CIRCULAR

ABOLISHING CERTAIN LEGAL DOCUMENTS ON PERSONNEL WORK IN THE FIELD OF CIVIL ENFORCEMENT ACTS ISSUED BY THE MINISTER OF JUSTICE

Pursuant to the Law on Legislative Regulatory Documents dated June 22, 2015; the Law Amending and Supplementing Certain Provisions of the Law on Legislative Regulatory Documents dated June 18, 2020;

Pursuant to Decree No. 62/2015/NĐ-CP dated July 18, 2015 of the Government detailing and guiding the implementation of certain provisions of the Civil Enforcement Act; Decree No. 33/2020/NĐ-CP dated March 17, 2020 of the Government amending and supplementing certain provisions of Decree No. 62/2015/NĐ-CP;

Pursuant to Decree No. 34/2016/NĐ-CP dated May 14, 2016 of the Government detailing certain provisions and measures for implementing the Law on Issuing Legal Normative Documents; Decree No. 154/2020/NĐ-CP dated December 31, 2020 of the Government amending and supplementing certain provisions of Decree No. 34/2016/NĐ-CP;

Pursuant to Decree No. 123/2016/NĐ-CP dated September 1, 2016 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies; Decree No. 101/2020/NĐ-CP dated August 28, 2020 of the Government amending and supplementing certain provisions of Decree No. 123/2016/NĐ-CP;

Pursuant to Decree No. 96/2017/NĐ-CP dated August 16, 2017, issued by the Government on the functions, tasks, powers, and organizational structure of the Ministry of Justice;

Pursuant to Decree No. 138/2020/NĐ-CP dated November 27, 2020 of the Government on recruitment, use, and management of civil servants;

At the proposal of the Director of the Civil Enforcement General Department;

The Minister of Justice issues this Circular abolishing certain legal normative documents on personnel work in the field of civil enforcement acts issued by the Minister of Justice.

This Circular takes effect from January 25, 2026.

Abolish entirely Decision No. 51/2002/QĐ-BTP dated February 27, 2002 of the Minister of Justice on issuing ethical standards for civil enforcement officers.

Article 2. Repealing part of certain regulatory legal documents

1. Abolish certain articles, clauses, points, words, and characters of Circular No. 02/2017/TT-BTP dated March 23, 2017 of the Minister of Justice guiding certain contents of management of civil servants, officials, and employees under the civil enforcement organization system as follows:

a) Abolish Clause 2 Article 1; Article 3; point c, d Clause 2 Article 5; point d, đ Clause 2 Article 7; Articles 20, 25, 27, 30, 31, 34, 37, 38, 41, 42, 43, 46, 47, 48, 65, 85 and Appendix No. 01;

b) Remove the word "The", "the" and character ", c, d" at point b Clause 2 Article 6; character ", d, đ" at point b Clause 2 Article 8; the word "The" and character ", d, đ" at point b Clause 2 Article 9; the words "The", "the" and character ", d, đ" at point b Clause 2 of Articles 10, 11, 12, 17, 18; character ", d, đ" at Clause 2 Article 13, point b Clause 2 Article 14; the words "The", "the" and character ", d, đ" at point c Clause 2 Article 15; the word "the" and character ", d, đ" at point b Clause 2 Article 16.

2. Abolish the Clauses 4, 5, 6, 7, 8, 9, 10, 11, 12, 13, 14, 15, 16, 17, 18, 19 and 24 Article 1; Clause 2 Article 3 of Circular No. 18/2018/TT-BTP dated December 28, 2018 of the Minister of Justice amending and supplementing certain provisions of Circular No. 02/2017/TT-BTP dated March 23, 2017 of the Minister of Justice guiding certain contents of management of civil servants, officials, and employees under the civil enforcement organization system.

3. Abolish point d Clause 4 of Article 5 and Article 8; point c Clause 4 of Articles 6, 7, 9, 10, 11 and Article 12 of Circular No. 03/2017/TT-BTP dated April 5, 2017 of the Minister of Justice stipulating job titles, grade codes, and professional standards of civil servant grades in the civil enforcement field.

4. Abolish certain provisions of Circular No. 08/2020/TT-BTP dated December 28, 2020 of the Minister of Justice amending and supplementing certain provisions of Circular No. 03/2017/TT-BTP dated April 5, 2017 of the Minister of Justice stipulating job titles, grade codes, and professional standards of civil servant grades in the civil enforcement field as follows:

a) Abolish the amendment and supplementation point đ Clause 4 Article 5 of Circular No. 03/2017/TT-BTP at Clause 3 Article 1 of Circular No. 08/2020/TT-BTP;

b) Abolish the amendment and supplementation point d Clause 4 Article 6 of Circular No. 03/2017/TT-BTP at Clause 4 Article 1 of Circular No. 08/2020/TT-BTP;

c) Abolish the amendment and supplementation point d Clause 4 Article 7 of Circular No. 03/2017/TT-BTP at Clause 5 Article 1 of Circular No. 08/2020/TT-BTP;

d) Abolish the amendment and supplementation

đ) Abolish the amendment and supplementation point d Clause 4 Article 9 of Circular No. 03/2017/TT-BTP at Clause 11 Article 1 of Circular No. 08/2020/TT-BTP;

e) Abolish the amendment and supplementation point d Clause 4 Article 10 of Circular No. 03/2017/TT-BTP at Clause 13 Article 1 of Circular No. 08/2020/TT-BTP;

g) Abolish the amendment and supplementation point d Clause 4 Article 11 of Circular No. 03/2017/TT-BTP at Clause 16 Article 1 of Circular No. 08/2020/TT-BTP;

h) Abolish the amendment and supplementation point d Clause 4 Article 12 of Circular No. 03/2017/TT-BTP at Clause 19 Article 1 of Circular No. 08/2020/TT-BTP;

i) Abolish the phrase: "issued in accordance with" point b Clause 4 Article 5, point b Clause 4 Article 6, point b Clause 4 Article 7, point b Clause 4 Article 8, point b Clause 4 Article 9, point b Clause 4 Article 10, point b Clause 4 Article 11 of Circular No. 03/2017/TT-BTP dated April 5, 2017 of the Minister of Justice stipulating job titles, grade codes, and professional standards of civil servant grades and the phrase "issued before the effectiveness of this Circular" at Clause 21 Article 1.

Article 3. Effectiveness

1. This Circular takes effect from the date of signature.

2. Heads of units under the Ministry of Justice, Heads of local civil enforcement agencies, and Director of the Civil Enforcement Department of the Ministry of National Defense within their respective duties and authorities shall be responsible for implementing this Circular.
