The Government issues this Decree on management and development of industrial clusters.

Pursuant to Decree No. 47/2014/NĐ-CP dated May 15, 2014 of the Government stipulating compensation, support, and resettlement when the State reclaims land;on compensation,ỗ support,June 2024;resettlement when the State reclaims land;ồland;

At the proposal of the Minister of Labor, Invalids and Social Affairs,

The Prime Minister issues this Decision regarding policies to support vocational training and employment resolution for workers whose agricultural land has been reclaimed.ồThis Decision stipulates policies to support vocational training and employment resolution for workers whose land has been reclaimed according to Articles 20 and 21 of Decree No. 47/2014/NĐ-CP dated May 15, 2014 of the Government stipulating compensation, support, and resettlement when the State reclaims land (hereinafter referred to as Decree No. 47/2014/NĐ-CP).

Article 1. Scope of Regulation

Workers whose land has been reclaimed include:

Article 2. Applicability

1. Workers belonging to households or individuals directly engaged in agricultural production as specified in Points a, b, c, and d of Clause 1, Article 19 of Decree No. 47/2014/NĐ-CP (excluding cases where households or individuals are former employees of state-owned farms or forestry farms who have retired, left work due to health reasons, or received retirement benefits) when the State reclaims agricultural land and compensates them in cash for the area of reclaimed agricultural land (hereinafter referred to as workers whose agricultural land has been reclaimed);

2. Workers belonging to households or individuals when the State reclaims land for combined business and service purposes and they must relocate their residence (hereinafter referred to as workers whose business land has been reclaimed).

Workers whose land has been reclaimed shall be supported in vocational training and employment resolution if they meet the following conditions:

Article 3. Conditions for Support

1. They have a need for vocational training and employment resolution;

2. They are within the working age.

Workers whose land has been reclaimed shall enjoy support policies for a period of five years from the date of the Land Reclamation Decision.

Article 4. Duration of Support

1. Workers whose land has been reclaimed participating in vocational training shall be supported as follows:

Article 5. Vocational Training Support

a) Vocational training at the primary level, training under three months: Supported according to the provisions of Decision No. 46/2015/QĐ-TTg dated September 28, 2015 of the Government;

b) Vocational training at the intermediate and college levels: Supported with tuition fees for one course. The amount of tuition fee supported equals the actual tuition fee of the vocational education institution but not exceeding the maximum tuition fee cap for public institutions as prescribed by law. The funding for support is allocated from the training, job transition, and job search budget in the training, job transition, and job search plan and included in the total project investment or compensation, support, and resettlement plan approved; THEDeputy ministers of ministerial-level agencies, organize credit institutions, foreign bank branches are responsible for organizing the implementation of this Circular.ước) Access to loans according to credit policies for students and trainees. roadDeputy ministers of ministerial-level agencies, von 2. Free career counseling, job orientation, and job introduction at Employment Service Centers; OF "7. Preferential loans from the National Employment Fund according to the law.

1. Workers whose agricultural land has been reclaimed going to work abroad under contracts shall be supported according to the provisions of Decree No. 61/2015/NĐ-CP dated July 9, 2015 of the Government on employment creation policies and the National Employment Fund.

2. Workers whose business land has been reclaimed going to work abroad under contracts shall be supported like workers whose agricultural land has been reclaimed as stipulated in Clause 1 of this Article.

3. Funding for going to work abroad under contracts as stipulated in Clauses 1 and 2 of this Article shall be allocated from the training, job transition, and job search budget in the training, job transition, and job search plan and included in the total project investment or compensation, support, and resettlement plan approved.

Article 6. Domestic Job Placement Support

4. Workers whose land has been reclaimed may obtain preferential loans to go to work abroad under contracts from the Social Policy Bank.

The maximum loan amount equals the total necessary costs that the worker must contribute according to regulations for working abroad in each labor market.

The interest rate equals the interest rate for poor households' loans during each period as prescribed by the Government.

Article 7. Overseas Employment Under Contract Support

The maximum loan term equals the duration of working abroad under the contract.

5. Workers whose land has been reclaimed in poor districts shall be supported to go to work abroad under contracts according to the support policy for poor districts.

6. Workers whose land has been reclaimed shall be supported to go to work abroad once according to the policy stipulated herein.

1. The Ministry of Labor, Invalids, and Social Affairs shall take the lead and coordinate with relevant agencies:

a) To inspect and supervise the implementation of this Decision;

b) To compile and report

Article 8. Implementation organization

whose land has been reclaimed;

2. The Ministry of Planning and Investment shall take the lead and coordinate with relevant agencies to aggregate and propose additional funds for the Social Policy Bank to provide loans for job creation as stipulated in Clause 2, Article 6 and for loans to work abroad under contracts as stipulated in Clause 4, Article 7 of this Decision.

3. The Social Policy Bank shall organize lending to workers whose land has been reclaimed according to this Decision. This Decision takes effect from February 1, 2016.1. Fulfilling requirements stipulated in Article 13 of Decree No. 135/2021/NĐ-CP.2. Decision No. 52/2012/QĐ-TTg dated November 16, 2012 of the Government on vocational training and job placement for workers whose agricultural land has been reclaimed shall cease to be enforced from the date this Decision takes effect. Workers whose business land has been reclaimed with a decision to reclaim land after July 1, 2014 shall enjoy support policies for vocational training and job placement as stipulated in this Decision.ồi k) Clause 4, Article 8 of Circular No. 09/2021/TT-BKHĐT dated November 16, 2021 of the Minister of Planning and Investment guiding the selection of investors for implementing investment projects under the Public-Private Partnership method and investment projects using land.3. Experts, leading scientists, chief engineers participating in national defense and security industrial activities at key national defense industrial facilities and key security industrial facilities.

2. The Ministry of Planning and Investment shall take the lead and coordinate with relevant agencies to aggregate and propose additional capital sources for the Social Policy Bank to provide loans for job creation in accordance with Clause 2, Article 6 of this Decision and to provide loans for working abroad under contracts in accordance with Clause 4, Article 7 of this Decision.

3. The Social Policy Bank shall organize lending activities for workers whose land has been reclaimed in accordance with this Decision.

4. Provincial People's Committees directly under the Central Government shall be responsible for:

a) Directing the establishment and implementation of training, occupational transition, and employment support plans for workers whose land has been reclaimed;

b) Reporting on vocational training and employment resolution situations for workers whose land has been reclaimed to the Ministry of Labor, Invalids, and Social Affairs for consolidation and reporting. Article 9. Effective Date and Responsibility for Implementation

1. This Decision shall take effect from February 1, 2016.

3. Workers whose business land was decided to be reclaimed after July 1, 2014 shall enjoy vocational training and employment resolution support policies in accordance with this Decision.

4. The Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairpersons of provincial People's Committees under the central government, and related agencies, organizations, and individuals shall be responsible for implementing this Decision./.
