Regarding the Adjustment of Tasks and Organizational Structure of the Planning Department, the Cadre and Civil Servant Organization Department, the Finance Department, the Inspectorate, the Cooperative and Rural Development Bureau

Adjusting the tasks of the following agencies and units:

THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT

Pursuant to Decree No. 86/2003/NĐ-CP dated July 18, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to Article 16, Article 18, and Article 19 of Decree No. 86/2002/NĐ-CP dated November 5, 2002, of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

These regulations are hereby promulgated along with this Decision "Regulations on the Transfer, Rotation, and Temporary Assignment of Officials and Civil Servants of the Government Inspectorate."

DECISION:

Article 1. Adjust the tasks of the following agencies and units:

1. The Planning Department shall cease performing the following tasks:

a) Submitting to the Minister the goals, tasks, strategies, and five-year development orientations for state-owned enterprises under the Ministry.

b) Reviewing investment and production development projects of enterprises.

c) Participating in reviewing and approving plans for the establishment, merger, dissolution, shareholding reform, ownership transfer, and additional business fields of state-owned enterprises under the Ministry.

d) Leading the drafting and implementation of monitoring and evaluating the effectiveness of operations of state-owned enterprises under the Ministry.

2. The Cadre and Civil Servant Organization Department shall cease performing the following tasks:

a) Leading the drafting and submitting to the Minister comprehensive plans and programs on restructuring, reforming, and developing state-owned enterprises under the Ministry's management.

b) Submitting to the Minister the charter of organization and operation of state-owned corporations directly under the Ministry.

c) Submitting to the Minister the quota and unit price of wages for state-owned enterprises under the Ministry, in accordance with the provisions of the law.

d) Submitting to the Minister the establishment, merger, consolidation, division, dissolution, restructuring, ownership transfer, additional business fields, and ranking of state-owned enterprises under the Ministry, in accordance with the provisions of the law.

đ) Serving as the permanent member of the Board for reviewing and approving plans for ownership transfer of state-owned enterprises within the Minister's decision-making authority.

e) Serving as the permanent member of the Reform and Development Board of State-Owned Enterprises under the Ministry.

g) Participating in reviewing investment and development projects of enterprises under the Ministry's management.

3. The Finance Department shall cease performing the following tasks:

a) Monitoring and inspecting the financial situation of state-owned enterprises directly under the Ministry and state-owned enterprises with capital from the Ministry as the representative owner; analyzing and assessing, proposing to the Minister measures for managing and improving the efficiency of production and business operations of enterprises in the sector, in accordance with the provisions of the law.

b) Participating in the Board for reviewing and approving plans for the establishment, merger, dissolution, shareholding reform, and ownership transfer of state-owned enterprises within the Minister's decision-making authority, organizing the review and determination of the value of state-owned enterprises when transferring ownership, in accordance with the regulations.

c) Participating in reviewing investment and development projects of enterprises under the Ministry's management.

d) Leading the organization of the review and determination of the value of state-owned enterprises when transferring ownership, in accordance with the regulations.

4. The Inspectorate shall cease performing the following tasks:

Inspecting the implementation of state-assigned objectives and tasks, operational effectiveness, and post-tax profit distribution of state-owned enterprises directly under the Ministry and state-owned enterprises with capital from the Ministry as the representative owner.

5. The Cooperative and Rural Development Bureau shall cease performing the following tasks:

a) Uniformly managing policies for the development of various types of small and medium-sized agricultural enterprises, state-owned farms, and forestry farms.

b) Researching and summarizing the reorganization, reform, and development of state-owned farms and forestry farms.

c) Participating in the reorganization, reform, and development of state-owned farms and forestry farms according to the Minister's assignment.

d) Enhancing the capacity of managers in state-owned farms and forestry farms.

Article 2. This Decision abolishes:

1. The content regarding the construction of strategies and long-term plans related to enterprises specified in Clause 2 and Point b ("Reviewing investment and production development projects of enterprises under the Ministry's management") of Point c, Clause 6, Article 2 of Decision No. 81/2003/QĐ-BNN dated September 4, 2003, of the Minister of Agriculture and Rural Development stipulating the functions, tasks, powers, and organizational structure of the Planning Department.

2. Point a ("Leading the drafting and submitting to the Minister comprehensive plans and programs on restructuring, reforming, and developing state-owned enterprises under the Ministry's management"), Point d ("Submitting to the Minister the charter of organization and operation of state-owned corporations directly under the Ministry"), Point e ("Allocating the quota and unit price of wages for state-owned enterprises under the Ministry according to the provisions of the law") of Clause 1, the content of Point b of Clause 3 ("Guiding enterprises under the Ministry to implement policies for redundant workers due to enterprise restructuring"), Points a, b, and d of Clause 5, the content of Clause 7 ("Reporting and statistics on organization, cadres, labor, training, and enhancement for enterprises under the Ministry's management"), the content of Clause 10 ("Organizing inspections and audits of organizational work, cadre work, and training and enhancement work of enterprises"), Point 14 ("Serving as the permanent member of the State-Owned Enterprise Reform and Development Board") of Article 2 of Decision No. 86/2003/QĐ-BNN dated September 4, 2003, of the Minister of Agriculture and Rural Development stipulating the functions, tasks, powers, and organizational structure of the Cadre and Civil Servant Organization Department.

3. The content of Point a ("Monitoring and inspecting the financial situation of state-owned enterprises directly under the Ministry and state-owned enterprises with capital from the Ministry as the representative owner; analyzing and assessing, proposing to the Minister measures for managing and improving the efficiency of production and business operations of enterprises in the sector, in accordance with the provisions of the law"), Points b and c of Clause 8 of Article 2 of Decision No. 99/2003/QĐ-BNN dated September 4, 2003, of the Minister of Agriculture and Rural Development stipulating the functions, tasks, powers, and organizational structure of the Finance Department.

4. Point b of Clause 5 of Article 2 of Decision No. 97/2003/QĐ-BNN dated September 4, 2003, of the Minister of Agriculture and Rural Development stipulating the functions, tasks, powers, and organizational structure of the Inspectorate.

5. The content of point a "Unifying management on policies for the development of medium and small agricultural enterprises; state farms and forestry farms," point d (the phrase "training to enhance the capacity of farm and forestry managers"), and point đ of Clause 5, Article 2 and point d of Clause 2, Article 3 of Decision No. 96/2003/QĐ-BNN dated September 4, 2003 of the Minister of Agriculture and Rural Development regarding the functions, tasks, authorities, and organizational structure of the Department of Cooperatives and Rural Development.

Article 3. The Director of the Cadre and Civil Service Department shall take the lead, coordinate with relevant Departments and Bureaus, and be responsible for transferring the adjusted duties of the agencies and units specified in Article 1 of this Decision to the Board for Agricultural Enterprise Reform and Management under the Ministry of Agriculture and Rural Development.

Article 4. This Decision shall take effect fifteen days after its publication in the Official Gazette.

Article 5. The Heads of the Office, the Directors of the Cadre and Civil Service Department, the Planning Department, the Finance Department, the Inspectorate, the Department of Cooperatives and Rural Development, the Board for Agricultural Enterprise Reform and Management, and the Heads of related units under the Ministry shall be responsible for implementing this Decision./.
