Regulations on the List of Goods Produced from Neighboring Countries for Import into the Socialist Republic of Vietnam under the Form of Purchase, Sale, and Exchange of Border Residents' Goods

Pursuant to Decree No. 95/2012/NĐ-CP dated November 12, 2012, of the Government, detailing the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;

Pursuant to Decision No. 254/2006/QĐ-TTg dated November 7, 2006 of the Prime Minister on the management of border trade activities with neighboring countries, which has been amended and supplemented by Decision No. 139/2009/QĐ-TTg dated December 23, 2009 of the Prime Minister;

After reaching consensus with relevant ministries, sectors, and People's Committees of border provinces, the Ministry of Industry and Trade promulgates the List of goods permitted for import into the Socialist Republic of Vietnam under the form of purchase, sale, and exchange of border residents' goods as follows:

Article 1. List of goods produced from neighboring countries for import into the Socialist Republic of Vietnam under the form of purchase, sale, and exchange of border residents' goods

Clause 1. The List of goods produced from neighboring countries for import into the Socialist Republic of Vietnam under the form of purchase, sale, and exchange of border residents' goods is specified in the Appendix attached to this Circular.

Clause 2. Goods not specified in this Circular shall not be imported into the Socialist Republic of Vietnam under the form of purchase, sale, and exchange of border residents' goods.

Article 2. Limitations and Supplemental Goods

Clause 1. In cases where it is necessary to ensure food safety, prevent cross-border diseases, or national food security, the Minister of Industry and Trade, after reaching consensus with members of the Border Trade Steering Committee, issues a decision prohibiting border residents from importing certain goods listed in Clause 1 of Article 1 of this Circular at specific border gates, specific provinces, or along the entire border line.

Clause 2. In cases where it is necessary to promote production or supply essential goods for daily life of border residents or due to natural disasters or epidemics, the Minister of Industry and Trade, after reaching consensus with members of the Border Trade Steering Committee, issues a decision allowing border residents to import and enjoy tax-free quotas for certain goods not listed in Clause 1 of Article 1 of this Circular at specific border gates, specific provinces, or along the entire border line.

Article 3. Effectiveness

Article 1. This Circular takes effect from March 1, 2013, and replaces Circular No. 10/2010/TT-BCT dated March 29, 2010 of the Ministry of Industry and Trade on goods produced from neighboring countries for import into the Socialist Republic of Vietnam under the form of purchase, sale, and exchange of border residents' goods during the period 2010-2012.

Clause 2. During the period when this Circular is not yet effective, from January 1, 2013 to February 28, 2013, Circular No. 10/2010/TT-BCT dated March 29, 2010 of the Ministry of Industry and Trade on goods produced from neighboring countries for import into the Socialist Republic of Vietnam under the form of purchase, sale, and exchange of border residents' goods during the period 2010-2012 shall continue to be implemented.

Clause 3. In the course of implementation, if there are difficulties or obstacles, they should be reported to the Ministry of Industry and Trade for timely consideration and resolution.
