Decree No. 61/2019/ND-CP detailing some provisions and measures for the implementation of the Law on Vietnam Coast Guard

Detailed provisions on certain articles and implementation measures of the Law on Vietnam Coast Guard

Pursuant to the Law on Government Organization dated June 19, 2015;

Pursuant to the Law on the Vietnam Coast Guard dated November 19, 2018;

"Based on the proposal of the Minister of National Defense;"

The Government promulgates this Decree providing detailed provisions on certain articles and implementation measures of the Law on Vietnam Coast Guard.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Decree stipulates the organization; uniforms; flags, colors, identification marks for vessels, boats, aircraft; the regime and policies for the Vietnam Coast Guard and the responsibilities of the Minister, Heads of ministerial-level agencies, Chairpersons of provincial People's Committees in coordinating activities with the Vietnam Coast Guard.

Article 2. Applicability

This Decree applies to agencies, units, officers, soldiers of the Vietnam Coast Guard and other relevant agencies, organizations, and individuals.

Article 3. Implementation of work measures of the Vietnam Coast Guard

Agencies, units, officers, and soldiers under the Vietnam Coast Guard, when performing their duties, shall implement work measures as prescribed in Article 12 of the Law on Vietnam Coast Guard, other related legal normative documents, and shall be responsible before the law, superiors, and the Commander of the Vietnam Coast Guard regarding their activities.

Article 4. Legal titles of the Vietnam Coast Guard

1. Police officer, Investigator, and Investigative Officer are legal titles of the Vietnam Coast Guard, tasked with preventing, stopping, detecting, and combating crime and violations of the law.

2. Police officers and Investigators of the Vietnam Coast Guard include:

a) Junior Police Officers and Investigators;

b) Intermediate Police Officers and Investigators;

c) Senior Police Officers and Investigators.

3. The Minister of National Defense shall prescribe conditions, standards, procedures, and formalities for appointment, removal, dismissal, and the Model Certificate for Police Officers and Investigators of the Vietnam Coast Guard.

4. The Commander of the Vietnam Coast Guard shall decide on the appointment, removal, and dismissal of Police Officers and Investigators; issue, revoke, and regulate the management and use of Certificates for Police Officers and Investigators of the Vietnam Coast Guard.

5. Investigative Officers of the Vietnam Coast Guard, when assigned to investigate criminal cases according to the Criminal Procedure Code and the Law on Organization of Criminal Investigation Agencies, shall be responsible before the law and the Head who issued the assignment regarding the performance of their tasks and powers.

Article 5. Regime and policies for officers and soldiers of the Vietnam Coast Guard

Officers and soldiers of the Vietnam Coast Guard shall enjoy salaries based on rank, grade, position, allowance systems; they shall also enjoy out-of-scale seniority allowances, allowances for兼任police officers and investigators' concurrent positions, regional allowances, special allowances, attraction allowances, mobility allowances, hazardous duty allowances, occupational seniority allowances, responsibility allowances for occupations, task responsibility allowances, national defense and security service allowances, long-term service at sea allowances, sea day allowances, and special sea allowances corresponding to the working regions and islands, job requirements, and other regimes and policies as officers and soldiers of armed forces and officials and civil servants with similar working conditions, environments, regions, and islands according to the law.

Article 6. Funding for the Vietnam Coast Guard

1. The Command of the Vietnam Coast Guard shall open an account at the State Treasury; funding for the operations of the Vietnam Coast Guard shall be provided from the state budget and recorded as a separate item within the total funding of the Ministry of National Defense.

Chapter II

ORGANIZATION OF THE VIETNAM COAST GUARD

Article 7. Organizational System of the Vietnam Coast Guard

The organizational system of the Vietnam Coast Guard includes:

1. The Command of the Vietnam Coast Guard.

2. Units subordinate to the Command of the Vietnam Coast Guard:

a) The Command of Coast Guard Zone 1; The Command of Coast Guard Zone 2; The Command of Coast Guard Zone 3; The Command of Coast Guard Zone 4;

b) Special Task Force 1 against drug crimes; Special Task Force 2 against drug crimes; Special Task Force 3 against drug crimes; Special Task Force 4 against drug crimes;

c) Reconnaissance Team 1; Reconnaissance Team 2;

d) Training and Professional Development Center.

3. Agencies and units directly under the units specified in Clause 2 of this Article.

The agencies of the Command of the Vietnam Coast Guard include the Operations Directorate, the Political Department, the Operations and Legal Department, the Logistics Department, the Technical Department, and other agencies directly under the Command of the Vietnam Coast Guard.

Article 9. Scope of Operation and Management Area

2. The scope of operation and management area of the units specified in Points b, c, d of Clause 2 and Clause 3 of Article 7 of this Decree shall be determined by the Commander of the Vietnam Coast Guard.

Article 10. Authority to Establish, Reorganize, Split, Merge, Change Name, and Dissolve Agencies and Units of the Vietnam Coast Guard

1. The establishment, reorganization, splitting, merging, changing name, and dissolution of the Command of the Vietnam Coast Guard shall be decided by the competent authority.

2. The establishment, reorganization, splitting, merging, changing name, and dissolution of the units specified in Point a of Clause 2 of Article 7 of this Decree shall be decided by the Minister of National Defense upon submission to the Prime Minister.

3. The establishment, reorganization, splitting, merging, changing name, and dissolution of the remaining agencies and units of the Vietnam Coast Guard shall be decided by the Minister of National Defense.

4. The Commander, Political Commissar, Deputy Political Commissar, and Deputy Commanders of the Vietnam Coast Guard shall be appointed by the Prime Minister upon recommendation by the Minister of National Defense and the Minister of Interior Affairs.

Chapter III

UNIFORMS OF THE VIETNAM COAST GUARD

Section 1

SIGNALS, RANK BADGES, AND INSIGNIA OF THE VIETNAM COAST GUARD

Article 11. Emblem

1. The emblem of the Vietnam Coast Guard is circular, with a five-pointed yellow star prominently displayed on a bright red background, surrounded by two yellow ears of rice on a blue background, below which there is a half gear wheel in yellow, the outer rim of the emblem being yellow, and two branches of golden pine trees on either side.

Article 12. Rank Insignia

The rank insignia of the Vietnam Coast Guard is a symbol representing the rank of officers, non-commissioned officers, cadets, warrant officers, and enlisted personnel of the Vietnam Coast Guard worn on their shoulder. The basic structure of the rank insignia includes: Background, border, rank button, stars, and stripes (for officers and non-commissioned officers), and bars (for warrant officers and enlisted personnel).

1. Rank insignia for Vietnam Coast Guard officers

a) Shape: Two narrow sides and two vertical sides;

b) The background color of the rank insignia is blue; the background of the insignia for general officers has a sunken bronze drum pattern, with the center of the drum located where the rank button is attached;

c) The border color of the rank insignia is gold;

d) On the background of the rank insignia, there are: Rank buttons, stripes, and gold stars. The rank button is round, embossed with patterns (for generals, it is the national emblem; for colonels and majors, it is two ears of rice surrounding a five-pointed star in the middle), the insignia for generals does not have horizontal stripes, colonels have two horizontal stripes, majors have one horizontal stripe, the number of stars:

Second Lieutenant, Second Lieutenant Colonel, Second General: 01 star;

Lieutenant, Lieutenant Colonel, Lieutenant General: 02 stars;

Senior Lieutenant, Senior Colonel: 03 stars;

Major, Colonel: 04 stars.

2. Rank insignia for professional military personnel of the Vietnam Coast Guard

Follows the provisions of Clause 1 of this Article but on the background of the rank insignia, there is a pink strip 5 mm wide in the middle along the vertical direction.

3. Rank insignia for warrant officers and enlisted personnel of the Vietnam Coast Guard

a) Shape: Two narrow sides and two vertical sides;

b) The background color of the rank insignia is blue;

c) The border color of the rank insignia is gold;

d) On the background of the rank insignia, there are: Rank buttons, horizontal bars or V-shaped bars in gold. The rank button is embossed with patterns of two ears of rice surrounding a five-pointed star in the middle, the number of horizontal bars or V-shaped bars:

Private Second Class: 01 V-shaped bar;

Private First Class: 02 V-shaped bars;

Corporal: 01 horizontal bar;

Sergeant: 02 horizontal bars;

Staff Sergeant: 03 horizontal bars.

4. Rank insignia for cadets training to become officers, warrant officers, and technical staff of the Vietnam Coast Guard

a) Shape: Two narrow sides and two vertical sides;

b) The background color of the rank insignia is blue;

c) The border color of the rank insignia is gold. For officer cadets, the border width is 5 mm; for warrant officer and technical staff cadets, the border width is 3 mm;

d) On the background of the rank insignia, there is a rank button. The rank button is embossed with patterns of two ears of rice surrounding a five-pointed star in the middle.

Article 13. Shoulder Patch

1. Background and shape of the shoulder patch worn on the collar

a) The background of the shoulder patch is parallelogram-shaped, blue, with the Vietnam Coast Guard emblem in yellow on the background; the background of the shoulder patch for generals has a gold border 5 mm wide on three sides;

b) The Vietnam Coast Guard emblem on the shoulder patch is yellow, shield-shaped, with two crossed swords behind, inside which there is an anchor shape, below which there is a yellow ear of rice, and above which there is a yellow five-pointed star.

a) Single pine branch for general officers;

b) Single pine branch for colonel and major officers.

Article 14. Emblem

The emblem of the Vietnam Coast Guard is worn on the chest and has the shape of a wave wing, with a shield-shaped figure in the middle, on a blue sea background bordered in gold, with two crossed swords behind it, inside which there is a yellow anchor-shaped figure, and on both sides of the wave wings are dark blue colored.

Article 15. Nameplate

The nameplate of the Vietnam Coast Guard is worn on the chest and has a rectangular shape, measuring 2x8 cm, with a dark blue background and a gold border, the upper right corner of which has a red star and yellow flag, and in the center of the nameplate is the surname and name printed in white.

Article 16. Logo

The logo of the Vietnam Coast Guard has a shield shape on a dark blue background, with a red outer border and a gold inner border; in the middle is a small shield-shaped figure with a red border, two crossed swords behind it, and inside is an anchor-shaped figure; below the badge is a golden ear of rice; above is a five-pointed yellow star, directly under the star is the text "CẢNH SÁT BIỂN VIỆT NAM", followed immediately below by the text "VIETNAM COAST GUARD"; below the two ears of rice is a golden half gear wheel.

Article 17. Rank Badge Combined with Service Badge

The rank badge combined with service badge of the Vietnam Coast Guard is worn on the collar of the combat uniform and consists of: Badge background, badge figure, star, vertical line (for officers, professional military personnel, students), stripe (for non-commissioned officers); specifically, generals do not have vertical lines and soldiers do not have stripes.

1. General: The badge background is a parallelogram shape, navy blue in color with a 5 mm wide gold border on three sides, attached with the badge figure and a five-pointed yellow star. Number of stars:

Lieutenant General: 01 star;

Major General: 02 stars.

2. Officer: The badge background is a parallelogram shape, navy blue in color, attached with the badge figure, a five-pointed yellow star, and a vertical gold line, the number of stars as specified in point d, Clause 1, Article 12 of this Decree; number of vertical lines: The rank of colonel has two vertical lines, the rank of captain has one vertical line.

3. Professional Military Personnel: The rank badge combined with service badge for professional military personnel is similar to that of officers as specified in Clause 2 of this Article.

4. Non-Commissioned Officers, Soldiers

a) Non-Commissioned Officers: The badge background is a parallelogram shape, navy blue in color, attached with the badge figure, a five-pointed yellow star, and a single vertical line made of golden thread 3 mm wide. Number of stars:

Corporal: 01 star;

Sergeant: 02 stars;

Senior Sergeant: 03 stars.

b) Soldier: The badge background is a parallelogram shape, navy blue in color, attached with the badge figure and a five-pointed yellow star, the number of stars:

Private Second Class: 01 star;

Private First Class: 02 stars.

5. Students

a) Students who are officers: The rank badge combined with service badge for officer students is similar to that of officers as specified in Clause 2 of this Article;

b) Students training to become officers: The badge background is a parallelogram shape, navy blue in color, attached with the badge figure, and has a single vertical line made of golden thread 5 mm wide, without stars;

c) Students training to become non-commissioned officers and technical staff: The badge background is a parallelogram shape, navy blue in color, attached with the badge figure, and has a single vertical line made of golden thread 3 mm wide, without stars.

Section 2

UNIFORMS AND DRESS UNIFORMS OF THE VIETNAM COAST GUARD

Article 18. Uniforms and Dress Uniforms

1. The uniforms of the Vietnam Coast Guard include:

a) Regular uniforms;

b) Combat uniforms;

c) Special duty uniforms;

d) Working uniforms.

a) Winter dress uniforms;

b) Summer dress uniforms;

c) Dress uniforms for workers and defense officials;

d) Dress uniforms for honor guards and sentinels.

Article 19. Regular uniforms, combat uniforms, service uniforms, work uniforms; cold weather hats and coats of the Vietnam Coast Guard

1. The regular uniform for officers, professional soldiers, student officers, female non-commissioned officers - soldiers, workers, and defense civil servants includes winter regular uniforms and summer regular uniforms:

a) Winter regular uniforms include hat, trousers, coat, undershirt, tie, belt, shoes, socks;

b) Summer regular uniforms include hat, trousers, shirt, belt, shoes, socks.

2. The regular uniform for male non-commissioned officers - soldiers; male students who are not yet officers or professional soldiers; male students training to become non-commissioned officers and technical specialists: Use a single type of uniform for both winter and summer, including hat, trousers, shirt, belt, shoes, socks.

3. Combat uniforms for officers, professional soldiers, student officers, and non-commissioned officers - soldiers include training hats, combat hats, soft combat caps, combat clothing, combat boots, combat belts.

4. Service uniforms for officers and soldiers of the Vietnam Coast Guard performing ceremonial duties, bilateral patrols, diplomatic missions, hotline communications, ship operations, search and rescue, and special tasks include winter and summer service uniforms, consisting of hat, clothing, shoes or boots, gloves, belt, victory belt.

5. Work uniforms for specialized professions within the Vietnam Coast Guard when performing special tasks include hat, trousers, shirt, shoes or boots.

6. Officers and soldiers of the Vietnam Coast Guard are provided with cold weather hats and coats; officers and professional soldiers also receive utility coats; male non-commissioned officers - soldiers on guard duty receive additional guard coats.

7. The styles and colors of the uniforms specified in this Article shall be implemented according to the regulations of the Minister of National Defense.

1. Cap

a) Style: The cap has an oval-shaped top; the button of the cap for general officers bears a raised national emblem, for colonels and majors a raised five-pointed star in gold; there is a visor in front of the forehead for attaching insignia, a cooc dong cord above the brim, and two rice ears below the brim;

b) Colors:

Cap top color: Dark navy blue;

Cap band color: Light blue;

Inner lining, brim edge, strap color: Black;

Cooc dong cord, rice ears color: Gold.

2. Trousers and Coat

a) Style:

Coat: Long-sleeved style, V-neck, front with four welt pockets, back with a split hem, shoulder straps for rank insignia, lined body and sleeves. On the sleeve of the dominant hand, the Vietnam Coast Guard logo as prescribed in Article 16 of this Decree is attached;

Trousers: Long-style dress pants, with two diagonal pockets, full-length zipper closure.

b) Color: Dark navy blue.

3. Under-shirt: Loose-fitting style, worn tucked into trousers, long-sleeved, stand-up collar, white color.

4. Tie: Pre-tied style, matching the coat color.

5. Belt: Leather core, black color; for generals, double-layer leather; for colonels and majors, single-layer smooth leather. The buckle is made of gold metal with a raised five-pointed star within a circle.

6. Shoes: Black leather; for generals, smooth-toed style with fixed laces; for colonels, horizontal-grained toe style with fixed laces; for majors, horizontal-grained toe style with tied laces.

7. Socks: Tube-knit style, matching the trousers color.

1. Soft cap

a) Model: A round cap with a brim all around, foldable on both sides of the ears and at the back of the head, with a visor in front for wearing insignia, a cooc dong string above the brim, and two rice flowers below the brim;

b) Color: Charcoal blue. The cooc dong string and rice flowers are yellow.

2. Trousers and Coat

a) Style:

Coat: Long-sleeved model with a V-neck, two overlapping pockets at the front bottom, shoulder and waist pleats, a slit at the back bottom, shoulder straps for insignia, and the logo of the Vietnam Coast Guard attached to the left sleeve according to Article 16 of this Decree;

Trousers: European-style long trousers with two vertical pockets, full-length zipper opening;

b) Color: Dark navy blue.

3. Under-shirt: Loose-fitting white shirt with a belt at the waist, worn tucked into the trousers, long sleeves, standing collar;

4. Tie: Pre-tied style, matching the coat color.

5. Leather shoes: Square-toed high-heeled shoes with a leather strap adorned with decorative laces, black color;

6. Socks: Knitted socks matching the color of the trousers;

1. Cap, trousers, belt, leather shoes, socks: Colors and models follow the provisions of Clauses 1, 2, 5, 6, and 7 of Article 20 of this Decree;

2. Shirt

Model: Short-sleeved shirt with a V-neck, four overlapping pockets at the front, a slit at the back bottom, shoulder straps for insignia, and the logo of the Vietnam Coast Guard attached to the left sleeve according to Article 16 of this Decree;

Color: Charcoal blue;

Article 23. Summer ceremonial uniform for female officers, professional military personnel, and students training to become officers of the Vietnam Coast Guard

1. Soft cap: Model and color follow the provisions of Clause 1 of Article 21 of this Decree;

2. Dress and blouse

a) Style:

Blouse: Short-sleeved shirt with a V-neck, two overlapping pockets at the front bottom, shoulder and waist pleats, a slit at the back bottom, shoulder straps for insignia, and the logo of the Vietnam Coast Guard attached to the left sleeve according to Article 16 of this Decree;

Dress: Fitted dress below the knee with an inner lining layer, slit at the back bottom;

b) Color: Dark navy blue.

3. Leather garter: High-collared leather garter with a zipper closure, collar height reaching mid-calf, smooth toe, textured sole to prevent slipping; black color;

4. Stockings: Skin-colored;

Article 24. Ceremonial uniform for workers and civil servants

1. Male workers wear suits, female workers wear traditional Vietnamese ao dai, and both wear leather shoes and socks;

2. Details regarding the models and colors of the ceremonial uniforms for workers and civil servants shall be implemented according to the regulations of the Minister of National Defense;

Article 25. Ceremonial uniform for honor guards and sentinels

1. The ceremonial uniform for honor guards and sentinels of the Vietnam Coast Guard at the Coast Guard Command, Regional Coast Guard Command, Special Task Force against Drug Crimes, and Reconnaissance Team includes two types, for winter and summer use;

2. Models

a) Cap: Oval-shaped crown with a circular spring wire rim around it, 1.5 mm wide. The forehead and brim are reinforced with plastic. The top of the brim is covered with black imitation leather, with a visor trim attached. The visor trim has embossed rice flowers connected together, with a bow in the middle. Above the visor, there is a cooc dong string with gold thread, with each end fastened to the cap with buttons. The buttons are star-shaped. In the center of the front crown, there is a visor for wearing insignia with a diameter of 36 mm and paired pine branches; on both sides of the forehead, there are air vents. The internal cap strap can be adjusted. The outer cap band has horizontal stripes;

Color: Crown charcoal blue; inner crown light blue; inner brim, visor cover, and cap strap black; cooc dong string and rice flowers yellow;

b) Coat

Outer coat: Overcoat with lining; collar with a 3 mm wide light blue edge, V-neck. Collar with a notch for wearing pine branches. Front with four overlapping pockets, each pocket with a buttonhole, bottom corners cut at an angle, flap with a pointed tip, top button with a diameter of 18 mm, bottom button with a diameter of 22 mm, four buttons on the lapel with a diameter of 22 mm. Back with a slit at the bottom. On both sides of the coat, between the seams and pleats, there are ribs to hold the belt. Shoulder straps for insignia. On the left shoulder of the back, there is a loop for securing the victory belt. Long sleeves with cuffs that can be turned outwards, with two parallel blue stripes inside and yellow stripes outside, sewn diagonally towards the back seam. The left sleeve has the logo of the Vietnam Coast Guard attached according to Article 16 of this Decree. Buttons are sewn directly onto the coat. On the right side of the front, there is a notch for wearing the Vietnam Coast Guard emblem according to Article 14 of this Decree;

Inner shirt: Loose-fitting white shirt, long sleeves, standing collar;

Inner vest: Four plastic buttons with a diameter of 15 mm. At the waist of the back, there is a 2 cm wide elastic band. Vest filled with cotton in diamond shape;

Color: Charcoal blue;

c) Trousers: Long trousers with two diagonal pockets, full-length zipper opening. Front with a pleat on each side folded towards the side. Back with a pleat on each side and two rear pockets. Waistband with a deep bottom to accommodate the belt. Vertical stripes on both sides of the trousers;

Color: Charcoal blue;

d) Necktie: Pre-tied, same color as the coat;

đ) Buttons: Round buttons slightly convex, front surface embossed with two rice flowers and a five-pointed star in the middle. On the back of the button, there is a protruding base;

e) Sleeve cuffs and trouser stripes: Embossed stripe, 2 cm wide;

Color: Light blue background, yellow edges;

g) Black or white leather shoes (for use in ceremonies of ministries and agencies): Designed with a rounded toe, horizontal texture. Leather strap with four pairs of lace holes for decoration, elastic under the strap. Toe made of cowhide. Sole and heel lined with light yellow leather, toe lined with specialized canvas. Sole and toe bonded with specialized adhesive, stitched at the toe and nailed at the heel. Sole molded with a fixed heel, textured sole to prevent slipping, inner lining in bright yellow;

Black leather boots (used for welcoming international delegations): High-top style with smooth toe, the collar and toe are sewn together; the sole has anti-slip patterns, under the heel part there is a steel plate to prevent wear; inside the ankle area, there is a thick foam cushion to provide comfort when marching.

h) Belt

Large shoulder belt: The main strap width is 5 cm, with decorative stitching around the outer edge. On the surface of the main strap, there are embroidered diamond-shaped decorations. The belt has four loops (two loops for connecting the shoulder strap, one loop for adjusting the length, and one loop for securing the excess end). The shoulder strap width is 2 cm, with a length adjustment mechanism. The shoulder strap connects to the main strap using stainless steel loops. The buckle is made of brass with a gold finish, featuring a raised five-pointed star within a circle on its surface. There are two loops at each end to connect the main straps. Accompanying the large shoulder belt is a K59 pistol holster and a magazine pouch worn on the right side of the main strap.

Large belt without shoulder strap: Specifications are the same as the large shoulder belt, except it does not include the K59 pistol holster and magazine pouch.

Small belt: Consists of two main parts, the strap and the buckle; the belt strap width is 3.3 cm, the excess tail of the strap is threaded outwards when in use, made of leather, one side is smooth; the buckle type is a continuous adjustable mechanism, with a raised five-pointed star within a circle in the center of the buckle's upper surface.

Color: The large shoulder belt, large belt without shoulder strap, K59 pistol holster, and magazine pouch are white, the buckle is gold. The small belt is black, the buckle surface is gold.

i) Victory ribbon

Shoulder strap consists of a single strand of wire with a diameter of 5 mm running parallel to a braided cord. The braided cord is made from three double strands (in a fishbone pattern).

Chest strap is a section of a braided cord from three single strands in a fishbone pattern, one end is attached to the end of the shoulder strap, the other end connects to two grenade straps.

Grenade straps: Each strap has a knot, one end connects to the chest strap and the other end connects to the grenade.

Two grenade pendants are cast from zinc alloy, coated in gold, the body of the pendant is hollow for attaching the strap, the cap of the pendant is spherical, with two rice ears surrounding a five-pointed star.

Color: The victory ribbon and grenade pendants are gold.

k) White gloves: The cuff and palm are knitted together, the wrist has elastic, the top of the palm has three stitched lines to shape the glove. The hand has five fingers, the wrist area is knitted in 1:1 rib, the sleeve area is knitted in 2:2 rib, the palm area is plain knit.

l) Dark navy socks: Knitted tube style, the leg and arch of the foot are knitted in 2:1 rib. The toe, heel, and sole are plain knit on the right side. The toe and heel are made of 100% polyamide fiber to enhance wear resistance. The sock top is knitted in 1:1 rib with an elastic band.

3. Subjects and Cases of Use

a) Officers and professional soldiers of the Vietnam Coast Guard use ceremonial uniforms and honor guards according to the seasons. For the summer ceremonial jacket, there is no lining in the body and sleeves, and no vest.

b) Non-commissioned officers and soldiers of the Vietnam Coast Guard use ceremonial uniforms and honor guards according to the seasons. For the ceremonial jacket, there are no two lower pockets. The summer ceremonial jacket has no lining in the body and sleeves, and no vest.

Article 26. Provisions on the management and use of insignia, rank badges, emblem patches, and uniforms of the Vietnam Coast Guard

1. Insignia, rank badges, emblem patches, and uniforms of the Vietnam Coast Guard are used for officers and soldiers under the Vietnam Coast Guard's establishment.

2. Insignia, rank badges, emblem patches, and uniforms of the Vietnam Coast Guard are issued and used uniformly and strictly in accordance with the provisions of the law. The use and recovery of insignia, rank badges, emblem patches, and uniforms for each individual serving or retiring from the Vietnam Coast Guard shall be carried out according to the regulations of the Minister of National Defense.

3. It is strictly prohibited for agencies, units, organizations, and individuals to produce, forge, imitate, store, rent, borrow, exchange, sell, give, or use insignia, rank badges, emblem patches, and uniforms of the Vietnam Coast Guard illegally. In cases of violation, depending on the nature and severity, they will be subject to disciplinary action, administrative penalties, or criminal responsibility as stipulated by law.

4. The time and type of uniform used by agencies and units under the Vietnam Coast Guard shall be implemented uniformly in accordance with the regulations of the Commander of the Vietnam Coast Guard.

5. When performing tasks, officers and soldiers of the Vietnam Coast Guard must wear insignia, rank badges, emblem patches, and uniforms in accordance with regulations. In cases of conducting reconnaissance missions, undercover operations, special case investigations, and criminal cases, they may wear civilian clothes as prescribed by the Commander of the Vietnam Coast Guard.

6. When performing ceremonial duties such as honor guard, band, bugler, state reception, and diplomatic activities, officers and soldiers of the Vietnam Coast Guard shall wear uniforms as prescribed by the Minister of National Defense.

Chapter IV

FLAGS, COLORS, AND IDENTIFICATION MARKS OF THE VIETNAM COAST GUARD'S SHIPS, BOATS, AND AIRCRAFT

Article 27. Flags

1. The flag of the Vietnam Coast Guard is an equilateral triangle with a blue sea background, measuring 1.5 meters in height and 1.0 meter at the base, featuring the national emblem in the center and a yellow arrow running horizontally behind it; it is hoisted on a pole 2.5 meters high at the stern of the ship, except for rescue ships which hoist it on the upper deck aft.

2. Ships, boats, and other vessels of the Vietnam Coast Guard must fly the flag of the Vietnam Coast Guard when performing tasks. Civilian ships mobilized or participating, coordinating, cooperating, or supporting the Vietnam Coast Guard in patrol, inspection, and control tasks must display the flag of the Vietnam Coast Guard as prescribed in Clause 1 of this Article.

Article 28. Colors of Ships and Boats of the Vietnam Coast Guard

1. Rescue Ships

The hull is painted orange, the deck surface is painted green, the front marking line is the ship's serial number in white, and the rear marking line is the phrase "VIETNAM COAST GUARD" in uppercase letters, white color.

The cabin is painted white, the upper edge of the cabin is painted orange, and on both sides of the cabin are the words "VIETNAM COAST GUARD" in uppercase letters, blue color.

On the smokestack, there is a red flag with a yellow star painted.

2. Patrol Ships and Other Types of Ships

The hull is painted white, the deck surface is painted green, the front marking line is the ship's serial number in blue, and the rear marking line is the phrase "VIETNAM COAST GUARD" in uppercase letters, blue color.

The cabin is painted white, and on both sides of the cabin are the words "VIETNAM COAST GUARD" in uppercase letters, blue color.

On the smokestack, there is a red flag with a yellow star painted.

The gun platform is painted gray.

3. Patrol Boats

The hull is painted white, the front marking line is the boat's serial number in blue, and the rear marking line has the top row reading "VIETNAM COAST GUARD" and the bottom row reading "VIETNAM COAST GUARD" in uppercase letters, blue color.

The cabin is painted white.

4. The Commander of the Vietnam Coast Guard specifies the exact dimensions of the number 1 marking line, the Vietnam Coast Guard emblem patch, the phrase "VIETNAM COAST GUARD," the red flag with a yellow star on the smokestack, suitable for each type of patrol ship and boat of the Vietnam Coast Guard.

Article 29. Color Scheme of the Vietnam Coast Guard Aircraft

1. Aircraft Body

The underside of the aircraft body is painted blue (from below the protruding window sill of the aircraft down to the belly of the aircraft up to the edge of the cockpit window glass).

The upper part of the aircraft body is painted white (from below the protruding window sill of the aircraft up to the back of the aircraft up to the edge of the cockpit window glass and the wings of the aircraft).

2. Aircraft Nose

The aircraft nose has two yellow-orange and white marking stripes painted on the blue-painted underside of the aircraft body. Stripe number 1 is painted yellow-orange from the bottom edge of the cockpit down to the lower edge of the aircraft body, inclined at 15° to 20°, with a width of 0.5 m - 1.0 m (depending on the size of the aircraft). In the middle, the Vietnam Coast Guard emblem is painted. Next is stripe number 2, painted white, parallel and equal to one-fourth the width of stripe number 1.

Above the two marking stripes, the aircraft number is written in white.

Below the two marking stripes, the letters "VIETNAM COAST GUARD" are written in uppercase white letters on the blue-painted aircraft body:

The front of the aircraft nose is painted blue.

3. Aircraft Wings

Main wings and horizontal stabilizers: The top and bottom parts of the wings are painted white.

Vertical stabilizer: On both sides of the top of the vertical stabilizer, the national flag of Vietnam is painted, and on the bottom, the Vietnam Coast Guard emblem is painted, with the remaining parts on both sides of the vertical stabilizer painted white.

4. Aircraft Engine

The outer casing of the two engines is painted white.

5. Colors, Flags, and Identification Marks on Other Parts of Each Type of Vietnam Coast Guard Aircraft Shall Be Implemented According to the Regulations of the Minister of National Defense.

Article 30. Markings

The markings of Vietnam Coast Guard vessels and patrol boats are as follows:

Three adjacent stripes on both sides of the hull of the vessels and patrol boats. Stripe number 1 is orange placed at the end of the bow of the vessel or patrol boat, aligned with the beginning of the hull, inclined at 30° - 40°, with the center of stripe number 1 affixed with the Vietnam Coast Guard emblem. Next is stripe number 2, white, and stripe number 3, blue. The width of stripe number 1 varies according to the size of each type of vessel or patrol boat; the width of stripe number 2 and number 3 is one-fourth the width of stripe number 1. The length of the stripes equals the height of the hull sides of the vessels and patrol boats.

Chapter V

COORDINATION

Article 31. Responsibilities of the Minister of National Defense

1. Coordinate with the Ministers, Heads of Ministries Equivalent to Ministries, and Chairpersons of Provincial People's Committees in coordinating activities between the Vietnam Coast Guard and agencies, units, and functional forces under ministries, ministries equivalent to ministries, and provincial people's committees as stipulated in Articles 22, 23, and 24 of the Vietnam Coast Guard Law.

2. Direct and command directly the activities of the Vietnam Coast Guard according to the provisions of the Vietnam Coast Guard Law and other relevant legal regulations; direct agencies, units, and functional forces under his authority to coordinate activities with the Vietnam Coast Guard.

3. Direct the Vietnam Coast Guard and agencies, units, and functional forces under his authority to cooperate with agencies, units, and functional forces under ministries, ministries equivalent to ministries, and provincial people's committees to create conditions for the Vietnam Coast Guard to perform its assigned functions, tasks, and powers.

Article 32. Responsibilities of the Minister of Public Security

The Minister of Public Security shall be responsible for directing and guiding agencies, units, and functional forces under his authority to coordinate with the Vietnam Coast Guard in the following activities:

1. Providing the Vietnam Coast Guard with relevant and necessary information on national security protection and social order and safety assurance; necessary information for announcing or changing the maritime security level for port facilities and other information related to the functions and tasks of the Vietnam Coast Guard.

2. Struggling against crime prevention and suppression; combating piracy and armed robbery against ships; transferring case files, suspects, means, and objects involved in cases within the jurisdiction of the Vietnam Coast Guard; receiving case files, suspects, means, and objects involved in cases within the jurisdiction of functional forces under the Ministry of Public Security.

3. Leading investigations and apprehending individuals violating laws at sea and those hiding inland and related to violations of laws at sea according to the provisions of the law.

4. Enhancing the professional expertise of officers and soldiers of the Vietnam Coast Guard in protecting national security and ensuring national security and social order and safety.

5. International cooperation activities in crime prevention and suppression, law violation prevention and suppression, and national security protection.

6. Propaganda, dissemination, and education on laws concerning national security, social order, and safety.

7. Implementing other coordinated contents as prescribed by the Law on the Vietnam Coast Guard, relevant legal regulations, and coordination rules and plans between both parties.

Article 33. Responsibilities of the Minister of Foreign Affairs

The Minister of Foreign Affairs shall be responsible for directing and guiding agencies and units under his authority to coordinate with the Vietnam Coast Guard in the following activities:

1. Exchanging necessary information and documents on the Party's policies and State's policies in diplomatic activities related to the operations of the Vietnam Coast Guard; information on the rights and obligations of Vietnam related to the operations of the Vietnam Coast Guard under international treaties to which the Socialist Republic of Vietnam is a party.

2. Guiding and supporting the Vietnam Coast Guard in handling cases involving foreign organizations and individuals violating Vietnamese laws and international treaties to which the Socialist Republic of Vietnam is a party in Vietnamese waters.

3. Guiding, supporting, and coordinating with the Vietnam Coast Guard in implementing international cooperation contents.

4. Implementing other coordinated contents as prescribed by the Law on the Vietnam Coast Guard, relevant legal regulations, and coordination rules and plans between both parties.

Article 34. Responsibilities of the Minister of Transport

The Minister of Transport shall be responsible for directing and guiding agencies, units, and functional forces under his authority to coordinate with the Vietnam Coast Guard in the following activities:

1. Timely providing information on maritime security and safety; changes to the maritime navigation aid system, permissible depths for various types of vessels entering and exiting channels and ports, construction or demolition of structures on the sea, and other obstructions in Vietnamese waters to ensure maritime safety.

Announcing the issuance, suspension, extension, amendment, revocation, or cancellation of documents and materials; technical standards and specifications related to the operation of vessels at sea.

Announcing the name, symbol, identification, route, time, scope, area of operation, and permission for foreign vessels before operating at Vietnamese ports and maritime areas.

2. Coordinating drills for maritime security incidents in Vietnamese waters; participating in search and rescue operations at sea; struggling against piracy and armed robbery against ships.

4. Guiding and supporting the Vietnam Coast Guard in specialized professional work to determine acts of violation and the extent of damage caused by violations of maritime laws; supporting, guiding, and creating conditions for anchoring vessels seized and processed by the Vietnam Coast Guard in port waters, and for loading and unloading goods from such vessels.

5. International cooperation activities in maritime affairs.

6. Propaganda, dissemination, and education on laws for organizations and individuals operating in Vietnamese waters.

7. Implementing other coordinated contents as prescribed by the Law on the Vietnam Coast Guard, relevant legal regulations, and coordination rules and plans between both parties.

Article 35. Responsibilities of the Minister of Finance

The Minister of Finance shall be responsible for directing and guiding agencies, units, and functional forces under his/her authority to coordinate with the Vietnam Coast Guard in the following activities:

2. Struggling against criminal offenses and violations of laws; transferring case files, suspects, means of transportation, and evidence in cases within the jurisdiction of the Vietnam Coast Guard; receiving case files, suspects, means of transportation, and evidence in cases within the jurisdiction of functional forces under the Ministry of Finance.

3. Providing guidance and support to the Vietnam Coast Guard on specialized professional work to identify violations of tax and customs laws; preparing budgets and ensuring financial resources for the implementation of tasks of the Vietnam Coast Guard.

4. International cooperation activities in the fields of taxation and customs.

5. Propagating, disseminating, and educating about laws related to taxation and customs for organizations and individuals operating in Vietnam's maritime zones.

6. Implementing other coordinated contents as stipulated by the Law on the Vietnam Coast Guard, relevant legal provisions, and the coordination regulations and plans between both parties.

The Minister of Planning and Investment shall be responsible for directing and guiding agencies and units under his/her authority to coordinate with the Vietnam Coast Guard in the following activities:

1. Compiling medium-term and annual investment plans of the Vietnam Coast Guard according to the provisions of the Law on Public Investment.

2. Monitoring and inspecting investment activities, proposing solutions to issues arising during the formation and implementation of investment projects; inspecting and evaluating the results of investment activities.

3. Implementing other coordinated contents as stipulated by the Law on the Vietnam Coast Guard, relevant legal provisions, and the coordination regulations and plans between both parties.

The Minister of Agriculture and Rural Development shall be responsible for directing and guiding agencies, units, and functional forces under his/her authority to coordinate with the Vietnam Coast Guard in the following activities:

1. Providing necessary information and documents on marine fisheries activities and related matters; various types of permit samples, documents, and professional certificates related to marine fisheries activities.

Notifying the name, code, registration book, distinctive features, route, and operational area range of foreign vessels before these vessels enter Vietnam's maritime zones.

Reporting situations involving fishing vessels and their operators engaging in illegal activities in the exploitation and protection of marine fishery resources in Vietnam's maritime zones; situations where Vietnamese fishing vessels and fishermen are detained by foreign countries; situations where Vietnamese fishing vessels illegally fish in foreign maritime zones.

2. Conducting patrols, inspections, and controls to protect national sovereignty, sovereign rights, and jurisdictional powers over Vietnam's maritime zones; search and rescue operations at sea; combating piracy and armed robbery against ships.

3. Protecting the security and safety of research and conservation activities of marine fishery resources.

4. Transferring case files, suspects, means of transportation, and evidence in cases within the jurisdiction of the Vietnam Coast Guard; receiving case files, suspects, means of transportation, and evidence in cases within the jurisdiction of functional forces under the Ministry of Agriculture and Rural Development.

5. Providing guidance and support to the Vietnam Coast Guard on specialized professional work in the exploitation and protection of marine fishery resources to identify violations in the field of marine fisheries.

6. Enhancing the professional skills of Vietnam Coast Guard officers and soldiers in marine fisheries.

7. International cooperation activities in the fields of exploitation and protection of marine fishery resources.

8. Propagating, disseminating, and educating about laws related to marine fisheries for organizations and individuals operating in Vietnam's maritime zones.

9. Implementing other coordinated contents as stipulated by the Law on the Vietnam Coast Guard, relevant legal provisions, and the coordination regulations and plans between both parties.

The Minister of Natural Resources and Environment shall be responsible for directing and guiding agencies and units under their authority to coordinate with the Vietnam Coast Guard in the following activities:

1. Reporting on environmental incidents at sea; violations of laws on natural resources, environment, islands; information related to protecting marine and island resources and environment; providing meteorological and hydrological data on the sea.

Announcing new issuance, changes to Vietnamese regulations, standards, and other necessary contents related to protecting marine and island resources and environment.

2. Ensuring safety and security for basic investigation, scientific research, exploitation, utilization of marine resources, and environmental protection activities at sea.

3. Implementing preventive measures, detecting, handling, and remedying pollution and degradation of the marine environment, ecosystems, and islands; monitoring, remedying, and resolving consequences of oil spills and toxic chemical accidents at sea; controlling cross-border environmental pollution.

4. Handing over case files, objects, means, and evidence in violation cases within the jurisdiction of the Vietnam Coast Guard; receiving case files, objects, means, and evidence in violation cases within the jurisdiction of agencies under the Ministry of Natural Resources and Environment.

5. Providing professional support and guidance in marine and island resources and environment matters to identify violations in exploitation, utilization, and protection of marine and island resources and environment, remedying marine and island environmental incidents; supporting, guiding, and facilitating the Vietnam Coast Guard in disposing dredged materials from coast guard ports.

6. Training and enhancing professional skills in marine and island resources and environment matters for coast guard officers.

7. International cooperation in the field of marine and island resources and environment.

8. Promoting, disseminating, and educating laws on marine resources and environment to organizations and individuals operating in Vietnamese maritime zones.

9. Implementing other coordinated contents as stipulated by the Law on the Vietnam Coast Guard, relevant legal provisions, and the coordination regulations and plans between both parties.

The Minister of Information and Communications shall be responsible for directing and guiding agencies and units under their authority to coordinate with the Vietnam Coast Guard in the following activities:

1. Exchanging necessary information and materials on the use of radio frequencies; submarine cables and shore stations of submarine cables in Vietnamese maritime zones.

2. Ensuring safety and security of information; safety of submarine cable systems, shore stations of submarine cables, and telecommunications facilities at sea; safety of radio frequency bands between networks serving economic, social, defense, and security purposes.

4. Training, enhancing, and improving professional skills in using radio frequency transmitters and information technology for coast guard officers.

6. Implementing other coordinated contents as stipulated by the Law on the Vietnam Coast Guard, relevant legal provisions, and the coordination regulations and plans between both parties.

The Minister of Industry and Trade shall be responsible for directing and guiding agencies, units, and functional forces under his/her authority to coordinate with the Vietnam Coast Guard in the following activities:

1. Exchanging information and documents related to import and export activities, border trade, oil and gas operations, and market management that pertain to the duties and powers of the Vietnam Coast Guard.

2. Safeguarding the security and safety of survey, research, exploration, and exploitation of oil and gas; oil pipelines, offshore oil facilities.

3. Struggling against crime and law violations; transferring case files, suspects, means, and evidence in cases within the jurisdiction of the Vietnam Coast Guard; receiving case files, suspects, means, and evidence in cases within the jurisdiction of functional forces under the Ministry of Industry and Trade.

4. Propagating, disseminating, and educating the law to organizations and individuals operating in Vietnam's maritime zones.

5. Implementing other cooperative contents as prescribed by the Law on the Vietnam Coast Guard, relevant laws, and the cooperation regulations and plans between both parties.

Directing specialized agencies and People's Committees at the district level to closely coordinate with agencies and units of the Vietnam Coast Guard in the following activities:

1. Search and rescue, disaster relief, and environmental remediation.

2. Transferring, receiving, and utilizing civilian personnel, vessels, and means mobilized to participate in protecting sovereignty and sovereign rights over Vietnam's maritime zones.

3. Managing areas related to the activities of the Vietnam Coast Guard; supporting and creating favorable conditions regarding land, housing, and construction sites for military quarters, anchorage, repair of vessels and aircraft, warehouses, docks, and other necessary conditions for the Vietnam Coast Guard to perform their tasks.

4. Handling violations of law related to local citizens; propagating, disseminating, and educating the law to organizations and individuals in the locality; organizations and individuals operating in Vietnam's maritime zones.

Article 42. Responsibilities for organizing the implementation of cooperative activities of ministries and ministerial-level agencies

The Ministry of National Defense shall take the lead and coordinate with relevant ministries and ministerial-level agencies to issue cooperation regulations between the Vietnam Coast Guard and agencies, units, and functional forces under ministries and ministerial-level agencies as prescribed by the Law on the Vietnam Coast Guard and this Decree.

Chapter VI

IMPLEMENTING PROVISIONS

Article 43. Effective Date

1. This Decree takes effect from August 28, 2019.

2. Decree No. 86/2009/NĐ-CP dated October 19, 2009, of the Government detailing certain provisions of the Ordinance on the Vietnam Coast Guard Force; Decree No. 96/2013/NĐ-CP dated August 27, 2013, of the Government amending and supplementing certain articles of Decree No. 86/2009/NĐ-CP dated October 19, 2009, of the Government detailing certain provisions of the Ordinance on the Vietnam Coast Guard Force; Decree No. 13/2015/NĐ-CP dated February 12, 2015, of the Government amending and supplementing Article 9 of Decree No. 86/2009/NĐ-CP dated October 19, 2009, of the Government detailing certain provisions of the Ordinance on the Vietnam Coast Guard Force; Decree No. 66/2010/NĐ-CP dated June 14, 2010, of the Government promulgating the Regulations on the Implementation of State Management over the Activities of the Vietnam Coast Guard Force and the Cooperation Activities among Forces in Vietnam's Maritime Zones and Continental Shelf cease to be effective from the date this Decree takes effect.

Article 44. Transitional Provisions

Decision No. 25/2012/QĐ-TTg dated June 4, 2012, of the Prime Minister stipulating certain preferential policies for officers, professional soldiers, non-commissioned officers, soldiers, civil servants, and workers in the Vietnam Coast Guard continue to be effective until they are abolished or replaced by another legal document as prescribed by law.

Article 45. Responsibility for Implementation

1. The Minister of National Defense shall urge, inspect, and guide the implementation of this Decree.

2. Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairpersons of provincial and centrally-administered city People's Committees are responsible for implementing this Decree./.
