Pursuant to Decree No. 15/CP dated March 2, 1993 of the Government on the tasks, powers, and responsibilities for state management of Ministries and ministerial-level agencies;
Pursuant to Government Decree No. 43/2000/NĐ-CP dated August 30, 2000 detailing and guiding the implementation of certain provisions of the Education Law;
Pursuant to Decree No. 43/2000/NĐ-CP dated August 30, 2000 of the Government detailing and guiding the implementation of certain provisions of the Education Law;
Pursuant to Decree No. 15/2001/NĐ-CP dated May 1, 2001 of the Government on national defense education;
At the proposal of the Director of the Department of National Defense Education,

DECISION:

Article 1. The attached Decision promulgates the Regulations on the National Defense Education Subject.

Article 2. This Decision takes effect fifteen days from the date of issuance.

Article 3The heads of Ministries, ministerial-level agencies, and agencies under the Government that have secondary vocational schools, colleges, and universities directly affiliated with them; Chairpersons of People's Committees of provinces and centrally governed cities; Directors of the Office, Heads of the Department of National Defense Education; Heads of units under the Ministry of Education and Training; Directors of Departments of Education and Training; Directors of universities; Directors of academies; Principals of relevant schools shall be responsible for implementing this Decision./.

REGULATIONS

NATIONAL DEFENSE EDUCATION SUBJECT
(issued together with Decision No. 40/2002/QĐ-BGDĐT dated October 14, 2002 of the Ministry Ministry of Science and Technology of Education and Training).

Chapter 1:
GENERAL PROVISIONS

Article 1SCOPE OF APPLICATION.     

These regulations govern teaching and learning of the national defense education subject in secondary general education schools, secondary vocational schools, colleges, and universities within the national education system.

Article 2POSITION OF THE SUBJECT.

1. National defense education is part of the national education content, it is a fundamental component in building the people's all-round national defense and has significant importance in the strategy of training new human resources to serve the country's industrialization and modernization cause and the construction of socialism.

2. National defense education is a regular course in secondary general education schools, secondary vocational schools, colleges, and universities within the national education system.

Chapter 2:
REGULATIONS FOR STUDENTS AND STUDENTS

Article 3OBJECTS OF LEARNING, EXEMPTIONS, AND TEMPORARY SUSPENSION.

1. Objects of learning the national defense education subject: All students in secondary general education schools, secondary vocational schools, and students in colleges and universities in both public and private institutions, including those in regular and non-regular educational programs.

2. Objects exempted from the national defense education subject:

Students who were former military officers.

Foreign students.

Individuals receiving state salaries who are sent to study in non-regular programs by their agencies.

Students who have been granted a National Defense Education Certificate appropriate to their level of training.

3. Objects exempted from practical components of the national defense education subject:

Students who have completed their compulsory military service (with discharge orders).

Students who are religious clergy.

Students with disabilities or congenital defects that limit their physical functions (certified by county-level hospitals or equivalent).

4. Objects temporarily suspended from the national defense education subject:

Students whose health does not permit them to continue studying.

Pregnant students or those nursing infants under 24 months old.

Students with special family circumstances.

These objects may be temporarily suspended from the national defense education subject upon approval by the school principal. After the suspension period ends, they must complete the remaining required content in the prescribed curriculum.

Article 4. RESPONSIBILITIES AND RIGHTS OF STUDENTS AND STUDENTS.

Students have responsibilities and rights as stipulated in the corresponding regulations for each level of education, degree program, and training level.

Additionally, when studying national defense education, students must:

Strictly comply with all safety regulations and rules concerning personnel, weapons, equipment, and facilities.

Wear uniforms neatly and uniformly according to the guidelines provided by teachers and lecturers during practical sessions.

Chapter 3:
REGULATIONS FOR TEACHERS AND LECTURERS

Article 5TEACHERS AND LECTURERS.

Teachers and lecturers of national defense education are those directly responsible for teaching the national defense education subject to students, including:

1. Teachers and lecturers belonging to the staff of schools and centers for national defense education.

2. Teachers and lecturers hired by the school principal or center director for joint teaching or guest lectures.

Article 6STANDARDS FOR TEACHERS AND LECTURERS.

In addition to the standards for secondary general education and secondary vocational education teachers already specified in Chapter IV of the Secondary School Regulation, the Vocational High School Regulation, and the regulations of colleges and universities for lecturers, teachers and lecturers of national defense education must meet one of the following additional standards:

1. For teachers:

a) Graduated from a regular combined major in national defense education at a Normal University.

b) Secondary general education or secondary vocational education teachers who have completed a short-term national defense education teacher training program and are hired for joint teaching or guest lectures.

c) Graduated from a university in the military and received pedagogical training according to the program issued by the Ministry of Education and Training.

d) Military officers with relevant professional training as specified in the training program, hired for joint teaching or guest lectures. 2. For lecturers:

Graduated from a university in the military with relevant professional training, having worked in a unit for two years or more, and received pedagogical training according to the program issued by the Ministry of Education and Training.

TASKS, RIGHTS, AND PRIVILEGES OF TEACHERS AND LECTURERS.

, Clause 1, Clause 2 Article 7a of this Regulation.Teachers and lecturers have responsibilities and rights as stipulated in the corresponding regulations for each level of education, degree program, and training level.

Additionally, due to the nature of the subject, teachers and lecturers must:

Wear uniforms according to regulations.

Strictly adhere to safety regulations and rules concerning personnel, weapons, equipment, and facilities, and guide students to follow these rules.

Enjoy other preferential rights based on the special nature of their work as teachers and lecturers of the national defense education subject according to current state regulations.

ORGANIZATION AND MANAGEMENT OF THE NATIONAL DEFENSE EDUCATION SUBJECT

Chapter 4:
ORGANIZATION, MANAGEMENT, AND GUIDANCE.

Article 81. The Department of National Defense Education leads and coordinates with relevant agencies to assist the Minister of Education and Training and the Minister of Defense in performing state management functions over the national defense education subject.

1. The Department of National Defense Education shall take the lead and coordinate with relevant agencies to assist the Minister of Education and Training and the Minister of National Defense in performing the state management function for the national defense education subject.

2. The Department of Education and Training shall be allocated professional or semi-professional staff to manage the national defense education subject of the sector (some centrally-administered cities and key provinces will have military officers seconded to the Department of Education and Training to assist the Director of the Department in managing the national defense education subject). The Department of Education and Training has the following responsibilities:

a) To take the lead and coordinate with the Military Command of provinces and cities in managing, directing, and implementing the Party's policies, state regulatory legal documents, and those of the sector and locality regarding the national defense education subject for secondary schools, vocational high schools, and colleges in the locality.

b) To take the lead and coordinate with the Military Command of provinces and cities, relevant sectors, to develop plans and organize professional training for national defense education teachers in secondary schools, vocational high schools, and colleges under the management of the Department of Education and Training in accordance with the regulations of the Ministry of Education and Training.

c) To manage military officers seconded to the Department.

d) To organize regular national defense education sports meetings.

e) To guide and ensure educational facilities for teaching and learning the national defense education subject.

g) To conduct inspections and checks on national defense education work at educational institutions in the locality.

Article 9. Implementing organization.

1. National Defense Education Center: To perform tasks according to Article 3 of the Regulation on the Organization and Operation of the National Defense Education Center (issued by Decision No. 03/2001/QĐ-BGDĐT dated February 6, 2001 of the Minister of Education and Training).

2. Universities and colleges organize departments or subjects of national defense education, with the responsibility to organize teaching, learning, and evaluating the results of the national defense education subject for students in accordance with the curriculum and regulations of the Ministry of Education and Training, report and propose the President of the University to issue a National Defense Education Certificate to students who have completed the national defense education subject.

To purchase fully the equipment and teaching materials according to the list of national defense education teaching equipment.

To organize for students to participate in extracurricular activities related to national defense education.

3. Secondary schools, vocational high schools:

a) To develop plans and implement teaching and learning of the national defense education subject in accordance with the program, content, and time stipulated by the Department of Education and Training.

b) To allocate national defense education teachers or lecturers or organize contractual joint teaching or guest lectures for the school; at the same time, fully implement the policies for national defense education teachers.

c) To regularly coordinate with the District, County, City Military Command to inspect the national defense education subject at the school.

d) To organize for students to participate in extracurricular activities related to national defense education.

Article 10. Teaching and learning methods for the national defense education subject.

To implement general requirements for teaching and learning methods prescribed in Articles 24, 30, and 36 of the Education Law, flexibly applying various forms and methods of learning suitable to the specific conditions of each educational institution to improve the quality of teaching and learning the national defense education subject.

Article 11. Evaluation of learning outcomes.

1. Secondary school and vocational high school students studying national defense education at school, when conditions permit, the school may send students to national defense education centers; the learning outcomes of students are evaluated according to the regulations on examination, testing, promotion, graduation recognition, and the provisions of each level of education.

2. College and university students study the national defense education subject through centralized learning, distributed learning at school, national defense education centers, or inter-school collaboration as specified by the Minister of Education and Training. Students who complete the national defense education content and program, and achieve the required points in examinations according to regulations will be issued a National Defense Education Certificate by the training institution. The National Defense Education Certificate is one of the conditions for recognizing graduation for students.

Article 12. Management and training of teachers and lecturers.

Organizations, agencies, and training institutions shall manage the team of national defense education teachers and lecturers according to their respective levels. National defense education lecturers who are seconded military officers are managed not only by the agency or unit where they work but also by the military in accordance with the Government's regulations on seconded officers.

Article 13. Curriculum, textbooks, teaching materials.

Curriculum and teaching materials for national defense education courses at secondary schools, vocational high schools, colleges, and universities shall be issued by the Ministry of Education and Training.

Research materials for students shall be compiled by the school and relevant specialized agencies.

Article 14. Physical infrastructure.

1. For national defense education centers, they shall implement Article 38 of the Regulations on the Organization and Operation of National Defense Education Centers.

2. Secondary schools, vocational high schools, colleges, universities, and national defense education centers must ensure sufficient conditions to serve the teaching and learning of national defense education subjects such as equipment, teaching aids, training grounds, and fields.

National defense education centers and universities must have dedicated classrooms, training fields, practice fields, equipment, devices, tools, and models to support learning.

The equipment and teaching aids for national defense education subjects are listed in the School Equipment Catalogue issued by the Ministry of Education and Training.

When conducting practical lessons, it must be ensured that there are weapons and equipment as prescribed:

Secondary schools: 30 students/1 firearm.

Vocational high schools, colleges, and universities: 20 students, trainees/1 firearm.

Actual shooting tests using K56 ammunition: 3% of students, trainees; the remainder will be tested using practice shooting machines, sports guns, air rifles.

The use and maintenance of equipment, weapons, and military supplies shall comply with the Regulations of the Vietnam People's Army.

In theory classes, each class shall not exceed 150 people; in practical classes, each class shall not exceed 50 people.

3. Schools and national defense education institutions shall coordinate with local military authorities (District, City, County Military Command) to borrow weapons and equipment.

Article 15. Funding.

Funding for national defense education activities shall be implemented according to Section II Clause 2 of Circular Joint No. 4086/2001/TTLT-BQP-BGDĐT-BLĐTBXH-BTC dated December 24, 2001, issued by the Joint Ministries of National Defense, Education and Training, Labor, Invalids and Social Affairs, and Finance to guide the implementation of Decree No. 15/2001/NĐ-CP of the Government.

Chapter 5:
REWARD AND VIOLATION HANDLING

Article 16. Awards.

1. Groups and individuals who achieve outstanding results in national defense education work shall be considered for rewards in accordance with current state regulations.

2. Educational management levels shall consider rewarding units and individuals who achieve results in national defense education according to the current regulations of the Ministry of Education and Training.

Article 17. Handling violations.

Individuals and units violating this Regulation shall be subject to disciplinary action, administrative penalties, or criminal prosecution depending on the nature and severity of the violation. If material damage is caused, compensation must be made in accordance with the law./.
