OF THE PRIME MINISTER NO. 390/TTG DATED OCTOBER 27, 1959 ON VISA PROCEDURES
PRIME MINISTER
Pursuant to Decree No. 389/TTg dated October 27, 1959 on the issuance of passports;
At the proposal of the Ministers of the Ministry of Foreign Affairs and the Ministry of Public Security.
DECREE
Article 1: Citizens of Vietnam or foreigners entering or leaving the Democratic Republic of Vietnam must carry a passport with a visa issued by the competent authority of the Democratic Republic of Vietnam and must present their passport with the visa to the police station at the last exit point or the first entry point.
Article 2: The visa attached to the passport includes the following types:
- Exit visa,
- Entry visa,
- Entry-exit visa,
- Exit-entry visa,
- Transit visa.
Article 3: The Ministry of Foreign Affairs issues all types of visas for all types of passports.
Diplomatic missions and consular offices of the Democratic Republic of Vietnam abroad may issue entry, exit-entry, and transit visas for all types of passports.
Depending on the circumstances, these agencies will decide whether the visa has diplomatic, official, or ordinary status.
The Ministry of Public Security and public security agencies authorized by the Ministry of Public Security may issue exit visas for ordinary passports for Vietnamese citizens and foreign residents.
Article 4: Within their respective jurisdictions, the Ministries of Foreign Affairs and Public Security shall stipulate procedures and necessary documents required to apply for a visa.
Applicants for a visa must pay a processing fee. The processing fee and method of collection for applying for a visa attached to a passport shall be determined by the Ministries of Foreign Affairs, Public Security, and Finance.
Article 5: The validity period of a visa attached to a passport is up to three months. In special cases, a visa may be issued for up to six months.
An exit-entry or entry-exit visa can be used multiple times within the validity period.
Article 6: A single transit visa through the Democratic Republic of Vietnam or a round-trip transit visa is valid for up to fifteen days. In the case of transit by air, temporary stay at the airport for up to twenty-four hours is exempt from visa requirements.
Article 7: Any person who uses or produces a counterfeit visa, uses another person's visa, or arbitrarily alters information recorded on the visa shall be prosecuted under the law.
Article 8: The Ministers of Foreign Affairs, Public Security, and Finance are responsible for implementing this Decree.
