DECREE OF THE GOVERNMENT
On the retirement age for coal miners working underground

Pursuant to the Government Organization Law dated September 30, 1992;
Pursuant to the Labour Code dated June 23, 1994;
Pursuant to Decree No. 12/CP dated January 26, 1995 of the Government on the issuance of the Social Insurance Regulations and Decree No. 93/1998/NĐ-CP dated November 12, 1998 of the Government amending and supplementing certain provisions of the Social Insurance Regulations issued together with Decree No. 12/CP dated January 26, 1995;
At the proposal of the Minister of Labor, Invalids and Social Affairs,
DECREE:
Article 1. The retirement age for workers engaged in underground coal mining work (including underground coal miners, tunnel diggers, and underground coal transporters) is set at fifty years old if they have contributed to social insurance for twenty years, including at least fifteen years in such work.
In cases where workers engaged in underground coal mining work meet the age requirement but have not yet met the required period of social insurance contributions as stipulated above, and still meet the health requirements, they may continue working until they meet the retirement conditions, but not exceeding fifty-five years old.
Article 2. The monthly pension of workers engaged in underground coal mining work shall be calculated according to the general provisions of Decree No. 12/CP dated January 26, 1995 and Decree No. 93/1998/NĐ-CP dated November 12, 1998 of the Government, specifically as follows: contributing to social insurance for fifteen years equals forty-five percent of the average monthly salary used as the basis for social insurance contributions during the five consecutive years with the highest salaries, and for each additional year of contribution, two percent is added, up to a maximum of seventy-five percent of the average monthly salary used as the basis for social insurance contributions during the five consecutive years with the highest salaries.
Article 3. This Decree takes effect from January 1, 2002.
Article 4. The Ministry of Labor, Invalids and Social Affairs is responsible for guiding the implementation of this Decree.
Article 5. Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairmen Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).Provincial People's Committees under the Central Government are responsible for enforcing this Decree./.
