister of Public Security regarding standards, tasks, training, and inspection procedures for design review and acceptance of fire prevention and firefighting operations of the Fire Prevention and Fighting Police force and Circular No. 06/2022/TT-BCA dated January 17, 2022 issued by the Minister of Public Security regarding the procedures for performing fire prevention, firefighting, and rescue tasks within the People's Police force.
Article 38. Transitional provisions
1. The results of the professional inspection of design review and acceptance work for fire prevention and firefighting, and inspection work on fire prevention, firefighting, and rescue operations as prescribed in Circulars No. 82/2021/TT-BCA and No. 141/2020/TT-BCA meeting the requirements of the Team Leader, Deputy Team Leader, and officers still within their validity period may continue to be used until the expiration date and serve as the basis for assigning officers to perform design review work and inspect fire prevention and firefighting acceptance work, and inspection work on fire prevention, firefighting.
2. Heads of Departments and Deputy Heads of Departments under the Fire Prevention and Fighting Police Bureau, Heads of Departments and Deputy Heads of Departments of Fire Prevention and Fighting Police currently responsible for and executing design review, acceptance work for fire prevention and firefighting, and inspection work on fire prevention, firefighting, and rescue operations without having received training and professional inspection as prescribed in this Circular may continue to be responsible for and execute design review work and inspect fire prevention and firefighting acceptance work, and inspection work on fire prevention, firefighting but not exceeding twelve months from the effective date of this Circular.
Article 39. Responsibility for Implementation
1. The Director of the Fire Prevention and Fighting Police Bureau has the responsibility to monitor, guide, inspect, and urge the implementation of this Circular.
2. Provincial Public Security Directors directly under the central government have the responsibility:
a) To direct and organize the integration of the emergency call number 114 for fire and rescue situations, the public security hotline number 113, and the medical emergency number 115 into the unified call center system for numbers 113, 114, and 115 according to the decision of the competent authority;
b) To organize the deployment of the emergency call reception system at the Command Information Center to ensure that it can display caller information, record calls, block calls, store incoming calls, and facilitate classification, handling of reports, and quick connection of reports to units tasked with the mission as required by the competent authority;
c) To assign and arrange personnel, ensure material resources, equipment to perform the task of receiving and handling reports at the Command Information Center to ensure uniformity and effectiveness in the work of receiving, handling, and resolving fire reports, rescue situation reports, public security reports within the jurisdiction;
d) To direct the coordination and exchange of information to serve command, control, and resolution of security and public order cases, fire incidents, explosions, accidents, and emergencies between the Command Information Center and the Administrative Management Police Department, Fire Prevention and Fighting Police Department, communal police stations, health agencies, and related units.
3. Heads of units under the Ministry, Provincial Public Security Directors directly under the central government, and relevant agencies, organizations, facilities, and individuals are responsible for implementing this Circular. During the implementation of this Circular, if there are difficulties or obstacles, local police units, relevant agencies, organizations, individuals should report to the Ministry of Public Security (through the Fire Prevention and Fighting Police Bureau) for timely guidance.
