Circular No. 46/2025/TT-BXD on announcing maritime areas of seaports and maritime zones within the jurisdiction of Da Nang City and under the management of Da Nang Port Maritime Administration

CIRCULAR

Issuing the maritime area of the seaport and the maritime zone within the jurisdiction of the city of

Da Nang and the management area of the Da Nang Marine Port Supervision Authority

On the basis of The Maritime Code of Vietnam dated November 25, 2015;

Decree No. Decree No. 58/2017/NĐ-CP dated May 10, 2017 of the Government detailing certain provisions of The Vietnam Maritime Code on maritime activity management and amendments to other decrees;

Decree No. Decree No. 33/2025/NĐ-CP dated February 25, 2025 of the Government stipulating the functions, tasks, authorities, and organizational structure of the Ministry of Construction;

At the proposal of the Director of the Vietnam Maritime and Inland Waterway Administration;

The Minister of Construction issues this Circular to announce the maritime area of the seaport and the maritime zone within the jurisdiction of the city of Da Nang and the management area of the Da Nang Marine Port Supervision Authority.

Article 1. Announcement of the port waters within the territory of Da Nang City

The maritime area of the seaport within the jurisdiction of the city of Da Nang includes the following areas:

1. The Danang Bay area with the scope:

a) The boundary towards the sea: limited by the straight line connecting points DN1, DN2, DN3, and DN4 with the following coordinates:

DN1: 16º12’37,7’’N, 108º12’17,4’’E (the southern edge of Son Tra Island);

DN2: 16º13’56,42’’N, 108º14’04,66’’E;

DN3: 16º10’42,4’’N, 108º16’37,14’’E;

DN4: 16º09’23,7’’N, 108º14’49,9’’E (the northwestern edge of Son Tra Peninsula).

b) The boundary towards the mainland: from point DN4 running along the shoreline of Danang Bay towards the west of Son Tra Peninsula, continuing through the lower limit of Man Quang Bridge and the shoreline of Danang Bay to point DN5 with the coordinates 16º06’40,7’’N, 108º13’29,4’’E.

From point DN5 connected by a straight line to point DN6 with the coordinates 16º06’34,9’’N, 108º13’05,3’’E (the green light of the North bank) from point DN6 connected by a straight line to point DN7 (located on the right bank of Han River counting from the sea) with the coordinates 16º05’41,8’’N, 108º12’56,5’’E.

From point DN7 running along the shoreline towards the west of Danang Bay through the Cape Nam O and Cape Isabelle, up towards the north of Danang Bay to point DN8 with the coordinates 16º12’37,7’’N, 108º11’34,4’’E (the eastern edge of Hai Van Pass, adjacent to Hue City); from point DN8 connected by a straight line to point DN9 with the coordinates 16º12’44,7’’N, 108º11’56,4’’E (the southwestern edge of Son Tra Island) and running along the southwestern shoreline of Son Tra Island, ending at point DN1.

2. The My Khe area with the scope:

a) The boundary towards the sea: limited by the straight lines connecting points MK1, MK2, MK3, and MK4 with the following coordinates:

MK1: 16º03’09,7’’N, 108º14’50,4’’E;

MK2: 16º03’09,7’’N, 108º18’06,4’’E;

MK3: 16º05’12,7’’N, 108º18’06,4’’E;

MK4: 16º05’12,7’’N, 108º14’52,4’’E.

b) The boundary towards the mainland: starting from point MK1 to point MK4.

3. The Ky Ha area with the scope:

a) Seaward boundary:

Limited by the straight lines connecting points KH1, KH2, KH3, KH4, KH5 with the following coordinates:

KH1: 15º30’21,8”N, 108º37’53,5”E;

KH2: 15º34’09,8”N, 108º37’53,5”E;

KH3: 15º34’09,8”N, 108º43’23,5”E;

KH4: 15º27’03,7”N, 108º43’23,5”E;

KH5: 15º27’03,7”N, 108º41’45,5”E.

b) The boundary towards the mainland:

From point KH5 running along the shoreline towards the north through the Cape of Ky Ha Lighthouse to point KH6 with the coordinates 15º29’00,2”N, 108º40’57,5”E (Elgas Port), continuing along the shoreline of Ky Ha Channel to point KH7 with the coordinates 15º28’28,4”N, 108º40’54,3”E, continuing along the shoreline towards the southwest to point TG1 with the coordinates 15º27’46,8”N, 108º39’56,1”E.

From point TG1 connected by a straight line to point TG2 with the coordinates 15º27’46,7”N, 108º39’35,1”E continuing along the shoreline towards the northwest through the Fisheries Port, then running along the shoreline towards the south of Ben Van River to point TG3 with the coordinates 15º27’00,1”N, 108º38’24,9”E.

From point TG3 connected by a straight line to point TG4 with the coordinates 15º27’27,2”N, 108º37’19,2”E.

From point TG4 continuing along the shoreline in the north direction passing through Chu Lai Port to point TH1 with the coordinates 15º29’04,7”N, 108º36’30,0”E. From point TH1 connected by a straight line to point TH2 with the coordinates 15º29’08,5”N, 108º36’27,1”E.

From point TH2 running along the shoreline towards the northeast to point TH3 with the coordinates 15º29’34,8”N, 108º38’22,5”E. From point TH3 connected by a straight line to point TH4 with the coordinates 15º29’42,1”N, 108º38’28,2”E.

From point TH4 running along the shoreline towards the northeast connecting with point KH1.

4. The Cu Lao Cham area with the scope:

Limited by the straight lines connecting points CLC1, CLC2, CLC3, and CLC4 with the following coordinates:

CLC1: 15º54’01,3”N, 108º27’12,2”E;

CLC2: 15º54’54,4”N, 108º27’51,6”E;

CLC3: 15º53’36,3”N, 108º29’43,9”E;

CLC4: 15º52’43,2”N, 108º29’04,5”E.

5. The boundary of the maritime area of the seaport within the jurisdiction of the city of Da Nang is calculated based on the highest tidal water level, except for the beach section from point DN7 running along the shoreline towards the west of Danang Bay to the south of Nam O Bridge at point b Clause 1 of this Article and the beach section from point MK1 to point MK4 at point b Clause 2 of this Article, which are calculated based on the lowest mean annual water level.

6. The boundary of the maritime area of the seaport within the jurisdiction of the city of Da Nang stipulated in this Circular is determined on the nautical charts issued by Vietnam Maritime Safety Assurance Corporation, including: VN30012 updated latest in 2023; VN50051 updated latest in 2024 and VN50022 updated latest in 2025. The coordinates of the points specified in this Circular are applied according to the VN-2000 Coordinate System and converted to the WGS-84 Coordinate System as detailed in the Appendix attached to this Circular.

Article 2. Maritime areas within the jurisdiction of Da Nang City

The port waters within the jurisdiction of Da Nang City include two maritime areas:

1. Da Nang - My Khe maritime area.

2. Ky Ha - Cu Lao Cham maritime area.

Article 3. Management area of the Da Nang Port Maritime Service

The Da Nang Port Maritime Service manages the specialized maritime affairs at the ports within the jurisdiction of Da Nang City and the maritime areas specified in Article 2 of this Circular.

Article 4. Implementation provisions

1. This Circular takes effect from February 1, 2026.

2. Repeal Circular No. 02/2019/TT-BGTVT dated January 11, 2019 issued by the Minister of Transport announcing the port waters within the jurisdiction of Da Nang City and the management area of the Da Nang Port Maritime Service, and Circular No. 16/2019/TT-BGTVT dated May 3, 2019 issued by the Minister of Transport announcing the port waters within the jurisdiction of Quang Nam Province and the management area of the Quang Nam Port Maritime Service.

3. Repeal items 11 and 12 of the List of maritime areas under the management of the Port Maritime Services issued together with Circular No. 32/2019/TT-BGTVT dated September 4, 2019 issued by the Minister of Transport announcing the List of maritime areas under the management of the Port Maritime Services./.
