Amending and supplementing certain provisions of the Regulation on Response Activities to Oil Spill Incidents issued together with Decision No. 02/2013/QĐ-TTg
dated January 14, 2013 of the Prime Minister
On the basis of the Environmental Protection Law dated November 29, 2005;

Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to the Maritime Code of Vietnam dated June 14, 2005;
The Prime Minister issues this Decision amending and supplementing certain provisions of the Regulation on Response Activities to Oil Spill Incidents issued together with Decision No. 02/2013/QĐ-TTg dated January 14, 2013 of the Prime Minister.
Pursuant to the Law on Inland Waterway Traffic dated June 15, 2004;
Pursuant to the Law on the Sea of Vietnam dated June 21, 2012;
At the proposal of the Minister of National Defense,
Article 1. Amend and supplement Clause 7, Clause 8 of Article 7 of the Regulation on Response Activities to Oil Spill Incidents issued together with Decision No. 02/2013/QĐ-TTg dated January 14, 2013 of the Prime Minister:
1. Clause 7 of Article 7 shall be amended and supplemented as follows:
"Vietnamese oil tankers with a total tonnage of 150RT or more, and other vessels with a total tonnage of 400RT or more must have an 'Oil Pollution Emergency Plan for Vessels'; vessels carrying hazardous liquid cargoes with a total tonnage of 150RT or more must have a 'Pollution Emergency Plan for Vessels due to Carriage of Hazardous Liquid Cargoes.' These plans must be approved by the competent authority of the Ministry of Transport in accordance with regulations."
2. Clause 8 of Article 7 shall be amended and supplemented as follows:
"Vietnamese oil tankers with a total tonnage of 150RT or more participating in ship-to-ship oil transfer operations at sea must have a 'Ship-to-Ship Oil Transfer Plan at Sea' which must be approved by the competent authority of the Ministry of Transport in accordance with regulations."
This Decision takes effect from January 1, 2015.
Article 2. Effective Date
Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairpersons of provincial People's Committees directly under the central government, and related agencies, organizations, and individuals are responsible for implementing this Decision./.
Article 3. Responsibility for Implementation
The Ministers of the ministries, the Heads of agencies at the ministerial level, the Heads of government agencies, the Chairpersons of the People's Committees of provinces and centrally governed cities, and related organizations and individuals are responsible for implementing this Decision./.
