CIRCULAR

Regulations on prescribing traditional medicine, herbal drugs, and combined prescriptions of traditional medicine, herbal drugs with chemical drugs in medical examination and treatment facilities

Pursuant to the Drug Law number 105/2016/QH13 amended and supplemented by Law number 28/2018/QH14 and Law number 44/2024/QH15;

Pursuant to the Medical Examination and Treatment Law number 15/2023/QH15;

Pursuant to Decree number 163/2025/NĐ-CP dated June 29, 2025 detailing certain provisions and measures for organizing and guiding the implementation of the Drug Law;

Pursuant to Decree number 96/2023/NĐ-CP dated December 30, 2023 detailing certain provisions of the Medical Examination and Treatment Law;

Pursuant to Decree No. 42/2025/NĐ-CP dated February 27, 2025 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Health;

At the proposal of the Director of the Traditional Medicine Management Department;

The Minister of Health issues this Circular regulating the prescription of traditional medicine, herbal drugs, and combined prescriptions of traditional medicine, herbal drugs with chemical drugs in medical examination and treatment facilities.

PART I
GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

1. This Circular regulates the prescription of traditional medicine, herbal drugs, and combined prescriptions of traditional medicine, herbal drugs with chemical drugs in inpatient treatment, day treatment, and outpatient treatment at medical examination and treatment facilities.

2. This Circular applies to medical examination and treatment facilities, including medical examination and treatment facilities under the Ministry of National Defense and the Ministry of Public Security; agencies, organizations, and individuals related to the prescription of traditional medicine, herbal drugs, and combined prescriptions of traditional medicine, herbal drugs with chemical drugs.

Article 2. Interpretation of Terms

1. Traditional medicine has traditional preparation forms and modern preparation forms.

2. Decoction is a traditional preparation form of traditional medicine used in medical examination and treatment facilities, prepared by practitioners based on traditional medical theory or folk experience, packaged or processed, compounded for disease prevention and treatment.

3. Southern medicine is traditional medicine of domestic origin from cultivated or collected herbs, used directly, fresh, or raw, or processed and compounded according to folk experience or traditional medical theory, having preparation forms such as decoctions, traditional preparation forms, or modern preparation forms.

Article 3. Principles of prescribing traditional medicine, herbal drugs, and combined prescriptions of traditional medicine, herbal drugs with chemical drugs

Prescribing of drugs must be carried out in accordance with the provisions of Articles 62 and 63 of the Medical Examination and Treatment Law number 15/2023/QH15 and the following principles:

1. In accordance with one of the following documents:

a) The drug usage instructions approved by the Ministry of Health;

b) Diagnosis and treatment guidelines issued by the Minister of Health or diagnosis and treatment guidelines established by medical examination and treatment facilities in accordance with Clause 6 of Circular number 21/2013/TT-BYT dated August 8, 2013 of the Minister of Health on the organization and operation of the Pharmacy and Treatment Council in hospitals in cases where there are no diagnosis and treatment guidelines issued by the Ministry of Health;

c) Current Vietnamese Pharmacopoeia or foreign pharmacopoeia recognized by the Ministry of Health;

d) Current National Formulary of Vietnam.

2. May be prescribed when there is overlap of some traditional medicine ingredients or herbal drugs in decoctions, traditional medicine with traditional preparation forms or modern preparation forms as stipulated in Clause 2, Article 2 of Circular number 32/2020/TT-BYT dated December 31, 2020 of the Minister of Health on the standards for processing and compounding traditional medicine in medical examination and treatment facilities using traditional medicine (hereinafter referred to as traditional medicine with traditional preparation forms or modern preparation forms), herbal drugs.

3. May prescribe individual decoctions or combined prescriptions of decoctions, traditional medicine with traditional preparation forms or modern preparation forms, herbal drugs with larger doses as stipulated in point a, b, and point c, Clause 1 of this Article when there is overlap of traditional medicine ingredients or herbal drugs in each combined prescription or individual prescription as specified in point b, Clause 5, Article 8 of this Circular.

4. May prescribe combined prescriptions of decoctions, traditional medicine with traditional preparation forms or modern preparation forms, herbal drugs with chemical drugs or prescribe individual prescriptions of each type of prescription in each prescription.

5. In the case of prescribing combined prescriptions of decoctions, traditional medicine with traditional preparation forms or modern preparation forms, herbal drugs with chemical drugs in outpatient treatment, the prescription of chemical drugs shall be carried out in accordance with Circular number 26/2025/TT-BYT dated June 30, 2025 of the Minister of Health on prescriptions and the prescription of chemical drugs, biological products in outpatient treatment at medical examination and treatment facilities (hereinafter referred to as Circular number 26/2025/TT-BYT).

6. In the case of prescribing drugs in inpatient treatment and day treatment, it shall be carried out in accordance with Circular number 23/2011/TT-BYT dated June 10, 2011 of the Minister of Health on the use of drugs in medical facilities with beds and related documents.

Chapter II
PRESCRIPTION OF TRADITIONAL MEDICINE AND HERBAL DRUGS

Article 4. Authority to prescribe traditional medicine and herbal drugs

Persons holding a practice certificate for medical diagnosis and treatment or a license for medical diagnosis and treatment (hereinafter referred to collectively as practitioners) are authorized to prescribe traditional medicine and herbal drugs.

1. Practitioners are authorized to prescribe traditional decoctions, combined traditional medicine prescriptions with traditional preparation forms or modern preparation forms, including the following professional titles:

a) Traditional Medicine Specialist Doctors; Ethnic Medicine Specialist Doctors; General Medical Doctors or General Practitioners with a certificate in Traditional Medicine specialization training lasting at least six months; Doctors with a basic Traditional Medicine specialty certificate;

b) Traditional Medicine Doctors with a bachelor's degree in Traditional Medicine from an overseas educational institution recognized by the Minister of Education and Training as equivalent to a university degree and who have completed the supplementary training program for Traditional Medicine Doctors as prescribed by the Minister of Health;

c) Traditional Medicine Attendants; Traditional Medicine Attendants with a college-level certificate in Traditional Medicine Attendant or Traditional Medicine, or a General Attendant with a certificate in Traditional Medicine orientation;

d) Traditional Medicine Attendants with a graduation certificate from an overseas educational institution recognized by the competent state authority as equivalent to a college-level certificate in Traditional Medicine Attendant or Traditional Medicine, except for Traditional Medicine Attendants with a practice certificate or a license for non-pharmacological methods;

đ) Traditional Medicine Practitioners;

e) Traditional Medicine Practitioners within the scope of medical diagnosis and treatment using southern herbs may only prescribe southern herb decoctions in healthcare facilities when they hold a practice certificate or a license, provided that they have been granted such certification.

2. Practitioners are authorized to prescribe traditional medicine

Practitioners are authorized to prescribe traditional medicine with traditional preparation forms and modern preparation forms, including the following professional titles:

a) Practitioners specified in points a, b, c, d, and đ of Clause 1 of this Article;

b) General Medical Doctors, General Practitioners, Specialty Doctors, Dental Surgeons, Preventive Medicine Doctors;

c) General Attendants.

3. Practitioners are authorized to prescribe herbal drugs: Practitioners specified in points a, b, c, and d of Clause 1; points b and c of Clause 2 of this Article.

4. Persons holding a certificate for hereditary prescriptions are only authorized to prescribe hereditary prescriptions approved by the competent authority.

Article 5. Forms of prescribing traditional medicine and herbal drugs

1. Prescribing individually one of the following types of medicines: decoctions, traditional medicine with traditional preparation forms and modern preparation forms, herbal drugs.

2. Combining prescriptions as specified in Clause 1 of this Article.

3. Prescribing hereditary prescriptions.

Chapter III
COMBINED PRESCRIPTION OF TRADITIONAL MEDICINE AND HERBAL DRUGS WITH CHEMICAL DRUGS

Article 6. Authority to prescribe combined traditional medicine, herbal drugs with chemical drugs

1. Practitioners are authorized to prescribe combined decoctions, traditional medicine with traditional preparation forms and modern preparation forms, herbal drugs with chemical drugs appropriate to the diagnosis, condition of the patient, scope of professional activities, and technical classification level of the healthcare facility approved by the competent authority, including the following professional titles:

a) Practitioners specified in point a of Clause 1 of this Article;

b) Practitioners specified in points b and đ of Clause 1 of this Article may only carry out such activities upon written permission from the person responsible for professional matters at the healthcare facility.

2. General Medical Doctors or General Practitioners, Basic Specialty Doctors, Dental Surgeons, Preventive Medicine Doctors, General Attendants are authorized to prescribe combined chemical drugs with traditional medicine in traditional preparation forms and modern preparation forms, herbal drugs.

3. Practitioners are authorized to prescribe chemical drugs separately

a) Practitioners specified in point a of Clause 1 and Clause 2 of this Article;

b) Traditional Medicine Attendants are authorized to prescribe and use chemical drugs in emergency situations at healthcare facilities.

Article 7. Forms of combined prescription of decoctions, traditional medicine, herbal drugs with chemical drugs

1. Prescribing chemical drugs combined with one or more forms of prescription as specified in Article 5 of this Circular.

2. Combined prescription of decoctions, traditional medicine with traditional preparation forms and modern preparation forms, herbal drugs with chemical drugs for outpatient patients

a) Decoction prescriptions shall be carried out according to the Decoction Prescription form specified in Appendix I attached to this Circular;

b) Traditional medicine prescriptions with traditional preparation forms and modern preparation forms, herbal drug prescriptions shall be carried out according to the Traditional Medicine and Herbal Drug Prescription form specified in Appendix II attached to this Circular;

c) Chemical drug prescriptions shall be carried out according to the provisions of Circular No. 26/2025/TT-BYT.

Chapter IV
CONTENT OF THE PRESCRIPTION, USE OF MEDICATION, AND EXPIRATION DATE OF THE PRESCRIPTION

Article 8. General requirements for drug prescription content and medical records, medical records

1. The name of the medicine must be written in Vietnamese language, accurately, clearly, and fully including all items in the prescription or in the patient's medical record; in cases where the practitioner is a foreigner, the prescription must comply with the provisions set forth in Clause 3, Article 35 of Decree No. 96/2023/NĐ-CP dated December 30, 2023, detailing certain provisions of the Law on Medical Examination and Treatment.

2. Record personal identification number or citizen identification card number or identity card number or passport number of the patient (if available).

3. Record the place of residence of the patient.

4. For children under 72 months old, their age in months and weight must be recorded; along with the full name of the person bringing the child for examination and treatment.

5. Prescription format for decoction medicines, traditional medicines, and herbal medicines

a) When prescribing decoction medicines, write the name according to the Pharmacopoeia or common name, excluding the scientific name of the herbal ingredients, traditional medicinal herbs, species, seedlings, minerals used as medicine; specify the quantity, unit of measurement, number of decoctions, without abbreviating the name of the medicine; provide specific instructions on how to prepare and take the decoction, including the time to take it; for traditional medicinal herbs weighing less than 10 (ten) grams, the number 0 (zero) must be written before the weight;

Example: Six-Ingredient Formula

One decoction for seven days.

Boil and drink one decoction daily, divided into two doses morning and evening, after meals.

b) When prescribing individual decoction medicines or combined decoction medicines, traditional medicines in traditional preparation forms or modern preparation forms, and herbal medicines that contain overlapping traditional medicinal herbs or herbal ingredients as specified in Clause 3, Article 3 of this Circular, if the quantity of overlapping components exceeds the limit set out in points a, b, and c of Clause 1, Article 3 of this Circular, the practitioner must record the quantity of traditional medicinal herbs in both numerical and written form next to the quantity and clearly state "I prescribed this dose" in the prescription or in the patient's medical record, including electronic prescriptions;

c) For traditional medicines produced and compounded by healthcare facilities, record the name of the medicine according to the name published and approved for internal circulation as stipulated in Clause 1, Article 70 of the Drug Law or circulated within the province as stipulated in Clause 2, Article 70 of the Drug Law. Medicines circulating nationwide shall be recorded according to the name approved by the Ministry of Health for registration and circulation;

d) For traditional medicines in traditional preparation forms or modern preparation forms, and herbal medicines, record the dosage, method of use, and route of administration;

Example:

- For traditional medicines produced by healthcare facilities:

Yin Kidney Pills, take 8g each time, twice daily, divided into morning and evening doses, after meals.

- For medicines registered for circulation by the Ministry of Health:

Six-Ingredient Formula, take 3 pills each time, twice daily, divided into morning and evening doses, after meals.

e) In cases where the prescription includes traditional medicinal herbs compounded from toxic herbs listed in the List of Toxic Herbs for Medicine issued together with Circular No. 13/2024/TT-BYT dated August 26, 2024, by the Minister of Health (hereinafter referred to as Circular No. 13/2024/TT-BYT), the quantity of such traditional medicinal herbs must be recorded in both numerical and written form.

6. Order of Prescription

a) For medical records: chemical drugs; decoction medicines, traditional medicines in traditional preparation forms or modern preparation forms; herbal medicines;

b) For prescriptions following the format specified in point b, Clause 2, Article 7 of this Circular: traditional medicines (in traditional preparation forms or modern preparation forms), herbal medicines.

7. Duration of Use for Each Medicine in the Prescription

a) Outpatient Prescription

- For decoction medicines:

+ Depending on the patient's condition, the practitioner may prescribe a maximum of 30 (thirty) days or according to the diagnosis and treatment guidelines issued by the competent authority;

+ For medicines containing traditional medicinal herbs compounded from toxic herbs, each prescription should not exceed 5 (five) days;

+ For acute conditions, the quantity of medicine prescribed at one time should not exceed 5 (five) days.

- For herbal medicines; traditional medicines in traditional preparation forms or modern preparation forms: based on the clinical status and stability of the patient, the practitioner may prescribe a maximum duration of use of 90 (ninety) days for each medicine in the prescription.

b) Prescription for Inpatient and Day Hospital Treatment

- Prescribe medication at least twice every ten days;

- If subsequent examinations do not change the treatment regimen and the previous prescription remains unchanged, the practitioner may repeat the prescription by writing "Prescription or formula of day, month, year" once, and if the same formula is continued in the next prescription, it must be rewritten.

c) Prescription for Patients Immediately After Discharge from Inpatient or Day Hospital Treatment, Including Decoction Medicines, Traditional Medicines in Traditional Preparation Forms or Modern Preparation Forms, Herbal Medicines, and Chemical Drugs:

- If the patient needs to continue using medicine for 1 (one) to 7 (seven) days after discharge, the practitioner shall determine further treatment and record it in the inpatient medical record while also prescribing appropriate medicine for the patient consistent with the inpatient medical record;

- If the patient needs to continue treatment for more than 7 (seven) days after discharge, based on the patient's condition, the practitioner shall decide whether to prescribe outpatient medicine or establish an outpatient medical record or refer the patient to another suitable healthcare facility for continued treatment. The duration of use for each medicine prescribed in the outpatient prescription or designated in the outpatient medical record shall comply with the provisions set out in point a of this clause.

Article 9. Provisions on changes in prescriptions, drug usage, and drug cancellation

1. Cases of changing contents in prescriptions

a) Medical establishments with hospital form that issue prescriptions in electronic medical records, electronic prescriptions, or paper medication pick-up slips: The practitioner must notify and send the adjusted prescription or pick-up slip to the pharmacy department or pharmaceutical unit;

b) Private medical establishments with outpatient clinic form that issue prescriptions in paper medical records, paper prescriptions: The practitioner must sign and date next to the modified content in the prescription. In cases where a previously approved prescription is replaced, the practitioner must retain the prescription before and after adjustment and send it to the dispensing or decoction unit.

2. Cases of traditional medicine preparations in traditional or modern forms, medicinal herbs not used due to changes in medical orders, patient transfers, discharges, or deaths must be confirmed by the head of the clinical ward or their authorized representative in writing and sent to the pharmacy department or pharmaceutical unit within 24 hours.

3. Cases of cancellation for addictive drugs, psychotropic drugs

a) Unused addictive drugs, psychotropic drugs, and precursors by patients who have transferred to another facility or died, treatment wards, clinics must prepare a return certificate and submit it to the pharmaceutical unit. The head of the pharmaceutical unit must decide based on specific conditions whether to reuse or cancel according to regulations and record the cancellation at the facility;

b) In cases where medical establishments need to cancel addictive drugs, psychotropic drugs, or precursors, they shall follow the provisions of Article 36 of Decree No. 163/2025/NĐ-CP dated June 29, 2025, of the Government detailing certain provisions and measures to organize and guide the implementation of the Drug Law.

4. Cases of cancellation for decocted herbal formulas

Decocted herbal formulas when patients transfer to another hospital or die, the head of the clinical ward must prepare a record, transfer it to the pharmacy department, and cancel according to the following: Based on the prescription, the number of decoctions already used, the number of unused decoctions, the head of the medical establishment decides to establish a committee to organize the cancellation, determine the method of cancellation, and supervise the cancellation process. The committee must consist of at least three people, including one representative responsible for the professional management of the facility. The cancellation record must comply with Model No. 06 Appendix III issued together with Circular No. 30/2025/TT-BYT dated July 1, 2025, of the Minister of Health guiding the application of quality standards, drug testing, and the recovery and handling of non-compliant drugs.

Article 10. Outpatient prescriptions in electronic form at medical establishments

1. Electronic prescriptions established, displayed, digitally signed, shared, and stored electronically must contain all information as prescribed by this Circular and have the same legal value as paper prescriptions.

2. Electronic prescriptions are stored in the database of medical establishments, ensuring connectivity with the national health database and electronic health records.

For private medical establishments with outpatient clinics using information technology, prescriptions are recorded in computers once, then printed out, and practitioners sign them, giving one copy to the patient to keep in their medical record or chronic disease treatment book.

3. Medical establishments using information technology must ensure the storage of prescriptions for retrieval or printing as necessary data.

Article 11. Validity period of prescriptions for purchasing and collecting drugs, and prescription retention

1. Prescriptions are valid for purchasing and collecting drugs for a maximum period of five days from the date of issuance.

2. The retention period for prescriptions shall be implemented in accordance with point a, Clause 2, Article 1 of Circular No. 33/2025/TT-BYT dated July 1, 2025, of the Minister of Health on the retention period of health sector files and documents.

Chapter V
IMPLEMENTING PROVISIONS

Article 12. Effective Date

1. This Circular takes effect from March 1, 2026.

2. Circular No. 44/2018/TT-BYT dated December 28, 2018, of the Minister of Health on traditional medicine prescriptions, medicinal herb prescriptions, and combined traditional medicine and medicinal herb prescriptions with chemical drugs ceases to be effective from the date this Circular takes effect.

3. Implementation schedule for electronic prescribing: Medical establishments must implement electronic prescribing according to the schedule set by the Government and the Ministry of Health.

Article 13. Reference Provisions

In cases where legal normative documents and provisions referred to in this Circular are replaced, amended, or supplemented, they shall be applied according to the documents that have been replaced, amended, or supplemented.

Article 14. Transitional Provisions

For healthcare facilities that have printed out the outpatient treatment prescription forms prescribed in the Appendix issued together with Circular No. 44/2018/TT-BYT dated December 28, 2018, of the Minister of Health regarding traditional medicine prescriptions, herbal medicines, and combined traditional medicine and herbal medicine prescriptions with chemical drugs, such facilities may continue to use these forms until June 30, 2026.

Article 15. Implementation Organization

1. The Traditional Medicine and Pharmaceutical Management Department shall take the lead in coordinating with the Medical Examination and Treatment Management Department, the Pharmaceutical Management Department, and related units to organize the implementation, inspection, and evaluation of this Circular.

2. Departments of Health, health sectors, and relevant ministries and agencies shall be responsible for:

a) Directing and organizing the implementation of this Circular within their respective jurisdictions;

b) Inspecting and evaluating the results of implementing this Circular within their respective jurisdictions.

3. Healthcare facilities shall be responsible for:

a) Implementing the provisions of this Circular;

b) Collecting back unused or expired medications, including narcotic drugs, psychotropic substances, and precursor chemicals that were previously dispensed to patients, and documenting them according to the model form specified in Appendix VI issued together with Circular No. 26/2025/TT-BYT. Collected medications must be securely stored in a designated area and destroyed in accordance with legal regulations;

c) Ensuring that information technology infrastructure meets technical criteria set forth by the Ministry of Health to implement electronic medical records;

d) Uploading electronic prescriptions to the National Prescription System immediately upon completion of the outpatient examination and treatment process;

đ) Sending electronic prescriptions or electronic prescription codes to patients or their representatives through electronic means as stipulated by the Ministry of Health;

e) Storing prescriptions in accordance with this Circular and ensuring data extraction when necessary;

g) The person in charge of professional responsibilities at healthcare facilities shall base on their scope of expertise, professional certification, and training credentials issued by legitimate educational institutions, and their capacity as defined in point b and point d, Clause 1, Article 4 of this Circular, to prescribe combined prescriptions of decoctions, traditional medicine preparations, modern preparations, herbal medicines, and chemical drugs for treatment, monitoring, and assessing patient outcomes during treatment in writing.

4. Prescribers shall be responsible for:

a) Implementing the prescription regulations set forth in this Circular and being accountable for prescriptions issued to patients;

b) Advising patients or their representatives on medication usage, dietary regimes, and lifestyle habits during medication use, and instructing them to report any unusual symptoms immediately to the prescriber or the nearest healthcare facility after using the medication;

c) Informing patients about the best time frame for purchasing medications from prescriptions;

d) Notifying patients of any changes to their prescriptions.

5. Patients and their representatives shall be responsible for:

a) Implementing the provisions of this Circular;

b) Medication pickup period

- For outpatient treatment cases, the medication should be picked up within a maximum of five days from the date of the prescription;

- For cases where patients need to continue using medication from one to seven days after discharge, the medication should be picked up within a maximum of two days from the date of the prescription;

c) If the medication is not used or is not fully used, or if there is a change in the prescription, including narcotic drugs, psychotropic substances, and precursor chemicals, they must be destroyed or returned to the issuing or selling facility for destruction in accordance with regulations; they may not be sold, given away, or used for other purposes.

6. Retail pharmacies shall be responsible for:

a) Implementing the provisions of this Circular;

b) Collecting back unused or expired narcotic drugs, psychotropic substances, and precursor chemicals that were previously sold to patients, documenting them, and handling them in accordance with the regulations of the Ministry of Health;

c) For medicines containing toxic herbs listed in the Herbal Medicine Toxicity List issued together with Circular No. 13/2024/TT-BYT or those with indications as specified in point b, Clause 2, Article 8 of Circular No. 29/2025/TT-BYT dated July 1, 2025, of the Minister of Health regarding the registration of circulation of traditional medicine, traditional herbal medicines, and medicinal herbs, retail pharmacies may only sell these medicines when the buyer has a prescription as stipulated in this Circular;

d) Retail pharmacies selling narcotic drugs must sell narcotic drugs to patients based on "N" prescriptions prescribed in accordance with Articles 7 and 8 of Circular No. 26/2025/TT-BYT.

Article 16. Responsibility for Implementation

The following individuals and entities shall be responsible for implementing this Circular: Heads of the Ministry's Office; Director of the Traditional Medicine Management Department; Director of the Medical Examination and Treatment Management Department; Director of the Drug Management Department; Heads of Departments and Divisions under the Ministry of Health; Directors of hospitals and institutes with hospital beds directly under the Ministry of Health; specialized health agencies under provincial People's Committees; heads of health sectors; related organizations and individuals.

During implementation, if there are difficulties or obstacles, they are requested to promptly report them to the Ministry of Health (Traditional Medicine Management Department) for consideration and resolution.
