PRIME MINISTER
Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to the State Budget Law No. 01/2002/QH11 dated December 16, 2002, and Decree No. 60/2003/NĐ-CP dated June 6, 2003 of the Government detailing and guiding the implementation of the State Budget Law;
The Prime Minister issues this Decision on principles, criteria, and allocation standards for state budget investment capital development phase 2016-2020.
DECISION:
Article 1. This Decision promulgates the principles, criteria, and allocation standards for development investment capital from the state budget applicable for the period 2011-2015.
Article 2. The criteria and allocation standards for development investment capital from the state budget stipulated in Article 1 of this Decision serve as the basis for compiling the budget estimates for development investment expenditures from the state budget of ministries, ministerial-level agencies, central agencies under the Government, and other central agencies using development investment capital from the state budget (referred to as central ministries and sectors); and the budget estimates for development investment expenditures from the state budget of provinces and centrally-administered cities.
Article 3. Responsibilities and reporting deadlines for ministries, ministerial-level agencies, and provincial People's Committees of centrally-administered cities:
1. Responsibilities of ministries and ministerial-level agencies
- The Ministry of Planning and Investment shall take the lead and coordinate with the Ministry of Finance to balance the total amount of development investment capital from the state budget to implement the criteria and standards set forth in this Decision. The Ministry of Planning and Investment (General Statistics Office) shall be responsible for providing data on population, ethnic minority population, natural land area, and poverty rate as of December 31 of the previous year for provinces and centrally-administered cities.
- The Ministry of Finance shall be responsible for providing actual domestic revenue (excluding land revenue) and annual import-export revenue of provinces and centrally-administered cities.
- The Ministry of Home Affairs shall be responsible for providing data on district administrative units of provinces and centrally-administered cities; number of commune administrative units in poor districts as of December 31 of the previous year.
- The Ministry of Labor, Invalids and Social Affairs shall be responsible for providing data on compliance with reporting requirements of provinces with poor districts according to Resolution No. 30a/2008/NQ-CP.
- The Ministry of Foreign Affairs shall take the lead and coordinate with the Ministry of Home Affairs to provide data on border district administrative units of provinces and centrally-administered cities; number of border communes in poor districts according to Resolution No. 30a/2008/NQ-CP.
- The Ministry of Natural Resources and Environment shall take the lead and coordinate with the Ministry of Agriculture and Rural Development to provide data on rice planting area of provinces and centrally-administered cities as of December 31 of the previous year.
- The Ministry of Construction shall be responsible for providing data on the number of first, second, and third-tier cities of provinces and centrally-administered cities to be sent to the Ministry of Planning and Investment.
- The Committee for Ethnic Minorities shall be responsible for providing data on mountainous, highland, and island district administrative units of provinces and centrally-administered cities; number of extremely difficult communes in ethnic minority and mountainous areas under the Special Program for Developing Extremely Difficult Communes in Ethnic Minority and Mountainous Areas for the period 2011-2015; communes with extremely difficult hamlets in poor districts as of December 31 of the previous year.
2. Responsibilities of the People's Committees of provinces and centrally governed cities
- Based on the principles, criteria, and allocation standards for development investment capital attached to this Decision, financial capacity, and local conditions, establish principles and criteria for allocating development investment capital for local sectors and levels, and report to the Provincial People's Council for decision-making.
- Provinces and centrally-administered cities with poor districts shall be responsible for providing data on poor districts regarding: disbursement rate of supplementary targeted capital for poor districts; total population, including ethnic minority population; poverty rate, reduction rate, and relapse rate; forest coverage rate, new planted forest area as of December 31 of the previous year.
- Provinces and centrally-administered cities with border districts according to Decision No. 120/2003/QĐ-TTg dated June 11, 2003, and Decision No. 160/2007/QĐ-TTg dated October 17, 2007 shall be responsible for providing data on: border area area; population living in border areas; border length; number of border communes; number of border districts as of December 31 of the previous year.
- Provinces and centrally-administered cities with communes in safe zones (ATK) shall be responsible for providing data on: area, number of communes, population, ethnic minority population, poverty rate, clean water usage rate, national grid electricity usage rate, number of hospital beds at health centers and commune health stations per 1,000 people, road length per 10 square kilometers of natural land area in ATK as of December 31 of the previous year.
3. Reporting Deadline and Data Provision
Ministries, sectors, and provincial People's Committees of centrally-administered cities shall be responsible for reporting and providing the data specified in Clause 1 and Clause 2 of this Article to the Ministry of Planning and Investment before July 20 each year.
Provincial People's Committees of centrally-administered cities shall annually report on the implementation of this Decision to the Ministry of Planning and Investment before July 20 each year.
The Ministry of Planning and Investment shall compile the implementation status of this Decision and report it to the Prime Minister in the annual plan for developing state budget capital.
Article 4. This Decision takes effect from November 15, 2010, and applies to the fiscal years from 2011 to 2015. This Decision replaces Decision No. 210/2006/QĐ-TTg dated September 12, 2006, of the Prime Minister.
Article 5. The Minister of Planning and Investment shall be responsible for organizing and implementing this Decision. Ministers, heads of ministerial-level agencies, heads of central agencies under the Government, and Chairmen of provincial People's Committees of centrally-administered cities shall be responsible for enforcing this Decision./.
