On Simplifying Administrative Procedures within the Scope of Management Functions of the Ministry of Labor, Invalids and Social Affairs

THE GOVERNMENT

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Upon the proposal of the Minister, Head of the Government Office, and the Team Leader of the Specialized Task Force for Administrative Procedure Reform under the Prime Minister,

RESOLVES

Article 1. Approves the Plan to Simplify Administrative Procedures within the Scope of State Management Functions of the Ministry of Labor, Invalids and Social Affairs (hereinafter referred to as the Simplification Plan) attached to this Resolution.

Article 2. Assigns the Ministry of Labor, Invalids and Social Affairs and relevant ministries and sectors within their respective authorities to implement according to the contents and deadlines specified in the Simplification Plan for Administrative Procedures approved by the Government at Article 1 of this Resolution.

During the implementation process, the Ministry of Labor, Invalids and Social Affairs shall proactively identify and promptly amend, supplement, replace, or abolish and cancel related provisions in documents within its authority to issue or propose in writing to the Ministry of Justice and the Government Office regarding laws, ordinances of the National Assembly, Standing Committee of the National Assembly, decrees of the Government, decisions of the Prime Minister concerning administrative procedures that need to be amended, supplemented, replaced, or abolished and canceled according to the Simplification Plan approved by the Government at Article 1 of this Resolution.

Article 3. For administrative procedures stipulated in laws and ordinances that need to be amended, supplemented, replaced, or abolished according to the Simplification Plan set forth in Article 1 of this Resolution, assigns the Minister of Justice, acting on behalf of the Prime Minister, to report to the Standing Committee of the National Assembly before December 31, 2010, proposing the Government's request for permission to include additional draft laws and ordinances to implement the Simplification Plans for administrative procedures approved by the Government in the legislative program for 2011 and 2012 in the form of one document amending multiple documents and applying the expedited procedure as prescribed by the Law on Legislative Acts in 2008.

Based on the legislative program adopted by the National Assembly, assigns the Government Office to take the lead and coordinate with the Ministry of Justice to submit to the Prime Minister for decision on the deadline for drafting the aforementioned draft laws and ordinances to be submitted to the Ministry of Justice for consolidation into a single document to be submitted to the Government for consideration and decision.

Article 4. For administrative procedures stipulated in legislative acts within the authority to issue by the Government, the Prime Minister, Ministers, and Heads of agencies equivalent to Ministries that need to be amended, supplemented, replaced, or abolished according to the Simplification Plan set forth in Article 1 of this Resolution, assigns the Ministry of Labor, Invalids and Social Affairs to apply the form of one document amending multiple documents through the expedited procedure to issue within its authority or submit to the Government and the Prime Minister for issuance. In cases where a single document is needed to amend another document, assigns the Minister of Labor, Invalids and Social Affairs to consider and decide.

Article 5. Assigns the People's Committees of provinces and centrally-administered cities to base on the content of legislative acts to implement the Simplification Plan for administrative procedures issued by central agencies as set forth in Article 1 of this Resolution, immediately amend, supplement, replace, or abolish and cancel related provisions in documents within their authority to issue, ensuring implementation when the aforementioned central documents come into effect.

Article 6. Assigns the Government Office to inspect and urge the implementation of this Resolution and compile any issues arising during the implementation of this Resolution, promptly reporting to the Prime Minister to resolve them.

Article 7. This Resolution takes effect from the date of signature.

Ministers, Heads of agencies equivalent to Ministries, Chairmen of People's Committees of provinces and centrally-administered cities, and related agencies are responsible for enforcing this Resolution./.
