DECREE
Regulations on the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology
Pursuant to the Government Organization Law on February 18, 2025;
Pursuant to the proposal of the Minister of Science and Technology;
The Government promulgates this Decree to regulate the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology.
Article 1. Position and Functions
The Ministry of Science and Technology is an agency of the Government, responsible for managing state activities related to scientific research, technological development, innovation, high technology, strategic technology, scientific and technological potential development; intellectual property; standards, measurements, and quality; atomic energy, radiation and nuclear safety; postal services; telecommunications; radio frequencies; information and communication technology industry, digital technology industry; information and communication technology application; electronic transactions; national digital transformation; state management over public services under the sector and field managed by the ministry according to the law.
b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;
The Ministry of Science and Technology performs the tasks and powers as prescribed by the Law on the Organization of the Government, the Government's regulations on the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies, and the following specific tasks and powers:
1. Submit to the Government draft laws, draft resolutions of the National Assembly, draft ordinances, draft resolutions of the Standing Committee of the National Assembly; draft decrees of the Government according to the annual legislative program and plans of the Government and resolutions, projects, programs assigned by the Government and the Prime Minister.
2. Submit to the Government and the Prime Minister strategies, planning, long-term, medium-term, and annual development plans; important national projects, programs, projects, and programs within the sectors and fields under its management; decisions, directives, and other documents within the authority of the Prime Minister.
3. Issue circulars, decisions, directives, and other documents regarding the management of sectors and fields under the state management of the ministry.
4. Approve directions, goals, tasks, and plans for science, technology, and innovation every five years and annually; tasks for science, technology, and innovation under the state management of the ministry in accordance with the strategy for the development of science, technology, and innovation and the delegation and authorization of the Government and the Prime Minister.
5. Direct, guide, inspect, and be responsible for organizing the implementation of normative legal documents, strategies, planning, programs, projects, and plans that have been approved; disseminate, popularize, and educate about the law in sectors and fields under the state management of the ministry.
6. Issue, amend, supplement, extend, temporarily suspend, suspend, and revoke licenses, certificates, confirmation papers, registration papers within the scope of state management of the ministry's sectors and fields according to the law.
7. Regarding scientific, technological, and innovation activities
a) Direct and guide the implementation of directions, goals, and tasks for scientific research, technology, and innovation, promoting the development of key economic and technical sectors based on the application, innovation, and mastery of technology, developing new technologies, high technologies, digital technologies, strategic technologies, and commercializing technology, results of scientific research, and technological development;
b) Manage state activities related to research, development, and application of technology in various economic and technical sectors; guide ministries, sectors, and localities on professional management of scientific research, technology, and innovation activities;
c) Build, guide, and organize the implementation of mechanisms and policies for high technology and high-tech zones; manage and organize the certification of high technology activities and high technology enterprises; build databases and information infrastructure for high technology;
d) Manage state activities related to strategic technology; build, guide, and organize the implementation of mechanisms, policies, programs, and measures to encourage and promote the development of strategic technology in Vietnam;
đ) Guide the determination, ordering, selection, direct assignment, evaluation, and acceptance of scientific research, technology, and innovation tasks; coordinate with the Ministry of Finance to guide the determination of the value of assets resulting from scientific and technological tasks and intellectual property according to the law; the transfer of ownership and usage rights of research results, technological development, and innovation funded by the state budget. Exploit, apply, and commercialize technology, results of scientific research, and technological development; publish and promote the results of scientific research, technological development, and innovation;
e) Manage scientific research, technology, and innovation tasks within the scope of the ministry's management; build, guide, and organize the implementation of national scientific and technological tasks; manage and organize the implementation of tasks in national scientific, technological, and innovation programs approved by the Prime Minister;
g) Inspect, supervise, and evaluate the implementation process and post-acceptance of scientific, technological, and innovation programs, topics, and projects funded by the state budget according to the delegation; organize independent evaluations of scientific research, technological development, and innovation results;
h) Guide and register the activities of scientific and technological organizations according to the law;
i) Build, guide, and organize the implementation of mechanisms and policies to encourage and support the development of applied technology and technical progress, and technology incubation;
k) Support organizations and individuals in evaluating technology, innovating technology, searching for technology, transferring technology, decoding, and mastering technology from abroad, exploiting inventions; guide, assess technological level and capacity, and build a national technology development orientation and innovation roadmap according to the law;
1) Establish, submit to the Government for approval specific regulations on the authority, procedures, conditions for issuing certificates of qualification for technology assessment, inspection, and appraisal services; special conditions regarding human resources and technical infrastructure for organizations conducting technology valuation activities and after issuance;
m) Establish, guide, and implement mechanisms and policies for technology assessment, inspection, appraisal, and technology transfer activities; manage the importation of used machinery, equipment, and technological production lines; manage the identification of investment projects using outdated technology with potential environmental pollution risks; inspect the quality and value of machinery, equipment, and technological production lines of investment projects in accordance with the law; assess and provide opinions on technology; provide comments on scientific and technological content in national-level, regional, provincial, special administrative-economic zone, urban, rural planning, specialized technical planning, research programs, and development plans serving technology transfer and the science and technology market;
8. On innovation and development of the technology market
a) Uniformly manage innovation activities; establish, guide, inspect, and implement preferential mechanisms and policies to encourage innovation and mobilize investment resources for innovation;
b) Manage, guide, and organize the implementation of innovation activities; develop the science and technology market and the national innovation system with enterprises at the center; create and promote a supportive legal environment for innovation;
c) Guide the establishment, management, and development of innovation organizations and innovation support organizations; organize the determination of innovation centers and innovation support organizations in accordance with the law; build, operate, and develop an innovation network;
d) Manage, guide, and implement the development of the science and technology market; promote the technology market at the regional, national, and international levels; intermediary organizations of the science and technology market, technology trading centers, and technology exchange platforms;
đ) Support the enhancement of technological capacity for enterprises in accordance with the law; build and implement programs and projects to support the development of the science and technology market;
e) Direct and organize technology and equipment markets, activities connecting supply and demand for technology; technology transactions and promotion of technology transfer; exhibitions of science, technology, and innovation;
9. On creative entrepreneurship and science and technology enterprises
a) Uniformly manage technology incubation, creative entrepreneurship, and science and technology enterprises; establish, guide, inspect, and implement mechanisms and policies for identifying, recognizing, providing incentives, supporting, and encouraging the development of technology incubators, enterprise incubators, technical facilities, shared workspaces, individuals, individual groups, creative entrepreneurs, startup advisors, startup support organizations, investors for startups, and other subjects in the startup ecosystem;
b) Manage and develop the national startup ecosystem; create and promote a legal environment and mobilize investment resources for creative entrepreneurship, technology incubation, and enterprise incubation;
c) Manage, guide, and organize the implementation of the development of startup support organizations, technology incubators, enterprise incubators, technical facilities, shared workspaces for startups; build, operate, and develop a national startup network, experts, advisors, and startup investors;
d) Build and implement programs, projects, and initiatives to support technology incubation, enterprise incubation, and creative entrepreneurship; support public higher education institutions, vocational training institutions, and other public science and technology organizations in establishing, participating in establishing, and contributing capital to enterprises to commercialize research results and technological development; direct and organize events on technology incubation, enterprise incubation, and creative entrepreneurship domestically and internationally;
10. On developing scientific, technological, and innovative capabilities
a) Lead and coordinate with ministries, sectors, and localities to build and submit to competent authorities for approval the planning of networks of public science and technology organizations and implement after issuance; guide the implementation of self-management mechanisms for public science and technology organizations; submit to the Prime Minister for approval the list of basic and essential public service programs in the field of science and technology; lead and coordinate with the Ministry of Finance and relevant ministries and agencies to submit to competent authorities for approval and implement mechanisms and policies to enhance the self-management capacity of public science and technology organizations;
b) Specify criteria for classification, ranking, establishment conditions, mergers, consolidations, restructuring, and dissolution of science and technology organizations; establish, review the establishment, restructure, and dissolution of public science and technology organizations in accordance with the law; guide the functions, tasks, powers, organizational structure, and operational regulations of the Management Council in public science and technology organizations;
c) Build and implement long-term training plans for scientific and technological human resources; training, upgrading, and enhancing professional skills in science and technology; organize the implementation of professional training and upgrading for scientific and technological personnel under its management scope;
d) Issue or submit to competent authorities for issuance and implementation mechanisms and policies on training, development, utilization, and promotion of individuals engaged in science and technology activities; policies to attract scientists, excellent experts, and overseas Vietnamese intellectuals;
đ) Manage, guide, and organize the implementation of information, library, statistical activities related to science, technology, and innovation; manage domestic scientific and technological publications; build infrastructure for scientific and technological information, statistics, and innovation; develop national databases on science and technology; scientific and technological databases and innovation; concentrate on collecting international scientific and technological information; invest in developing a national scientific and technological information network connected with regions and internationally;
e) Build, guide, and organize the implementation of communication activities related to science, technology, and innovation;
11. On intellectual property
a) Take the lead in coordinating with ministries, sectors, and localities to build, guide, and implement mechanisms, policies, strategies, plans, programs, and projects on intellectual property;
b) Build, guide, organize the implementation, and inspect the enforcement of laws on intellectual property; establish procedures and processes for establishing and transferring industrial property rights of organizations and individuals;
c) Manage state activities related to inventions;
d) Guide and organize the implementation of the establishment and transfer of industrial property rights, including managing the use of national geographical indications ("Vietnam," "Viet," "Viet Nam," "Viet") for registering certification marks and collective marks for Vietnamese products and services; take measures to protect the legitimate rights and interests of the State, organizations, and individuals in the field of industrial property;
đ) Provide guidance on industrial property business for management agencies, organizations, and individuals; guide and support organizations and individuals in managing, exploiting, and developing intellectual property assets within the scope of state management according to the provisions of the law;
e) Manage activities related to representation of industrial property, technical appraisal on industrial property, and other intellectual property services;
g) Lead the organization to resolve disputes over industrial property and commercial disputes related to industrial property according to the provisions of the law;
h) Coordinate with the Ministry of Culture, Sports and Tourism, the Ministry of Agriculture and Rural Development, and the Ministry of Industry and Trade to manage intellectual property in relevant fields according to the division of labor by the Government;
12. On standards, measurement, and quality
a) Manage activities in the field of standards and technical regulations; appraise and publish national standards; guide the construction and appraisal of national technical regulations; participate in building international standards, regional standards; guide the application of international standards, regional standards, and foreign standards in Vietnam; guide the construction of local technical regulations; guide the construction and publication of basic standards; manage the activities of the network of notification and inquiry agencies and the inter-ministerial board on technical trade barriers; manage the national database on national standards and national technical regulations; manage state activities on product labels, codes, barcodes, and product origin traceability;
b) Organize the construction and guidance on the application of national standards and the construction, issuance, and guidance on the application of national technical regulations in the assigned management areas; perform the functions and tasks of the notification and inquiry agency on technical trade barriers in the areas under the ministry's state management;
c) Manage the establishment, maintenance, preservation, use, development, and application of the metrology standard system; approve national metrology standards; organize research, deployment, application, development, manufacturing, production of metrology products, standards, and equipment; designate organizations to maintain national metrology standards; organize management of metrology activities for measuring instruments, measurements, prepackaged quantities, metrology standards; organize management of metrological verification, calibration, testing of measuring instruments, metrology standards; support innovation and development of metrology activities in enterprises; carry out state inspections on metrology, product quality, and product labels according to the provisions of the law;
d) Lead and coordinate with relevant ministries and sectors to organize state management of product quality and origin traceability in export and import goods production, circulation in the market, and during use according to the provisions of the law;
đ) Guide and manage conformity assessment activities related to standards and technical regulations, recognition of conformity assessment organization capabilities;
e) Organize research, deployment, application, and improvement of productivity and quality in industries and fields; lead the implementation of the national program to improve productivity and quality of products and goods; lead, deploy, and apply origin traceability; research, advise, train, apply science, technology, and innovation in the field of standards, measurement, and quality; lead and coordinate with relevant ministries and sectors to implement international agreements and treaties in the fields of standards, technical regulations, measurement, productivity, product quality, product labels, codes, barcodes, and product origin traceability, conformity assessment; manage, guide, and organize the implementation of advanced quality management systems in the activities of administrative state agencies, organizations, and enterprises; manage, guide, and organize the National Quality Award; manage the organization of awarding quality product and good awards to organizations and individuals;
g) Organize the construction, management, operation, maintenance, exploitation of the database system for product and commodity code numbers and barcodes and origin tracing; organize training, instruction, and professional development in the field of product and commodity code numbers and barcode and origin tracing for administrative state agencies, organizations, and enterprises.
13. On atomic energy, radiation safety, and nuclear safety
a) State management over research, development, and application of atomic energy in economic and technical sectors; take the lead and coordinate with ministries and sectors to build, guide, and implement planning and plans for the development of atomic energy applications serving economic and social development;
b) State management over ensuring radiation safety and nuclear safety, nuclear security, and nuclear inspection; emergency response to radiation and nuclear incidents;
c) Build, submit to competent authorities for issuance or issue according to their authority, and organize the implementation of mechanisms, policies, regulatory legal documents on atomic energy, radiation safety, and nuclear safety as prescribed;
d) Inspect and handle violations concerning the assurance of radiation safety and nuclear safety in activities within the field of atomic energy;
đ) Organize the management of the national radiation monitoring and warning network and the radiation and nuclear measurement standard system;
e) Implement state management over nuclear fuel safety, used nuclear fuel, nuclear materials, nuclear material sources, radioactive waste, and service activities supporting the application of atomic energy; manage the import and export of radiation technology equipment, nuclear fuel, used nuclear fuel, nuclear materials, and radioactive sources nationwide;
g) Specify the control and handling of radiation incidents and nuclear incidents;
h) Specify regulations on occupational radiation exposure control, medical radiation, and public radiation safety;
14. On postal services
a) Guide, organize, and inspect the implementation of mechanisms, policies, strategies, planning, plans, projects, programs on postal services; organize inspections of the postal service public utility service catalog, support mechanisms, and operations according to the provisions of the law;
b) Specify, manage prices and quality of postal service public utilities, exclusive postal services, postal services for Party and State agencies, and other postal services according to the provisions of the law;
c) Manage postal stamps, ensure safety in postal service activities according to their authority;
d) Manage the national postal code system, Vietnam's postal stamp numbering system;
đ) Specify and guide the operation of the public postal network and the postal network serving Party and State agencies;
e) Coordinate in managing competition and resolving disputes in the postal sector, protecting the legitimate rights of postal service users according to the provisions of the law;
15. On telecommunications
a) Guide, direct, and organize the implementation of strategies, planning, plans, programs, mechanisms, and policies on telecommunications, the Internet, digital infrastructure;
b) Issue, specify the catalog, scope, target groups, prices of telecommunications public utility services, and support mechanisms for enterprises to provide telecommunications public utility services, support the use of telecommunications public utility services, and terminal equipment according to the provisions of the law; organize the implementation of the program for providing telecommunications public utility services;
c) Take the lead in building and organizing the implementation of regulations on market management and competition in the telecommunications and Internet sectors; protect the rights of telecommunications and Internet service users according to the provisions of the law;
d) Issue and organize the implementation of planning and regulations on the management and use of telecommunications number pools and Internet resources; allocate, issue, and reclaim telecommunications number pools and Internet resources; organize the implementation of auctions and transfers of rights to use telecommunications codes and numbers, and the national domain name ".vn";
đ) Issue mechanisms, policies, regulations, and organize the implementation of price management in the telecommunications and Internet sectors according to the provisions of the law; monitor, suspend the application of prices for telecommunications services when telecommunications enterprises impose or undercut prices causing instability in the telecommunications market, harming the legitimate rights and interests of telecommunications service users, other telecommunications enterprises, and the State. Coordinate in implementing promotional management in the telecommunications sector. Direct and guide the implementation of reporting, accounting, and auditing systems to serve the management of telecommunications and Internet service prices;
e) Issue and organize the implementation of regulations on connecting telecommunications networks;
g) Specify and guide the operation of dedicated telecommunications networks serving Party and State agencies;
Guide the establishment, implementation of plans, and deployment of telecommunications network development schemes; direct, guide, and inspect shared infrastructure usage in the telecommunications sector;
Lead in ensuring the safety of telecommunications infrastructure, coordinate with the Ministry of Public Security to ensure information security in telecommunications activities according to the provisions of the law;
Manage telecommunications and Internet quality; establish, manage, operate specialized telecommunications and Internet testing and calibration laboratories according to the provisions of the law;
1) Establish, manage, operate, and exploit the system for collecting and managing telecommunications data and the mobile terrestrial roaming number retention system (roaming center);
m) Establish, manage, operate, and ensure the safety of the national domain name server system, the national Internet exchange VNIX station, the national Internet resource management system, and connections with regional and international systems;
n) Establish a system and platform for measuring Internet access speed and resource usage, IPv6. Collect, compile, and publish statistics on the Internet and Internet resources;
o) Develop programs, organize the promotion of the application and transition to new generation IPv6 Internet, develop industrial Internet, Internet of Things (IoT); promote the safe and sustainable development of Internet resources, popularize the national domain name ".vn".
p) International cooperation, registration, reception, transfer, and maintenance of Vietnam's Internet resources with regional and international organizations.
16. On radio frequency spectrum
a) Guide and organize the implementation of national radio frequency spectrum planning; transmission and broadcasting activities according to the infrastructure information and communication plan approved by the Prime Minister;
b) Take the lead and coordinate with the Ministry of National Defense and the Ministry of Public Security in allocating frequency bands for defense and security purposes to be submitted for approval by the Prime Minister;
c) Issue frequency band planning, channel allocation planning, frequency usage planning, and regulations on conditions for allocation, assignment, and use of radio frequencies;
d) Manage the quality of radio emissions, electromagnetic compatibility, and safety from radio frequency radiation in accordance with the law;
đ) Specify technical conditions and operational conditions for radio equipment exempted from licensing;
e) Train and guide radio service operations; manage training and certification issuance for radio operators;
g) Manage license fees for using radio frequencies, radio frequency usage fees, and payments for rights to use radio frequencies in accordance with the law;
h) Inspect and control radio frequencies and radio equipment, handle harmful interference;
i) Register and coordinate internationally on radio frequencies and satellite orbits;
k) Submit proposals to competent authorities for issuing and implementing regulations on auctioning, competitive bidding, and transferring rights to use radio frequencies;
17. On the information technology industry and digital industry
a) Guide, direct, and organize the implementation of strategies, plans, policies, programs, projects for developing the information technology industry, digital industry, and semiconductor industry;
b) Submit proposals to competent authorities for issuing or issue within their authority policies, incentives, and priorities for investment in developing the information technology industry, digital industry, and semiconductor industry; publish lists and develop programs for developing key information technology products and services, digital products and services;
c) Review programs, plans, and projects for developing the information technology industry, digital industry, and semiconductor industry;
d) Issue or submit proposals to competent authorities for issuing criteria for evaluating and certifying the functions and technical features of information technology products and services, digital products and services; management mechanisms and policies for developing concentrated information technology parks, digital parks;
đ) Issue and recognize standards for information technology skills and digital skills within their authority;
e) Organize activities to support investment promotion and trade promotion in the information technology industry and digital industry;
g) Implement quality management and conformity assessment activities for products and services in the information technology industry and digital industry in accordance with the law;
18. On national digital transformation
a) Carry out the permanent tasks of the National Committee for Digital Transformation; serve as the focal point for consolidating, advising, and coordinating inter-ministerial and inter-departmental activities among ministries, sectors, and localities to implement policies, strategies, programs, plans, projects, mechanisms, and policies to create a legal environment to promote the application of information technology and national digital transformation;
b) Develop, guide, and organize the implementation of common mechanisms, policies, strategies, plans, programs, and projects on national digital transformation;
c) Issue national and sector-specific indices for assessing the level of digital transformation; organize assessments and publish annual results;
19. On building and developing the electronic government and digital government
a) Develop, guide, and organize the implementation of mechanisms, policies, strategies, plans, programs, and projects at the national level on the application of information technology in state agencies, building the electronic government, digital government, and smart cities; guide, review, inspect, evaluate, and rank the construction and implementation of programs, plans, projects, and initiatives on the application of information technology, building the electronic government, digital government, and smart cities by ministries, sectors, and localities within their authority; evaluate and test the quality of information technology application products and solutions, electronic government, digital government, and smart city construction;
b) Develop and issue a list of shared digital platforms for state agencies; announce key tasks for digital transformation in state agencies, place orders, and assign tasks to digital enterprises to implement;
c) Guide, supervise, and inspect data governance, sharing, and exploitation activities in the construction of the electronic government and digital government in accordance with the law;
d) Develop, maintain, update, and organize the implementation of the Framework Architecture of the Electronic Government and Digital Government of Vietnam, the ICT Reference Framework for Smart City Development; develop and guide the organization and implementation of models for Smart City Command and Control Centers of state agencies;
đ) Develop and operate testing laboratories for information systems; develop, manage, and operate the national integrated and shared data platform, monitoring and measuring platform for the provision and use of digital government services, cloud computing platform for the government, management platform for investment in information technology applications, and other digital platforms serving the application of information technology in state agencies, building the electronic government, and digital government within their authority;
e) Promote, disseminate, train, and conduct workshops on the application of information technology, digital transformation in state agencies, building, and developing the electronic government and digital government;
20. On digital economy and digital society
a) Guide and organize the implementation of mechanisms, policies, strategies, laws, plans, programs, and national projects on the development of the digital economy and digital society;
b) Guide and assess the construction and implementation of programs, plans, projects, and initiatives related to the digital economy and digital society;
c) Manage and promote the development of digital economy platform and national digital platforms to serve the development of the digital economy and digital society; publicize, disseminate, train, instruct, and encourage the digital transformation of enterprises, new business models applying digital technology, digital skills, digital citizens, digital connectivity, and digital culture, as well as activities complying with rules of conduct on digital environments in society and communities;
d) Build, manage, and operate information systems and databases on the national digital economy and digital society development in accordance with the provisions of the law.
21. On electronic transactions
a) Guide, direct, organize the implementation of strategies, plans, policies, programs, projects for the development of electronic transactions; normative legal documents on electronic transactions; technical requirements, technical audits, product and service quality in electronic transactions;
b) Manage reporting, measurement, and statistical work on electronic transaction activities; manage the supervision of information system security serving electronic transactions by the information system managers; build, manage, and operate systems to receive and aggregate data serving state management of electronic transactions by state agencies;
c) Manage electronic signatures, trusted services, organizations providing trusted services; recognize foreign electronic signatures, foreign electronic signature certificates, and foreign organizations providing electronic certification services in Vietnam in accordance with the provisions of the law;
d) Manage and organize the construction, exploitation, and development of the national electronic authentication infrastructure, the system maintaining the status of electronic signature certificates; the issuance and revocation of electronic signature certificates;
đ) Specify the interconnection between public electronic signature service systems and specialized electronic signature systems for official duties.
22. Build, manage, and operate dedicated postal and telecommunications networks, dedicated data transmission networks serving the guidance and management of Party and State agencies.
23. Decide measures to mobilize networks and services, means, and equipment for transmitting information in cases of national security emergencies, natural disasters, and enemy threats according to the division of labor by the Government and the Prime Minister.
24. Manage civil servants and employees under the jurisdiction of the ministry in accordance with the provisions of the law.
25. Manage, guide, and organize the implementation of the awarding of Ho Chi Minh Prize, State Prize for Science and Technology; other awards in fields under the jurisdiction of the ministry in accordance with the provisions of the law. Organize awards and implement commendation and reward work in accordance with the provisions of the law.
26. Decide and organize the implementation of preventive and curbing measures against illegal information activities within the scope of functions and tasks assigned in accordance with the provisions of the law.
27. Carry out inspection, examination, complaint resolution, and accusation handling; organize citizen reception; implement anti-corruption, wastefulness, and punishment of violations of laws in areas under the state management of the ministry in accordance with the provisions of the law.
28. Train and develop human resources in fields under the jurisdiction of the ministry; forecast demand and guide the development of human resources in fields under the jurisdiction of the ministry.
29. Manage organizational structure, job positions, civil servant quota, number of staff in public institutions; decide on appointment, reappointment, transfer, rotation, dismissal, resignation, removal from office, implement salary systems, benefits, rewards, disciplinary actions, and other systems for cadres, civil servants, and employees; build and organize the implementation of training and professional development plans for cadres, civil servants, employees, and workers under the ministry in accordance with the provisions of the law.
30. Manage finance, assets, and implement the budget allocated according to the provisions of the law; propose the structure and proportion of state budget allocation for science and technology.
31. On international cooperation and integration
a) Guide and organize the implementation of international integration activities in fields under the jurisdiction of the ministry in accordance with the provisions;
b) Lead negotiations, consider funding for joint programs and projects with international partners in fields under the jurisdiction of the ministry within the framework of bilateral, multilateral, regional, and sub-regional agreements; implement programs, agreements, cooperation accords, integration projects and regional initiatives in fields under the jurisdiction of the ministry; deploy a network of overseas science and technology representatives according to the directives of the Government and the Prime Minister;
c) Officially represent Vietnam at international organizations in fields under the jurisdiction of the ministry according to the delegation and authorization of the Government and the Prime Minister.
32. Manage state-run public services in fields under the state management of the ministry; supervise, evaluate, and certify the quality of state-run public services and the effectiveness of public institution operations under its management; implement state management tasks regarding the pricing of state-run public services in accordance with the provisions of the law.
33. Implement the rights, responsibilities, and obligations of the state's representative owner in state-owned enterprises and state capital invested in other enterprises in accordance with the provisions of the law.
34. Organize the implementation of management over associations and non-governmental organizations operating in fields under the state management of the ministry in accordance with the provisions of the law.
35. Manage extrabudgetary financial funds under the ministry's jurisdiction in accordance with the provisions of the law; manage and organize the implementation of investment projects within the ministry's authority in accordance with the provisions of the law.
36. Organize the implementation of the administrative reform plan of the ministry according to the national administrative reform program approved by the Government and the Prime Minister.
37. Perform other tasks, powers, and responsibilities assigned by the Government and the Prime Minister and in accordance with the provisions of the law.

The units specified from Clause 1 to Clause 22 of this Article are administrative organizations assisting the Minister in performing state management functions; the organizations specified from Clause 23 to Clause 25 of this Article are public service units serving the state management functions of the ministry. The National Standardization, Metrology and Quality Control Committee shall use the State Emblem seal.
The Minister of Science and Technology shall submit to the Prime Minister for issuance of a decision specifying the functions, tasks, powers, and organizational structure of the Academy of Science and Technology Strategy and the list of other public service units directly under the ministry.
The Minister of Science and Technology shall specify the functions, tasks, powers, and organizational structure of the units directly under the ministry within their authority.
Article 4. Transitional Provisions
1. The Academy of Science and Technology Innovation, Vietnam Science and Technology Journal (as prescribed in Decree No. 28/2023/NĐ-CP dated June 2, 2023 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology), the Institute of Strategic Information and Communication, the School for Training and Capacity Building of Information and Communication Managers, the Information and Communication Journal (as prescribed in Decree No. 48/2022/NĐ-CP dated July 26, 2022 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Information and Communications) shall continue to operate until the Prime Minister issues a decision specifying the functions, tasks, powers, and organizational structure of the Academy of Science and Technology Strategy. The implementation period shall not exceed three months from the date this Decree takes effect.
2. The Cybersecurity Department (as prescribed in Decree No. 48/2022/NĐ-CP dated July 26, 2022 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Information and Communications) shall continue to operate to handle financial, state budget, public asset, program, project, personnel, and other pending issues (if any) within a period not exceeding three months from the date this Decree takes effect.
3. VietNamNet Newspaper (as prescribed in Decree No. 48/2022/NĐ-CP dated July 26, 2022 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Information and Communications) shall continue to operate until the competent authority approves the transfer of VietNamNet Newspaper to be directly under the Ministry of Ethnic Affairs and Religion. The Minister of Science and Technology shall have the responsibility to report to the competent authority for consideration and approval by March 2025.
Article 5. Effective Date
1. This Decree shall take effect from March 1, 2025.
2. This Decree replaces Decree No. 28/2023/NĐ-CP dated June 2, 2023 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology and Decree No. 48/2022/NĐ-CP dated July 26, 2022 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Information and Communications.
Article 6. Responsibility for Implementation
The Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairpersons of provincial and centrally governed city People's Committees are responsible for implementing this Decree.
