CIRCULAR

Regulations on the list of job positions and periodic rotation terms for job positions work for civil servants and officials in the natural resources and environment sector

Pursuant to Decree No. 158/2007/NĐ-CP dated October 27, 2007 of the Government stipulating the list of job positions and periodic rotation terms for cadres, civil servants, and officials; amended and supplemented by Decree No. 150/2013/NĐ-CP dated November 1, 2013;

Pursuant to Decree No. 21/2013/NĐ-CP dated March 4, 2013, promulgated by the Government, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Natural Resources and Environment;

At the proposal of the Director of the Cadre and Civil Servant Organization Department and the Director of the Legal Department,

The Minister of Natural Resources and Environment issues this Circular stipulating the list of job positions and periodic rotation terms for civil servants and officials in the natural resources and environment sector.

Article 1. Scope of Regulation and Applicability

Thông tư này quy định chi tiết khoản 4 Điều 38 Luật Thủy sản số 18/2017/QH14 đã được sửa đổi, bổ sung tại điểm c khoản 21 Điều 14 Luật số 146/2025/QH15.

This Circular stipulates the job positions in land; water resources; minerals; environment; meteorology and hydrology; climate change; surveying and mapping; sea and islands that must be periodically rotated and the periodic rotation terms for job positions at agencies, units, and organizations under the natural resources and environment sector.

This Circular applies to civil servants and officials not holding leadership or management positions at agencies, units, and organizations under the natural resources and environment sector that must be periodically rotated.

Article 2. List of Job Positions and Periodic Rotation Terms

1. List of Job Positions for Periodic Rotation

a) Reviewing applications for certificates of land use rights, ownership certificates of houses and other assets attached to land; registering, transferring land use rights and other assets attached to land;

b) Reviewing applications for land allocation, land lease, land use purpose conversion, extension of land use time;

c) Reviewing applications for land valuation, land auction, project bidding involving land use;

d) Reviewing applications for sale, lease of assets attached to land and granting land use quotas; identifying land users eligible for compensation and support; compensation and support levels in land clearance and resettlement;

đ) Reviewing applications for issuance, extension, adjustment, and reissuance of permits for mineral resource exploration, exploitation, utilization, discharge of wastewater into water sources, and groundwater drilling operations;

e) Reviewing applications for issuance, extension, approval of return of mineral exploration permits, mineral exploitation permits; permission for transfer of mineral exploration rights, mineral exploitation rights;

g) Reviewing applications for issuance, extension of hazardous waste treatment business permits; issuing Hazardous Waste Emitter Registration Books;

h) Reviewing applications for approval of environmental impact assessment reports, confirmation of environmental protection plans; approval of projects for environmental remediation and restoration during mineral exploitation activities;

i) Reviewing applications for issuance, extension, revocation of other environmental permits and certificates;

k) Reviewing applications for certification of clean development mechanism (CDM) projects and other international mechanisms on greenhouse gas emission reduction for economic sectors;

l) Reviewing applications for issuance of certificates for import registration of HCFCs, pre-mixed HCFC-141b polyols; export registration of HCFCs;

m) Reviewing applications for issuance, supplementation, extension of surveying and mapping business permits;

n) Reviewing applications for issuance, extension of marine and island resources exploitation and utilization business permits; scientific research on marine and island matters involving foreign factors; review or issuance of permits for investment projects of equipment, exploitation and utilization of marine, coastal, and island resources.

2. Periodic Rotation Implementation Term

The periodic rotation term for job positions is five years (sixty months) according to the list of job positions specified in Clause 1 of this Article.

Article 3. Implementation Organization

1. Heads of agencies, units, and organizations under the natural resources and environment sector shall be responsible for building and organizing the implementation of the annual periodic rotation plan for job positions for civil servants and officials for the following year within their authority after being reviewed and approved by the competent authority before October 31 each year.

2. People's Committees of provinces and centrally-administered cities shall be responsible for compiling and reporting to the Ministry of Natural Resources and Environment on the implementation of this Circular before November 15 each year.

3. The Director of the Cadre and Civil Servant Organization Department, Ministry of Natural Resources and Environment shall be responsible for guiding, monitoring, urging, inspecting the implementation, and compiling reports to the Minister of Natural Resources and Environment on the implementation of periodic job position rotation before November 30 each year.

Article 4. Effective date

This Circular takes effect from January 1, 2015.

Article 5. Responsibilities for Implementation

1. Ministers, heads of ministerial-level agencies, heads of government agencies, Chairpersons of provincial and centrally-administered city People's Committees shall be responsible for directing heads of agencies, units, and individuals under their management to implement this Circular.

2. In the course of implementation, if there are difficulties, units and organizations shall promptly reflect them to the Ministry of Natural Resources and Environment for consideration and resolution./.
