DECREE
IMPLEMENTATION OF THE TRIAL MANAGEMENT OF SALARIES FOR THE PARENT COMPANY - MILITARY COMMUNICATION GROUP DURING THE 2011-2013 PERIOD
Decree No. 65/2011/NĐ-CP dated July 29, 2011 of the Government on implementing the trial management of salaries for the Parent Company - Military Communication Group during the 2011-2013 period, which took effect from September 15, 2011, was amended and supplemented by:
Decree No. 74/2014/NĐ-CP dated July 23, 2014 of the Government amending and supplementing certain articles of Decree No. 65/2011/NĐ-CP dated July 29, 2011 of the Government on implementing the trial management of salaries for the Parent Company - Military Communication Group, which took effect from September 10, 2014.
Pursuant to the Law on Government Organization dated December 25 the 2001;
Pursuant to the Labor Code dated June 23, 1994; Law Amending, MANAGEMENT AND USE OF DEPOSITS AT THE ENVIRONMENT PROTECTION FUND Certain Articles of the Labor Code dated April 2 the 2002; Law Amending and Supplementing Certain Articles of the Labor Code dated June 29, 2006;
Pursuant to the Enterprise Law dated November the 29, 2005;
Considering the proposal of the Minister of Labor, Invalids and Social Affairs and the Minister of National Defense1,
DECREE:
Article 1. Scope of Regulation
2This Decree stipulates the implementation of the trial management of salaries for the Parent Company - Military Communication Group (hereinafter referred to collectively as the Military Communication Group).
Article 2. Applicability
1. General Director, Deputy General Director, Chief Accountant, and Auditor.
2. Officers, professional military personnel, defense civil servants, and workers employed under labor contracts as prescribed by the Labor Code (hereinafter referred to collectively as workers).
3. Organizations and individuals specified in Article 6, Article 7, Article 8, and Article 9 of this Decree.
Article 3. Salary Classification and Allowances
31. The General Director, Deputy General Director, Chief Accountant, Auditor, and workers who are officers and professional military personnel shall implement salary classification and allowances according to the salary scale and allowance scale prescribed in Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on the salary system for cadres, civil servants, public officials, and armed forces.
2. Defense civil servants and workers employed under labor contracts shall implement salary classification and allowances according to the wage scale and salary scale established by the Military Communication Group in accordance with Decree No. 49/2013/NĐ-CP dated May 14, 2013 of the Government detailing the implementation of certain provisions of the Labor Code regarding wages.
Article 4. Management of Salaries for Workers
1. Labor Management
a) Based on volume, quality, requirements, and production and business tasks, each year, the Military Communication Group shall determine the labor utilization plan and report to the Ministry of National Defense for comments before implementation.
b) On the basis of the labor utilization plan that has been commented on by the Ministry of National Defense, the Military Communication Group shall directly recruit workers in accordance with its recruitment regulations and enter into labor contracts in accordance with the provisions of labor laws. transfer of enterprise ownership form or restructuring of enterprises. c) Each year, the Military Communication Group shall be responsible for evaluating the labor utilization plan and resolving employment benefits for unemployed workers in accordance with the provisions of labor laws.
2. Salary Management
a) The Ministry of National Defense shall take the lead and coordinate with the Ministry of Labor, Invalids and Social Affairs, and the Ministry of Finance to set a stable unit price for salaries based on the total revenue minus total costs without salaries for the Military Communication Group during the 2014-2015 period. The stable unit price for salaries shall be determined based on the actual unit price for salaries implemented according to the total revenue minus total costs without salaries of the Military Communication Group during the 2011-2013 period.
b) When implementing the stable unit price for salaries as prescribed in point a of this clause, the Military Communication Group must ensure the following conditions:
- Fulfilling well the national defense and security tasks assigned by the Party and State.
- Paying taxes to the state budget in accordance with the law.
- The average salary increase must be lower than the average productivity increase.
- Annual profit must be at least 5% higher than the previous year's profit.
c) The annual salary fund of the Military Communication Group shall be determined based on the unit price for salaries prescribed in points a and b of this clause and the actual total revenue minus total costs without salaries. In case the Military Communication Group fails to meet the profit and productivity targets prescribed in point b of this clause, it must reduce the salary fund to ensure compliance with the prescribed conditions.
d) Based on the salary fund prescribed in point c of this clause, the Military Communication Group shall be responsible for establishing a wage regulation for workers ensuring democracy, fairness, transparency, linking salaries to the level of completion of production and business tasks, encouraging talented and highly skilled workers with high productivity who make significant contributions to the Military Communication Group.
When drafting the wage regulation, the Military Communication Group must seek opinions from the Trade Union Executive Board of the Group, report to the Ministry of National Defense for comments before implementation, and disseminate it to each worker.
e) Based on the actual salary fund, the Military Communication Group shall establish a reserve fund to supplement the salary fund of the next year and distribute salaries to workers according to the Group's wage regulation. The reserve fund of the Military Communication Group shall not exceed 17% of the actual salary fund.
đ)5 On the basis of the actual payroll fund, the Military Telecommunications Group shall establish a reserve fund to supplement the payroll fund for the following year and distribute salaries to employees according to the salary payment regulations of the Military Telecommunications Group. The reserve fund of the Military Telecommunications Group shall not exceed 17% of the actual payroll fund.
Article 5. Management of salaries for the General Director, Deputy General Directors, Chief Accountant, and Auditors
1. The salary and allowances of the General Director, Deputy General Directors, Chief Accountant, and Auditors shall be calculated within the unit price of salaries of the Military Telecommunications Corporation according to Clause 2, Article 4 of this Decree.
2. Based on the salary fund as prescribed in point c, Clause 2, Article 4 of this Decree, the Military Telecommunications Corporation shall determine the salary fund and implement payment of salaries for the General Director, Deputy General Directors, Accountant Chief Accountant, and Auditors according to the salary regulations of the Corporation, ensuring that salaries are linked to the level of completion of production and business tasks, management responsibilities of the General Director, Deputy General Directors, Accountant Chief Accountant, and Auditors, and reasonable correlation among types of labor within the Corporation. The salary regulations for the General Director, Deputy General Directors, Accountant Chief Accountant, and Auditors shall be established together with the salary regulations for employees as prescribed in point d, Clause 2, Article 4 of this Decree and reported to the Ministry of National Defense for comments before implementation.
Article 6. Responsibilities of the Military Telecommunications Corporation
1. In the first quarter of each year, develop plans for labor utilization, total revenue minus total expenses excluding salaries, profit plans, annual salary funds; compile results of production, business, profits, labor, salaries, bonuses of the previous year of the Corporation; report to the Ministry of National Defense, Ministry of Labor, Invalids and Social Affairs, Ministry of Finance for supervision and inspection.
2. Determine the annual salary fund; establish salary regulations according to the provisions of point d, Clause 2, Article 4 and Clause 2, Article 5 of this Decree.
3.6 Establish salary scales and wage tables according to Decree No. 49/2013/NĐ-CP dated May 14, 2013 of the Government detailing certain provisions of the Labor Code regarding wages.
4.7 By the third quarter of 2015, summarize and report to the Ministry of National Defense, Ministry of Labor, Invalids and Social Affairs, Ministry of Finance the results of piloting salary management for of the Military Telecommunications Corporation during the period 2011-2015.
Article 7. Responsibilities of the Ministry of National Defense
1. Take the lead and coordinate with the Ministry of Labor, Invalids and Social Affairs, Ministry of Finance to assign stable salary unit prices according to points a and b, Clause 2, Article 4 of this Decree; supervise and inspect the implementation of piloting salary management for the Military Telecommunications Corporation as prescribed in this Decree.
2. Provide comments on the labor utilization plan, salary scales, and salary regulations of the Military Telecommunications Corporation.
Article 8. Responsibilities of the Ministry of Labor, Invalids and Social Affairs
1. Coordinate with the Ministry of National Defense to inspect and supervise the implementation of piloting salary management for the Military Telecommunications Corporation as prescribed in this Decree.
2. Guide the Military Telecommunications Corporation to establish salary scales and wage tables according to Clause 3, Article 6 of this Decree.
3.8 By the fourth quarter of 2015, summarize and evaluate the results of piloting salary management for the Military Telecommunications Corporation during the period 2011-2015, report to the Prime Minister.
Article 9. Effective Date
91.10 The provisions of this Decree shall be implemented from January 1, 2014 to December 31, 2015.
2. The Ministry of Labor, Invalids and Social Affairs shall take the lead and coordinate with the Ministry of National Defense, Ministry of Finance, and relevant ministries to guide the implementation of this Decree.
3. Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairmen of the National Assembly; of provincial people's committees directly under the central government, and the General Director of the Military Telecommunications Corporation are responsible for implementing this Decree.

9 Article 2 of Decree No. 74/2014/ND-CP amending MANAGEMENT AND USE OF DEPOSITS AT THE ENVIRONMENT PROTECTION FUND certain articles of Decree No. 65/2011/ND-CP dated July 29, 2011 of of the Government on pilot management of salaries for the Parent Company - Military Telecommunications Group, which took effect from September 10, 2014, is hereby stipulated as follows:
“Article 2. Effective Date
1. This Decree takes effect from September 10, 2014.
The provisions of this Decree shall be implemented from January 1, 2014 to December 31, 2015.
2. The Minister of Labor, Invalids and Social Affairs shall take the lead and coordinate with the Minister of National Defense, the Minister of Finance Interior, the People's Committee Chairmen of provinces and centrally governed cities, and the General Director of the Military Telecommunications Group to guide the implementation of this Decree.
3. Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairmen of the National Assembly; The people's councils of provinces and centrally governed cities and the General Director of the Military Telecommunications Group are responsible for implementing this Decree./.
10 This paragraph has been amended pursuant to Clause 7, Article 1 of Decree No. 74/2014/ND-CP amending and supplementing certain articles of Decree No. 65/2011/ND-CP dated July 29, 2011 of the Government on pilot management of salaries for the Parent Company - Military Telecommunications Group, which took effect from September 10, 2014.
