DECISION OF THE PRIME MINISTER
On the management and implementation of national target programs
PRIME MINISTER
Pursuant to the Law on Organization of the Government dated December 25, 2001;
To strengthen and continue to innovate the management mechanism and implementation of national target programs;
At the proposal of the Minister of Planning and Investment,
DECISION:
I. General Provisions
Article 1. A national target program is a set of synchronized objectives, tasks, and solutions regarding economy, society, science, technology, environment, mechanisms, policies, and organization to achieve one or more objectives determined in the national general strategy for economic and social development within a specific period of time.
A national target program consists of various projects to implement its objectives. The objects of management and planning are defined according to the program, while investment is carried out according to the project.
Article 2. A project under a national target program is a set of activities aimed at accomplishing a specific task to achieve one or more clearly defined objectives within the program with specified resources and timeframe.
Article 3. Criteria for selecting national target programs.
1. Issues selected for resolution through national target programs must be urgent, cross-sectoral, cross-regional, and significant for the country's overall economic and social development, requiring focused resources and government guidance to address.
2. Objectives of national target programs must be clear, quantifiable, and fall within the national general strategy.
3. The implementation period of the program must be limited, typically five years, or divided into phases for each five-year period.
4. Social issues that the Government of Vietnam has committed to international organizations to implement according to global or regional programs.
Article 4. Contents of national target programs:
1. Current situation of the field covered by the national target program; urgent issues that need to be resolved through the national target program.
2. Scope, scale, and general objectives of the program; basic indicators to be achieved during specific periods; projects of the program.
3. Total budget of the program including funds for addressing scientific and technological issues (if applicable), annual budgets, and methods of mobilizing capital sources.
4. Mechanisms and policies for implementing the program.
5. Requirements for training human resources to implement the program.
6. Scientific and technological issues that need to be addressed (if applicable).
7. Overall economic and social benefits of the program and each project.
8. Ability to integrate with other programs.
9. Plan and progress schedule for organizing and implementing the program and projects.
10. International cooperation (if applicable).
11. Plan and parameters for monitoring and supervising the implementation of the program.
II. Building, reviewing, approving, and reporting on the results
of national target programs
Article 5. Based on the contents and tasks of the ten-year strategy, the five-year plan, relevant ministries, sectors, and central agencies propose urgent social issues that need to be resolved through national target programs.
The Ministry of Planning and Investment takes the lead, in coordination with the Ministry of Finance, relevant ministries, sectors, and central agencies, to select and compile a list of national target programs and propose the managing agency for the programs, to submit to the Government for consideration and then to the National Assembly for approval of the list of national target programs.
Article 6. The agency responsible for managing the national target program leads, in coordination with the Ministry of Planning and Investment, the Ministry of Finance, and relevant ministries, sectors, and localities, to organize the development of the program content and projects.
The development of programs and projects is conducted during the period of developing annual and five-year plans.
Article 7. The Ministry of Planning and Investment leads, in coordination with the Ministry of Finance and relevant ministries, sectors, and localities, to organize the review of national target programs and submit them to the Prime Minister for approval.
The review period for national target programs shall not exceed forty-five days from the date of receipt of complete valid documents.
The review and approval of projects under the program shall be carried out in accordance with current regulations on investment and construction management.
Article 8. When developing annual and five-year plans, if conditions or program goals change, the Ministry of Planning and Investment will coordinate with the Ministry of Finance and the national target program management agency to adjust the national target program according to the following specific contents:
1. Evaluation of the implemented portion of the program.
2. Justification for the necessity and reasons for adjustment.
3. Content of adjustment (including program objectives, tasks, and budget).
4. Impact of such adjustments on the final goal of the program and the effectiveness of the adjustment.
Article 9.
1. Ministries, sectors, central agencies participating in the management and implementation of national target program projects and People's Committees of provinces and centrally-administered cities have the responsibility to report periodically (quarterly and annually) on the implementation of national target programs (objectives, tasks, budget, mechanisms, policies, etc.); mid-term reports for national target programs with a five-year duration; final reports upon completion of national target programs, according to prescribed forms.
These reports are submitted to the Prime Minister, the Ministry of Planning and Investment, the Ministry of Finance, and national target program management agencies.
2. The agency responsible for managing national target programs has the responsibility to report periodically (quarterly and annually) on the implementation of national target programs; mid-term reports for national target programs with a five-year duration; final reports upon completion of national target programs.
These reports are submitted to the Prime Minister, the Ministry of Planning and Investment, and the Ministry of Finance.
3. The Ministry of Planning and Investment leads, in coordination with the Ministry of Finance, to aggregate the situation and results of implementing national target programs (quarterly and annually), mid-term and final situations and results of national target programs, and report to the Prime Minister.
III. Financial Mechanism for Programs

Article 10. Annually, based on the tasks and objectives of projects under the national target program, the agency managing the national target program shall work with the Ministry of Planning and Investment and the Ministry of Finance to propose the budget allocation for the national target program for the Ministry of Planning and Investment to compile and report to the Government for consideration and submit to the National Assembly for approval.
Article 11. Based on the budget level notified by the competent authority for each program, the agency managing the national target program shall prepare the budget allocation of the program for each ministry, sector, central agency, and locality, and send it to the Ministry of Finance and the Ministry of Planning and Investment for consolidation into the budget plan of ministries, sectors, and localities to be submitted to the Prime Minister for decision.
Article 12. The funds for implementing the national target program shall be balanced within the central government's budget estimate issued directly by the Ministry of Finance to ministries, sectors, and central agencies to carry out the program's tasks managed centrally and supplemented with targeted funds for provinces and centrally-administered cities to implement the program's tasks managed locally.
The management of expenditure and settlement of accounts for the national target program shall be carried out in accordance with the provisions of the State Budget Law, guiding documents of the Law, and other related regulations issued by the Government.
Article 13. To achieve the program's objectives, in addition to state budget funds, additional credit resources both domestically and internationally must be mobilized, along with contributions from organizations, individuals, and communities to implement the program.
For funds raised from the people, the agency managing the national target program and the People's Committees of provinces and centrally-administered cities (where the program is implemented) may use them for works within the program's content but must manage and settle payments and accounts according to current regulations.
IV. Allocation and分级任务和管理

Article 14. The Ministry of Planning and Investment has the following responsibilities:
1. Serve as the focal point to assist the Government in managing and operating the national target programs.
2. Based on the five-year and ten-year socio-economic development directions of the State and proposals from ministries, sectors, central agencies, and localities, take the lead and coordinate with the Ministry of Finance to select and establish a list of national target programs and propose the management agencies for these programs, to be reported to the Government for review and submission to the National Assembly for approval.
3. Take the lead and coordinate with the Ministry of Finance and relevant ministries, sectors, central agencies, and localities to evaluate the national target programs and submit them to the Prime Minister for approval.
4. Take the lead and coordinate with the Ministry of Finance to propose the total budget allocation for specific national target programs (including both operational expenses and development investment capital) to be reviewed by the Government and submitted to the National Assembly for approval.
5. Take the lead and coordinate with ministries, sectors, central agencies, and localities to develop mechanisms for managing and operating the national target programs to be promulgated by the Government.
6. Participate with the agencies managing the national target programs in allocating program funds according to tasks and objectives.
Consolidate the funding sources of the national target programs allocated to ministries, sectors, central agencies, and provinces and centrally-administered cities into the overall plans of these agencies to be submitted to the Prime Minister for review and decision.
7. Provide information to the agencies managing the national target programs and localities regarding the direction for building annual plans for the national target programs.
8. Coordinate with the agencies managing the national target programs and relevant ministries and sectors to inspect and monitor the implementation of the national target programs by ministries, sectors, central agencies, and localities.
9. Summarize the implementation status of the national target programs (quarterly and annually), mid-term and final results, identify issues and challenges, and propose solutions, reporting to the Prime Minister and sending copies to the Ministry of Finance.
Article 15. The Ministry of Finance has the following responsibilities:
1. Coordinate with the Ministry of Planning and Investment to propose the total budget allocation for specific national target programs (including both operational expenses and development investment capital).
2. Allocate funds balanced within the central government's annual budget estimate to ministries, sectors, and central agencies to implement the national target program's objectives and tasks managed centrally.
Supplement targeted funds for provinces and centrally-administered cities according to the budget allocation plan for the national target programs.
Inspect and guide the agencies managing the national target programs to comply with current financial and accounting regulations.
3. Participate with the agencies managing the national target programs in allocating program funds according to tasks and objectives.
4. Organize inspections and monitoring of the implementation of national target program funds by ministries, sectors, central agencies, and localities.
5. Approve and notify the settlement of accounts for the national target program in the state budget settlement conducted by ministries, sectors, and central agencies.
Consolidate the settlement of accounts for the programs implemented by ministries, sectors, central agencies, and localities, report to the Prime Minister, and send copies to the Ministry of Planning and Investment.
Article 16. The agency managing the national target program has the following responsibilities:
1. Take the lead and coordinate with relevant ministries, sectors, central agencies, and provinces and centrally-administered cities to organize the development of program content and projects under the program, and submit them to the Ministry of Planning and Investment and the Ministry of Finance for evaluation and submission to the Prime Minister for approval.
2. Establish a Program Steering Committee to assist the head of the managing agency in organizing the implementation of the program; dissolve the Program Steering Committee when the program ends.
The head of the national target program is a leader of the management agency of the national target program. Members of the Steering Board include representatives with authority from the following departments: planning, finance, and other relevant departments.
The operational regulations of the Steering Board of the national target program shall be decided by the management agency of the national target program.
The operating funds of the Steering Board of the national target program shall be allocated within the regular operating budget of the management agency of the national target program.
For national target programs of particular importance, the Steering Board of the national target program must have members from relevant central ministries, sectors, and agencies.
The composition and operational regulations of the Steering Board of this national target program shall be decided by the Prime Minister.
Annually, the management agency of the national target program is responsible for developing plans regarding objectives, tasks, financial requirements, and proposals for implementing solutions of the national target program to be submitted to the Ministry of Planning and Investment and the Ministry of Finance for consolidation and submission to the Government.
Based on the total financial allocation of the program announced by the competent authority, the management agency of the national target program shall take the lead and coordinate with the Ministry of Planning and Investment and the Ministry of Finance to propose the allocation of the program's budget, both in terms of structure and specific budget allocations for relevant ministries, sectors, central agencies, and provinces/cities directly under the Central Government, in accordance with approved objectives and tasks (in cases where there are differing opinions on the specific structure and capital allocations for implementing units, the opinion of the program management agency shall prevail).
Documents detailing the objectives, tasks, and budgets of the programs shall be sent to the Ministry of Planning and Investment and the Ministry of Finance for consolidation into the general budget of relevant ministries, sectors, central agencies, and provinces/cities directly under the Central Government, to be decided by the Prime Minister.
Responsible for finalizing the financial settlement of the national target program directly implemented.
Responsible for using the national target program's funds for their intended purposes, effectively, and without loss.
Take the lead and coordinate with functional agencies to develop regulations, policies, and guidelines for relevant ministries, sectors, central agencies, and provinces/cities directly under the Central Government to provide a basis for implementation.
Direct provincial sectoral agencies to cooperate with the Provincial Department of Planning and Investment to develop annual plans for the national target program (objectives, tasks, budget, organizational measures for implementation) to be consolidated into the province's overall socio-economic development plan.
Guide provincial People's Committees to develop annual plans for the national target program (objectives, tasks, budget, organizational measures for implementation); ensure full reporting on the implementation of the national target program according to established regulations.
Supervise and monitor the implementation of the national target program by relevant ministries, sectors, central agencies, and provinces/cities directly under the Central Government.
Regularly (quarterly, annually, mid-term, end-of-program) consolidate the implementation status of the national target program by relevant ministries, sectors, central agencies, and provinces/cities directly under the Central Government, report to the Prime Minister, the Ministry of Planning and Investment, and the Ministry of Finance.
Article 17. Ministries, sectors, and central agencies participating in managing and implementing projects of the national target program have the responsibility to:
Annually, based on guidance from the national target program management agencies, the Ministry of Planning and Investment, and the Ministry of Finance, develop plans to implement objectives and tasks, propose resources to implement assigned national target program projects, submit to the national target program management agency, the Ministry of Planning and Investment, and the Ministry of Finance.
Be responsible for implementing the annual plan in accordance with the objectives, tasks, and progress of assigned projects.
Be responsible for managing and settling accounts for the direct implementation of the national target program's budget according to current financial regulations.
Responsible for using the national target program's funds for their intended purposes, effectively, and without loss.
In addition to allocated funds, they are permitted to mobilize other resources in accordance with the law to supplement the implementation of national target program projects.
Report additional funding levels (if any) to the national target program management agency.
Consolidate the implementation status of assigned national target program projects according to specified content, forms, and timeframes (quarterly, annually, mid-term, end-of-program), report to the Prime Minister, the national target program management agency, the Ministry of Planning and Investment, and the Ministry of Finance.
Article 18. The Chairperson of the People's Committee of provinces/cities directly under the Central Government has the responsibility to:
Uniformly manage resources, direct, and organize the implementation of objectives and tasks of national target programs in their jurisdiction.
Establish a Steering Committee for national target programs at the local level to manage, plan, integrate, and organize the implementation of national target programs in their jurisdiction.
The Chairman of the Steering Committee is a leader of the People's Committee of the province/city directly under the Central Government. The Standing Committee of the Steering Committee is led by the leadership of the Provincial Department of Planning and Investment, with members being representatives of leaders from related Departments, Bureaus, and Sectors.
Each province/city shall only establish one Steering Committee to centrally manage all national target programs in their jurisdiction.
The operational regulations of the Steering Committee shall be decided by the Chairperson of the People's Committee of the province/city directly under the Central Government.
The operating funds of the Steering Committee shall be guaranteed by the local budget.
3. Annually, based on the guidance of the agencies managing the national target programs, the Ministry of Planning and Investment, and the Ministry of Finance, direct the Department of Planning and Investment to coordinate with relevant departments and sectors to develop plans for national target programs within their jurisdiction (objectives, tasks, proposals for resource allocation, organizational measures, mechanisms, and policies) and submit them to the agency managing the national target programs, the Ministry of Planning and Investment, and the Ministry of Finance.
4. Organize the appraisal and approval of projects under national target programs managed by localities in accordance with current regulations.
5. Organize the integration and coordination of resources from national target programs and projects managed by localities to avoid overlap, reduce management levels, and concentrate resources on priority objectives.
6. In addition to the central budget allocated, organize the mobilization of local resources (including funds, labor days, and other material factors) to supplement the implementation of the program.
Report additional funding for each program (if applicable) to the agency managing the program.
7. Assign targets, tasks, and budgets for national target programs managed by localities within their jurisdiction to project leaders and district and county People's Committees for implementation.
8. Be responsible for the use of funds for national target programs according to assigned objectives and tasks within their jurisdiction, ensuring they are used for their intended purposes effectively without waste; be responsible for managing and implementing financial settlements in accordance with current financial regulations.
9. Organize inspections and supervision of the implementation of national target programs at the grassroots level.
Promptly correct any errors in the implementation of the program.
Severely handle cases of fund loss due to negligence or corruption.
10. Summarize the implementation status of national target programs within their jurisdiction according to specified content, formats, and deadlines (quarterly, annually, mid-term, end-of-program), and report to the Prime Minister, the Ministry of Planning and Investment, the Ministry of Finance, and the agency managing national target programs.
V. Assignment of Targets and Plans for Programs

Article 19. The Prime Minister assigns the Ministries, ministerial-level agencies, government agencies, central agencies, and provinces and centrally-administered cities the following targets:
1. Total funding for all national target programs; including development investment capital and operating expenses;
2. Objectives and tasks of each national target program implemented within their jurisdiction.
Article 20. Based on the total budget estimate and the objectives and tasks of national target programs assigned by the Prime Minister, the Chairpersons of the People's Committees of provinces and centrally-administered cities shall proactively integrate and allocate funding for each objective and task of national target programs, and submit the funding plan (including both centrally-supported funds and locally-raised funds) and the objectives and tasks of each national target program to the Ministry of Planning and Investment, the Ministry of Finance, and the agency managing national target programs.
The Ministry of Finance will base its disbursement and settlement on the funding plan allocated to each national target program of the localities.
VI. Implementation Provisions.
Article 21. This Decision shall take effect from the date of signing.
This Decision replaces Decisions No. 531/TTg dated August 8, 1996 of the Prime Minister on the management of national programs; No. 05/1998/QĐ-TTg dated January 14, 1998 on the management of national target programs; and No. 38/2000/QĐ-TTg dated March 24, 2000 amending and supplementing certain provisions of Decision No. 531/TTg dated August 8, 1996.
National target programs identified in Decision No. 71/2001/QĐ-TTg dated May 4, 2001 of the Prime Minister shall be implemented in accordance with the provisions of this Decision.
Article 22. The Ministry of Planning and Investment shall coordinate with the Ministry of Finance to guide the implementation of this Decision.
Article 23. Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of People's Committees of provinces and centrally governed cities are responsible for implementing this Decision./.
