Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Labor Code dated June 23, 1994; Law Amending and Supplementing Certain Provisions of the Labor Code dated April 2, 2002; Law Amending and Supplementing Certain Provisions of the Labor Code dated June 29, 2006;

Pursuant to Decree No. 205/2004/NĐ-CP dated December 14, 2004 of the Government stipulating the wage scale and wage system and the allowance regime in state-owned enterprises;

The Prime Minister promulgates this Decision amending the name and amending and supplementing Article 1 of Decision No. 234/2005/QĐ-TTg dated September 26, 2005 of the Prime Minister on special regimes for workers, staff, and officials in certain industries and occupations within state-owned enterprises,

Article 1. Amending the name of Decision No. 234/2005/QĐ-TTg dated September 26, 2005 of the Prime Minister on special regimes for workers, staff, and officials in certain industries and occupations within state-owned enterprises (hereinafter referred to as Decision No. 234/2005/QĐ-TTg) to "Decision on Special Regimes for Workers, Staff, and Officials Managing Certain Industries and Occupations in State-Owned Limited Liability Companies"

Article 2. Amending and supplementing Article 1 of Decision No. 234/2005/QĐ-TTg as follows:

"Article 1. Regulations on certain special regimes applicable to workers, staff, and officials managing working in certain industries and occupations in state-owned limited liability companies are as follows:
1. A daily meal allowance calculated in monetary terms based on actual working days includes:
a) VND 77,000/day applicable to: Light signal workers from sea gate to port; workers and employees during marine survey, photography work to establish topographic maps, marine maps.
b) VND 93,000/day applicable to: Underground mining workers; underground mining electrical workers; underground mining machinery operators; locomotive drivers and locomotive assistant drivers; workers and employees engaged in coal transportation, loading, unloading, and delivery at sea; seafarers on cargo ships, construction ships, buoy-laying ships, geophysical ships, escort ships, service ships, supply ships working at sea; maritime pilots (excluding those specified in Point c Clause herein); air traffic controllers; employees directly operating, repairing communication equipment; air traffic information officers; air traffic coordination officers; aircraft maintenance technicians; flight technicians and cabin crew; aerial photography team members.
c) VND 108,000/day applicable to: Divers; seafarers on fishing vessels, transport vessels with a power of 800 horsepower or more; salvage ships, search and rescue ships; maritime pilots performing duties guiding oil tankers from offshore platforms.
d) VND 170,000/day applicable to: Aircraft cockpit crew; workers and employees working on ocean-going vessels during overseas trips; underground miners working in shafts deeper than 100 meters; workers and employees working at ship channels, lighthouse stations (except those already subject to meal allowances as provided in Point đ Clause herein).
đ) VND 232,000/day applicable to: Vietnamese workers and employees working on offshore platforms, oil and gas service vessels, lighthouse stations in the Spratly Islands, and lighthouse stations located more than 20 nautical miles from the mainland. The aforementioned meal allowance, employees contribute 30% from their salary, while the enterprise covers the remaining 70%, which is accounted for in production costs or business expenses. Employees receiving meal allowances shall not be entitled to meal allowances during work hours, nor to hardship and hazardous work allowances in kind as prescribed.
2. Safety bonus at two rates of 15% and 20% of the salary grade and position, applicable to workers and employees in certain occupations with special working conditions. The application of the safety bonus is specified in the Appendix attached hereto.
3. Diver allowance ranging from 0.1 to 1.0 times the general minimum wage stipulated by the Government, applicable to divers diving deeper than 3 meters, with the allowance applied according to the actual diving time.
4. Sea allowance of VND 232,000/day applicable to: Workers and employees during actual working days on offshore platforms, oil and gas service vessels, offshore construction projects, salvage and rescue ships, construction ships, buoy-laying ships, escort and service ships, supply ships working at sea, ship channel operation; workers and employees operating lighthouses on remote islands; maritime pilots performing duties guiding ships at sea.

Article 3. Implementation Provisions

1. This Decision takes effect from December 1, 2012.

2. Abolish Article 1 of Decision No. 234/2005/QĐ-TTg and Decision No. 72/2008/QĐ-TTg dated May 30, 2008 of

3. The Ministry of Labor, Invalids and Social Affairs, the Ministry of Finance shall guide the implementation of this Decision.

4. Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial and centrally-administered city People's Committees, leaders of state-owned limited liability companies, and related units are responsible for implementing this Decision./.
