Circular No. 20/2024/TT-BCA amends and supplements certain Articles of Circular No. 56/2021/TT-BCA and Circular No. 17/2024/TT-BCA related to the procedures for registering residence, managing residence, and citizen identity cards. This Circular takes effect from July 1, 2025.

CIRCULAR
Amending and supplementing some articles of Circular No. 55/2021/TT-BCA dated May 15, 2021, issued by the Minister of Public Security detailing certain provisions and measures to implement the Law on Residence, which has been amended and supplemented by Circular No. 66/2023/TT-BCA dated November 17, 2023; Circular No. 56/2021/TT-BCA dated May 15, 2021 issued by the Minister of Public Security regarding forms for registration and management of residence, which has been amended and supplemented by Circular No. 66/2023/TT-BCA dated November 17, 2023; Circular No. 17/2024/TT-BCA dated May 15, 2024 issued by the Minister of Public Security detailing certain provisions and measures to implement the Law on National Identity Cards. At the proposal of the Director of the Police Department for Administrative Management under Social Order; The Minister of Public Security issues this Circular amending and supplementing some articles of Circular No. 55/2021/TT-BCA dated May 15, 2021, issued by the Minister of Public Security detailing certain provisions and measures to implement the Law on Residence, which has been amended and supplemented by Circular No. 66/2023/TT-BCA dated November 17, 2023; Circular No. 56/2021/TT-BCA dated May 15, 2021, issued by the Minister of Public Security regarding forms for registration and management of residence, which has been amended and supplemented by Circular No. 66/2023/TT-BCA dated November 17, 2023; Circular No. 17/2024/TT-BCA dated May 15, 2024 issued by the Minister of Public Security detailing certain provisions and measures to implement the Law on National Identity Cards. Article 1. Amending and supplementing some articles of Circular No. 55/2021/TT-BCA dated May 15, 2021, issued by the Minister of Public Security detailing certain provisions and measures to implement the Law on Residence, which has been amended and supplemented by Circular No. 66/2023/TT-BCA dated November 17, 2023
Based on the Residence Law dated November 13, 2020;
Pursuant to the Law on Identity Cards dated November 27, 2023;
BASED ON DECREE NO. 02/2025/ND-CP DATED FEBRUARY 18, 2025 OF THE GOVERNMENT ON FUNCTIONS, TASKS, POWERS, AND ORGANIZATIONAL STRUCTURE OF THE MINISTRY OF PUBLIC SECURITY;
1. Amending and supplementing Clause 2 and Clause 3 of Article 3 as follows:
"2. In cases where the application is submitted directly at the registration authority, citizens provide information including their surname, middle name, given name at birth, date of birth, personal identification number, place of residence, and other information about the conditions for registering residence. The officer receiving the application will search and extract citizen information from the National Population Database and related databases and systems to create the registration file. After completing the submission, the person requesting online registration will be issued one administrative procedure file number for tracking and checking the progress of the file processing. Citizens are responsible for presenting original documents and materials proving the declared information for the registration authority to check, compare, and record the accuracy in the verification report.
3. In cases of online registration, citizens declare information according to the provided electronic form and other information and documents about the conditions for registering residence; pay fees through the online payment function. After completing the submission, the person requesting online registration will be issued one administrative procedure file number for tracking and checking the progress of the file processing. Citizens are responsible for presenting original documents and materials proving the declared information for the registration authority to check, compare, and record the accuracy in the verification report."
"2. Documents and materials confirming care, upbringing, and assistance include one of the following documents: confirmation by the People's Committee of the commune on care and upbringing; decision to accept by the head of a social welfare facility; decision to support by the People's Committee of the commune or other documents and materials as prescribed by law."
3. Amending and supplementing Clause 1 of Article 9 as follows:
"1. Foreigners who are granted Vietnamese nationality upon registering permanent residence, temporary residence, or first-time declaration of residence information must have a Decision of the President of the State granting Vietnamese nationality. Vietnamese origin persons who are re-granted Vietnamese nationality upon registering permanent residence, temporary residence, or first-time declaration of residence information must have a Decision of the President of the State granting re-granting of Vietnamese nationality, except when such information can be obtained from the Nationality Database."
2. Amending and supplementing Clause 2 Article 8 as follows:
4. Amending Clause 7 of Article 22 as follows:
"7. Directing, inspecting, and guiding the police at the commune level on registration and management of residence; guiding registration to ensure community reintegration for individuals who have completed serving prison sentences and reside in the locality; managing, operating, and utilizing the Database on Residence."
5. Amending and supplementing Article 24 as follows:
"Article 24. Responsibilities of the police at the commune level
1. Implementing the responsibilities stipulated in Article 33 of the Law on Residence.
2. Collecting, updating, and correcting information about citizens in the Database on Residence and the National Population Database within their jurisdiction;
3. Cooperating with agencies, organizations, and individuals directly managing road transport vehicles, railway transport vehicles, inland waterway transport vehicles operating passenger transport services in their management area to review and compile statistics on the residence status of drivers and staff on these vehicles to serve the management of residence and crime prevention.
4. Performing other tasks related to residence management as prescribed by higher-level public security authorities.
5. Regularly and urgently conducting inspections of residence."
6. Removing the phrase "under the Central Government" in Articles 9, 22, and 27.
7. Abolishing Article 23.
5. Periodically and unexpectedly carry out residence inspections.
6. Delete the phrase "under the central authority" in Article 9, Article 22, and Article 27.
7. Repeal Article 23.
Article 2. Amend, supplement, and abolish some forms issued together with Circular No. 56/2021/TT-BCA dated May 15, 2021, of the Minister of Public Security stipulating forms for registration and management of residence, which have been amended and supplemented by Circular No. 66/2023/TT-BCA dated November 17, 2023 (hereinafter referred to as Circular No. 56/2021/TT-BCA).
1. Replace form CT01 issued together with Circular No. 56/2021/TT-BCA with the form Declaration of Change in Residence Information, designated as CT01 issued together with this Circular.
2. Replace form CT02 issued together with Circular No. 56/2021/TT-BCA with the form Declaration of Change in Residence Information (for Vietnamese citizens residing abroad without valid Vietnamese passports), designated as CT02 issued together with this Circular.
3. Replace form CT03 issued together with Circular No. 56/2021/TT-BCA with the form Temporary Absence Declaration Form, designated as CT03 issued together with this Circular.
4. Replace form CT12 issued together with Circular No. 56/2021/TT-BCA with the form Statistics on Registration and Management of Residence Status, designated as CT12 issued together with this Circular.
5. Replace form CT15 issued together with Circular No. 56/2021/TT-BCA with the form Register of Receipt and Delivery of Residence Files, designated as CT15 issued together with this Circular.
6. Replace form CT16 issued together with Circular No. 56/2021/TT-BCA, which has been amended and supplemented by Circular No. 18/2024/TT-BCA dated May 15, 2024, of the Minister of Public Security stipulating procedures for issuance, replacement, and reissuance of identity cards, with the form Register for Search and Exploitation of Identity and Residence Records, designated as CT16 issued together with this Circular.
7. Abolish form Residency File Bag, designated as CT13 issued together with Circular No. 56/2021/TT-BCA.
8. Delete the phrase "under the Central" in Article 7.
Article 3. Amend and supplement some articles of Circular No. 17/2024/TT-BCA dated May 15, 2024, of the Minister of Public Security detailing certain provisions and measures for implementation of the Law on Identity Cards.
1. Amend and supplement Article 5 as follows:
"Article 5. Information about place of birth, place of birth registration, place of origin, ethnicity, and religion in the National Population Database and the Identity Card Database
1. In cases where information about place of birth, place of birth registration, and place of origin in the National Population Database and the Identity Card Database does not contain or is incomplete regarding administrative units at the commune and provincial levels, the identity card management authority shall request citizens to provide documents and materials issued by competent authorities that fully reflect such information to collect, update, and adjust it into the National Population Database and the Identity Card Database. Information about place of birth, place of birth registration, and place of origin shall be recorded according to the information on the birth certificate; in cases where there has been a change in administrative unit names, the new name shall be recorded along with a note of the original information on the birth certificate.
In cases where the documents and materials provided by citizens do not fully reflect administrative units at the commune and provincial levels, the identity card management authority shall request citizens to provide the information and issue a written commitment and assume responsibility for the information about place of birth, place of birth registration, and place of origin they have provided. The identity card management authority shall cooperate with the civil registry management authority and other relevant authorities to verify and ensure accuracy and consistency before collecting, updating, and adjusting the information into the National Population Database and the Identity Card Database.
2. In cases where information about ethnicity and religion on the identity card is not present or has already been collected but citizens request updates or adjustments, the identity card management authority shall be responsible for updating and adjusting according to the provisions of Article 10 of the Law on Identity Cards.
Information about ethnicity and religion must belong to the list of ethnicities and religions recognized by the competent authority and must be updated and adjusted into the National Population Database and the Identity Card Database.".
2. Amend and supplement Article 15 as follows:
"Article 15. Responsibilities of the Police Station at the Commune Level
1. Collect, update, and adjust information about citizens and Vietnamese nationals whose nationality cannot be determined in the National Population Database and the Identity Card Database; standardize, digitize, and exploit information in the National Population Database and the Identity Card Database; manage identity cards and identity card certificates.
2. Monitor, compile statistics, and review citizens and Vietnamese nationals whose nationality cannot be determined who have not been issued identity cards or identity card certificates.
3. Organize the collection of applications for issuance of identity cards and identity card certificates; inspect the use of identity cards and identity card certificates by citizens and Vietnamese nationals whose nationality cannot be determined according to the law.
4. Resolve complaints and reports related to the collection, updating, adjustment, and exploitation of information in the National Population Database and the Identity Card Database and the issuance and management of identity cards within their jurisdiction.
5. Report periodically and urgently on the issuance and management of identity cards in their jurisdiction to the Provincial Police Department.".
3. Replace some forms issued together with Circular No. 17/2024/TT-BCA as follows:
a) Replace form DC01 issued together with Circular No. 17/2024/TT-BCA with the form Citizen Information Collection Form, designated as DC01 issued together with this Circular;
b) Replace form CC03 issued together with Circular No. 17/2024/TT-BCA with the form Notice of Refusal to Process Identity Card Procedures, designated as CC03 issued together with this Circular.
4. Delete the phrase "under the Central" in Article 17.
5. Abolish Article 14.
Article 4. Effective date
This Circular takes effect from July 1, 2025.
Article 5. Responsibilities for Implementation
1. The Director of the Administrative Police Department under the Ministry of Public Security shall be responsible for monitoring, guiding, inspecting, and urging units and local police forces to implement this Circular.
2. Heads of units under the Ministry of Public Security and Directors of Provincial Police Departments shall be responsible for implementing this Circular.
3. During the implementation of this Circular, if there are difficulties or obstacles, the police units and localities shall report to the Ministry of Public Security (through the Administrative Police Management Bureau) for timely guidance./.
