CIRCULAR

Regulations on the List of Waste Materials and the List of Used Goods Temporarily Ceased from Being Traded for Temporary Import, Re-export, and Transshipment

 

Pursuant to the Law on Foreign Trade Management No. 05/2017/QH14;

Pursuant to Decree No. 40/2025/NĐ-CP of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade, amended and supplemented by Decree No.109/2025/NĐ-CP and Decree No. Decision No. 193/2025/NĐ-CP;

Pursuant to Decree No. 292/2026/NĐ-CP of the Government detailing certain provisions and measures to organize and guide the implementation of the Law on Foreign Trade Management;

At the proposal of the Director of the Department of Import-Export;

The Minister of Industry and Trade promulgates this Circular stipulating the List of Waste Materials and the List of Used Goods Temporarily Ceased from Being Traded for Temporary Import, Re-export, and Transshipment.

Article 1. Scope of Regulation

This Circular stipulates the List of Waste Materials and the List of Used Goods Temporarily Ceased from Being Traded for Temporary Import, Re-export, and Transshipment as prescribed in Clause 3, Article 40 of the Law on Foreign Trade Management and at Clause 3, Article 13 of Decree No. 292/2026/NĐ-CP dated July 22, 2026 of the Government detailing certain provisions and measures to organize and guide the implementation of the Law on Foreign Trade Management.

Article 2. Applicability

1. Business entities participating in temporary import, re-export, and transshipment activities of goods.

2. Organizations and management agencies for temporary import, re-export, and transshipment activities of goods.

3. Other agencies, organizations, and individuals related to temporary import, re-export, and transshipment activities of goods.

Article 3. List of Waste Materials and List of Used Goods Temporarily Ceased from Being Traded for Temporary Import, Re-export, and Transshipment

1. Issue the List of Waste Materials Temporarily Ceased from Being Traded for Temporary Import, Re-export, and Transshipment in Appendix I attached hereto.

2. Issue the List of Used Goods Temporarily Ceased from Being Traded for Temporary Import, Re-export, and Transshipment in Appendix II attached hereto.

3. The List of Waste Materials and the List of Used Goods issued with this Circular shall not apply to cases where goods are transshipped directly from the exporting country to the importing country without passing through Vietnamese customs checkpoints.

Article 4. Organization of Implementation

1. In case the cited documents in this Circular are amended, supplemented, or replaced, they shall be implemented according to the amended, supplemented, or replacement documents.

2. During the implementation of this Circular, if any difficulties arise, business entities, agencies, organizations, and individuals related to it shall report in writing to the Department of Import-Export - Ministry of Industry and Trade for handling.

Article 5. Transitional Provisions

For consignments of waste materials and used goods that have completed customs procedures for temporary import and transshipment before the effective date of this Circular, they may continue to be re-exported or transshipped in accordance with the laws applicable at the time of completing the temporary import and transshipment customs procedures.

Article 6. Implementation Provisions

1. This Circular takes effect from September 5, 2026 until December 31, 2029.

2. This Circular abolishes:

a) Circular No. 18/2024/TT-BCT dated October 8, 2024 of the Minister of Industry and Trade stipulating the List of Waste Materials Temporarily Ceased from Being Traded for Temporary Import, Re-export, and Transshipment

b) Article 4 of Circular No. 12/2018/TT-BCT dated June 15, 2018 of the Minister of Industry and Trade detailing certain provisions of the Law on Foreign Trade Management and Decree No. 69/2018/NĐ-CP dated May 15, 2018 of the Government detailing certain provisions of the Law on Foreign Trade Management.

c) Clause 2, Article 1 and Appendix II issued together with Circular No. 08/2023/TT-BCT dated March 31, 2023 of the Minister of Industry and Trade amending and supplementing certain provisions stipulating the detailed list according to HS codes of exported and imported goods issued together with some Circulars of the Minister of Industry and Trade./.
