CIRCULAR

Article 24regulating technical classification of inland waterways

Pursuant to the Road Traffic Law promulgated on November 13, 2008; đinland waterways June 15, 2004, and the Law Amending and Supplementing Certain Articles of the Inland waterway transport dated June 17, 2014;

Pursuant to Decree No. 107/2012/NĐ-CP dated December 20, 20122 của Chính phủ quy định chức năng, nhiệm vụ, quyền hạn và cơ cấu tổ chức của Bộ Giao thông vận tải;

the Director the proposal of the Director of Infrastructure Department and the Director of The Minister of Transport issues this Circular on the identification and handling of dangerous locations on inland waterways;

The Minister of Transport hereby promulgates this Circular on technical classification of inland waterways.

This Circular stipulates the technical classification of inland waterways.

This Circular applies to organizations and individuals related to management, investment, construction, maintenance, and exploitation of inland waterway transport.

Article 3. Explanation of Terms

1. The dimensions of inland waterways refer to the depth, width, and radius of curvature of navigation channels corresponding to each technical grade of inland waterways.

2. Special technical grade inland waterways are those inland waterways whose technical grade is calculated based on design vessels and above Grade I.

3. Restricted technical grade inland waterways are those inland waterways where one or more actual dimensions of the waterway are smaller than the minimum values specified for the corresponding technical grade.

1. The technical grades of inland waterways are determined based on:

a) National Standard TCVN 5664:2009 on Technical Classification of Inland Waterways;

b) Master plans for the development of inland waterway infrastructure approved by competent authorities;

c) Current conditions of inland waterways (depth, width, radius of curvature).

2. The dimensions of inland waterways corresponding to each technical grade of inland waterways are specified in Appendix 1 of this Circular.

3. The technical grades of national inland waterway routes specified in Appendix 2 of this Circular shall be implemented according to the provisions in Appendix 2 of Circular No. 15/2016/TT-BGTVT dated June 30, 2016 issued by the Minister of Transport on the management of inland waterways.

4. Organizations and individuals exploiting inland waterway transport shall base their operations on the technical grades and navigation channel announcements issued by competent inland waterway management agencies pursuant to Circular No. 19/2016/TT-BGTVT dated June 30, 2016 issued by the Minister of Transport on surveys for managing and announcing inland waterway navigation channels.

Article 5. Responsibilities of Agencies and Organizations

1. The Vietnam Inland Waterway Administration is responsible for updating, supplementing, and compiling information to submit to the Ministry of Transport for decisions on setting and adjusting the technical grades of national inland waterways to ensure alignment with reality.

2. Provincial Departments of Transport have the responsibility to update, supplement, and compile information to submit to the People's Committees of provinces and centrally governed cities for decisions on setting and adjusting the technical grades of local inland waterways to ensure alignment with reality.

Article 6. Effectiveness

1. This Circular takes effect from February 1, 2017.

2. Repeal Circular No. 36/2012/TT-BGTVT dated September 13, 2012 issued by the Minister of Transport on technical classification of inland waterways.

3. In cases where referenced documents in this Circular are amended, supplemented, or replaced, they shall be applied according to the provisions in the amended, supplemented, or replaced documents.

Article 7. Implementation Organization

The Head of the Ministry’s Office, the Inspector General, Heads of Departments, the Director of the Vietnam Inland Waterway Administration, Directors of Provincial Departments of Transport, Heads of agencies, organizations, and individuals concerned are responsible for implementing this Circular./.
