Pursuant to Decree No. 199/2013/ND-CP dated November 26, 2013 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;
Pursuant to Circular No. 09/2011/TT-BNV dated June 3, 2011 of the Ministry of Home Affairs stipulating the retention period for files and documents formed commonly in the activities of agencies and organizations;
Pursuant to the Archive Work Regulation issued together with Decision No. 484/QD-BNN-VP dated March 12, 2012 of the Ministry of Agriculture and Rural Development;
Considering the proposal of the Department of Animal Health at Report No. 1657/TY-VP dated September 24, 2014 regarding the Regulations on the list of veterinary-related files and documents and their retention periods;
Based on the opinion of the Ministry of Home Affairs at Document No. 4781/BNV-VTLTNN dated November 11, 2014 concerning the draft table of retention periods for veterinary-related files and documents;
The Minister of Industry and Trade promulgates the Circular amending and supplementing certain provisions on the delegation of administrative procedures in fields under the management of the Ministry of Industry and Trade."
DECISION:
Article 1. Issued together with this Decision are the Temporary Regulations on the retention period for veterinary-related files and documents.
Article 2. This Decision takes effect from the date of signature.
Article 3. The Director of the Ministry's Office, the Director of the Department of Animal Health, and relevant units, organizations, and individuals shall be responsible for implementing this decision./.

Temporary regulations on the retention period for veterinary-related files and documents

Article 1. Scope of Regulation and Applicability
2. Applicability:
These regulations stipulate the retention period for files and documents belonging to the veterinary specialty sector formed during the operation of agencies, organizations, and individuals within the veterinary field.

They apply to agencies, organizations, and individuals involved in managing and using files and documents related to the veterinary specialty sector.
Article 2. Interpretation of Terms
a) "Document" is a carrier of information formed during the operation of agencies, organizations, and individuals performing tasks in the veterinary field.
Documents include: texts, information, inspection data, testing results, monitoring, evaluation, statistics, compilations, reports related to veterinary matters; results of issuing, extending, and revoking veterinary certification documents; outcomes of veterinary specialty programs and projects; films, photographs, and other carriers of information related to the veterinary field.
b) "File" is a set of related documents concerning a specific issue, event, or subject formed during the process of monitoring and resolving work within the scope of the veterinary field by agencies, organizations, or individuals.
c) "Retention period for files and documents": is the necessary time for retaining and preserving files and documents calculated from the year the work ends.
d) "Files and documents with permanent retention period": are types of files and documents that have significance and value of use independent of time.
đ) "Files and documents with a fixed retention period": is the necessary time for retaining and preserving, the time being determined by a specific number of years.
Article 3. Content of the table of retention periods for veterinary-related files and documents
The table of retention periods for veterinary-related files and documents issued in this Decision includes seven groups of files and documents as follows:
Group 1: Prevention and control of animal diseases
Group 2: Inspection of animals, slaughterhouse supervision (SLS), hygiene inspection (HI), and food safety
Group 3: Management of veterinary drugs
Group 4: Testing of veterinary drugs
Group 5: Diagnosis of animal diseases
Group 6: Management of scientific and technological files
Group 7: Inspection and legal affairs.
Article 4. Use of the Preservation Period Table for Veterinary Records and Documents
1. The Preservation Period Table for Veterinary Records and Documents shall be used to determine the preservation period for records and documents formed during the activities of veterinary agencies and organizations. When determining the value of documents, the following requirements must be met:
a) The level of determination of the preservation period for each specific record or document must not be lower than the level prescribed in the Preservation Period Table for Records and Documents issued by this Decision.
b) For records and documents that have exceeded their preservation period, the Document Value Determination Council of the agency shall review and assess them again, and if necessary, may extend the preservation period.
2. For veterinary records and documents not specified in this Preservation Period Table for Records and Documents, or newly formed records and documents during the course of operations, units shall apply the Preservation Period Table for Records and Documents as stipulated herein, while simultaneously reporting to the Department of Animal Health for consolidation and reporting to the Ministry.
3. The preservation period for other common records and documents formed, and documents belonging to other specialized fields (not being special veterinary records and documents according to this Regulation) formed during the activities of veterinary agencies and organizations shall be implemented in accordance with Circular 09/2011/TT-BNV dated June 3, 2011 of the Ministry of Home Affairs and the regulations of other specialized management agencies.
State-owned enterprises that have been assigned by the Ministry of Agriculture and Rural Development to conduct offshore wind power project surveys before the effective date of this Circular shall continue to implement according to the assigned documents; any new matters arising after the effective date of this Circular shall be implemented in accordance with the provisions of this Circular.
1. The Department of Animal Health is responsible for guiding, urging, and organizing the implementation of this Regulation within the veterinary system's organizational structure.
2. Units and organizations within the specialized veterinary system are responsible for implementing this regulation.
Establishing records, determining the preservation period for each record as prescribed herein, and organizing the management, preservation, and use of archival records and documents, transferring archival records and documents with permanent preservation periods as prescribed.
For accumulated records and documents that have not been processed, they must be organized, the preservation period determined, and expired records and documents processed according to the regulations. Report the results to the Department of Animal Health for consolidation and reporting to the Ministry.
3. During the implementation process, any difficulties or obstacles should be promptly reported to the Department of Animal Health, the Ministry of Agriculture and Rural Development for resolution./.
