Article 3. General Professional Ethics Standards for Specialized Cadres in Surveying and Mapping

1. High sense of responsibility towards assigned tasks, always adhering to laws; fulfilling all obligations of a public official in professional activities.

2. Having a spirit of inquiry, cooperation, and continuous learning to improve professional skills, actively researching and applying scientific achievements in surveying and mapping work; passionate about their work.

3. Not exploiting positions or powers to harm national defense, security, or national interests; not seeking personal benefits; maintaining state secrets within their professional scope.

Chapter II

OCCUPATIONAL STANDARDS

5. Being honest, united, objective, modest, and not harassing or obstructing citizens' rights and interests when performing duties.

1. Duties:

a) Lead in drafting project proposals, technical designs - budget estimates for surveying and mapping projects; organize the implementation of complex surveying and mapping projects.

Article 4. Surveyor Level II - Job Code: V.06.06.16

a) Leading the development of project proposals, technical designs - budget estimates for surveying and mapping projects; organizing the implementation of complex technical surveying and mapping projects;

b) Participating in scientific research topics aimed at improving management content and methods related to surveying and mapping;

c) Leading the establishment of technical standards, norms, and economic-technical quotas for surveying and mapping;

2. Qualifications regarding education and training:

d) Leading or participating in compiling materials and training for surveying and mapping specialists at equivalent or lower levels;

đ) Participating in inspecting surveying and mapping specialists at lower levels during career advancement examinations.

a) Graduated from university or higher in geodesy, cartography, remote sensing, land, cadastral, geography, or other relevant fields; if graduated from another field, must complete the professional knowledge and skill enhancement program specified by the competent authority for surveying and mapping specialists;

b) Possessing foreign language proficiency level 3 as prescribed in Circular No. 01/2014/TT-BGDĐT dated January 24, 2014 of the Ministry of Education and Training on the six-level foreign language competency framework for Vietnam (hereinafter referred to as Circular No. 01/2014/TT-BGDĐT);

3. Qualifications regarding professional expertise and skills:

c) Possessing basic information technology skills as prescribed in Circular No. 03/2014/TT-BTTTT dated March 11, 2014 of the Ministry of Information and Communications on Information Technology Competency Standards (hereinafter referred to as Circular No. 03/2014/TT-BTTTT);

d) Holding a certificate for professional development according to the qualification standards for surveyor Level II.

a) Proficient in surveying and mapping development strategies;

b) Proficient in legal regulations, standard systems, and technical norms in the field of surveying and mapping;

c) Capable of developing programs and compiling specialized materials for training and enhancing lower-level surveying and mapping specialists;

d) Able to organize and implement specialized tasks in surveying and mapping;

đ) Participating in at least one provincial, ministerial, or higher level scientific and technological project, topic, or task, or leading one grassroots level project, topic, or task that has been accepted at a satisfactory level or higher.

Article 5. Surveying and Mapping Officer Level III - Code: V.06.06.17

1. Duties:

a) Organize and implement activities: investigation, survey, preparation, and supervision of technical design - budget estimates; inspect and accept construction works and products related to surveying and mapping.

b) Participate in establishing technical standards and norms, economic and technical norms for surveying and mapping.

c) Participate in research work, propose the application of technical innovations; organize and implement trials of new technical solutions.

d) Participate in compiling materials and training for surveying and mapping professionals at equivalent levels or lower.

2. Qualifications regarding education and training:

d) Leading or participating in compiling materials and training for surveying and mapping specialists at equivalent or lower levels;

b) Have a foreign language proficiency level of grade 2 as stipulated in Circular No. 01/2014/TT-BGDĐT;

c) Have computer skills meeting the basic information technology standards as stipulated in Circular No. 03/2014/TT-BTTTT;

d) Hold a certificate for professional development according to the job title standards for surveying and mapping officers at Level III.

3. Qualifications regarding professional expertise and skills:

a) Master legal regulations on surveying and mapping, standard systems, and technical norms in the field of surveying and mapping; have knowledge of some related specialized fields.

b) Possess the ability to implement specialized tasks related to surveying and mapping.

4. Promotion to the position of Surveying and Mapping Officer Level III:

a) For initial recruitment with a college degree or higher, there must be a minimum of two years of service in the position of Surveying and Mapping Officer Level IV.

b) For initial recruitment with a secondary vocational degree, there must be a minimum of three years of service in the position of Surveying and Mapping Officer Level IV.

A professional promoted from the position of Surveying and Mapping Officer Level IV to Surveying and Mapping Officer Level III must have served in the position of Surveying and Mapping Officer Level IV as follows:

Article 6. Surveying and Mapping Officer Level IV - Code: V.06.06.18

1. Duties:

a) Collect and process data; operate and use surveying and mapping equipment.

b) Manage technical operations within the scope of responsibility, ensuring production activities comply with technical standards and norms.

c) Test common tools and equipment used in surveying and mapping work.

d) Participate in implementing surveying and mapping work within the assigned responsibilities.

đ) Guide and supervise surveying and mapping staff in adhering to technical standards and norms, labor safety when performing surveying and mapping tasks.

e) Carry out technical work related to surveying and mapping in the production technology process.

2. Qualifications regarding education and training:

a) Graduated from a secondary vocational school or higher in geodesy, cartography, remote sensing, land management, cadastral, geography, or other relevant fields; if graduated from another field, must complete a professional knowledge and skills enhancement program as prescribed by the competent authority for surveying and mapping professionals.

b) Have a foreign language proficiency level of Grade 1 as stipulated in Circular No. 01/2014/TT-BGDĐT.

c) Have computer skills meeting the basic information technology usage standards as stipulated in Circular No. 03/2014/TT-BTTTT.

3. Qualifications regarding professional expertise and skills:

a) Possess the ability to apply technical standards and norms for surveying and mapping; skills in conducting surveying and mapping work.

b) Master labor safety regulations.

c) Understand the features, operating principles, and proficiently use specialized machinery and equipment in surveying and mapping work.

Chapter III

   APPOINTMENT AND PAY GRADE ASSIGNMENT BASED ON PROFESSIONAL POSITION

Article 7. Principles for Appointment and Salary Classification According to Professional Titles

1. Appointment to professional positions and pay grade assignment for surveying and mapping professionals must be based on job positions; educational and training qualifications; professional expertise and duties currently undertaken.

2. Professionals appointed to professional positions and pay grades must meet the qualifications for professional positions of surveying and mapping professionals as prescribed in Chapters I and II of this Joint Circular.

3. When appointing from the current rank to a corresponding professional position in surveying and mapping, it shall not be combined with pay grade advancement or promotion to a higher professional position.

Article 8. Appointment to Professional Positions

In cases where civil servants have been transferred to a rank and salary grade or appointed to the cadastral surveying ranks as prescribed in Decision No. 07/2008/QĐ-BTNMT dated October 6, 2008 of the Minister of Natural Resources and Environment promulgating the business standards for each rank of civil servants in the natural resources and environment sector (hereinafter referred to as Decision No. 07/2008/QĐ-BTNMT) and Circular Joint No. 30/2010/TTLT-BTNMT-BNV dated November 25, 2010 of the Ministry of Natural Resources and Environment - Ministry of Home Affairs guiding the transfer to a rank and salary grade for civil servants in the natural resources and environment sector (hereinafter referred to as Circular Joint No. 30/2010/TTLT-BTNMT-BNV), they shall be appointed to professional positions as follows:

1. Appoint the professional position of Cadastral Surveyor Level II (code V.06.06.16) to civil servants holding the rank of Senior Cadastral Surveyor (rank code 14.233).

2. Appoint the professional position of Cadastral Surveyor Level III (code V.06.06.17) to civil servants holding the rank of Cadastral Surveyor (rank code 14.234).

3. Appoint the professional position of Cadastral Surveyor Level IV (code V.06.06.18) to civil servants holding the ranks of College Cadastral Surveyor (rank code 14.235) and Secondary Cadastral Surveyor (rank code 14.236).

Article 9. Salary Grading Method

1. The professional positions of civil servants specializing in cadastral surveying shall apply the Specialized Salary Table for Staff in State Public Institutions (Table 3) issued together with Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on the wage system for cadres, civil servants, public officials, and armed forces personnel (hereinafter referred to as Decree No. 204/2004/NĐ-CP), as follows:

a) The professional position of Cadastral Surveyor Level II applies the salary grade and coefficient of type A2, Group 1 (A2.1), from coefficient 4.40 to coefficient 6.78.

b) The professional position of Cadastral Surveyor Level III applies the salary grade and coefficient of type A1, from coefficient 2.34 to coefficient 4.98.

c) The professional position of Cadastral Surveyor Level IV applies the salary grade and coefficient of type B, from coefficient 1.86 to coefficient 4.06.

2. Wage classification when civil servants complete their probation period and are appointed to a professional position:

After completing the probation period as stipulated and being appointed to a professional position by the competent authority managing civil servants, the following wage classification shall be implemented according to the appointed professional position:

a) In cases where civil servants hold a doctoral degree and are appointed to the professional position of Cadastral Surveyor Level III (code V.06.06.17), they shall be classified at grade 3/9, coefficient 3.00 of type A1.

b) In cases where civil servants hold a master's degree and are appointed to the professional position of Cadastral Surveyor Level III (code V.06.06.17), they shall be classified at grade 2/9, coefficient 2.67 of type A1.

c) In cases where civil servants hold a bachelor's degree and are appointed to the professional position of Cadastral Surveyor Level III (code V.06.06.17), they shall be classified at grade 1/9, coefficient 2.34 of type A1.

d) In cases where civil servants hold a college degree and are appointed to the professional position of Cadastral Surveyor Level IV (code V.06.06.18), they shall be classified at grade 2/12, coefficient 2.06 of type B.

e) In cases where civil servants hold a secondary degree and are appointed to the professional position of Cadastral Surveyor Level IV (code V.06.06.18), they shall be classified at grade 1/12, coefficient 1.86 of type B.

3. The wage classification into professional positions of civil servants as prescribed in Clause 1 of this Article for civil servants who have been transferred to a rank and salary grade or appointed to cadastral surveying ranks as prescribed in Decision No. 07/2008/QĐ-BTNMT and Circular Joint No. 30/2010/TTLT-BTNMT-BNV shall be implemented as follows:

a) In cases where civil servants meet the conditions for appointment to the professional position of cadastral surveying specialists with the same salary coefficient and grade as in the previous rank, they shall be classified at the same salary coefficient and grade and any seniority allowance exceeding the ceiling (if applicable) currently enjoyed in the previous rank (including the time for the next promotion or enjoyment of seniority allowance in the previous rank) into the newly appointed professional position.

Example 1: Mr. Ngô Văn B is working at the Technical Center for Natural Resources and Environment, Department of Natural Resources and Environment, Ha Giang Province, has been appointed and ranked as Cadastral Surveyor (rank code 14.234), grade 5/9, coefficient 3.66 since January 1, 2013. Now, Mr. Ngô Văn B meets the conditions and criteria and is appointed to the professional position of Cadastral Surveyor Level III (code V.06.06.17) by the competent authority, he shall be classified at grade 5/9, coefficient 3.66 of the professional position of Cadastral Surveyor Level III from the date the decision takes effect; the time for the next promotion shall be calculated from January 1, 2013.

b) In cases where cadastral surveying specialists hold a college degree and are currently classified under type A0 as prescribed in Decree No. 204/2004/NĐ-CP, now they are appointed to the professional position of Cadastral Surveyor Level IV (code V.06.06.18), the wage classification shall be based on the time of work with mandatory social insurance contributions according to the wage scale prescribed by the state (excluding the probation period), as follows:

- Starting from grade 2 of the professional position of Cadastral Surveyor Level IV, every two years (24 months) they will be classified up one grade (if there is a break in service without enjoying social insurance benefits, it will be accumulated); in cases where there is a year during the period of work that does not meet the assigned tasks or is disciplined, the promotion period will be extended according to the regular promotion system.

- After transferring to the salary grade for the profession title of Surveyor Grade IV as mentioned above, if the salary coefficient assigned at the profession title of Surveyor Grade IV plus any seniority allowance exceeding the ceiling (if applicable) is lower than the salary coefficient currently enjoyed at the old rank, then the difference coefficient shall be retained and enjoyed, including any seniority allowance exceeding the ceiling (if applicable), at the old rank. This retained difference coefficient shall be enjoyed throughout the entire period during which the officer is assigned the salary grade for the profession title of Surveyor Grade IV. Subsequently, if the officer is promoted to a higher profession title, this retained difference coefficient shall be added to the current salary coefficient (including any seniority allowance exceeding the ceiling, if applicable) to determine the salary grade for the newly appointed profession title, and the retention of the difference coefficient shall cease from the date the new profession title salary takes effect.

Example 2: Mr. Le Minh B, who graduated from a college majoring in Geography, was recruited to work at the Border and Administrative Boundary Center under the Vietnam National Mapping Agency, started social insurance contributions on January 1, 2008, and currently holds the rank of Cartographic Surveyor College (rank code 14.235), level 3/10, with a salary coefficient of 2.72 for Class A0 officers since July 1, 2014; during his tenure, he has consistently fulfilled assigned tasks without disciplinary actions. Now, Mr. Le Minh B meets the criteria and is appointed by the competent authority to the profession title of Surveyor Grade IV (code V.06.06.18). He will be assigned the following levels and salary coefficients:

- The working period of Mr. Le Minh B from January 1, 2008, excluding the six-month probationary period, starts from level 2 of the profession title of Surveyor Grade IV, and every two years, he advances one level. By July 1, 2014, Mr. Le Minh B will be assigned to level 5/12, with a salary coefficient of 2.66 for the profession title of Surveyor Grade IV, effective from the date the decision takes effect; the next salary increase review date will be July 1, 2014; concurrently, Mr. Le Minh B will enjoy a retention difference coefficient of 0.06 (2.72 - 2.66).

- On July 1, 2016 (after two years), if Mr. Le Minh B meets the conditions, he will be regularly promoted to level 6/12, with a salary coefficient of 2.86 for the profession title of Surveyor Grade IV, and continue to enjoy a retention difference coefficient of 0.06 (total salary coefficient received is 2.92).

4. For specialized surveyors who achieve results in promotion examinations and are appointed by the competent authority to the next higher profession title of specialized surveyor, the salary assignment shall be carried out according to the provisions of this Circular and the guidance provided in Clause 1, Section II of Circular No. 02/2007/TT-BNV dated May 25, 2007, issued by the Ministry of Home Affairs regarding salary assignment when upgrading ranks, changing ranks, or changing types of civil servants and officers.

Chapter IV

IMPLEMENTING PROVISIONS

Article 10. Provisions on Application

The agencies and units authorized to manage and utilize officers have the responsibility to create conditions for officers to supplement any missing criteria for the profession title of specialized surveyor as stipulated in this Circular for officers who have been transferred to new ranks and salary grades or appointed to surveyor ranks as prescribed in Decision No. 07/2008/QĐ-BTNMT and Joint Circular No. 30/2010/TTLT-BTNMT-BNV.

Article 11. Implementation Organization

1. This Circular serves as the basis for implementing the recruitment, utilization, and management of specialized surveyor officers in public service organizations.

2. Non-public service organizations may apply these regulations to recruit, utilize, and manage personnel engaged in surveying activities.

3. The heads of public service units directly managing and utilizing civil servants shall be responsible for:

a) Review the job positions of the unit, develop a plan to transfer officers holding surveyor ranks to the profession title of specialized surveyor (hereinafter referred to as the transfer plan) for officers within the scope of management according to the attached model in this Joint Circular, submit it to the superior management agency for consolidation and submission to the competent authority for approval;

b) Appoint the profession title of specialized surveyor officer according to the authority or delegated authority after the transfer plan has been approved by the competent authority.

4. The head of the agency or unit subordinate to a ministry, ministerial-level agency, government agency, provincial people's committee, or centrally-administered city has the responsibility:

a) To consolidate the transfer plans of subordinate agencies and units, submit them to the ministry, ministerial-level agency, government agency, provincial people's committee, or centrally-administered city for examination and approval;

b) Appoint the profession title of specialized surveyor officer according to the authority or delegated authority after the transfer plan has been approved by the competent authority.

5. Ministries, ministerial-level agencies, provincial people's committees, or centrally-administered cities have the responsibility:

a) To direct agencies and units under their jurisdiction to implement the transfer of profession titles;

b) To approve the transfer plans of agencies and units under their jurisdiction; resolve issues within their authority during the process of transferring profession titles;

c) To appoint the profession title of specialized surveyor officer according to their authority;

d) Annually report the results of appointing profession titles and assigning salaries for specialized surveyor officers under their jurisdiction to the Ministry of Natural Resources and Environment and the Ministry of Home Affairs.

Article 12. Effective Date

1. This Circular takes effect from February 1, 2016.

2. Abolish the provisions on the profession titles and codes of surveyor officer ranks in Decision No. 01/2008/QĐ-BNV dated August 4, 2008, issued by the Minister of Home Affairs on the issuance of profession titles and codes of surveyor officer ranks in the natural resources and environment sector.

3. Abolish the provisions on the professional standards of surveyor officer ranks in Decision No. 07/2008/QĐ-BTNMT dated October 6, 2008, issued by the Minister of Natural Resources and Environment on the issuance of professional standards of surveyor officer ranks in the natural resources and environment sector.

4. ABOLISH THE PROVISIONS ON GUIDELINES FOR TRANSFER AND GRADING OF RANKS AND SALARIES OF SPECIALIST GEOGRAPHIC INFORMATION OFFICERS IN JOINT CIRCULAR NO. 30/2010/TTLT-BTNMT-BNV DATED NOVEMBER 25, 2010 ISSUED BY THE MINISTRY OF NATURAL RESOURCES AND ENVIRONMENT AND THE MINISTRY OF HOME AFFAIRS ON GUIDELINES FOR TRANSFER AND GRADING OF RANKS AND SALARIES OF OFFICERS IN THE NATURAL RESOURCES AND ENVIRONMENT SECTOR.

Article 13. Responsibility for Implementation

1. THE MINISTER, HEADS OF MINISTRIES EQUIVALENT TO MINISTRIES; HEADS OF GOVERNMENT AGENCIES, CHAIRMEN OF PROVINCE PEOPLE'S COMMITTEES, AND DIRECTLY-GOVERNED CITY PEOPLE'S COMMITTEES SHALL BE RESPONSIBLE FOR IMPLEMENTING THIS JOINT CIRCULAR.

2. IF ANY DIFFICULTIES ARISE DURING IMPLEMENTATION, THEY ARE REQUESTED TO REPORT TO THE MINISTRY OF NATURAL RESOURCES AND ENVIRONMENT FOR COMBINATION AND LEADERSHIP IN COORDINATION WITH THE MINISTRY OF HOME AFFAIRS TO CONSIDER AND RESOLVE THEM.
