CIRCULAR
Regulations on the appointment, recognition, reappointment, and re-recognition of the directors of vocational colleges and intermediate vocational schools and the directors of vocational training centers.

Pursuant to the Vocational Training Law dated November 29, 2006;
Pursuant to Decree No. 186/2007/NĐ-CP dated December 25, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor - War Invalids and Social Affairs;
Pursuant to Resolution No. 48/NQ-CP dated December 9, 2010 of the Government on simplifying administrative procedures within the scope of the Ministry of Labor, Invalids and Social Affairs' functions.
The Ministry of Labor, Invalids and Social Affairs hereby stipulates regulations on the appointment, recognition, reappointment, and re-recognition of the directors of vocational colleges and intermediate vocational schools and vocational training centers as follows:
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Circular stipulates the conditions, procedures, and steps for the appointment, recognition, reappointment, and re-recognition of the directors of vocational colleges and intermediate vocational schools and the directors of vocational training centers.
Article 2. Applicability
1. This Circular applies to public and private vocational colleges and intermediate vocational schools (hereinafter referred to as "schools") and public and private vocational training centers (hereinafter referred to as "centers").
2. This Circular does not apply to vocational colleges and intermediate vocational schools and vocational training centers with foreign investment capital.
Article 3. Principles of Appointment, Recognition, Reappointment, and Re-recognition
1. Implementing the principle of centralized democracy, promoting the responsibility of the school director/center director.
2. Starting from the requirements and tasks of the school/center and the capabilities of cadres.
3. Ensuring stability, continuity, and development of the cadre team, improving the quality and effectiveness of school/center operations.
4. When the term of office of the school director/center director expires, they must be considered for reappointment or re-recognition or not reappointed or recognized again.
5. School directors appointed, recognized, reappointed, or re-recognized must meet the criteria specified in Clause 1 of Article 46 of the Vocational Training Law and the conditions specified in Article 4, Clause 1 of Article 12, and Clause 1 of Article 13 of this Circular.
Chapter II
CONDITIONS FOR APPOINTING AND RECOGNIZING THE DIRECTORS OF VOCATIONAL COLLEGES AND INTERMEDIATE VOCATIONAL SCHOOLS AND THE DIRECTORS OF VOCATIONAL TRAINING CENTERS
Article 4. Conditions for Appointing and Recognizing the Directors of Vocational Colleges and Intermediate Vocational Schools
1. For public school directors: The initial age for appointment shall not exceed 55 years old for males and 50 years old for females; each term of appointment lasts five years and shall not exceed two consecutive terms.
2. For private school directors: They must ensure that they are not civil servants or state employees; each term of recognition lasts five years.

Section I
PROCEDURES, DOCUMENTS, AND AUTHORITY FOR APPOINTING THE DIRECTORS OF PUBLIC VOCATIONAL COLLEGES AND INTERMEDIATE VOCATIONAL SCHOOLS AND THE DIRECTORS OF PUBLIC VOCATIONAL TRAINING CENTERS
Article 6. Appointment Procedures
1. Schools/Centers that need to appoint a principal/director must submit to the competent authority for approval of the policy, clearly stating the requirements for the appointment.
2. After receiving agreement from the competent authority, the school/center leadership shall propose specific personnel according to the following procedures:
a) For internal personnel sources
b) For external personnel sources
c) For the first principal/director of newly established vocational colleges, intermediate vocational schools, and training centers
Article 7. Application Documents for Appointment
The application documents for appointment consist of one set, including:
1. For internal personnel sources
a) A proposal requesting the authorized person to decide on the appointment, in accordance with Model No. 1 issued together with this Circular;
b) Minutes of the meeting of key cadres, in accordance with Model No. 2 issued together with this Circular;
c) Minutes of the joint meeting proposing the appointment, in accordance with Model No. 3 issued together with this Circular;
d) A self-declared curriculum vitae of the proposed appointee according to Model 2a-BNV/2007 issued together with Decision No. 06/2007/QĐ-BNV dated June 18, 2007 of the Ministry of Home Affairs on the components of cadres' and civil servants' files and management forms for cadres' and civil servants' files; a declaration of assets and income according to Model 1 issued together with Decree No. 37/2007/NĐ-CP dated March 9, 2007 of the Government on transparency of assets and income, and accompanying educational certificates and training certificates of the proposed appointee;
đ) An evaluation and assessment report by the school/center leadership collective regarding the proposed appointee, in accordance with Model No. 5 issued together with this Circular;
e) Comments from the local party committee or government where the proposed appointee resides.
2. For external personnel sources or the first principal/director of newly established schools/centers
a) A proposal requesting the authorized person to decide on the appointment, in accordance with Model No. 6 issued together with this Circular;
b) A self-declared curriculum vitae of the proposed appointee according to Model 2a-BNV/2007 issued together with Decision No. 06/2007/QĐ-BNV dated June 18, 2007 of the Ministry of Home Affairs on the components of cadres' and civil servants' files and management forms for cadres' and civil servants' files; a declaration of assets and income according to Model 1 issued together with Decree No. 37/2007/NĐ-CP dated March 9, 2007 of the Government on transparency of assets and income, and accompanying educational certificates and training certificates of the proposed appointee;
c) An evaluation and assessment report by the collective of the agency/unit where the proposed appointee is currently working, in accordance with Model No. 7 issued together with this Circular;
d) Comments from the local party committee or government where the proposed appointee resides.
Article 8. Time Limit and Authority to Decide on Appointment
Within twenty working days from the date of receipt of complete and valid application documents for appointment, the Minister, Head of a ministry equivalent to a ministry, Head of a government agency, Leader of the central agency of political-social organizations, Chairman of the People's Committee of a province or centrally governed city (hereinafter referred to as the Chairman of the Provincial People's Committee) shall issue a decision to appoint the principal of a vocational college/director of a training center under their jurisdiction.
PART II
PROCEDURES, DOCUMENTS AND AUTHORITY FOR RECOGNITION OF PRINCIPALS OF VOCATIONAL COLLEGES, INTERMEDIATE VOCATIONAL SCHOOLS, AND DIRECTORS OF PRIVATE TRAINING CENTERS
Article 9. Selection of Principals
1. For private vocational colleges and private vocational secondary schools, the board of directors or the individual owner of the school shall select the principal based on the criteria and conditions for appointing and recognizing principals stipulated in Clause 1 of Article 46 of the Vocational Training Law and Clause 2 of Article 4 of this Circular, and propose to the competent authority specified in Article 11 of this Circular to recognize.
2. For private vocational training centers established by organizations or individuals contributing capital or by the individual owner of the center, they shall select the director based on the criteria and conditions for appointing and recognizing directors stipulated in Clause 1 of Article 45 of the Vocational Training Law and Clause 2 of Article 5 of this Circular, and propose to the competent authority specified in Article 11 of this Circular to recognize.
Article 10. Application Documents for Recognition
The application documents for recognition consist of one set, including:
1. A letter from the board of directors or the individual owner of the school/organization or individuals contributing capital to establish the center or the individual owner of the center proposing the competent authority to recognize, according to Model No. 8 issued together with this Circular.
2. Minutes of the meeting of the board of directors of the school/organization or individuals contributing capital to establish the center, according to Model No. 9 issued together with this Circular.
3. Curriculum vitae of the person proposed, self-declared in accordance with Form 2a-BNV/2007 issued together with Decision No. 06/2007/QĐ-BNV dated June 18, 2007 of the Ministry of Home Affairs on the issuance of the components of the cadre and civil servant file and management forms for cadre and civil servant files (with confirmation from the People's Committee of the commune where the person resides) and certificates of education and training of the person proposed for recognition attached.
Article 11. Time Limit and Competent Authority for Recognition
1. Within twenty working days from the date of receipt of complete and valid application documents for recognizing the principal of a private vocational secondary school proposed by the board of directors or the individual owner of the school; or the director of a private vocational training center proposed by the organization or individuals contributing capital to establish the center or the individual owner of the center, the Chairman of the Provincial People's Committee shall issue a decision recognizing the principal of a private vocational secondary school/director of a private vocational training center within their jurisdiction.
2. Within twenty working days from the date of receipt of complete and valid application documents for recognizing the principal of a private vocational college proposed by the board of directors or the individual owner of the school, the Minister of Labor, Invalids and Social Affairs shall issue a decision recognizing the principal of a private vocational college.
Section III
CONDITIONS, PROCEDURES, APPLICATION DOCUMENTS, AND COMPETENT AUTHORITY FOR REAPPOINTING THE PRINCIPAL OF VOCATIONAL COLLEGES AND VOCATIONAL SECONDARY SCHOOLS AND THE DIRECTOR OF VOCATIONAL TRAINING CENTERS
Article 12. Reappointment
1. Conditions for Reappointment
a) Completion of tasks during the term of office;
b) Meeting the qualification standards for principal/director at the time of reappointment review, capable of fulfilling work requirements in the future;
c) The school/center has a need;
d) Being in good health to fulfill assigned tasks and responsibilities;
đ) The principal/director proposed for reappointment must have completed one term of office, in cases where the remaining years until retirement age is less than five years, the term of reappointment will be calculated up to the retirement age as prescribed.
2. Procedures for Reappointment
a) The principal/director proposed for reappointment must write a personal responsibility self-assessment during the term of office;
b) Organize a meeting of key cadres chaired by the leadership of the school/center to discuss and deliberate on the conditions for reappointment; provide comments and evaluate the performance of the principal/director during the term of office.
c) Organize a joint meeting chaired by the head or deputy head of the school/center including the Secretary of the Party Committee (or Secretary of the Branch), the leadership team of the school/center to discuss and vote. The person proposed for reappointment must be approved by the majority of members in the meeting.
3. Application Documents for Reappointment
a) Personal responsibility self-assessment during the term of office, according to Model No. 10 issued together with this Circular;
b) Comments and evaluations of the principal/director by the leadership team of the school/center and the Party committee, according to Model No. 11 issued together with this Circular;
c) Minutes of the meeting of key cadres, according to Model No. 12 issued together with this Circular;
d) Minutes of the joint meeting proposing reappointment, according to Model No. 13 issued together with this Circular;
đ) A letter (proposal) from the leadership of the school/center proposing the competent authority to decide on reappointing the principal of the school/director of the center, according to Model No. 14 issued together with this Circular.

ARTICLE 13. RECOGNITION AGAIN
1. CONDITIONS FOR RECOGNITION AGAIN
b) Meeting the standards for the title of principal/director as prescribed at the time of re-recognition, and able to meet future work requirements;
a) Completion of tasks during the term of office;
d) Being in good health to fulfill assigned tasks and responsibilities.
c) The school/center has a need;
2. PROCEDURES FOR RECOGNITION AGAIN
a) Principals/directors who are recognized again must prepare a personal self-assessment report during their tenure;
b) The board of directors or individual owner of the school/organization or the founders of the center or the individual owner of the center shall review, evaluate, and propose to the competent authority to recognize again or not to recognize again.
3. DOCUMENTS FOR RECOGNITION AGAIN
a) A letter (proposal) from the board of directors or individual owner of the school/organization or the founders of the center or the individual owner of the center proposing the competent authority to recognize again the principal/director,
according to Model No. 16 issued together with this Circular; b) A personal self-assessment report during the tenure,
according to Model No. 17 issued together with this Circular; c) A review and evaluation report from the board of directors or individual owner of the school/organization or the founders of the center or the individual owner of the center,
according to Model No. 18 issued together with this Circular. 4. TIME LIMIT AND AUTHORITY FOR RECOGNITION AGAIN
a) Within 20 working days from the date of receiving complete and valid documents proposing recognition again of the principal of a private vocational secondary school from the board of directors or individual owner of the school; or proposing recognition again of the director of a private vocational training center from the organization or the founders of the center or the individual owner of the center, the Chairman of the Provincial People's Committee shall issue a decision to recognize again the principal of a private vocational secondary school/director of a private vocational training center within its jurisdiction;
b) Within 20 working days from the date of receiving complete and valid documents proposing recognition again of the principal of a private vocational college from the board of directors or individual owner of the school, the Minister of Labor, Invalids and Social Affairs shall issue a decision to recognize again the principal of a private vocational college.
- The school council/leadership team of the center discusses, selects, and proposes personnel options based on the cadre planning source or the recommendation of key staff members of the school/center, potentially recommending from one to three individuals for selection.
- Organize a meeting of key staff members chaired by the head or deputy head of the school/center to exchange and discuss the appointment requirements, criteria, and conditions; announce the list of recommended candidates; summarize the candidate's curriculum vitae, educational and work history, strengths, weaknesses, development prospects, and evaluations.
The meeting collects opinions on the appointment through secret ballot voting,
according to Model No. 4 issued together with this Circular (the endorsement vote serves as a reference and is not the sole basis for appointment). The meeting elects a counting committee consisting of three people who are not among those being voted on. The counting committee includes a chairperson and two members. The counting record must be signed by the chairperson and the two members. - Organize a joint meeting chaired by the head or deputy head of the school/center including the Secretary of the Party Committee (or Branch Secretary), the leadership team of the school/center to discuss and vote. The proposed appointee must be approved by a majority of the meeting participants.
- The organizational cadres department under the Ministry, the equivalent ministry, the central body of political-social organizations, or the provincial-level People's Committee (hereinafter referred to as the provincial-level People's Committee) introduces personnel meeting the appointment criteria and conditions.
- Representatives of the organizational cadres department under the Ministry, the equivalent ministry, the central body of political-social organizations, or the provincial-level People's Committee work with the party committee and leadership of the agency or unit where the proposed appointee is currently working to understand and verify the candidate's background and exchange views on the need for appointment with the agency or unit.
- Based on the results of understanding and verifying the candidate's background and the opinion of the agency or unit where the proposed appointee is currently working, the organizational cadres department under the Ministry, the equivalent ministry, the central body of political-social organizations, or the provincial-level People's Committee seeks the opinion of the party committee of the agency to unify the appointment of the principal/director; discuss, evaluate, and vote.
- The organizational cadres department under the Ministry, the equivalent ministry, the central body of political-social organizations, or the provincial-level People's Committee proposes to the competent authority to consider and decide on the appointment.
Based on the appointment criteria and conditions for principals/directors stipulated in Clause 1 of Article 45, Clause 1 of Article 46 of the Vocational Training Law and the conditions specified in Articles 4 and 5 of this Circular, the organizational cadres department under the Ministry, the equivalent ministry, the central body of political-social organizations, or the provincial-level People's Committee selects and proposes to the competent authority stipulated in Article 8 of this Circular to consider and decide on the appointment.
Principals/directors considered for reappointment must meet the following conditions:

Within twenty working days from the date of receiving complete and valid files for reappointment, the Minister, Head of a ministry-level agency, Head of a government-affiliated agency, Head of the central body of a political-social organization, and Chairman of the People's Committee at the provincial level shall issue a decision on reappointing the principal of the school/director of the training center.
If the principal/director does not meet the conditions for reappointment upon expiration of the term, the person authorized to appoint shall issue a decision to assign other work.

IMPLEMENTATION
Article 14. Effectiveness and Responsibility for Implementation
1. This Circular takes effect forty-five days from the date of issuance and revokes Decision No. 59/2008/QĐ-BLĐTBXH dated July 18, 2008 issued by the Minister of Labor, Invalids, and Social Affairs regarding the regulations on appointment, confirmation, reappointment, reconfirmation, removal, resignation, and voluntary resignation of principals of vocational colleges and secondary vocational schools and directors of training centers.
2. Based on the provisions of this Circular, the Ministers, Heads of ministry-level agencies, Heads of government-affiliated agencies, Heads of central bodies of political-social organizations with vocational training facilities; Chairmen of People's Committees at provincial and centrally-administered city levels; Directors of Departments of Labor, Invalids, and Social Affairs at provincial and centrally-administered city levels; Principals of vocational colleges and secondary vocational schools, Directors of training centers, and Heads of related units are responsible for implementing this Circular.
3. During implementation, any arising issues or difficulties (if any) should be promptly reported to the Ministry of Labor, Invalids, and Social Affairs for study, supplementation, and amendment.
