REGULATIONS ON THE TITLES, RANK CODES AND PROFESSIONAL STANDARDS OF RANKS FOR SPECIALIZED CIVIL SERVANTS IN CIVIL ENFORCEMENT
Circular No. 03/2017/TT-BTP dated April 5, 2017 issued by the Minister of Justice on titles, rank codes and professional standards for ranks of specialized civil servants in civil enforcement, which took effect from May 22, 2017, has been amended and supplemented by:
Circular No. 08/2020/TT-BTP dated December 28, 2020 issued by the Minister of Justice amending and supplementing certain articles of Circular No. 03/2017/TT-BTP dated April 5, 2017 issued by the Minister of Justice on titles, rank codes and professional standards for ranks of specialized civil servants in civil enforcement, which took effect from March 1, 2021;
Circular No. 06/2021/TT-BTP dated October 14, 2021 issued by the Minister of Justice abolishing some legal normative documents on cadre work in the field of civil enforcement issued by the Minister of Justice, which took effect from October 14, 2021.
Pursuant to the Law on Public Officials and Civil Servants dated November 13, 2008;
Pursuant to the Civil Enforcement Law 2008; the Law Amending and Supplementing Certain Provisions of the Civil Enforcement Law 2014;
Pursuant to Decree No. 123/2016/NĐ-CP dated September 1, 2016 of the Government stipulating the functions, tasks, powers and organizational structure of Ministries and ministerial-level agencies;
Pursuant to Decree No. 22/2013/NĐ-CP dated March 13, 2013, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Justice;
Pursuant to Decree No. 24/2010/NĐ-CP dated March 15, 2010 of the Government stipulating recruitment, utilization and management of civil servants;
Pursuant to Decree No. 62/2015/NĐ-CP dated July 18, 2015 of the Government detailing and guiding the implementation of certain articles of the Civil Enforcement Law;
Based on the consensus opinion of the Ministry of Home Affairs regarding the authority to issue and the content of this Circular stipulating titles, rank codes and qualification standards for ranks of specialized civil servants in civil enforcement and professional standards for ranks of specialized civil servants in civil enforcement atOfficial Document No. 5463/BNV-CCVC dated November 21, 2016;
At the proposal of the Director of the Civil Enforcement General Department;
The Minister of Justice issues this Circular stipulating titles, rank codes and qualification standards for ranks of specialized civil servants in civil enforcement and professional standards for ranks of specialized civil servants in civil enforcement as follows:[1]
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation and Applicability
Article 1. This Circular stipulates titles, rank codes and professional standards for ranks of specialized civil servants in civil enforcement, including Enforcement Officers, Reviewers, and Civil Enforcement Secretaries.
Article 2. This Circular applies to persons engaged in civil enforcement work under the General Department of Civil Enforcement, Provincial/City Civil Enforcement Departments directly under the Central Government, and District Civil Enforcement Departments.
Article 2.
The period of legal work applied within the civil enforcement agency system includes:
1. Total time worked in the following ranks: Court Clerk, Judicial Investigator, Judge; Prosecutor, Assistant Prosecutor; Investigator under Investigation Agencies in the Public Security Force, People's Army of Vietnam, Supreme People's Procuracy; Intermediate-level Detective, Intermediate-level Police Officer of the Public Security Force, Intermediate-level Detective of the Security Force; Officer Investigator, Security Officer in the People's Army of Vietnam; Civil Enforcement Officer, Civil Enforcement Reviewer, Civil Enforcement Secretary, Intermediate-level Civil Enforcement Secretary; Inspector;
2.[2] Time spent in the position of Specialist and equivalent or higher positions at job positions requiring a bachelor's degree in law or higher for civil servants and officials working at the Ministry of Justice, Department of Justice, Justice Office; civil enforcement system; court agencies, prosecution agencies, inspection agencies, audit agencies, internal affairs agencies, internal security agencies or at job positions directly performing legal drafting work, organizing the implementation of laws in agencies belonging to the political system;
3.[3] Time with a bachelor's degree in law or higher and holding leadership positions at Party Committees, People's Councils, People's Committees (at district level or higher);
4. Time obtaining a practicing certificate for lawyers and appointment to the title of Notary Public for Notaries.

Article 4. General Standards
1. Possess firm political resolve, steadfast in Marxism-Leninism, Ho Chi Minh Thought, grasp the Party's policies and guidelines; loyal to the State and the Constitution of the Socialist Republic of Vietnam; protect the interests of the country and the people.
2. Fully perform the duties of a civil servant as prescribed by law; strictly comply with the assignment of tasks by superiors; adhere to laws, maintain discipline and administrative order; set an example in following internal regulations and rules of the agency.
3. Devoted, responsible, honest, impartial, fair, and exemplary in performing public duties; courteous, cultured, and appropriate in communication and service to the people.

5. Continuously have a sense of learning and training to improve moral qualities, competence, and capabilities.

7.[4] Civil servants who register for the examination to upgrade their ranks or are considered for rank upgrading must meet the standards and conditions stipulated in Article 30 and Article 31 of Decree No. 138/2020/NĐ-CP dated November 27, 2020, issued by the Government on the recruitment, utilization, and management of civil servants, as well as other relevant legal provisions.
Chapter II
DUTIES, TASKS AND PROFESSIONAL STANDARDS OF THE EXECUTION OFFICER RANKS
Article 5. Senior Enforcement Officer Rank
1. Responsibilities
The Senior Enforcement Officer is the highest-ranking civil servant with expertise in civil enforcement and administrative enforcement, directly organizing enforcement, urging the execution of particularly complex civil enforcement and administrative enforcement cases involving various sectors, levels, localities, or foreign elements within the jurisdiction of the Civil Enforcement Agency.
2. Tasks
a) Implement the duties and powers prescribed in Article 20 of the Civil Enforcement Law;
b) Organize and direct the implementation of administrative enforcement work according to the law;
c) Lead the research, propose programs of work, organizational and operational issues of civil enforcement and administrative enforcement, measures for guidance and organization of enforcement work;
d) Guide, urge or assist the head of the enforcement agency in guiding and urging subordinate enforcement agencies under their jurisdiction to implement civil enforcement and the law on civil enforcement, administrative enforcement; receive citizens as prescribed;
d) Develop plans for civil enforcement and organize the implementation of decisions of the head of the enforcement agency regarding civil enforcement;
e) Provide guidance on enforcement procedures to Intermediate Enforcement Officers and Junior Enforcement Officers;
g) Assist the head of the civil enforcement agency in grasping the situation of enforcement work and compliance with the law in enforcement activities on the territory; organize summaries of practical enforcement work and propose solutions to improve the effectiveness of civil enforcement and administrative enforcement;
h) Research and recommend amendments and supplements to enforcement-related documents, propose improvements to the legal system on civil enforcement and administrative enforcement;
i) Perform other tasks prescribed by law or assigned by the head of the civil enforcement agency.
3. Professional Qualification Standards
a) Profoundly understand the Party's policies and State laws, directives, and resolutions of superiors to apply them to civil enforcement and administrative enforcement work; strategic goals for economic, cultural, and social development;
b) Profoundly understand administrative management knowledge and civil enforcement and administrative enforcement laws; skillfully apply principles, systems, and procedures related to civil enforcement procedures;
c) Be aware of the development trends of civil enforcement both domestically and internationally; organize research to serve management and information processing;
d) Have the ability to propose and advise on policy formulation, lead the drafting of draft laws, ordinances, projects, and programs related to civil enforcement to submit for consideration and decision by competent authorities; have the ability to coordinate well with relevant agencies in organizing enforcement;
d) Have the ability to educate and persuade parties to comply with court judgments and decisions;
e) Be proficient and master skills in drafting, presenting, defending, and implementing to build and implement projects, proposals, programs, work plans, teaching materials related to civil enforcement and administrative enforcement work;
g) Have the ability to conduct scientific research, summarize broad topics within the assigned field, propose strategic issues related to civil enforcement work and administrative enforcement work; have the ability to analyze, generalize, and synthesize across multiple related fields;
h) For civil servants taking the examination to upgrade to the Senior Enforcement Officer rank, they must be individuals who have led or participated in drafting at least two normative legal documents submitted to competent authorities for issuance or have led or participated in researching, drafting at least two scientific research projects at the ministry, sector, or local level that have been accepted and met requirements or have led drafted or participated in drafting at least two specialized projects or have led and implemented effectively at least two projects, initiatives within the Civil Enforcement General Department or the civil enforcement organizational system;
i) Civil servants taking the examination to upgrade to the Senior Enforcement Officer rank must have held the Intermediate Enforcement Officer rank for at least five years (60 months).
4. Educational and Training Standards
a) Hold a bachelor's degree in law or higher;
b)[5] Hold a certificate of advanced training in state administration and high-level civil enforcement procedures according to the content and program of the Ministry of Justice;
c)[6] Hold a diploma in advanced political theory or advanced political theory and administration or a bachelor's degree in politics or a certificate confirming equivalent advanced political theory level from an authorized agency;

Article 6. Intermediate Enforcement Officer Rank
1. Responsibilities
The intermediate Enforcement Officer is a specialized civil servant responsible for enforcing civil judgments and administrative enforcement orders, directly organizing and supervising the execution of complex civil enforcement cases and administrative enforcement cases involving large amounts of money or assets; enforcement actions related to multiple regions under the jurisdiction of the Civil Enforcement Department or the Civil Enforcement Branch.
2. Tasks
a) Implement the duties and powers prescribed in Article 20 of the Civil Enforcement Law;
b) Implement administrative enforcement work in accordance with the provisions of the law;
c) Develop plans and organize the implementation of civil enforcement decisions; propose measures and direct the execution of civil enforcement decisions within their authority; perform citizen reception tasks as prescribed;
d) Report on the results of civil enforcement and administrative enforcement work, propose measures to organize civil enforcement and administrative enforcement within the scope of assigned functions and tasks;
đ) Provide guidance on enforcement procedures for初级级执行员、书记员和中级书记员;
e) Draft directives for enforcement work, compile materials and provide guidance on the enforcement procedures for civil enforcement and administrative enforcement;
g) Assist the head of the enforcement agency in understanding the situation of enforcement work and compliance with laws in enforcement matters within their jurisdiction as assigned;
h) Participate in researching and summarizing experiences and practical enforcement situations;
i) Study and propose amendments and supplements to enforcement-related documents, and contribute opinions to improve the enforcement legal system;
k) Perform other tasks as prescribed by law or assigned by the head of the enforcement agency;
3. Professional Qualification Standards
a) Be thoroughly familiar with the Party's policies and State laws, directives, and resolutions from higher authorities, and apply them to civil enforcement and administrative enforcement work;
b) Have a deep understanding of the content of civil enforcement and administrative enforcement laws; skillfully apply principles, systems, and procedures related to civil enforcement procedures;
c) Understand the situation and trends in civil enforcement work both domestically and internationally; organize research to serve management and information processing;
d) Possess the ability to coordinate well with relevant agencies in enforcement work;
d) Have the ability to educate and persuade parties to comply with court judgments and decisions; decisions of the Competition Case Handling Council and arbitral awards, decisions of commercial arbitration;
e) Possess the ability to analyze and synthesize, be proficient in drafting documents and materials related to assigned responsibilities and tasks, and present on assigned issues;
g) For civil servants applying for promotion to the Intermediate Enforcement Officer rank, they must have beenthe main organizer or participant in drafting at least one (1) regulatory legal document or the main organizer or participant in researching, drafting, or participating in researching and drafting at least one (1) scientific research topic, project, program at the Ministry level, sector level, provincial level, or county level, which has been issued or accepted and evaluated as meeting requirements by the competent authority, or have been the main organizer in drafting and effectively implementing at least one topic, project, or initiative within the Civil Enforcement Department or the Civil Enforcement Branch;
h) Civil servants applying for promotion to the Intermediate Enforcement Officer rank must have held the position of Junior Enforcement Officer for five years (60 months) or more.
4. Educational and Training Standards
a) Hold a bachelor's degree in law or higher;
b)[9] Hold a certificate in state administration management knowledge and civil enforcement procedures according to the content and curriculum of the Ministry of Justice;

Article 7. Junior Enforcement Officer Rank
1. Responsibilities
A junior enforcement officer is a specialized civil servant responsible for executing civil judgments and administrative decisions. They directly organize the execution of simple civil judgments and urge the execution of administrative decisions with small value assets within the jurisdiction of the Civil Enforcement Office and Branch Civil Enforcement Office.
2. Tasks
a) Implement the duties and powers prescribed in Article 20 of the Civil Enforcement Law;
b) Implement administrative enforcement work in accordance with the provisions of the law;
c) Develop plans and implement civil judgment enforcement decisions; perform citizen reception tasks as prescribed;
d) Report on the results of civil judgment enforcement and administrative decision enforcement; propose measures to resolve issues;
đ) Guide business procedures for Secretaries and Intermediate Level Secretaries in enforcement;
e) Study and propose amendments to enforcement-related documents; contribute suggestions for improving the enforcement legal system;
g) Participate in drafting documents related to civil judgment enforcement and administrative decision enforcement within their assigned field, and propose organizational matters concerning civil judgment enforcement and administrative decision enforcement within their authority;
h) Perform other tasks assigned by the head of the enforcement agency;
3. Professional Qualification Standards
a) Be thoroughly familiar with the Party's policies and State laws, directives, and resolutions from higher authorities, and apply them to civil enforcement and administrative enforcement work;
b) Master the content of laws on civil judgment enforcement and administrative decision enforcement and skillfully apply principles, systems, and procedures in the execution of assigned cases;
c) Understand the economic and social situation in the locality; be familiar with the area they are responsible for;
d) Have the ability to coordinate with relevant agencies, units, and individuals in performing assigned tasks;
đ) Have the ability to educate and persuade parties to comply with court judgments and decisions; decisions on competition dispute resolution and arbitral awards, decisions of commercial arbitration;
e) Have the ability to draft documents related to their responsibilities and tasks;
g) Candidates for the junior enforcement officer rank must currently hold the Specialist rank or equivalent and have at least three years (36 months) of legal work experience; Cmust be holding the Specialist rank or equivalent and have at least three years (36 months) of legal work experience;
4. Educational and Training Standards
a) Hold a bachelor's degree in law or higher;
b)[12] Hold a certificate in state management knowledge and civil judgment enforcement business training according to the content and program of the Ministry of Justice;

Chapter III
DUTIES, TASKS AND PROFESSIONAL STANDARDS OF THE AUDITOR RANKS
Article 8. Senior Auditor Rank
1.[15] Responsibilities
A senior auditor is the highest-ranking civil servant with expertise in civil judgment enforcement auditing, assisting the head of the civil enforcement management agency in conducting audits and inspections of important and complex civil judgment enforcement cases involving multiple levels, sectors, fields, and regions; auditing, inspecting, verifying complaints and petitions regarding civil judgment enforcement, and performing other tasks as assigned by the head of the civil enforcement management agency;.
2. Tasks
a) Implement the duties and powers stipulated in Article 67 of Decree No. 62/2015/ND-CP dated July 18, 2015, detailing and guiding the implementation of certain provisions of the Civil Judgment Enforcement Law (hereinafter referred to as Decree No. 62/2015/ND-CP);
b)[16] Conduct audits and inspections of civil judgment enforcement cases that have been and are being executed; develop inspection plans, proactively carry out or cooperate with relevant agencies and units to verify and inspect civil judgment enforcement work according to plans approved by the head of the civil enforcement management agency; During the inspection process, if errors are found, advise the competent authority to temporarily suspend the execution of erroneous decisions to correct them and bear responsibility for their recommendations; c)[17]
Draft plans for approval by the head of the civil enforcement management agency, organize implementation or cooperate with relevant agencies and units to audit, inspect, verify, and propose solutions for complaints and petitions regarding civil judgment enforcement and administrative enforcement management according to the directives of the head of the civil enforcement management agency; ) Draft plans, organize implementation, audit, verify, inspect, compile statistics, report data on civil judgment enforcement and administrative enforcement, and other related files and documents of provinces and centrally-administered cities; counties, districts, towns, and provincial-level cities under central administration;

e)[19] Advise the head of the civil enforcement management agency to respond to objections and proposals from the People's Procuracy within their authority;
g) Audit, inspect, and advise on resolving complex complaints and petitions related to personnel organization work within the civil enforcement system;
h) Audit, inspect, compile reports related to civil judgment enforcement work; report accounting for civil judgment enforcement business within the entire system;
i) Participate in drafting laws, ordinances, and other regulatory legal documents related to the functions and tasks of the civil enforcement system;
k)[20] Assist the head of the civil enforcement management agency in guiding and directing civil judgment enforcement business audits nationwide and proposing measures to ensure the lawful and effective organization of civil judgment enforcement;
l) Participate in researching scientific topics on enforcement work;
m) Participate in developing goals, contents, programs, and training materials for auditors in civil judgment enforcement;
n)[21] Perform other tasks as prescribed by law or assigned by the head of the civil enforcement management agency;
a) Master the Party's policies, State laws, directives, and resolutions of superiors to apply them to civil judgment enforcement and administrative enforcement work; strategic development goals for the economy, culture, and society;
3. Professional Qualification Standards
a) Profoundly understand the Party's policies and State laws, directives, and resolutions of superiors to apply them to civil enforcement and administrative enforcement work; strategic goals for economic, cultural, and social development;
b) Master and understand knowledge about administrative state management, deeply understand the contents of laws on civil enforcement, administrative enforcement, laws on handling complaints and denunciations; skillfully apply principles, systems, procedures for examination, inspection, handling complaints and denunciations in civil enforcement work, administrative enforcement work; deeply understand the contents of laws on civil enforcement, administrative enforcement; skillfully apply principles, systems, procedures related to civil enforcement business;
c) Be aware of the development trends of civil enforcement both domestically and internationally; organize research to serve management and information processing;
d) Have the ability to propose and advise on policy formulation, lead in drafting laws, ordinances, projects, programs related to the professional field of civil enforcement; civil enforcement to submit for consideration and decision by competent authorities;
đ) Be proficient and in control of skills in drafting, presenting, defending, and organizing implementation to build and implement projects, proposals, programsplans, teaching materials related to enforcement work civil enforcement, administrative enforcement, examination, inspection, complaint and denunciation resolution in civil enforcement;
e) Have the ability to conduct scientific research, summarize broad topics within the assigned field, propose strategic issues regarding civil enforcement work, administrative enforcement work; have the ability to analyze, generalize, and synthesize in many areas related to enforcement work;
g) For civil servants taking the exam to upgrade to Senior Examiner, they must be individuals who have led or participated in drafting at least two (2) normative legal documents submitted to competent authorities for issuance or have led, researched, drafted, or participated in researching and drafting at least two (2) scientific research topics, projects, programs at the ministry, sector levelor local level draft or that have been accepted and met requirements or have ledat least two (2) specialized topics, projects, programs or have led implemented drafted or participated in drafting effectively Operation and at least two topics, projects, initiatives within the Civil Enforcement General Department or the civil enforcement organization system; at least two projects, h)[22] Civil servants taking the exam to upgrade to Senior Examiner must have held the position of Chief Examiner or equivalent for at least six years (72 months), including at least one year (12 months) as Chief Examiner up to the deadline for submitting registration documents for the upgrading exam.
b)[23] Hold a certificate of advanced training in state administration management and civil enforcement business according to the content and program of the Ministry of Justice;

Article 9. Chief Examiner Rank (is repealed)
A Chief Examiner is a civil servant with expertise in the field of civil enforcement examination, assisting the head of the agency directly or participating in performing tasks of examining cases that have been and are being enforced, examining, inspecting,

verifying cases involving complaints and denunciations about civil enforcement and performing other tasks as assigned by the head of the civil enforcement management agency, civil enforcement agency. a) Perform duties and powers as prescribed in Article 67 of Decree No. 62/2015/NĐ-CP;
2. Tasks
b) Examine case files of cases that have been and are being enforced according to approved plans or assignments from the head of the civil enforcement management agency, civil enforcement agency, propose solutions and take responsibility for their recommendations. During the inspection process, if errors are found, advise the competent authority to temporarily suspend the execution of erroneous decisions to correct and repair and take responsibility for their recommendations;
c) Develop plans, organize implementation, or coordinate with relevant agencies and units to verify, inspect, and propose measures to resolve assigned tasks;
d) Examine, inspect reports and data on civil enforcement of mid-level enforcement officers, junior-level enforcement officers, and subordinate civil enforcement agencies;
đ) Advise the head of the civil enforcement management agency, civil enforcement agency: Respond to objections and suggestions from the People's Procuracy within their authority; advise on resolving complaints and denunciations within the authority of the head of the civil enforcement management agency, civil enforcement agency;
e) Examine, inspect, and advise on resolving complaints and denunciations related to personnel work in the civil enforcement organizational system;
g) Examine, inspect, compile reports related to civil enforcement work, accounting reports on civil enforcement business of subordinate units;
h) Participate in drafting laws, ordinances, and other normative legal documents related to the functions and responsibilities of the civil enforcement organizational system;
i) Draft materials, participate in guiding business for junior-level enforcement officer positions, examiner positions, enforcement clerk positions;
k) Perform other tasks as prescribed by law or assigned by the head of the agency.

Civil servants taking the exam to upgrade to Chief Examiner must have held the position of Examiner or equivalent for at least nine years (excluding probationary and trial periods), including at least one year as Examiner up to the deadline for submitting registration documents for the upgrading exam. Civil servants taking the examination to upgrade to the Chief Reviewer rank must have held the Reviewer rank or equivalent for at least nine years (excluding probationary and trial periods), including at least one year (12 months) holding the Reviewer rank. b)[28]

Article 10. The Inspector Position
1. Responsibilities
An Inspector is a civil servant with specialized knowledge and expertise in the field of inspection of civil enforcement proceedings and administrative enforcement proceedings, assisting the head of the agency directly in inspecting cases that have been and are being enforced, verifying complaints and reports according to the assignment of the head of the civil enforcement management agency or the civil enforcement agency.
2. Tasks
b) Examine case files of cases that have been and are being enforced according to approved plans or assignments from the head of the civil enforcement management agency, civil enforcement agency, propose solutions and take responsibility for their recommendations. During the inspection process, if errors are found, advise the competent authority to temporarily suspend the execution of erroneous decisions to correct and repair and take responsibility for their recommendations;
b)[31] Conduct inspections of case files of cases that have been and are being enforced by Enforcement Officers according to approved plans or assignments from the head of the civil enforcement management agency or the civil enforcement agency, propose solutions and be responsible for their own recommendations.;
c)[32] Inspect statistics, reports, and data on civil enforcement proceedings submitted by Enforcement Officers and subordinate enforcement agencies.;
d) Assist the head of the civil enforcement management agency or the civil enforcement agency in responding to protests and suggestions from the People's Public Prosecutor within their authority regarding simple cases; advise on resolving complaints and reports within the authority of the head of the civil enforcement management agency or the civil enforcement agency regarding simple cases.
Inspect, verify, and advise on resolving complaints and reports related to personnel work in the civil enforcement system.
e)[33] Inspect, verify, and compile reports related to civil enforcement proceedings and administrative enforcement proceedings.;
g) Advise on drafting laws, ordinances, and other regulatory documents related to the functions and responsibilities of the civil enforcement system.
h) Plan and organize inspection work according to the assignment of the head of the agency.
i) Coordinate with relevant agencies and units to carry out inspection work according to assigned tasks as stipulated by law.
k) Perform other tasks assigned by the head of the agency.
3. Professional Qualification Standards
a) Master the Party’s policies and State laws, directives, and resolutions of superiors to apply them to civil enforcement proceedings and administrative enforcement proceedings.
b) Master the legal provisions on civil enforcement proceedings and administrative enforcement proceedings, laws on handling complaints and reports, and inspection and verification procedures for civil enforcement proceedings and complaint resolution procedures.
c) Understand the economic and social conditions in the locality related to civil enforcement proceedings.
d) Possess the ability to coordinate with units and individuals during the performance of duties.
đ) Master the process of handling tasks, have skills in drafting documents and presenting issues assigned for research and advisory purposes.
A civil servant proposed for appointment to the Inspector position must currently hold the Specialist position or equivalent and have at least three years (36 months) of experience in legal work.

Chapter IV
RESPONSIBILITIES, TASKS, AND PROFESSIONAL STANDARDS OF THE CLERK OF ENFORCEMENT POSITION
Article 11. The Clerk of Enforcement Position
1. [37] Responsibilities
A Clerk of Enforcement is a civil servant specializing in civil enforcement proceedings, responsible for assisting Enforcement Officers in implementing procedures and formalities in civil enforcement proceedings and administrative enforcement proceedings, or assisting Inspectors in inspecting cases that have been and are being enforced, and verifying and investigating complaints and reports about civil enforcement proceedings as prescribed by law.
2. Tasks
a)[38] Advise and assist Enforcement Officers in preparing case files and formalities, organizing enforcement within the jurisdiction of the provincial or district civil enforcement agency; assist Enforcement Officers in performing tasks related to administrative enforcement proceedings as prescribed by law, or assist Inspectors in inspecting cases that have been and are being enforced, and complaints and reports about civil enforcement proceedings as prescribed by law.
b) Record minutes of investigations, enforcement resolutions, service of documents, disposal of evidence and seized assets, asset seizures, asset lists, meeting minutes, asset valuations, asset status checks, destruction of evidence, forced execution, property transfers, return of assets, and other procedural minutes.
c) Assist Enforcement Officers and Inspectors in serving enforcement documents.
d) Carry out some verification and case file preparation tasks for civil enforcement proceedings according to the assignment of Enforcement Officers and Inspectors.
đ) Coordinate with relevant agencies and units to assist Enforcement Officers in organizing enforcement; assist Inspectors in inspecting civil enforcement proceedings for assigned cases as prescribed by law.
e) Perform other tasks assigned by the head of the enforcement agency.
3. Professional Qualification Standards
a) Master the Party’s viewpoints, guidelines, and policies, and State laws related to civil enforcement proceedings.
b) Master basic knowledge about legal principles and civil enforcement procedures;
c) Possess the ability to synthesize and propose measures to resolve issues related to the duties of the Clerk of Enforcement;
d) Have skills in drafting documents related to assigned responsibilities and tasks.
đ) A civil servant applying for promotion to the Clerk of Enforcement position must have held the Intermediate Clerk of Enforcement position for at least three years (36 months).

Article 12. Intermediate Enforcement Clerk Rank
1.[42] Responsibilities
The intermediate enforcement clerk is a specialized civil servant in civil enforcement, responsible for assisting the Enforcement Officer in carrying out procedures and formalities in civil enforcement work, administrative enforcement, or assisting the Review Officer in reviewing cases that have been and are being enforced, as well as reviewing and verifying cases involving complaints and reports on civil enforcement according to the provisions of the law.
2. Tasks
a) Advise and assist the Enforcement Officer in preparing files, formalities, organizing enforcement within the authority of the provincial or district civil enforcement agency; assist the Enforcement Officer in tasks related to administrative enforcement work according to the provisions of the law, or assist the Review Officer in reviewing cases that have been and are being enforced, and cases involving complaints and reports on civil enforcement according to the provisions of the law;
b) Record minutes of investigations, enforcement resolutions, service of documents, disposal of evidence and seized assets, asset seizures, asset lists, meeting minutes, asset valuations, asset status checks, destruction of evidence, forced execution, property transfers, return of assets, and other procedural minutes.
c) Assist the初级级执行书记官和审查员送达执行文件;
d) Carry out certain verification contents and build civil enforcement case files according to the assignment of the primary level Enforcement Officer or the Review Officer;

a) Understand the viewpoints, policies, and guidelines of the Party and the state's policies and laws related to civil enforcement work;
b) Master basic knowledge about legal principles and civil enforcement procedures;
c) Possess the ability to synthesize and propose measures to resolve issues related to the duties of the intermediate enforcement clerk;
d) Possess the ability to draft documents related to the assigned responsibilities and tasks;
4. Educational and Training Standards
a) Hold a high school law degree or higher;
b) Hold a certificate of training in state administration knowledge and civil enforcement business according to the content and program of the Ministry of Justice;

Article 12a. Salary Classification for Specialized Civil Servants in Civil Enforcement
[47]Specialized civil servants in civil enforcement as stipulated in Circular No. 03/2017/TT-BTP shall apply the Professional and Business Salary Scale for State Agency Officials and Civil Servants (Scale 2) issued together with Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on salary systems for officials, civil servants, public employees, and armed forces (amended and supplemented by Decree No. 17/2013/NĐ-CP dated February 19, 2013 of the Government) as follows:
a) The Senior Enforcement Officer and Senior Review Officer ranks shall apply the A3 grade civil servant salary coefficient, group A3.1.
b) The Intermediate Enforcement Officer and Principal Review Officer ranks shall apply the A2 grade civil servant salary coefficient, group A2.1.
c) The Primary Enforcement Officer, Review Officer, and Enforcement Clerk ranks shall apply the A1 grade civil servant salary coefficient.
d) The Intermediate Enforcement Clerk rank shall apply the B grade civil servant salary coefficient.
Chapter V
IMPLEMENTING PROVISIONS
[48]Article 13. Implementation Organization
1. The professional standards of the ranks of specialized civil servants in the civil enforcement system serve as the basis for implementing recruitment, utilization, appointment, and management of the civil servant workforce engaged in civil enforcement work.
2. The educational and training standards for Enforcement Officers and Review Officers under the Ministry of National Defense shall be implemented according to the regulations of the Minister of National Defense, ensuring they are not lower than the standards of corresponding civil servant ranks prescribed in this Circular.
Article 14. Transitional provisions, implementation clauses
1. The current civil enforcement officer grade codes of Senior Examiner (code 03.232) and Examiner (code 03.230) shall be converted to new grade codes as follows:
a) The Senior Examiner grade (code 03.232) shall be converted to the Senior Examiner grade (code 03.230);
b) The Examiner grade (code 03.230) shall be converted to the Examiner grade (code 03.232).
2. From the date this Circular takes effect, the appointment of civil enforcement officer grades must comply with the standards set forth in this Circular, except for the standards specified in point b, Clause 4, Article 8, point b, Clause 4, Article 9, and point b, Clause 4, Article 10 which continue to be applied according to the provisions at point c, Clause 4, Sections I, II, III of Decision No. 01/2007/QD-BNV dated January 17, 2007 of the Minister of Home Affairs on the issuance of standards for the Examiner, Senior Examiner, and Senior Examiner civil enforcement officer grades until December 31, 2017.
3. Repeal Circular No. 10/2010/TT-BNV dated October 28, 2010 of the Ministry of Home Affairs on the code and professional standards of the Enforcement Officer and Clerk civil enforcement officer grades and Decision No. 01/2007/QD-BNV dated January 17, 2007 of the Minister of Home Affairs on the issuance of standards for the Examiner, Senior Examiner, and Senior Examiner civil enforcement officer grades.
4. From the date this Circular takes effect, vocational training certificates for civil enforcement officer grades will continue to be valid for appointment to corresponding grades.
Certificates of advanced knowledge in state management and civil enforcement practice can be used for promotion examinations and appointments to the Senior Specialist, Senior Enforcement Officer, and Senior Examiner grades; certificates of senior knowledge in state management and civil enforcement practice can be used for promotion examinations and appointments to the Senior Specialist, Intermediate Enforcement Officer, and Senior Examiner grades; certificates of knowledge in state management and civil enforcement practice can be used for promotion examinations and appointments to the Specialist, Junior Enforcement Officer, Examiner, Clerk, and Intermediate Clerk grades.
5. The time spent obtaining a bachelor's degree in law, performing tasks related to civil enforcement accounting, and holding an accountant grade or higher for civil enforcement officers before Circular No. 78/2020/TT-BTC dated August 14, 2020 of the Minister of Finance guiding civil enforcement accounting took effect, shall be counted as legal work experience.
6. For promotion plans and programs approved before the effective date of this Circular, they shall continue to be implemented according to the approved plans and programs within six months from the date this Circular takes effect. After this period, if the promotion examination has not been organized, it shall be conducted according to this Circular.
7. Entrust the Academy of Judicial Studies to take the lead and coordinate with the Civil Enforcement General Department to develop training and refresher courses as prescribed in this Circular; conversion programs for individuals holding specialized civil enforcement practice training certificates, refresher certificates for administrative or other specialized civil service grades to obtain certificates under this Circular.
Article 15. Effective Date
1. This Circular takes effect from May 22, 2017.
2. Heads of units under the Ministry of Justice, heads of local civil enforcement agencies, and the Director of the Civil Enforcement Bureau of the Ministry of National Defense within their assigned duties and authority are responsible for organizing and implementing the provisions of this Circular.

[42] This clause has been amended and supplemented pursuant to Clause 17, Article 1 of Circular No. 08/2020/TT-BTP dated December 28, 2020 of the Minister of Justice amending and supplementing certain provisions of Circular No. 03/2017/TT-BTP dated April 5, 2017 of the Minister of Justice on job titles, grade codes, and professional standards for civil enforcement specialist grades, which took effect from March 1, 2021.
[43] This point has been amended and supplemented pursuant to Clause 18, Article 1 of Circular No. 08/2020/TT-BTP dated December 28, 2020 of the Minister of Justice amending and supplementing certain provisions of Circular No. 03/2017/TT-BTP dated April 5, 2017 of the Minister of Justice on job titles, grade codes, and professional standards for civil enforcement specialist grades, which took effect from March 1, 2021.
[44] This point has been amended and supplemented pursuant to Clause 19, Article 1 of Circular No. 08/2020/TT-BTP dated December 28, 2020 of the Minister of Justice amending and supplementing certain provisions of Circular No. 03/2017/TT-BTP dated April 5, 2017 of the Minister of Justice on job titles, grade codes, and professional standards for civil enforcement specialist grades, which took effect from March 1, 2021.

[46] This point has been amended and supplemented pursuant to Clause 19, Article 1 of Circular No. 08/2020/TT-BTP dated December 28, 2020 of the Minister of Justice amending and supplementing certain provisions of Circular No. 03/2017/TT-BTP dated April 5, 2017 of the Minister of Justice on job titles, grade codes, and professional standards for civil enforcement specialist grades, which took effect from March 1, 2021, and was repealed pursuant to Point h, Clause 4, Article 2 of Circular No. 06/2021/TT-BTP dated October 14, 2021 of the Minister of Justice abolishing certain regulatory legal documents on personnel work in the field of civil enforcement issued by the Minister of Justice, which took effect from October 14, 2021.
[47] This is added pursuant to Clause 20, Article 1 of Circular No. 08/2020/TT-BTP dated December 28, 2020, issued by the Minister of Justice to amend and supplement certain provisions of Circular No. 03/2017/TT-BTP dated April 5, 2017, issued by the Minister of Justice on job titles, grade codes, and professional standards for civil enforcement grades, which takes effect from March 1, 2021.
[48] Article 2 of Circular No. 08/2020/TT-BTP dated December 28, 2020, issued by the Minister of Justice to amend and supplement certain provisions of Circular No. 03/2017/TT-BTP dated April 5, 2017, issued by the Minister of Justice on job titles, grade codes, and professional standards for civil enforcement grades, which takes effect from March 1, 2021, provides as follows:
“Article 2. Implementation clause
1. This Circular takes effect from March 1, 2021.
2. The heads of units under the Ministry of Justice, the heads of local civil enforcement agencies, and the Director of the Civil Enforcement Department of the Ministry of National Defense shall be responsible for implementing this Circular within their respective duties and authorities.
Article 3 of Circular No. 06/2021/TT-BTP dated October 14, 2021, issued by the Minister of Justice to abolish certain normative legal documents on cadre work in the field of civil enforcement issued by the Minister of Justice, which takes effect from October 14, 2021, provides as follows:
“Article 3. Effective Date
1. This Circular takes effect from the date of signature.
2. The heads of units under the Ministry of Justice, the heads of local civil enforcement agencies, and the Director of the Civil Enforcement Department of the Ministry of National Defense shall be responsible for implementing this Circular within their respective duties and authorities.

[50] The phrase "issued in accordance with point b, Clause 4, Article 5, point b, Clause 4, Article 6, point b, Clause 4, Article 7, point b, Clause 4, Article 8, point b, Clause 4, Article 9, point b, Clause 4, Article 10, and point b, Clause 4, Article 11 of Circular No. 03/2017/TT-BTP dated April 5, 2017, issued by the Minister of Justice on job titles, grade codes, and professional standards for civil enforcement grades” is abolished pursuant to point i, Clause 4, Article 2 of Circular No. 06/2021/TT-BTP dated October 14, 2021, issued by the Minister of Justice to abolish certain normative legal documents on cadre work in the field of civil enforcement issued by the Minister of Justice, which takes effect from October 14, 2021.
[51] This clause is added pursuant to Clause 21, Article 1 of Circular No. 08/2020/TT-BTP dated December 28, 2020, issued by the Minister of Justice to amend and supplement certain provisions of Circular No. 03/2017/TT-BTP dated April 5, 2017, issued by the Minister of Justice on job titles, grade codes, and professional standards for civil enforcement grades, which takes effect from March 1, 2021.
[52] This clause is added pursuant to Clause 21, Article 1 of Circular No. 08/2020/TT-BTP dated December 28, 2020, issued by the Minister of Justice to amend and supplement certain provisions of Circular No. 03/2017/TT-BTP dated April 5, 2017, issued by the Minister of Justice on job titles, grade codes, and professional standards for civil enforcement grades, which takes effect from March 1, 2021.
[53] This clause is added pursuant to Clause 21, Article 1 of Circular No. 08/2020/TT-BTP dated December 28, 2020, issued by the Minister of Justice to amend and supplement certain provisions of Circular No. 03/2017/TT-BTP dated April 5, 2017, issued by the Minister of Justice on job titles, grade codes, and professional standards for civil enforcement grades, which takes effect from March 1, 2021.
[54] the phrase "issued before this Circular takes effect” is abolished pursuant to point i, Clause 4, Article 2 of Circular No. 06/2021/TT-BTP dated October 14, 2021, issued by the Minister of Justice to abolish certain normative legal documents on organizational and cadre work in the field of civil enforcement issued by the Minister of Justice, which takes effect from October 14, 2021.
