Provisions on individual responsibilities and handling of violations

in inspection work of the transportation sectori

Based on the Civil Servants Law dated June 13,June 2024;Pursuant to the Enterprise Law dated December 26,

BASED ON THE Law on Public Officials dated November 15, 2010;June 2024;Decree No. 55/2012/NĐ-CP dated June 28, 2012 of the Government on the establishment, restructuring, and dissolution of public service units;

Based on the Labor Code dated 1August 8, 2012;

At the proposal of the Office of the Ministry of Public Security;June 2024;hereby issues this Circular on individual responsibilities and handling of violations in inspection work of the Transportation Sector.

This Circular stipulates on individual responsibilities and handling of violations in inspection work and administrative penalty enforcement in the Transportation Sector (hereinafter referred to as inspection work). reason This Circular applies to central and local state management agencies for transportation, State Inspection Agencies, agencies entrusted with specialized inspection functions in the Transportation Sector, inspection collaborators, and related organizations and individuals.

Chapter I

GENERAL PROVISIONS

Article 1. Scope of Regulation

In this Circular, the following terms shall be understood as follows:

Article 2. Applicability

1. Agencies performing specialized inspection functions in the Transportation Sector include: State Inspection Agencies and agencies entrusted with specialized inspection functions.

Article 3. Explanation of Terms

2. State Inspection Agencies include: The Inspectorate of the Ministry of Transport (hereinafter referred to as the Inspectorate of the Ministry) and the Inspectorate of the Department of Transport (hereinafter referred to as the Inspectorate of the Department).

3. Agencies entrusted with specialized inspection functions in the Transportation Sector include: Vietnam Highway Administration, Vietnam Railway Administration, Vietnam Inland Waterway Administration, Vietnam Civil Aviation Administration, Vietnam Maritime Administration, Road Management Division under Vietnam Highway Administration, Civil Aviation Port Supervision, Maritime Port Supervision, Inland Waterway Port Supervision, and Inland Waterway Supervision Division under Vietnam Inland Waterway Administration.

4. Individuals belonging to agencies performing specialized inspection functions in the Transportation Sector include:

a) Chief Inspector, Deputy Chief Inspectors of the Inspectorate of the Ministry, Heads, and Deputy Heads of Departments under the Inspectorate of the Ministry;

b) Chief Inspectors, Deputy Chief Inspectors of Vietnam Civil Aviation Administration, Vietnam Maritime Administration;

c) Heads, Deputy Heads of agencies entrusted with specialized inspection functions as stipulated in Clause 3 of this Article;

d) Chiefs, Deputies of Legal Affairs - Inspection Departments; Legal Affairs - Inspection Sections; Inspection - Safety Sections; Inspection - Safety Teams;

đ) Chief Inspectors, Deputy Chief Inspectors of the Inspectorate of the Department; Team Leaders, Deputy Team Leaders under the Inspectorate of the Department;

e) Heads of inspection teams;

g) Members of inspection teams;

h) Inspectors of various ranks, specialized civil servants (hereinafter referred to as specialized civil servants);

i) Staff assigned to participate in inspection, supervision, and administrative violation record-keeping activities (hereinafter referred to as staff);

l) Contract-based employees working to serve in inspection agencies of the Transportation Sector (hereinafter referred to as employees).

Article 4. Basis for determining responsibility

1. Duties, tasks, powers, benefits of individuals and matters prohibited for individuals according to laws.

2. Position, authority, relationships, and content of job assignments in leadership, management, and operation guidance of agencies and units.

3. Content, scope of responsibility under this Circular and relevant laws.

2. Position, authority, relationship, and content of work assignment in the guidance, management, and operation of the agency or unit.

3. Content and scope of responsibility under this Circular and relevant laws.

Article 5. Principles for considering responsibility

1. Considering responsibility for individuals must be consistent with the content of management levels, authority, duties, and tasks assigned, and carried out according to the procedures and formalities prescribed by law. A deputy bears equivalent responsibility to a head when the head delegates or authorizes the deputy to exercise the head's authority.

2. Responsibility shall only be considered for individuals when there are sufficient grounds to determine the liability regime for persons who violate laws or breach discipline in inspection work.

3. Handling individuals violating the liability regime while performing their duties in inspection work must be conducted openly, transparently, objectively, in accordance with the law, formalities, nature, and degree of the violation; no wrongful prosecution; no omission of violations.

Chapter II

RESPONSIBILITY OF INDIVIDUALS FOR INSPECTION WORK

Section 1

RESPONSIBILITY OF HEADS OF INSPECTION AUTHORITIES

TRANSPORTATION INDUSTRY

Article 6. Responsibilities of the Inspector General of the Ministry of Transport, Inspector General of the Department of Transport

1. Leading, directing, and inspecting inspection work within the scope of state management under their jurisdiction, including:

a) Issuing internal regulations within their authority to manage and direct the operations of the inspection agency;

b) Assigning tasks to Deputy Inspectors, Heads of Inspection Departments, Team Leaders;

c) Organizing meetings to discuss matters related to inspection work that, according to the law, the Inspector General must discuss before making decisions;

d) Directing and assigning the implementation of inspection work according to the directives of the Head of the State Management Agency for Transport;

đ) Regularly or urgently organizing inspections of inspection work within the scope of state management of the State Management Agency for Transport; inspecting agencies performing inspection functions in the Transport sector when there are signs of law violations.

2. Leading the inspection agency:

a) Guiding the preparation of annual inspection plans;

b) Building annual inspection and supervision plans to submit to the Head of the State Management Agency for Transport for issuance within the prescribed time;

c) Advising on adjustments to annual inspection and supervision plans according to regulations;

d) Directing and implementing annual, quarterly, and monthly inspection plans as prescribed;

đ) Promptly providing guidance on reports, recommendations, and proposals from subordinate levels;

e) Not interfering illegally in the inspection work of subordinates;

g) Deciding or delegating the power to issue administrative penalty decisions within the prescribed time, procedures, and formalities;

h) Organizing mid-term and final reviews of inspection work according to the directives of the Head of the State Management Agency for Transport.

3. Promptly addressing overlaps in the scope, subjects, content, and timing of inspections within the scope of state management of the Ministry of Transport.

4. Issuing inspection decisions according to plans, urgent inspections, and re-inspections promptly according to the directives of the Head of the State Management Agency for Transport and the provisions of the law.

5. Directing inspection teams to implement inspection plans approved.

6. Supervising inspection teams according to the supervision regulations upon receiving inspection decisions.

7. Issuing documents requesting the Head of the agency tasked with specialized inspection functions to conduct inspections when signs of law violations are detected to prevent damage to the legitimate rights and interests of agencies, organizations, and citizens.

8. Recommending the Head of the State Management Agency for Transport to temporarily suspend the execution of incorrect inspection decisions made by agencies or units; examining responsibility and handling persons under the management of the Head of the State Management Agency for Transport in a timely manner and in accordance with the law to prevent damage to the legitimate rights and interests of agencies, organizations, and citizens.

9. Reporting on inspection work to superiors within the prescribed deadlines; directing the use and management of seals and forms in accordance with the guidance of the competent authority.

10. Directing the operation and exploitation of the reporting software and directing the inspection activities of the Transport sector (tInspect); scientific and complete storage work in accordance with the law, guidance of the Minister of Transport, and the Inspector General of the Ministry.

11. Fulfilling other responsibilities as prescribed by law.

Article 7. Responsibilities of the Director of the Vietnam Civil Aviation Administration Inspectorate, the Director of the Vietnam Maritime Administration Inspectorate

1. Organizing, managing, and directing the activities of the Vietnam Civil Aviation Administration Inspectorate, the Vietnam Maritime Administration Inspectorate (hereinafter referred to collectively as the Inspectorate).

a) Directing the development of the annual inspection plan for the Vietnam Civil Aviation Administration, the Vietnam Maritime Administration (hereinafter referred to collectively as the Administration) to be submitted to the Director of the Vietnam Civil Aviation Administration, the Director of the Vietnam Maritime Administration (hereinafter referred to collectively as the Director).

b) Assigning clear tasks to Deputy Directors of the Inspectorate and civil servants to oversee and implement the Inspectorate's tasks.

c) Directing and assigning tasks to implement the inspection plan, directing specialized inspection work according to higher-level directives, and other specialized inspection tasks.

d) Organizing meetings to discuss contents related to inspection work before making decisions in accordance with the law.

đ) Reporting on inspection work to the Director, the Director of the Ministry of Transport Inspectorate (hereinafter referred to as the Director of the Ministry) in accordance with reporting regulations.

e) Organizing regular inspections of the implementation of specialized inspection tasks in accordance with regulations.

2. Leading specialized inspection work

a) Guiding and compiling inspection plans of Airports and Ports.

b) Directing the implementation of inspection plans.

c) Promptly providing guidance on reports, recommendations, and proposals from subordinate levels.

d) Not interfering illegally in the inspection activities of subordinate levels.

đ) Deciding on administrative penalties in the field of civil aviation, maritime affairs, or transferring cases exceeding jurisdiction or not within jurisdiction to competent authorities for handling.

3. Assisting the Director in resolving overlapping issues regarding the scope, subjects, content, and timeframes of inspections conducted by units under the Vietnam Civil Aviation Administration, the Vietnam Maritime Administration.

4. Deciding to establish inspection teams according to approved inspection programs and plans, or assigning inspectors and civil servants under the Inspectorate to carry out specialized civil aviation and maritime inspection tasks within their authority.

5. Submitting to the Director for re-inspection cases concluded by the Airport Port Director but showing signs of legal violations; conducting surprise inspections when discovering agencies, organizations, or individuals suspected of violating civil aviation or maritime laws, or upon request from the Director of the Ministry.

6. Directing inspection teams to strictly follow inspection plans and contents.

7. Supervising the performance of inspection tasks by inspection teams or assigned inspectors and civil servants.

8. Recommending the Director to promptly suspend the execution of incorrect inspection decisions made by Airport Port Directors in accordance with the law.

9. Deciding to suspend (including ordering cessation of illegal acts) or recommending authorized persons to suspend illegal specialized acts by agencies, organizations, or individuals if sufficient evidence indicates that such acts cause damage to state interests, citizens' rights and lawful interests, or hinder the inspection process.

10. Recommending the Director or requiring relevant organizations or individuals to take necessary measures to ensure safety, security, and environmental protection and prevention as prescribed.

11. Performing other duties and powers delegated by the Director or the Director of the Ministry in accordance with the law.

Article 8. Responsibilities of the Head of the Agency Assigned to Perform Specialized Inspection Functions

1. Leading, directing, and inspecting inspection work within the scope of state management of the Agency Assigned to Perform Specialized Inspection Functions, including:

a) Issuing internal regulations according to authority to manage, direct, and implement specialized inspection tasks;

b) Assigning tasks to Deputy Heads of the Agency Assigned to Perform Specialized Inspection Functions and Heads of advisory units;

c) Organizing meetings to discuss matters related to inspection work that, according to law, the Head of the Agency Assigned to Perform Specialized Inspection Functions must discuss before making decisions;

d) Directing and assigning to implement directives and guidance on inspection work from higher-level state management agencies or the Inspector General of the Ministry;

đ) Reporting to higher-level state management agencies or the Inspector General of the Ministry on matters required to be reported according to law or agency regulations;

e) Regularly or urgently organizing inspections of inspection work within the scope of state management of the Agency Assigned to Perform Specialized Inspection Functions; inspecting organizations and individuals involved in specialized inspection work when there are signs of law violations or directives from superiors.

2. The leadership of the Agency Assigned to Perform Specialized Inspection Functions shall perform duties and powers as follows:

a) Directing and implementing the annual inspection plan for subordinate levels;

b) Building the annual inspection plan and submitting it to the competent authority within the prescribed time;

c) Adjusting or requesting superiors to adjust the inspection plan according to regulations;

d) Directing and implementing the annual inspection plan, quarterly and monthly inspection plans according to regulations;

đ) Promptly providing guidance on reports, recommendations, and proposals from subordinate levels;

e) Not interfering illegally in the inspection work of subordinates;

g) Deciding or delegating the power to issue administrative penalty decisions within the prescribed time, procedures, and formalities;

h) Organizing mid-term and final reviews of inspection work according to directives from superior agencies.

3. Handling overlaps in the scope, objects, contents, and timing of inspections within the scope of state management of the Agency Assigned to Perform Specialized Inspection Functions.

4. Issuing inspection decisions according to plans, urgent inspections, and re-inspections promptly according to directives from superiors or the Inspector General of the Ministry and in accordance with legal provisions, avoiding damage to the legitimate rights and interests of agencies, organizations, and citizens.

5. Directing and supervising inspection teams to implement inspection plans approved correctly.

6. Issuing documents requiring the Head of the lower-level Agency Assigned to Perform Specialized Inspection Functions to conduct inspections promptly upon discovering signs of law violations to prevent such actions and avoid damage to the legitimate rights and interests of agencies, organizations, and citizens.

7. Recommending the Head of the higher-level state management agency to temporarily suspend the implementation of incorrect inspection decisions made by agencies or units; considering responsibility and handling persons under the management of the higher-level agency in a timely manner and in accordance with legal provisions to avoid consequences.

8. Reporting on inspection work to superiors within the deadline; directing the use and management of seals and forms in accordance with the guidance of the competent authority.

9. Selecting civil servants to submit to the competent authority for recognition as inspection civil servants meeting the prescribed standards.

10. Directing the operation and exploitation of the tInspect software, scientific and complete record-keeping work in accordance with legal provisions and the guidance of the Minister of Transport and the Inspector General of the Ministry.

11. Fulfilling other responsibilities as prescribed by law.

Article 9. Responsibilities of the Director of the Department of Transport

1. Leading and directing specialized inspection activities within the management scope of the Department of Transport, including:

a) Issuing internal regulations to serve as a basis for managing, directing, and operating the activities of the Department Inspectorate;

b) Directing the Department Inspectorate to perform its inspection functions properly, not performing tasks that belong to other agencies or units or matters outside the functions, duties, and powers of the Department Inspectorate, except in cases of natural disasters, typhoons, floods, or urgent support requirements for a certain period of time;

c) Promptly addressing recommendations and proposals regarding inspection work from the Department Inspectorate;

d) Not interfering illegally with the inspection work of the Department Inspectorate.

2. Approving the annual specialized inspection plan on time, in accordance with the content and guidelines of the Ministry of Transport.

3. Deciding on inspections; deciding on the handling of recommendations from the Head of the Department Inspectorate (hereinafter referred to as the Head of the Department Inspectorate) promptly and in accordance with the law.

4. Issuing business cards to the appropriate subjects in accordance with the provisions of the law.

5. Fulfilling other responsibilities as prescribed by law regarding inspection work.

6. To perform other responsibilities as prescribed by law.

Article 10. Responsibilities of the Head of the Advisory Unit

1. Advising the Head of the Agency entrusted with the function of specialized inspection to fully perform their duties and powers as stipulated in Government Decree No. 57/2013/NĐ-CP dated May 31, 2013, which stipulates the organization and operation of the transport sector's inspection.

2. Adhering to the division of labor assigned by the Head of the Agency entrusted with the function of specialized inspection.

3. Issuing internal documents assigning tasks to inspection officials and staff under their direct management to carry out their duties.

4. Assisting the Head of the Agency entrusted with the function of specialized inspection in guiding, urging, and inspecting the implementation of laws on inspection and administrative violations' penalties by subordinate levels.

5. Not interfering illegally in the inspection, supervision, and administrative violation penalty activities of staff under their management.

6. Reporting inspection work on time, in accordance with the content and guidelines of the competent authority.

7. Organizing the archiving of files and documents comprehensively and in compliance with regulations.

8. Fulfilling other responsibilities as prescribed by law.

Article 11. Responsibilities of the Team Leader under the Inspectorate the

1. Assisting the Head of the Department Inspectorate in performing specialized inspection functions as stipulated in Government Decree No. 57/2013/NĐ-CP dated May 31, 2013, which stipulates the organization and operation of the transport sector's inspection.

2. Adhering to the division of labor assigned by the Head of the Department Inspectorate within their authority as prescribed by law.

3. Issuing internal documents assigning tasks to officials under their direct management to carry out their duties.

4. Assisting the Head of the Department Inspectorate in conducting inspections according to the approved plan.

5. Not interfering illegally in the inspection and administrative violation penalty activities of staff under their management.

6. Reporting inspection results on time, in accordance with the content and guidelines of the competent authority.

7. Organizing the archiving of files and documents comprehensively and in compliance with regulations at the appropriate level.

8. Fulfilling other responsibilities as prescribed by law.

Section 2: RESPONSIBILITIES OF THE HEAD OF THE INSPECTION TEAM, INSPECTORS, INSPECTION OFFICERS, STAFF AND ASSISTANT INSPECTORS

Article 12. Responsibilities of the Head of the Inspection Team

1. Develop the inspection plan according to the inspection decision, report to the competent authority for approval.

2. Draft the outline and guidelines for the report in accordance with the approved inspection plan.

3. Organize and direct members of the inspection team to implement the contents of the inspection decision accurately.

4. Record and sign the Inspection Team's Logbook fully.

5. Report truthfully, comprehensively, on schedule, and within the deadline to the person issuing the inspection decision or to the competent authority if authorized by the person issuing the inspection decision.

6. Promptly propose recommendations to the person issuing the inspection decision to apply measures within the duties and powers of that person as stipulated by laws on inspections.

7. Exercise their authority properly in requesting inspected entities to present licenses, business registration certificates, professional certificates, and provide information, documents, written reports, explanations regarding issues related to the inspection content; inventory assets related to the inspection content of the inspected entity; seal the documents of the inspected entity.

8. Prepare administrative violation records when discovering violations by the inspected entity; impose administrative penalties according to the provisions of laws on handling administrative violations.

9. Properly exercise their authority and follow procedures to temporarily suspend activities if they determine such activities cause serious damage to the interests of the State, rights and legitimate interests of agencies, organizations, and individuals.

10. Establish inspection files in accordance with the provisions of the law.

11. Fulfilling other responsibilities as prescribed by law.

Article 13. Responsibilities of Inspectors and Inspection Officers

1. Comply with assignments from the competent authority.

2. During the inspection process, accept assignments from the Head of the Inspection Team.

3. Shall not collude with the inspected entity and those involved in the inspection case to distort the inspection results.

4. Shall not abuse their position and powers of inspection to cover up for the inspected entity and those involved.

5. Must refuse to join the inspection team and conduct independent inspections if their spouse (or husband), children, father, mother, brothers, sisters, or half-siblings, or the spouse's (or husband's) relatives are the inspected entity or hold leadership or management positions in the inspected agency or organization.

6. Properly perform their duties, powers, and authorities in inspection activities, discover and compel cessation of violations, stop means of transport, prepare administrative violation records, issue decisions on administrative penalties according to the provisions of the law.

7. Shall not exceed their authority while performing their duties.

8. Wear uniforms and badges as prescribed during official duties.

9. Safeguard and maintain the professional cards issued to them.

10. Implement confidentiality regulations in inspection activities as prescribed.

11. Properly adhere to conduct and procedures when performing duties as a member of the Inspection Team or exercising the authority to compel cessation of administrative violations, stopping means of transport.

12. Interact with inspected entities and violators appropriately and according to the rules of the agency.

13. Report the results of inspection work comprehensively, truthfully, and within the deadline within the scope of assigned tasks.

14. Fulfill other responsibilities as prescribed by law.

Article 14. Responsibilities of Civil Servants

1. Comply with assignments from the competent authority.

2. Perform duties and tasks accurately according to the inspection decision or the assignment of the Inspection Team Leader; assist inspectors and inspection officials in conducting independent inspections.

3. Compel the cessation of violations in accordance with procedures, formalities, and authority; prepare administrative violation records or inspection results according to the prescribed models of laws or documents and forms under international conventions to which Vietnam is a member.

4. Report promptly and fully to the competent authority about the inspection results; administrative violation cases.

5. Shall not collude with inspected entities and related persons in inspection cases to distort inspection results.

6. Shall not abuse their positions and powers for inspection purposes to cover up for inspected entities and related persons.

7. Must refuse to join inspection teams when their spouse (or husband), children, parents, siblings, or relatives by marriage of their spouse (or husband) are the inspected entities or hold leadership or management positions in inspected organizations.

8. Shall not exceed authority while performing duties.

9. Safeguard and maintain the professional cards issued to them.

10. Wear uniforms and insignias in accordance with regulations while performing official duties.

11. Comply with confidentiality regulations as stipulated.

12. Interact with inspected entities and violators in accordance with established standards and conduct rules issued by the competent authority.

13. Fulfill other responsibilities as prescribed by law.

Article 15. Responsibilities of Staff Members

1. Adhere to the law, be accountable before the head of the direct managing agency and before the law for the performance of assigned tasks and authorities.

2. Comply with labor contract provisions and obligations.

3. Carry out tasks according to the division of work by the agency head, unit head, or inspection team leader when supporting inspection activities.

4. Shall not exceed authority while performing duties.

5. Fulfill other responsibilities as prescribed by law.

Article 16. Responsibilities of Inspection Collaborators

1. Follow the assignment of inspection collaborator tasks by the head of the direct managing agency and participate fully in inspection teams according to plans.

2. Implement the provisions set forth in Clauses 2, 3, 4, 5, 7, 10, 12, 13, and Clause 14 of Article 13 of this Circular.

Article 17. Joint Liability- Size of the stamp: 1

1. The head of the agency implementing the inspection function in the transport sector who decides on inspections must bear joint liability when the Inspection Team Leader violates responsibilities.

2. The Inspection Team Leader bears joint liability when members of the Inspection Team violate responsibilities.

3. The head of units under the agency implementing the inspection function in the transport sector bears joint liability when allowing civil servants, civil employees, and staff under their direct management to violate responsibilities in inspection work.

Chapter III

AUTHORITY AND FORMS OF RESPONSIBILITY DISCIPLINE

Article 18. Authority to Examine and Discipline Individuals

1. The Minister examines and disciplines the Director of the Ministry’s Inspectorate after receiving the opinion of the State Inspector General; Deputy Director of the Ministry’s Inspectorate, Bureau Chief, Deputy Bureau Chief; Department Chief, Deputy Department Chief, Division Chief, Deputy Division Chief, Inspectors, and civil servants under the Minister's management.

2. The Chairman of the Provincial People's Committee examines and disciplines the Director and Deputy Director of the Provincial Department of Transport.

3. Bureau Chief, Department Chief, and Port Director examine and discipline individuals involved in inspection work within their分级回复

4. The Director of the Department of Transport shall consider and handle the responsibility of the Inspector General of the Department after receiving the opinion of the Provincial Inspector General; consider and handle the responsibility of the Deputy Inspector General and other positions within the Inspectorate according to the分级权限。

5. The head of the agency having jurisdiction over an inspector, inspection civil servant, staff member, collaborator, and employee shall have the authority to consider and handle their responsibility.

Article 19. Handling violations by individuals who are civil servants

1. Based on the level and acts of violation stipulated in Articles 6, 7, 8, 9, 10, 11, 12, and Article 13 of this Circular, civil servants and civil servants holding leadership positions shall be subject to one of the disciplinary measures of reprimand, warning, reduction in rank, demotion, removal from position, or forced resignation as prescribed in Decree No. 34/2011/NĐ-CP dated May 17, 2011 of the Government on disciplinary measures for civil servants.

2. In addition to disciplinary measures, inspectors and civil servant inspectors will have their inspector cards revoked according to regulations.

Article 20. Handling violations by individuals who are public officials

1. Based on the level and acts of violation stipulated in Article 14 of this Circular, public officials and public officials holding leadership positions shall be subject to one of the disciplinary measures of reprimand, warning, removal from position, or forced resignation as prescribed in Decree No. 27/2012/NĐ-CP dated April 6, 2012 of the Government on disciplinary measures for public officials and their liability for compensation and restitution.

2. In addition to being disciplined with reprimand, warning, or removal from position, public officials will also have their professional license suspended for a maximum period of six months.

3. In addition to being disciplined with forced resignation, public officials will have their professional license revoked according to regulations.

Article 21. Handling violations by individuals who are workers

1. Based on the level and acts of violation stipulated in Article 15 of this Circular, workers will be subject to one of the disciplinary measures of reprimand, extension of time for promotion in rank, transfer to another job with lower pay, or dismissal as prescribed in Decree No. 41/CP dated July 6, 1995 of the Government detailing and guiding the implementation of certain provisions of the Labor Code on labor discipline and material responsibility and Decree No. 33/2003/NĐ-CP dated February 4, 2003 of the Government supplementing certain provisions of Decree No. 41/CP dated July 6, 1995.

2. In addition to being disciplined with reprimand, extension of time for promotion in rank, or transfer to another job with lower pay, individuals who are workers will also have their professional license suspended for a maximum period of six months.

3. In addition to being disciplined with dismissal, individuals who are workers will have their professional license revoked according to regulations.

Article 22. Handling violations by cooperating members

1. At the proposal of the Head of the inspection team, the agency using the cooperating member will consider temporarily suspending their participation in the team for violations stipulated in Article 16 of this Circular, and at the same time issue a document requesting the direct management agency of the cooperating member to consider and handle the matter.

2. Based on the level and acts of violation stipulated in Article 16 of this Circular, cooperating members will be subject to one of the disciplinary measures prescribed in Article 19 or Article 20 of this Circular.

Chapter IV

IMPLEMENTING PROVISIONS

Article 23. Effectiveness of Implementation

1. This Circular takes effect from March 1, 2014.

2. This Circular replaces Decision No. 1467/2003/QĐ-BGTVT dated May 22, 2003 of the Minister of Transport on temporary responsibilities of organizations and individuals and forms of handling violations by individuals in specialized transport inspection activities.

Article 24. Responsibility for Implementation

1. The Director of the Ministry's Office, the Inspector General of the Ministry, Heads of Departments, Directors of the Vietnam Highway Administration, Directors of the Vietnam Railway Administration, Directors of the Vietnam Inland Waterway Administration, Directors of the Civil Aviation Administration, Directors of the Maritime Administration, Directors of Provincial Departments of Transport, relevant agencies, organizations, and individuals are responsible for implementing this Circular.

2. During the implementation process, if there are difficulties, heads of agencies and units shall report to the Ministry of Transport for consideration and decision./.
