RESOLUTION
On the investment policy for the Ninh Thuan nuclear power project

THE NATIONAL ASSEMBLY OF THE SOCIALIST REPUBLIC OF VIETNAM
BASED ON THE CONSTITUTION OF THE SOCIALIST REPUBLIC OF VIETNAM IN 1992 AS AMENDED AND COMPLEMENTED BY RESOLUTION NO. 51/2001/QH10;
Pursuant to Resolution No. 66/2006/QH11 dated June 29, 2006 of the National Assembly of the Socialist Republic of Vietnam, the 11th session, ninth meeting, concerning important national projects submitted to the National Assembly for decision on investment policies;
Pursuant to the Atomic Energy Law on June 3, 2008;
After considering the Government's Report No. 08/TTr-CP dated September 30, 2009, the Review Report No. 739/BC-UBKHCNMT 12 dated October 20, 2009 of the Science, Technology and Environment Committee of the National Assembly, the Government's Supplementary Report No. 15/TTr-CP dated October 23, 2009; other reports of the Government regarding the request for investment policy for the Ninh Thuan Nuclear Power Project and the opinions of the National Assembly deputies,
RESOLUTION:
Article 1. Decides to approve the investment policy for the Ninh Thuan Nuclear Power Project, which includes two plants, each with two units to supply electricity to the national grid, contributing to the development of the national economy and the province of Ninh Thuan.
Construction site: The Ninh Thuan 1 Nuclear Power Plant is located in Phuoc Dinh Commune, Thuan Nam District, Ninh Thuan Province; The Ninh Thuan 2 Nuclear Power Plant is located in Vinh Hai Commune, Ninh Hai District, Ninh Thuan Province.
Article 2. Some basic parameters of the Project:
1. Scale of the Project: total capacity of the two plants at over 4,000 megawatts (MW), suitable with the selected reactor technology and generation; capacity of the Ninh Thuan 1 Nuclear Power Plant approximately 2,000 megawatts (MW); capacity of the Ninh Thuan 2 Nuclear Power Plant approximately 2,000 megawatts (MW);
2. Main technology: advanced pressurized water reactor technology, the most modern generation that has been verified, ensuring absolute safety and economic efficiency at the time of project investment;
3. Land area: rational and economical land use;
4. Total investment cost: estimated at VND 200 trillion (at the time of project preparation, fourth quarter of 2008);
5. Time frame and implementation schedule:
- Start construction of the Ninh Thuan 1 Nuclear Power Plant in 2014, put the first unit into operation in 2020;
- Based on the preparation situation, the Government will report to the National Assembly to decide the start date for construction of the Ninh Thuan 2 Nuclear Power Plant.
Article 3. Entrust the Government to make investment decisions and implement the project with the following main requirements and tasks:
1. Promptly complete and approve planning schemes and promulgate comprehensive regulatory legal documents, technical standards and norms for the design, management, operation, and exploitation of nuclear power plants;
2. Design the works according to special standards, ensuring the highest level of security and safety. Conduct thorough studies and assessments of the impacts of geological fault zones and climate change phenomena, sea-level rise in the project implementation area; prepare and approve the environmental impact assessment report in accordance with regulations;
3. Develop specific plans and organize resettlement and relocation work well, invest in infrastructure construction serving the Project, construction sites, and auxiliary facilities for plant construction;
4. Implement preferential policies for the construction of technical infrastructure, economic, cultural, educational, and social welfare development in areas with nuclear power plants as stipulated in Article 5 of the Atomic Energy Law;
5. Select contractors with extensive experience in designing, manufacturing, constructing, and operating nuclear power plants from countries with high scientific and technological potential in this field, having implemented many nuclear power plant projects, capable of financing and reasonable investment costs. Develop plans to gradually increase domestic production rates in construction and equipment manufacturing;
6. Promptly implement training programs for human resources in the atomic energy and nuclear power fields to participate in plant construction, ensure quality and operation, inspect, monitor, and evaluate safety during construction, operation, and exploitation of nuclear power plants;
7. Study and assess uranium resources, reserves, extraction capabilities, processing, and long-term usage needs;
8. Plan and develop overall land use plans to meet the requirements for building safe radioactive waste treatment areas;
9. Effectively carry out propaganda and mobilization work through various concrete forms to create high consensus in society.
Article 4. The Government shall study and build special mechanisms and policies to allow investors to accumulate capital, provide bank credit; compensate and support relocation; construct socio-economic infrastructure, organize production, stabilize people's lives in affected areas, and submit them to the National Assembly for consideration and decision at appropriate times.
Article 5
1. Before starting construction of the first unit, the Government shall report to the National Assembly on the results of the preparation.
2. After implementing the Project, the Government shall report annually to the National Assembly on the progress of the Project.
3. The Standing Committee of the National Assembly, the National Ethnic Council, the Committees of the National Assembly, the Delegations of National Assembly members, and National Assembly deputies within their respective duties and powers shall supervise the implementation of this Resolution.
This Resolution takes effect from the date it is adopted by the National Assembly.
This Resolution was adopted by the National Assembly of the Socialist Republic of Vietnam, the 12th session, sixth meeting, on November 25, 2009./.
