for certain entities in the public interest sector

PRIME MINISTER

Pursuant to the Law on Organization of the Government dated December 25, 2001;

The Prime Minister issues this Decision amending and supplementing certain provisions of the Regulation on Response Activities to Oil Spill Incidents issued together with Decision No. 02/2013/QĐ-TTg dated January 14, 2013 of the Prime Minister.

Pursuant to Decision No. 64/2003/QĐ-TTg dated April 22, 2003 of the Government approving the Plan for Thoroughly Addressing Severe Environmental Pollution Sources (hereinafter referred to as Decision 64);

CONSIDERING THE PROPOSAL OF THE MINISTER OF NATURAL RESOURCES AND ENVIRONMENT,

DECISION:

Article 1. Amending and supplementing certain articles of Decision No. 58/2008/QĐ-TTg dated April 29, 2008 of the Government on financial support with targeted funds from the State budget aimed at thoroughly addressing, remedying environmental pollution and mitigating environmental degradation for certain entities in the public interest sector as follows:

1. Clause 2, Article 1 shall be supplemented as follows:

"a) Solid waste treatment works to implement the closure of old landfills according to Decision 64;
b) Centralized waste treatment works for traditional craft villages causing severe environmental pollution according to Decision 64;
c) Severe environmental pollution sources that must be thoroughly addressed according to the Prime Minister's Decision, belonging to the following public interest categories:

- Detention facilities, correctional institutions, reformatory schools, training centers under the People's Public Security force;

- Social welfare facilities, Rehabilitation-Education-Social Work Centers;

- Military training units at division level and above, facilities for handling weapons, military equipment, and gear."

4. State Bank Branch in Border Province is the State Bank Branch in provinces sharing borders with China, Laos, and Cambodia.

"Article 2. Conditions and Content of Support
1. Projects for thoroughly addressing environmental pollution of facilities as stipulated in Clause 2, Article 1 of this Decision shall be considered for support when they meet the following conditions:
a) They have been approved by competent state agencies in accordance with the law and included in the annual budget plan;
b) They lack funding or have been allocated but are insufficient to implement the project.
2. The projects as stipulated in Paragraph 1 of this Article must include one of the following contents: destruction and disposal of expired or banned pesticides, pesticide packaging; environmental restoration; chemical warfare agent contamination cleanup; landfill pollution control, landfill closure, environmental restoration, upgrading, construction, and new solid waste treatment works; domestic sewage treatment; centralized waste treatment for traditional craft villages; waste treatment for weapon, equipment, and gear handling facilities; construction, upgrading, and expansion of waste treatment systems."

c) A medical staff on duty or a written agreement with the nearest healthcare facility to provide first aid and emergency care for participants in dangerous sports activities when necessary."

"Article 6. Management Mechanism
1. The State allocates a portion of funds for targeted financial support to thoroughly address severe environmental pollution sources according to the Prime Minister's Decision. The management and utilization of these funds for implementing these objectives shall comply with the laws on the State budget.

2. The investment and construction management mechanism for waste treatment works of the projects shall follow the investment and construction management mechanism."

Article 2. This Decision takes effect from August 20, 2011.

Article 3. Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairpersons of provincial People's Committees, and Chairpersons of municipal People's Committees directly under the central government shall be responsible for implementing this Decision.
