Pursuant to Decree No. 90/2002/NĐ-CP dated November 11, 2002 of the Government on the functions, tasks, powers, and organizational structure of the Posts and Telecommunications Ministry;

Pursuant to Decision No. 217/2003/QĐ-TTg dated October 27, 2003 of the Prime Minister on the management of pricing for postal and telecommunications services;

Considering the proposal of Vietnam Post and Telecommunications Corporation at Document No. 4938/DV-GCTT dated August 19, 2004 regarding prepaid card fixed-line telephone tariffs 1719;

At the proposal of the Director of the Department of Planning and Finance,

DECISION:

Article 1. Now issuing the NGN prepaid card telephone service tariff for calls from the Public Switched Telephone Network (PSTN) of Vietnam Post and Telecommunications Corporation as follows:

1. NGN 64kbps prepaid card telephone service:

1.1. International NGN 64kbps prepaid card telephone service:

a) Maximum rate: Not higher than the current international call tariff (Public Switched Telephone Network - PSTN) of Vietnam Post and Telecommunications Corporation.

b) Minimum rate: Not lower than 10% of the current international call tariff (Public Switched Telephone Network - PSTN) of Vietnam Post and Telecommunications Corporation.

c) The method of calculating the NGN 64kbps international prepaid card telephone service tariff shall be calculated according to the current method of calculating international call tariffs (Public Switched Telephone Network - PSTN) of Vietnam Post and Telecommunications Corporation.

1.2. Provincial NGN 64kbps prepaid card telephone service:

a) Maximum rate: Not higher than the current long-distance call tariff (Public Switched Telephone Network - PSTN).

b) Minimum rate: Not lower than the current long-distance call tariff (Public Switched Telephone Network - PSTN) according to each region as follows:

+ For special route connections: 7%.

+ For Route 1 connections: 10%.

+ For Route 2 and Route 3 connections: 15%.

c) The provincial NGN 64kbps connection area is defined in the current long-distance call tariff decision (Public Switched Telephone Network - PSTN).

d) The method of calculating the NGN 64kbps provincial prepaid card telephone service tariff shall be calculated according to the current method of calculating long-distance call tariffs (Public Switched Telephone Network - PSTN) of Vietnam Post and Telecommunications Corporation.

1.3. Intra-provincial NGN 64kbps prepaid card telephone service:

a) Maximum rate: Not higher than the current intra-provincial long-distance call tariff (Public Switched Telephone Network - PSTN).

b) Minimum rate: Not lower than 15% of the current intra-provincial long-distance call tariff (Public Switched Telephone Network - PSTN).

c) The method of calculating the NGN 64kbps intra-provincial prepaid card telephone service tariff shall be calculated according to the current method of calculating intra-provincial long-distance call tariffs (Public Switched Telephone Network - PSTN) of Vietnam Post and Telecommunications Corporation.

1.4. NGN 64kbps prepaid card telephone service for mobile phone calls:

The tariff and calculation method shall apply as the tariff and calculation method for calls from fixed-line telephones of Vietnam Post and Telecommunications Corporation to mobile phones.

1.5. Calling other networks: The tariff and calculation method shall be the same as the tariff and calculation method for calls from fixed-line telephones of Vietnam Post and Telecommunications Corporation to that network.

2. NGN 8kbps prepaid card telephone service:

2.1. Long-distance and international NGN 8kbps prepaid card telephone service shall apply as the regulations for prepaid card IP long-distance and international telephone services of Vietnam Post and Telecommunications Corporation.

2.2. Intra-provincial NGN 8kbps, mobile phone calls, and calls to other networks shall apply as the NGN 64kbps prepaid card telephone service.

Article 2. NGN 64kbps and 8kbps prepaid card telephone services at public points, in addition to the tariffs and calculation methods specified in Clause 1 and 2 of Article 1, the public point management enterprise may charge additional service fees. The level of service fee shall be determined by the public point management enterprise but must ensure non-discrimination between services provided by prepaid card telephone service providers.

Article 3. Tariffs for fax and data transmission subscribers within standard voice band through the NGN network shall be applied as for telephone call tariffs according to the corresponding services stipulated in Article 1.

Article 4. The charges stipulated in Article 1 of this Decision do not include value-added tax.

Article 5. Vietnam Post and Telecommunications Corporation:

1. Based on the provisions of Articles 1, 2, 3, and 4 of this Decision, specific tariffs for NGN 64kbps and 8kbps prepaid card telephone services are issued. When issuing specific tariff decisions within their authority, the Corporation shall notify the Ministry of Posts and Telecommunications five working days before the effective date of the Decision.

2. Setting a reduction in NGN telephone call tariffs: international, inter-provincial, intra-provincial, mobile network calls, and calls to other networks using prepaid cards during holidays and compensatory holidays, Saturdays, Sundays, and from 11 PM the previous day to 7 AM the following day from Monday to Friday, but the maximum reduction shall not exceed 30% compared to the tariffs stipulated in Article 1 of this Decision.

3. Shall have the responsibility to publish quality standards for each type of NGN 64kbps and 8kbps prepaid card telephone service for customers and provide services according to the committed quality.

Article 6. These provisions of this Decision shall apply to users of NGN 64kbps and 8kbps prepaid card telephone services of Vietnam Post and Telecommunications Corporation.

Article 7. The Standard Measurement Quality Control Department shall be responsible for organizing and guiding the implementation of the Regulations adopted herein.

Article 8. The Director of the Office, the Head of the Planning and Finance Department, the Heads of units under the Ministry of Posts and Telecommunications, and the General Director of Vietnam Post and Telecommunications Corporation are responsible for implementing this Decision./.
