CIRCULAR
REGULATIONS ON CONDITIONS, DOCUMENTS, PROCEDURES FOR OPENING TRAINING PROGRAMS, SUSPENDING ENROLLMENT, AND WITHDRAWING DECISIONS TO OPEN TRAINING PROGRAMS AT THE VOCATIONAL COLLEGE LEVEL
Pursuant to the Education Law dated June 14, 2005; the Law Amending and Supplementing Certain Provisions of the Education Law dated November 25, 2009;
Pursuant to Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;
Pursuant to Decree No. 32/2008/NĐ-CP dated March 19, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;
Pursuant to Decree No. 75/2006/NĐ-CP dated August 2, 2006 of the Government detailing and guiding the implementation of certain provisions of the Education Law; and Decree No. 31/2011/NĐ-CP dated May 11, 2011 of the Government amending and supplementing certain articles of Decree No. 75/2006/NĐ-CP;
Pursuant to Decree No. 115/2010/NĐ-CP dated December 24, 2010 of the Government stipulating responsibilities for state management of education;
Pursuant to Decision No. 43/2008/QĐ-BGDĐT dated July 29, 2008 of the Minister of Education and Training promulgating the Charter of Vocational Colleges;
At the request of the Director of the Department of Vocational Education,
The Minister of Education and Training hereby stipulates the conditions, documents, and procedures for opening training programs, suspending enrollment, and withdrawing decisions to open training programs at the vocational college level, as follows:
Article 1. Scope of Regulation and Applicability
1. This document stipulates the conditions, documents, and procedures for opening training programs, suspending enrollment in training programs, and withdrawing decisions to open training programs at the vocational college level (hereinafter referred to as TCCN).
2. This document applies to vocational colleges, education and training institutions at the TCCN level (hereinafter collectively referred to as educational institutions) and organizations and individuals related thereto.
Article 2. Authority to Decide on Opening Training Programs at the TCCN Level
1. The Minister, Head of a ministry-level agency decides on opening training programs at the TCCN level for educational institutions under their respective ministries, ministry-level agencies, and educational institutions under enterprises where such ministries, ministry-level agencies exercise some ownership rights and obligations according to the law.
2. The Director of the Department of Education and Training decides on opening training programs at the TCCN level for educational institutions under the province.
3. The Minister of Education and Training decides on opening training programs at the TCCN level for educational institutions under political-social organizations, provincial political schools, provincial military schools, and other educational institutions that offer TCCN training.
Article 3. Conditions for Opening Training Programs at the TCCN Level
An educational institution may open a training program at the TCCN level when it meets the following conditions:
1. It has legal personality and complies with current regulations on TCCN training.
2. The training program proposed for opening must be consistent with the school's functional requirements, tasks, planning, and development strategy, local human resource planning, and industry planning. It ensures there is no overlap in training programs among schools in the same area.
3. The training program proposed for opening must be included in the list of training programs issued by the Ministry of Education and Training.
In cases where the proposed training program is not listed in the training program directory, the educational institution must present scientific arguments about the training program, the need for human resources in the locality and industry, and relevant experience from other countries (if available), and must obtain written approval from the Ministry of Education and Training before submitting the application to the competent authority to decide on opening the program.
4. There must be a teaching staff to implement the training program, specifically:
a) Teachers participating in teaching must meet the standards set forth in the Education Law and the Charter of Vocational Colleges; they must have the appropriate qualifications and practical experience in line with the requirements of the courses they will teach in the training program;
b) There must be a core teaching staff responsible for teaching at least 70% of the workload of the training program corresponding to each knowledge and skill block of the proposed training program, including at least three teachers with a bachelor’s degree or higher in the same field as the proposed training program.
5. There must be facilities and equipment to meet the requirements of the proposed training program, specifically:
a) There must be sufficient classrooms to accommodate the scale of training as prescribed. Classrooms must ensure adequate lighting, ventilation, hygiene, fire safety, and basic equipment for teaching and learning;
b) Laboratories, practice rooms, and internships must meet the basic requirements of the training program. Equipment within these rooms must be sufficient in quantity and quality, arranged appropriately to the content of the training program, student scale, teaching methods, labor safety regulations, and current production technology;
For external internship sites, the educational institution must obtain written consent from the external internship site through a signed agreement between both parties;
c) The library must have a room for information retrieval and equipment to facilitate borrowing and searching for materials; it must have sufficient textbooks, teaching and learning materials, and reference books for students and teachers according to the requirements of the proposed training program;
d) The school's website must be regularly updated, publicly committing to educational quality, disclosing actual educational quality, ensuring quality assurance conditions, and publicly disclosing financial income and expenditure.
6. There must be a training program and detailed course outlines for each course in the training program that meet the following requirements:
a) The program must comply with current regulations on TCCN training, including a plan for implementing the training program that reflects the allocation of time for activities, courses, and study hours suitable for the target group, ensuring a balanced academic load throughout the entire training period. The training program is established according to Model 1 of Appendix II attached to this Circular.
b) Detailed course outlines for each course are established according to Model 2 of Appendix II, wherein:
- The names of courses, course duration, and the timing of the course implementation must be consistent with the training program;
- Course objectives must affirm the expected outcomes of the course (knowledge, skills, attitudes, behaviors that students must achieve upon completion of the course) and align with the overall training program objectives;
- The detailed course outline must specify any prerequisite conditions (if applicable) that students must meet before enrolling in the course.
- Teaching and learning methods for each course must utilize methods that promote the积极性和主动性 of students and are suitable for the nature of the course;
- Assessment of learning outcomes must be consistent with the current regulations on vocational training and the objectives and nature of the course;
- The detailed content of each course includes specific knowledge and skills of the course, which are concretized into sections, chapters, or lessons, and the main contents for each chapter and lesson. These contents must meet the objectives of the course, be appropriate to the duration of the course, and the teaching and learning workload of teachers and students. The content of common courses must comply with the contents prescribed by the Ministry of Education and Training;
- For laboratory practice sessions or internships at external facilities, the objectives, content, plans, timeframes, quality assurance conditions for practice and internship, and other requirements for students during the practice and internship period must be clearly stated;
- Teaching equipment must specify the names, quantities of major equipment, tools, and materials serving theoretical and practical teaching and learning;
- Requirements for teachers instructing the course must clearly state the requirements for professional qualifications, pedagogical qualifications, teaching experience, and practical occupational experience;
- Reference materials used for the course must specify the names of the materials, authors, publication years, publishers. If the reference materials are from the Internet, the website access address must be clearly stated. Reference materials must be up-to-date and relevant to the course content (which can be in Vietnamese or foreign languages);
c) The program development council consists of lecturers and teachers with experience in related content within the program and vocational training teaching experience; educational managers; experts in program development; representatives from units employing labor in the training field. The total number of teachers and lecturers from the training institution participating in the Council shall not exceed two-thirds of the total number of members in the Council;
d) The training program and detailed programs of each course must be approved by the training program evaluation council of the training institution (for institutions permitted to self-evaluate their training programs) or by another training institution designated by the competent authority (for institutions not permitted to self-evaluate their training programs) or have approval documentation from the Ministry of Education and Training (for individual cases specified in point a, Clause 3, Article 4);
7. There must be a management structure and organizational and operational regulations of the school ensuring the implementation of the training program;
8. No violation of regulations on admission, organization, and management of training and other related legal provisions for three consecutive years up to the date of submitting the application to open a training program;
9. For certain special fields of training (Health; Physical Education and Sports; Arts; Teacher Training), in addition to the conditions for opening a training program stipulated in this Document, the training institution must also meet the conditions prescribed by the respective ministries or sectors主管该领域的部门。
Article 4. Review of Training Programs
1. Training institutions are permitted to self-review their training programs when they meet the following conditions:
a) They have been established and organized training for more than three years;
b) They have at least five full-time teachers with bachelor's degrees or higher in the same field as the field they intend to open, including at least one teacher with a master's degree or higher;
c) The field of training they intend to open is included in the list of training fields issued by the Ministry of Education and Training;
d) There has been no violation during the previous self-review of training programs or the review of training programs for other training institutions.
2. Training institutions are designated by authorized agencies to review vocational training programs for other training institutions when they meet the following conditions:
a) They have at least five full-time teachers with bachelor's degrees or higher in the same field as the field they intend to open, including at least one teacher with a master's degree or higher;
b) They are currently implementing vocational training in the field that needs to be reviewed and have at least three graduating classes from this field;
c) There has been no violation during the previous self-review of training programs or the review of training programs for other training institutions;
d) They have not violated current regulations on admissions, organization, and management of training and related legal provisions for three consecutive years up to the time they are designated to review vocational training programs for other training institutions with the field they intend to open.
3. Procedure for reviewing training programs
a) Before submitting the application to open a training field, the training institution sends a letter to the authorized agency requesting permission to self-review the training program (Annex VII) or requesting the authorized agency to designate a reputable training institution to review the training program. Within no more than five working days from the date of receipt of the training institution's request for self-review of the training program or designation of a reputable training institution to review, the authorized agency must respond in writing.
In cases where the field requiring review is not included in the list of fields issued by the Ministry of Education and Training or within the scope of management of the ministry, sector, or locality there is no training institution meeting the conditions stipulated to review the training program of the field intended to be opened and other special cases, the authorized agency to decide on opening the field sends a letter requesting the Ministry of Education and Training to handle individually.
b) After receiving the authorized agency's opinion allowing self-organization of the review of the training program or designating a reputable training institution to review the training program, the training institution proceeds to carry out the following tasks:
- If the training institution is allowed to self-organize the review of the training program, the head of the training institution issues a decision to establish the Review Board and organizes a meeting of the Review Board to review the training program of their own institution.
- If the training institution is not allowed to self-organize the review of the training program, after receiving the authorized agency's opinion on opening the field, the training institution sends the training program to the training institution designated by the authorized agency for review. The head of the designated training institution to perform the review issues a decision to establish the Review Board and organizes a meeting of the Review Board to review the training program within no more than twenty working days from the date the authorized agency sends a letter designating the training institution to perform the review and has received the training program of the training institution requesting the review.
- The composition of the Review Board, the content, and the method of conducting the meeting of the Review Board are carried out according to the current regulations on the review of vocational education programs. After completing the review of the training program, the head of the training institution performing the review confirms in the minutes of the Review Board (Annex VI) and in the training program.
- For training programs handled individually, the training institution sends the training program to the Ministry of Education and Training. Within no more than twenty working days from the date of receipt of the letter from the authorized agency deciding to open the field and the training program of the training institution, the Ministry of Education and Training will issue a response.
4. The costs of organizing the review of training programs are borne by the training institution applying to open a training field according to current regulations.
Article 5. Documents for registering to open a vocational training program
The application package for opening a program shall be compiled by the training institution, bound into a volume, and stamped with a cross-stamp seal, including:
1. Application for registering to open a program (Annex I).
2. Proposal for registering to open a program, including the following contents:
a) Training curriculum and detailed course outlines;
b) Capacity of the training institution:
- List of teaching staff (Model 1, Annex III);
- Inventory of facilities (Model 2, Annex III);
c) Supporting documents and evidence:
- Decision on establishing the Curriculum Development Committee;
- Decision on establishing the Program Review Committee along with the Minutes of the Program Review Committee conducted by the training institution (for institutions authorized to self-review programs) or by the designated authority (for institutions not authorized to self-review programs), or other documents regarding the program review (in exceptional cases);
- Summary files of the teaching staff of the program to be opened (Annex IV);
- Certified copies of academic certificates accompanied by signatures of the certificate holders and teaching credentials of the teachers (except for teachers who have graduated from teacher training universities);
- Evidence for the conditions stipulated in Point b, Clause 5, Article 3 of this Document;
- Minutes confirming the conditions regarding the teaching staff, facilities, and equipment serving training, together with written opinions of the Department of Education and Training where the school is located on the human resource needs in the area (excluding provincial-affiliated training institutions);
Article 6. Procedure for Opening a Vocational Training Program
1. For provincial-affiliated training institutions
a) The training institution prepares five sets of documents according to Article 5 of this Document and submits them to the Department of Education and Training:
- If the application for opening a program meets the required conditions and standards, the Department of Education and Training will lead and coordinate with relevant units to conduct an on-site inspection at the training institution.
- If the application is incomplete or does not meet the required conditions for opening a program, the Department of Education and Training will notify the training institution about the status of the application and request it to continue preparing the necessary conditions.
- The deadline for reviewing the application is no more than five working days from the date of receipt of the application for opening a program from the training institution.
b) On-site Inspection at the Training Institution
- The inspection team consists of representatives from the leadership of the Department of Education and Training (Team Leader), one representative from the unit directly managing vocational training of the Department (Secretary), one representative from the Examination and Quality Assurance Office, one representative from related local departments, and one specialist knowledgeable and experienced in the field of training.
- The inspection includes: The necessity of opening the program; comparing the information declared in the application with current regulations and actual conditions such as the teaching staff allocation plan, salary list, teacher insurance records, facilities, actual equipment, data published on the website of the training institution, and other supporting documents.
- The inspection minutes (Model 1, Annex V) must truthfully record the opinions of all present members regarding the actual situation, the ability to meet the conditions for training, the opinion of the training institution's leadership, and all sign the minutes. The conclusion of the minutes must provide sufficient basis for the competent authority to decide: Agreeing to approve the opening of the program; not allowing the opening of the program, requiring additional conditions; disagreeing with the opening of the program.
- Within twenty working days from the date of receiving a valid application, the authority responsible for opening the program must complete the on-site inspection at the institution.
c) Decision to Approve the Opening of a Training Program
If the training institution meets the required conditions for opening a program, the Director of the Department of Education and Training will issue a decision approving the opening of the training program within ten working days from the date of the on-site inspection results.
In case the training institution has not met the required conditions for opening a program, it is allowed to supplement within thirty days from the date of the on-site inspection results. After completing, the training institution submits a written report on the supplemented contents along with evidence and two complete sets of documents to the authority responsible for opening the program:
- If the training institution meets the required conditions and standards, within ten working days from the date of receiving the report from the training institution, the competent authority must issue a decision to approve the opening of the training program;
- If after thirty days from the date of the on-site inspection results, the training institution still fails to meet the required conditions for opening a program, it must wait three months from the date of the inspection results before resubmitting the application for opening a program and follow the procedures as stipulated in Clause 1 of this Article.
d) The decision to approve the opening of the program, along with the complete application for opening the program and the inspection minutes, must be sent by the authority responsible for opening the program to the Ministry of Education and Training for monitoring and management within five working days from the date of signing.
2. For central-affiliated training institutions and other training institutions
a) Before submitting the application to the authority responsible for opening the program, the training institution prepares the documents according to Article 5 and sends two sets to the Department of Education and Training where the main office is located, along with a letter requesting verification of the conditions regarding the teaching staff, facilities, and equipment serving training.
b) Verification of Conditions for Opening a Program
- The Department of Education and Training where the main office is located leads and coordinates with relevant units to organize the verification. The inspection team consists of representatives from the leadership of the Department of Education and Training (Team Leader), representatives from the unit directly managing vocational training of the Department (Secretary), one representative from the Examination and Quality Assurance Office, one representative from related local departments, and one specialist knowledgeable and experienced in the field of training.
- The inspection team conducts a verification check between the contents declared in the dossier and the actual conditions such as: the school's salary table, teachers' insurance books, infrastructure, actual equipment, and other evidentiary documents, while simultaneously preparing an inspection record (Model 2 Appendix V).
- The deadline for completing the inspection shall not exceed twenty working days from the date of receiving the valid dossier.
- The funding for the Department of Education and Training to carry out the inspection shall be borne by the training institution that has registered to open a program according to current regulations.
c) The training institution submits two sets of registration dossiers for opening a program along with the actual inspection record and a written opinion on the human resource needs in the area provided by the Department of Education and Training to the competent authority deciding to open the program.
- If the registration dossier for opening a program submitted by the training institution meets the required conditions and standards as stipulated, within ten working days from the date of receipt of the valid dossier, the competent authority must issue a decision allowing the opening of the vocational training program.
- If the registration dossier for opening a program submitted by the training institution meets the required conditions as stipulated but still requires some completion, within five working days from the date of receipt of the dossier, the authority deciding to open the program will notify the training institution in writing about the necessary supplementary and completion items. Within ten working days from the date of receipt of the completed dossier from the training institution, if the training institution meets the required conditions as stipulated, the competent authority will issue a decision to open the vocational training program.
- If the registration dossier for opening a program submitted by the training institution does not meet the required conditions as stipulated, within five working days from the date of receipt of the dossier, the authority deciding to open the program will notify the training institution in writing about the status of the dossier and request the training institution to continue preparing the required conditions. In this case, the training institution may resubmit the registration dossier for opening a program only after three months from the date the authority deciding to open the program sent the notification letter, and it must follow the procedures strictly as prescribed in Clause 2 of this Article.
The decision allowing the opening of a program, together with the completed registration dossier for opening a program and the inspection record of the conditions, must be sent by the authority deciding to open the program to the Ministry of Education and Training for monitoring and management within five working days from the date of signature (except for training institutions whose programs are decided by the Ministry of Education and Training).
Article 7. Suspension of Admissions for Vocational Training Programs
1. A training institution shall be suspended from admitting students into a vocational training program in the following cases:
a) Failing to meet one of the conditions for opening a vocational training program as specified in Article 3 of this Document;
b) Conducting training outside the permitted location;
c) Not complying with the procedure for opening a program as prescribed in Article 6;
d) The person authorizing the opening of the program lacks the appropriate authority;
đ) Violating education laws and regulations to the extent that administrative penalties require suspension;
f) Other cases as prescribed by law.
2. The authority deciding to open a vocational training program also has the authority to decide on suspension.
3. The decision to suspend admissions for a vocational training program must clearly state the reasons for the suspension, specify the duration of the suspension, and outline measures to ensure the rights of students and teachers. The decision to suspend admissions for a vocational training program must be publicly announced through mass media.
4. Procedures and formalities for suspending admissions or allowing admissions to resume:
a) When discovering that a training institution violates any of the circumstances stipulated in Clause 1 of this Article, the authority deciding to open the program organizes an inspection to assess the level of violation;
b) Based on the level of violation by the training institution, the authority deciding to open the program issues a decision to suspend admissions for the vocational training program;
c) After the suspension period, if the cause leading to the suspension of admissions is resolved and the training institution has a dossier requesting permission to resume admissions, the authority deciding to suspend admissions issues a decision allowing the training institution to resume admissions.
The dossier requesting permission to resume admissions includes: a request for permission to resume admissions; a report explaining the resolution of the causes leading to the suspension of admissions, accompanied by evidence.
5. Decisions to suspend admissions for vocational training programs and decisions to allow admissions to resume must be sent to the Ministry of Education and Training for monitoring within five working days from the date of signature (except for training institutions whose programs are decided by the Ministry of Education and Training).
Article 8. Revocation of Decision to Open Vocational Training Programs
1. Educational institutions shall have their decision to open vocational training programs revoked in the following cases:
a) Engaging in fraudulent acts or providing false evidence in declaring conditions for ensuring quality regarding physical facilities, teaching staff, management personnel, or copying entirely the training program of another educational institution;
b) Seriously violating regulations on management, organization, and training at the educational institution;
c) Expiring the suspension period for admissions to the training program without rectifying the causes leading to such suspension;
d) Violating education laws subject to administrative penalties that require revocation.
đ) Other cases as prescribed by law.
2. The authority that decides to open a training program has the authority to revoke this decision.
3. The decision to revoke the decision to open a training program must clearly specify the reasons for revocation and specific measures to ensure the rights of students and teachers. Such a decision must be publicly announced through mass media and sent to the Ministry of Education and Training within no more than five working days from the date of issuance (except for educational institutions whose training programs were decided by the Ministry of Education and Training).
4. Procedures and formalities for revoking the decision to open a training program
a) When an educational institution violates any of the provisions stipulated in Clause 1 of this Article, the authority deciding to open the training program shall organize inspections to assess the extent of the violation;
b) Based on the extent of the violation, the authority deciding to open the training program shall issue a decision to revoke the decision to open the training program.
5. In cases where an educational institution violates regulations on opening training programs but continues to admit students, the Ministry of Education and Training will issue a document requesting the authority deciding to open the training program to issue a decision suspending admissions or revoking the decision to open the training program depending on the severity of the violation. Simultaneously, within two years from the date the Ministry of Education and Training sends a document to the authority deciding to open the training program regarding the violation, the authority deciding to open the training program may only issue a new decision to open a training program after obtaining written consent from the Ministry of Education and Training.
Article 9. Responsibilities of the Ministry of Education and Training
The Department of Vocational Education shall take the lead and coordinate with the Department of Planning and Finance and related units to assist the Minister in:
1. Directing, guiding, inspecting, and supervising the implementation of regulations on opening training programs, suspending admissions, and revoking decisions to open training programs at the intermediate vocational level.
2. Organizing the review of applications and conditions for registering to open intermediate vocational training programs for educational institutions decided by the Ministry of Education and Training.
3. Annually compiling and reporting to the Minister on the situation of opening training programs at schools under ministries, sectors, localities, and other educational institutions.
Article 10. Responsibilities of Ministries and Agencies Equivalent to Ministries with Intermediate Vocational Training Institutions
1. Taking the lead and coordinating with related units to organize the review of applications and conditions for registering to open intermediate vocational training programs for educational institutions decided by ministries and agencies equivalent to ministries according to the provisions of this Document.
2. Monitoring the implementation of training organization by educational institutions for registered programs.
3. Reporting to the Ministry of Education and Training when educational institutions make changes to admission criteria, training duration, admission locations, and other changes.
4. Sending decisions allowing the opening of intermediate vocational training programs, suspending admissions to training programs, and revoking decisions to open training programs to local Departments of Education and Training where the schools are headquartered for monitoring.
5. Publicizing decisions allowing the opening of intermediate vocational training programs, suspending admissions to training programs, and revoking decisions to open training programs on the website of the unit.
6. Reviewing and inspecting quality assurance conditions for training programs of subordinate educational institutions that were permitted to admit students before the effective date of this Circular. Issuing decisions to suspend admissions for training programs that currently do not meet the prescribed quality assurance conditions.
Article 11. Responsibilities of the Department of Education and Training
1. Taking the lead and coordinating with related units to organize the review of applications and conditions for registering to open intermediate vocational training programs for educational institutions decided by Departments according to the provisions of this Document.
2. Monitoring the implementation of training organization by educational institutions for registered programs.
3. Reporting to the Ministry of Education and Training when educational institutions make changes to admission criteria, training duration, admission locations, and other changes.
4. Publicizing decisions allowing the opening of intermediate vocational training programs, suspending admissions to training programs, revoking decisions to open training programs, inspection team lists along with inspection records of program opening conditions (of all educational institutions in the locality) on the website of the unit.
5. Organizing inspections and confirming actual conditions regarding teaching staff, physical facilities, and equipment serving training for educational institutions outside the jurisdiction of the Department of Education and Training when the institution requests.
6. The Director of the Department of Education and Training is responsible for compliance with regulations, honesty, and accuracy of actual inspection results at educational institutions.
7. Reviewing and inspecting quality assurance conditions for training programs of subordinate educational institutions that were permitted to admit students before the effective date of this Circular. Issuing decisions to suspend admissions for training programs that currently do not meet the prescribed quality assurance conditions.
Article 12. Responsibilities and rights of training institutions designated to review training programs
1. Review training programs of training institutions in accordance with this Document and current regulations on reviewing vocational education programs when authorized by competent authorities to open new fields.
2. Have the right to examine relevant files and documents related to the development of training programs and have the right to request training institutions to provide related documents and information.
3. Conduct impartial and honest reviews. Bear responsibility for the results of the review of training programs.
4. Be subject to inspection, audit, and supervision by competent authorities that decide to open new fields and other competent authorities regarding the results of the review of training programs.
5. If during the review process, the training institution designated to review the training program of another institution violates the provisions of this Document, it will be suspended from being assigned the task of reviewing training programs and will be dealt with according to current regulations depending on the severity of the violation.
Article 13. Responsibilities of Training Institutions
1. Comply with regulations on conditions, application forms, and procedures for registering to open vocational training fields.
2. Ensure the accuracy and truthfulness of the registration form for opening vocational training fields.
3. Have the responsibility to provide complete information, documents, and evidence when requested by the inspection team or the Review Board.
4. Publicize the list of teachers and facilities of the field to be opened on the unit's website before submitting the registration form for opening the field.
5. Implement the content of the training program and quality assurance conditions as committed in the registration form for opening the field after approval and must make appropriate adjustments for subsequent courses to comply with current regulations on vocational training.
6. During the organization of training, if there is a need to supplement the recruitment target (change training duration) or recruit and train at a new branch (satellite campus), the training institution must adjust the training program, prepare the necessary conditions to ensure the output standards of the training field, and report to the competent authority that decides to open the field. The training institution may only recruit and train in these cases without violating current regulations on vocational training at the time of registration for supplementary adjustment and upon written approval by the competent authority.
7. For training fields where the training institution has not recruited students for five consecutive years, before resuming recruitment, the training institution must submit a report to the competent authority that decides to open the field regarding the quality assurance conditions for this training field.
Article 14. Effective Date
This Circular takes effect from December 26, 2011.
Previous regulations contrary to those stipulated in this Circular are hereby abolished.
Article 15. Implementation Organization
The Director of the Ministry’s Office, the Director of the Department of Vocational Education, the heads of units under the Ministry of Education and Training related to this matter, the heads of ministries and sectors with vocational colleges and other units providing vocational training, the Directors of provincial education and training departments, the Principals of vocational colleges, and the heads of other units providing vocational training are responsible for implementing this Circular./.
