REGULATIONS ON THE SYSTEM OF PERIODIC REPORTING ON INDUSTRIAL ZONES, NATIONAL DATABASE OF INDUSTRIAL ZONES AND SOME SAMPLE DOCUMENTS ON MANAGEMENT AND DEVELOPMENT OF INDUSTRIAL ZONES
Circular No. 14/2024/TT-BCT dated August 15, 2024, issued by the Minister of Industry and Trade, stipulates the system of periodic reporting on industrial zones, national database of industrial zones, and some sample documents on management and development of industrial zones, which shall take effect from October 1, 2024, amended and supplemented by:
Circular No. 38/2025/TT-BCT dated June 19, 2025, issued by the Minister of Industry and Trade, amending and supplementing certain provisions on the delegation of administrative procedures in fields under the purview of the Ministry of Industry and Trade, which shall take effect from July 1, 2025.
Pursuant to Decree No. 96/2022/NĐ-CP dated November 29, 2022, promulgated by the Government, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade; Decree No. 105/2024/NĐ-CP dated August 1, 2024, promulgated by the Government, amending and supplementing certain articles of Decree No. 96/2022/NĐ-CP dated November 29, 2022, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade; and Decree No. 26/2018/NĐ-CP dated February 28, 2018, promulgated by the Government, on the Charter of Organization and Operation of Vietnam Electricity Corporation;
Pursuant to Clause 1, Article 30 of Decree No. 32/2024/NĐ-CP dated March 15, 2024, promulgated by the Government, on management and development of industrial zones;
Pursuant to Clause 2, Article 6 and Clause 1, Article 30 of Decree No. 09/2019/NĐ-CP dated January 24, 2019, promulgated by the Government, on the system of reporting of state administrative agencies;
PURSUANT TO THE PROPOSAL OF THE DIRECTOR OF THE LOCAL INDUSTRY DEPARTMENT
The Minister of Industry and Trade issues this Circular stipulating the system of periodic reporting on industrial zones, national database of industrial zones, and some sample documents on management and development of industrial zones.[1]
Article 1. Scope of Regulation
This Circular stipulates the system of periodic reporting on industrial zones as prescribed in Decree No. 09/2019/NĐ-CP dated January 24, 2019, promulgated by the Government, on the system of reporting of state administrative agencies; national database of industrial zones and some sample documents on management and development of industrial zones as prescribed in Decree No. 32/2024/NĐ-CP dated March 15, 2024, promulgated by the Government, on management and development of industrial zones.
Article 2. Applicability
1. Enterprises, cooperatives, organizations investing in construction of technical infrastructure of industrial zones.
2. Organizations and individuals engaged in production and business within industrial zones.
3. Other relevant agencies, organizations, and individuals related to management, investment, and operation of industrial zones.
Article 3. System of Periodic Reporting on Industrial Zones
1. Subjects Implementing the System of Periodic Reporting
a) Departments of Industry and Trade of provinces and centrally governed cities (hereinafter referred to as Departments of Industry and Trade);
b) Commune People's Committees[2];
c) Investors in construction of technical infrastructure of industrial zones;
d) Organizations and individuals investing in production and business within industrial zones.
2. Time for Finalizing Data for Periodic Reporting
a) The period for finalizing data for the mid-year report (beginning of the year) is from December 15 of the previous year to June 14 of the reporting year;
b) The period for finalizing data for the annual report is from December 15 of the previous year to December 14 of the reporting year.
3. Implementation of the System of Periodic Reporting
a) Before June 20 and December 20 each year, organizations and individuals investing in production and business within industrial zones shall report on the operation of their investment projects within the industrial zone for six months and the whole year according to Form No. 01 in Appendix I attached hereto, to be submitted to the local statistical agency[3], and simultaneously to the People's Committee at the commune level[4];
b) Before June 20 and December 20 each year, investors in construction of technical infrastructure of industrial zones shall report on the operation of their investment projects for construction of technical infrastructure of industrial zones for six months and the whole year according to Form No. 02 in Appendix I attached hereto, to be submitted to the local statistical agency[5], and simultaneously to the People's Committee at the commune level[6] and the Department of Industry and Trade;
c) Before June 25 and December 25 each year, the People's Committee at the commune level[7] shall report on the situation of industrial zones within its jurisdiction for six months and the whole year according to Form No. 03 in Appendix I attached hereto, to be submitted to the People's Committee at the provincial level and the Department of Industry and Trade;
d) Before June 30 and December 31 each year, the Department of Industry and Trade shall report on the situation of industrial zones within its jurisdiction for six months and the whole year according to Form No. 04 in Appendix I attached hereto, to be submitted to the People's Committee at the provincial level and the Ministry of Industry and Trade (Department of Innovation, Green Transition, and Small and Medium Enterprise Promotion[8]).
4. Methods of Sending and Receiving Periodic Reports
Periodic reports may be presented in paper form or electronic form and sent to the receiving agency through one of the following methods: direct delivery, postal service, national electronic document transmission network, email, or other methods as prescribed by law.
In cases where the National Database of Industrial Zones has been established and operational, the Department of Industry and Trade shall send periodic reports to the Ministry of Industry and Trade (Department of Innovation, Green Transition, and Small and Medium Enterprise Promotion[9]) through data updates and submission of reports via the National Database of Industrial Zones.
Article 4. Construction and operation of the National Industrial Cluster Database
1. The Agency for Innovation, Green Transition, and Small and Medium Enterprise Promotion shall coordinate with the E-commerce and Digital Economy Agency and relevant agencies and units to organize the construction and operation of the National Industrial Cluster Database.[10] cooperate with the E-commerce and Digital Economy Department and relevant agencies and units to organize the construction and operation of the National Cluster Industry Database.
2. Provincial Departments of Industry and Trade shall be responsible for updating industrial cluster data within their provincial jurisdiction into the National Industrial Cluster Database in accordance with the regulations and guidelines of the Ministry of Industry and Trade.
Article 5. Templates for management and development of industrial clusters
Issue several templates for managing and developing industrial clusters in Appendix II attached hereto, including: Request for becoming the project investor to construct technical infrastructure for industrial clusters; Decision on establishment/expansion of industrial clusters; Decision on promulgating the Management Regulations for industrial clusters within the provincial jurisdiction and accompanying regulations; Decision on promulgating the Management Regulations for public services and utilities within industrial clusters and accompanying regulations.
Article 6. Implementation Provisions
[11]1. This Circular takes effect from October 1, 2024; abolishes Circular No. 28/2020/TT-BCT dated November 16, 2020 issued by the Minister of Industry and Trade guiding the implementation of certain provisions of Decree No. 68/2017/NĐ-CP dated May 25, 2017 of the Government on management and development of industrial clusters and Decree No. 66/2020/NĐ-CP dated June 11, 2020 of the Government amending and supplementing certain articles of Decree No. 68/2017/NĐ-CP.
2. In cases where legal normative documents cited in this Circular are replaced, amended, or supplemented, the new provisions shall apply.
3. During the implementation of this Circular, if there are any difficulties, relevant agencies, organizations, and individuals shall reflect them to the Ministry of Industry and Trade (through the Agency for Innovation, Green Transition, and Small and Medium Enterprise Promotion[12]) for consideration and resolution within their authority./.

[1] Circular No. 38/2025/TT-BCT amending and supplementing certain provisions on the delegation of administrative procedures in fields under the purview of the Ministry of Industry and Trade is based on the following grounds for issuance:
Pursuant to Decree No. 78/2025/NĐ-CP dated April 1, 2025 of the Government detailing some articles and measures to organize and guide the implementation of the Law on Issuing Regulatory Legal Documents;
Pursuant to the Law on Legislative Regulatory Documents No. 64/2025/QH15;
Pursuant to Resolution No. 190/2025/QH15 dated February 19, 2025 of the National Assembly on handling certain issues related to the restructuring of the state apparatus;
Pursuant to Decree No. 40/2025/NĐ-CP dated February 26, 2025, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;
Pursuant to Decree No. 78/2025/NĐ-CP dated April 1, 2025 of the Government detailing some provisions and measures to implement and guide the implementation of the Law on Legislative Acts;
Pursuant to Decree No. 139/2025/NĐ-CP dated June 12, 2025 of the Government on the division of authority of local governments at two levels in the field of state management of the Ministry of Industry and Trade;
At the proposal of the Director of the Office of the Ministry,
The Minister of Industry and Trade promulgates the Circular amending and supplementing certain provisions on the delegation of administrative procedures in fields under the management of the Ministry of Industry and Trade."

[8] The phrase "Local Industry and Trade Department" shall be replaced by the phrase "Department for Innovation, Green Transition, and Promoting Industry" pursuant to Article 29 of Circular No. 38/2025/TT-BCT amending and supplementing certain provisions on the delegation of administrative procedures in fields under the management of the Ministry of Industry and Trade, which takes effect from July 1, 2025.
[9] The phrase "Local Industry and Trade Department" shall be replaced by the phrase "Department for Innovation, Green Transition, and Promoting Industry" pursuant to Article 29 of Circular No. 38/2025/TT-BCT amending and supplementing certain provisions on the delegation of administrative procedures in fields under the management of the Ministry of Industry and Trade, which takes effect from July 1, 2025.
[10] The phrase "Local Industry and Trade Department" shall be replaced by the phrase "Department for Innovation, Green Transition, and Promoting Industry" pursuant to Article 29 of Circular No. 38/2025/TT-BCT amending and supplementing certain provisions on the delegation of administrative procedures in fields under the management of the Ministry of Industry and Trade, which takes effect from July 1, 2025.
[11] Article 37 of Circular No. 38/2025/TT-BCT amending and supplementing certain provisions on the delegation of administrative procedures in fields under the management of the Ministry of Industry and Trade, which takes effect from July 1, 2025, provides as follows:
"Article 37. Implementation Provisions
1. This Circular takes effect from July 1, 2025.
2. Accompanying this Circular are new forms replacing those in administrative procedures listed in Appendix I, and new forms prescribed in administrative procedures listed in Appendix II.
3. Transitional Provisions
Licenses, Certificates, Certifications, approval documents, and consent documents issued for administrative procedures in fields prior to July 1, 2025, shall continue to be valid until their expiration date as stated in the Licenses, Certificates, Certifications, approval documents, and consent documents according to the regulations.
4. This Circular abolishes:
a) Point d Clause 2 Article 4, Clause 3 Article 18 of Circular No. 23/2024/TT-BCT dated November 7, 2024, issued by the Minister of Industry and Trade, regarding the management and use of industrial explosives and explosive precursors under the management authority of the Ministry of Industry and Trade;
b) The phrase "Science and Technology Department" at point a Clause 4 Article 11; the phrase "Industry and Trade Department" in Note (5) Model 01, Note (7) Model 02 Appendix IV of Circular No. 23/2024/TT-BCT dated November 7, 2024, issued by the Minister of Industry and Trade, regarding the management and use of industrial explosives and explosive precursors under the management authority of the Ministry of Industry and Trade;
c) Appendix I promulgated with Circular No. 40/2018/TT-BCT dated October 30, 2018, issued by the Minister of Industry and Trade on the construction and content of safety management documents in oil and gas activities;
d) Article 17 of Circular No. 36/2019/TT-BCT dated November 29, 2019, issued by the Minister of Industry and Trade on product quality management under the responsibility of the Ministry of Industry and Trade;
d) The phrase "by postal service" in the content of Circular No. 11/2015/TT-BCT dated June 4, 2015, issued by the Minister of Industry and Trade, concerning the transit of goods of the People's Republic of China through the territory of the Socialist Republic of Vietnam;
e) Clause 2, Article 21 of Circular No. 57/2018/TT-BCT dated December 26, 2018, issued by the Minister of Industry and Trade detailing certain provisions of Decrees related to tobacco business;
g) Article 2 of Circular No. 43/2023/TT-BCT issued by the Minister of Industry and Trade amending and supplementing certain articles of Circular No. 57/2018/TT-BCT dated December 26, 2018, issued by the Ministry of Industry and Trade detailing certain provisions of Decrees related to tobacco trade;
h) Appendices 11, 12, 13, 14, 15 promulgated together with Circular No. 43/2023/TT-BCT issued by the Minister of Industry and Trade amending and supplementing certain articles of Circular No. 57/2018/TT-BCT dated December 26, 2018, issued by the Ministry of Industry and Trade detailing certain provisions of Decrees related to tobacco trade;
i) Clause 1, Clause 2 Article 18 of Circular No. 02/2025/TT-BCT dated February 1, 2025, issued by the Minister of Industry and Trade, regarding the protection of power facilities and safety in the power sector;
k) Clause 2, Article 12 of Circular No. 47/2014/TT-BCT dated December 5, 2014, issued by the Minister of Industry and Trade on the management of electronic commerce websites.
l) Clause 2, Article 11 of Circular No. 59/2015/TT-BCT dated December 31, 2015, issued by the Minister of Industry and Trade, stipulates the management of e-commerce activities through applications on mobile devices;
m) Appendix V promulgated together with Circular No. 07/2019/TT-BCT dated June 20, 2019, issued by the Minister of Industry and Trade, regarding the export of textile and garment products to Mexico under the Comprehensive and Progressive Agreement for Trans-Pacific Partnership;
Clause 2 Article 5, Clause 3 Article 6 of Circular No. 12/2018/TT-BCT dated June 15, 2018, issued by the Minister of Industry and Trade, detailing certain provisions of the Law on Foreign Trade Management and Decree No. 69/2018/NĐ-CP dated May 15, 2018, issued by the Government detailing certain provisions of the Law on Foreign Trade Management;
o) Article 15 of Circular No. 36/2019/TT-BCT dated November 29, 2019, issued by the Minister of Industry and Trade, stipulates the quality management of products and goods under the responsibility of the Ministry of Industry and Trade;
p) Clause 2 Article 5, Clause 3 Article 6, Clause 4 Article 7, Clause 2 Article 8 of Circular No. 12/2018/TT-BCT dated June 15, 2018, issued by the Minister of Industry and Trade, detailing certain provisions of the Law on Foreign Trade Management and Decree No. 69/2018/NĐ-CP dated May 15, 2018, issued by the Government detailing certain provisions of the Law on Foreign Trade Management.”
[12] The phrase "Local Industry and Trade Department" shall be replaced by the phrase "Department for Innovation, Green Transition, and Promoting Industry" pursuant to Article 29 of Circular No. 38/2025/TT-BCT amending and supplementing certain provisions on the delegation of administrative procedures in fields under the management of the Ministry of Industry and Trade, which takes effect from July 1, 2025.
