CIRCULAR
Amending and supplementing some Articles of Circular No. 122/2024/TT-BQP dated December 31, 2024, issued by the Minister of National Defense on implementing democracy at the grassroots level in the Vietnam People's Army
Pursuant to the Law on Implementing Democracy at the Grassroots Level dated November 10, 2022;
Pursuant to Decree No. 59/2023/NĐ-CP dated August 14, 2023 detailing some provisions of the Law on Implementing Democracy at the Grassroots Level;
Pursuant to Decree No. 146/2025/NĐ-CP dated June 12, 2025 of the Government on decentralization and delegation in the field of industry and trade;
Pursuant to Decree No. 01/2022/NĐ-CP dated November 30, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of National Defense; and Decree No. 03/2025/NĐ-CP dated February 28, 2025 of the Government amending and supplementing some provisions of Decree No. 01/2022/NĐ-CP dated November 30, 2022 of the Government;
At the proposal of the Director of the General Political Department;
The Minister of National Defense issues this Circular amending and supplementing some Articles of Circular No. 122/2024/TT-BQP dated December 31, 2024, issued by the Minister of National Defense on implementing democracy at the grassroots level in the Vietnam People's Army.
Article 1. Amending and supplementing some Articles of Circular No. 122/2024/TT-BQP dated December 31, 2024, issued by the Minister of National Defense on implementing democracy at the grassroots level in the Vietnam People's Army
1. Amending and supplementing Clause 1 of Article 13 as follows:
"1. Electing and removing members from the Military Council."
2. Amending and supplementing Article 14 as follows:
“Article 14. Forms of discussion and decision-making
1. Organizing collective military personnel meetings to discuss and decide on matters specified in Article 13 of this Circular based on proposals from the Military Council, command of the agency or unit, or with at least one-third of the total number of military personnel, workers, defense civil servants, and laborers proposing.
2. In cases where it is not possible to organize a collective military personnel meeting due to force majeure, the command of the agency or unit shall direct the Military Council to send ballots to all military personnel, workers, defense civil servants, and laborers for their opinions.”
3. Amending and supplementing some Points and Clauses of Article 15 as follows:
a) Amend and supplement Clause 1 as follows:
“1. Collective military personnel meetings on implementing grassroots democracy regulations are organized by the command of the agency or unit; they are held annually after the end of the work year of the agency or unit; if delayed, they must be held within the first month of the following year upon the decision of the commander after consultation with the Military Council.
Emergency meetings can be held when there are proposals from the subjects specified in Clause 1 of Article 14; monthly and quarterly meetings are conducted according to the provisions of Articles 24 and 37 of this Circular.”
b) Amending and supplementing Point b Clause 2 as follows:
“b) For battalion-level units or equivalent, or company-level units working in dispersed locations or due to work reasons cannot leave their posts, the command of the agency or unit, in consultation with the Military Council, decides on the composition of participants in the meeting, which may include all personnel or representatives of military personnel, workers, defense civil servants, and laborers, ensuring suitability with practical circumstances;”
c) Amending and supplementing Point b of Clause 4 as follows:
“b) Representatives of the Military Council of the agency or unit present reports on the contents specified in Point b of Clause 3 of this Article; results of supervision and support for military personnel, workers, defense civil servants, and laborers in implementing democracy;”
d) Amending and supplementing Point d of Clause 4 as follows:
“d) Commanders and Chairpersons of the Military Council of the agency or unit accept, explain, and agree on measures to implement the contents discussed at the meeting; answer questions and address issues within their authority;”
4. Amending and supplementing Clause 1 and Clause 2 of Article 16 as follows:
“1. The command of the agency or unit directs the Military Council to organize collective military personnel meetings or send ballots to allow military personnel, workers, defense civil servants, and laborers to participate in discussions and decisions on matters specified in Article 13 of this Circular.
2. Commanders and the Military Council disseminate, guide, and urge the implementation of action programs and contents agreed upon at the collective military personnel meetings, the democratic implementation regulations of the agency or unit, and other contents unanimously decided by the collective military personnel; promptly propose solutions to any arising issues during the implementation process.”
5. Amending and supplementing Clause 2 of Article 21 as follows:
“2. Military personnel, workers, defense civil servants, and laborers carry out inspections and supervision through the activities of the Military Council.”
6. Amending and supplementing Clause 2 and Clause 3 of Article 22 as follows:
“2. If signs of violations are detected, they should be reported or reflected to commanders, the Military Council, or mass organizations of which they are members, or they have the right to lodge complaints or denunciations in accordance with the law and the Ministry of National Defense.
3. The Military Council represents military personnel, workers, defense civil servants, and laborers to conduct inspections and supervision in accordance with the provisions of Articles 34 and 45 of this Circular.”
7. Amending and supplementing some Points and Clauses of Article 23 as follows:
a) Amending and supplementing Point a and Point b of Clause 1 as follows:
“a) Based on the requirements, tasks, characteristics, nature of organization and operation, and actual conditions of the agency or unit, in consultation with the Military Council, develop and issue detailed regulations on implementing democracy to specify the content and methods of implementing democracy in their own agency or unit, serving as a basis for military personnel, workers, defense civil servants, and laborers to inspect and supervise the implementation. The content of the regulations may be expanded but must not contravene or limit the implementation of the contents already prescribed in the Law on Implementing Democracy at the Grassroots Level;
b) Create conditions and ensure that the Military Council of the agency or unit can perform its inspection and supervision duties in accordance with the law. Strictly handle any acts obstructing military personnel, workers, defense civil servants, and laborers from exercising their rights to inspect and supervise;”
b) Amend and supplement Clause 2 as follows:
“2. Military personnel, workers, defense civil servants, and laborers are responsible for the content of their reflections, suggestions, complaints, and denunciations; actively and proactively cooperate with the Military Council, the executive committees of mass organizations, and competent authorities in verifying, inspecting, and supervising the content of complaints, denunciations, suggestions, and reflections.”
8. Amending and supplementing Point a and Point b of Clause 1 of Article 27 as follows:
"a) Company battalion; company headquarters; border guard post; border guard fleet; border guard district; maritime police team; maritime police station; anti-aircraft missile battalion; air force squadron; staff unit of division, regiment, maritime police brigade and equivalent units;"
"b) Department level of divisional headquarters, regional command (Navy and Maritime Police), provincial military command and equivalent units; staff unit of permanent divisional framework; permanent regimental framework and equivalent units;"
9. Amend and supplement some points and clauses of Article 54 as follows:
a) Amend and supplement Clause 1 as follows:
"1. The People's Inspection Board shall be established at state-owned enterprises by the workers' congress comprising from three to nine members upon the proposal of the Trade Union Committee of the enterprise.
In cases where the enterprise has special characteristics or operates in a dispersed manner, the workers' congress may decide on a higher number of members for the People's Inspection Board to ensure effective operation."
b) Amending and supplementing Point a Clause 3 as follows:
"a) Being an employee currently working in a state-owned enterprise with good moral character, having a good reputation within the enterprise, and possessing sufficient health to fulfill the tasks;"
c) Amend and supplement Clause 4 as follows:
"4. The term of office of the People's Inspection Board is two years.
During the term of office, if there is a vacancy among members or if a member fails to complete the assigned tasks, loses trust, or requests to resign, the Trade Union Committee of the enterprise shall propose to the workers' congress to decide on their removal and elect a replacement."
10. Amend and supplement Article 55 as follows:
“Article 55. Duties and powers of the People's Inspection Board
1. Inspect the implementation of decisions made by the collective of workers; monitor the implementation of the Party's guidelines and policies, State laws, and laws on democratic practices in state-owned enterprises.
2. Recommend the enterprise or persons with authority to handle matters according to the law when signs of law violations are detected, and supervise the implementation of such recommendations.
3. Require authorized representatives, management, and leadership of the enterprise to provide information and documents relevant to serve the purpose of verification, inspection, and supervision.
4. Examine and verify specific cases upon the request of workers in the enterprise.
5. Recommend the management and leadership of the enterprise to address deficiencies and shortcomings identified through inspections and supervision; ensure the rights and legitimate interests of workers; commend outstanding collectives and individuals. In cases where acts of law violations are discovered, recommend competent authorities to examine and handle them.
6. Attend meetings of the enterprise related to the performance of the People's Inspection Board's inspection and supervision duties.
7. Receive complaints and reflections from workers related to the scope of inspection and supervision of the People's Inspection Board."
11. Amend and supplement Article 56 as follows:
“Article 56. Principles of organization and operation of the People's Inspection Board
1. The People's Inspection Board in state-owned enterprises is directly guided and directed by the Trade Union Committee; it must comply with the provisions of the law, perform its assigned duties and powers accurately, ensuring objectivity, transparency, and fairness. All workers' feedbacks are truthfully reflected to the competent authority for resolution according to the law; they must not abuse their duties and powers to incite, entice, or lure workers to commit illegal acts; work collectively and decide by majority rule.
2. Based on the resolutions of the workers' congress of state-owned enterprises and the guidance of the Trade Union Committee, the People's Inspection Board develops a work program quarterly, semi-annually, and annually, including basic contents such as objectives, requirements, content, time frame, budget, implementation methods, and other guarantee conditions; develop specific inspection and supervision plans to report to the Trade Union Committee and notify the inspected and supervised entities (if any) at least five working days before conducting the inspection and supervision activities.
3. Receive information reported directly by workers through suggestion boxes and study relevant documents. Conduct work with relevant units and individuals regarding complaints and suggestions to assess the authenticity of the reported content; compile, analyze, compare with the enterprise's regulations and working rules to evaluate and make recommendations to the employer for consideration and resolution or through the Trade Union Committee of the enterprise. Inspection and supervision results are documented and sent to the entity or individual who made the complaint or suggestion. If illegal acts are discovered, recommend competent authorities to examine and handle them according to the law.
4. The People's Inspection Board is responsible for regularly reporting the results of its activities quarterly, semi-annually, and annually or when required to the Trade Union Committee of the enterprise; report the annual performance results at the workers' congress of the state-owned enterprise.
5. The People's Inspection Board maintains regular contact and closely collaborates with employers and workers to promptly receive opinions and feedback; compile, compare, verify, and make recommendations for resolution within their authority or report to competent authorities for resolution according to the law."
Article 2. Repeal certain Points and Articles of Circular No. 122/2024/TT-BQP dated December 31, 2024, issued by the Minister of National Defense regarding the implementation of grassroots democracy in the Vietnam People's Army
Repeal Point d, Point e Clause 4 Article 15; Point d Clause 1 Article 23 and Article 57.
Article 3. Implementation Provisions
1. This Circular takes effect from July 14, 2025.
2. The Chief of General Staff, the Director of the Political General Department, and the commanders of the agencies and units shall be responsible for organizing the implementation of this Circular./.
