Detailed regulations on certain provisions of the Law on Militia and Self-defense Forces regarding training, upgrading, instruction, competitions, exercises, and drills for Militia and Self-defense Forces.honorary title for training,

Pursuant to the Law on Militia and Self-defense Forces dated November 22, 2019; 2019;

Article 1. Amending and supplementing some articles of Circular No. 21/2023/TT-BTTTT dated December 31, 2023 of the Ministry of Information and Communications on functions and technical features of the Administrative Procedure Handling Information System at the ministerial and provincial levels (hereinafter referred to as Circular No. 21/2023/TT-BTTTT) as follows: The Ministry of National Defense issues this Circular detailing certain provisions of the Law on Militia and Self-defense Forces concerning training, upgrading, instruction, competitions, exercises, and drills for Militia and Self-defense Forces.This Circular details Clause 2, Article 27, and Clause 3, Article 28 of the Law on Militia and Self-defense Forces regarding the program, content, time, and list of materials for training, upgrading, and instruction for Militia and Self-defense Forces; it also specifies the organization and facilities for training and upgrading of command positions and instruction for Militia and Self-defense Forces.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

1. People's Militia Command at commune level, People's Militia Command of agencies, organizations, and Militia and Self-defense Forces units.

Article 2. Applicability

2. Relevant military agencies and units.

3. Agencies and organizations of Vietnam; foreign organizations and individuals residing and operating within the territory of the Socialist Republic of Vietnam related to training, upgrading, instruction, competitions, exercises, and drills for Militia and Self-defense Forces.

TRAINING, UPGRADE, INSTRUCTION, COMPETITIONS, EXERCISES, AND DRILLS FOR MILITIA AND SELF-DEFENSE FORCES

Chapter II

Article 3. Objectives, requirements, time, and programs for training and upgrading of command positions in Militia and Self-defense Forces

a) Mastering fundamental issues regarding the Party's policies, guidelines, State laws on national defense and security, militia and self-defense force work, national defense and security education; central and local administrative defense work; ethnic and religious affairs in new circumstances;

b) Unifying the programs, contents, times, and methods of organizing and conducting defense, military, and civil defense work relevant to central ministries, localities, agencies, and organizations;

c) Updating new contents on national defense, security, and civil defense work relevant to the situation;

d) Enhancing capabilities in advisory and implementation of defense, military, and civil defense work relevant to the situation.

a) Annually, command positions in Militia and Self-defense Forces, full-time and part-time staff responsible for defense and military work in agencies and organizations must be trained and upgraded according to the program, content, and time specified for each category, consistent with the tasks of the agency, organization, locality, region, or area;

2. Requirements

b) Mastering the content of training and upgrading and creatively applying it to advisory and implementation tasks according to assigned responsibilities.

3. Time

a) Training for command positions in People's Militia Commands at commune level, People's Militia Commands of agencies and organizations, battalions, naval detachments, companies, naval companies; platoons of Militia and Self-defense Forces anti-aircraft artillery: 7 days/year. For platoon leaders, squad leaders, ship captains, village leaders, and gun crew leaders: 5 days/year.

b) Upgrading based on the requirements and tasks, annually or during specific periods, the Commander of the Hanoi Military Command, the Commander of the Ho Chi Minh City Military Command, and the Commanders of provincial military commands shall consult with the Chairmen of the People's Committees at the provincial level to decide on upgrading command positions in People's Militia Commands at commune level, People's Militia Commands of agencies and organizations, and self-defense unit commanders (where there are no People's Militia Commands of agencies and organizations), not exceeding 7 days.

4. Programs

a) The training program is detailed in Appendix I attached to this Circular;

b) The upgrading program is detailed in Appendix II attached to this Circular.

b) The training program prescribed in Appendix II attached to this Circular.

Article 4. Classification of organization and training bases for militia self-defense command positions

1. Classification of organization

a) The provincial military authority; general departments, military branches, corps, groups, and holding companies organize training for militia self-defense command positions at village-level military commissariats, military commissariats of agencies and organizations, battalions, naval flotillas, companies, naval teams, independent self-defense units (where there is no military commissariat of agencies and organizations), platoon leaders, anti-aircraft gun platoon leaders, artillery militia self-defense, and anti-aircraft artillery;

b) The district military authority organizes training for platoon leaders, village team leaders, ship captains, squad leaders, 12.7mm, 14.5mm machine gun platoon leaders, recoilless rifle platoon leaders, 82mm mortar platoon leaders, 60mm mortar platoon leaders;

c) The provincial military authority organizes training for village-level military commissariats, military commissariats of agencies and organizations; command positions and technical specialists of permanent naval militia teams.

2. Training bases and facilities are determined by the organizing level.

Article 5. Objectives and requirements for militia self-defense training

1. Objectives

a) To firmly grasp the position, function, and mission of militia self-defense; to thoroughly understand basic issues regarding the Party's policies, the State's laws on national defense, security, foreign relations, ethnicity, religion, civil defense, and related matters; to clearly understand the plots and tactics of hostile forces' "peaceful evolution" and violent overthrow against Vietnam;

b) To gradually become proficient in using various types of weapons, military explosives, support tools, equipment, and technical means; to firmly grasp the militia self-defense tactical principles linked to the operational area and creatively apply them in handling situations;

c) To have the ability to fight independently, coordinate in combat, serve in combat, and perform civil defense tasks, completing assigned missions.

2. Requirements

a) To conduct training for each target group according to the time schedule specified in this Circular;

b) To thoroughly understand the training content; to creatively and effectively apply it in performing assigned tasks;

c) To ensure sufficient funding and material resources for training.

Article 6. Time and program for militia self-defense training

1. The training time for each militia self-defense target group shall be implemented according to the provisions of Clause 1, Article 28 of the Militia Self-Defense Law.

2. Program

a) First-year militia self-defense personnel shall follow the regulations set out in Appendix III attached to this Circular;

b) Second-year and subsequent militia self-defense personnel shall follow the regulations set out in Appendix IV attached to this Circular;

c) Annually, based on the program stipulated herein, the Commander of the Military Command of Hanoi Capital, the Commander of the Military Command of Ho Chi Minh City, the Chief of the Provincial Military Command, general departments, military branches, corps, academies, schools, groups, and holding companies under the Ministry of National Defense shall detail the training program and content for militia self-defense personnel under their jurisdiction.

Article 7. Classification and plan for organizing militia self-defense training

1. Classification of organization for training

a) The provincial military authority trains artillery and anti-aircraft artillery militia self-defense platoons, and permanent naval militia teams;

b) The district military commissariat trains militia self-defense units organized at the district level; first-year militia self-defense personnel, coastal militia self-defense units, reconnaissance, communication, engineering, chemical defense, medical, and mortar platoons at the commune level; based on local conditions, they may organize training in commune clusters;

c) The commune-level military commissariat trains for permanent, mobile, and local militia self-defense units at the commune level;

d) The military commissariat of agencies and organizations, or the self-defense unit commander (where there is no military commissariat of agencies and organizations) organizes training for self-defense units within agencies and organizations;

đ) The Navy Military Branch directs agencies and units to train self-defense units under their management;

e) The head of military enterprises directs agencies and units to train self-defense units under their management.

2. Plan for militia self-defense training

a) At the provincial level, the planning department leads and coordinates with relevant departments to develop plans, which are submitted to the Commander of the Military Command of Hanoi Capital, the Commander of the Military Command of Ho Chi Minh City, and the Chief of the Provincial Military Command for approval;

b) At the district level, the planning department leads and coordinates with relevant departments to develop plans, which are submitted to the Chief of the District Military Commissariat for approval;

c) At the commune and agency levels, the commune-level military commissariat, the military commissariat of agencies and organizations, or the self-defense unit commander (where there is no military commissariat of agencies and organizations) develops plans, which are submitted to the Chief of the District Military Commissariat for approval;

d) Plans for militia self-defense training, exercises, competitions, and sports events involving the use of explosives, grenades, and live ammunition shall be carried out in accordance with the regulations of the Minister of National Defense and the General Chief of Staff of the Vietnam People's Army.

Article 8. Objectives, requirements, contents, time of the militia and self-defense force competition and sports meeting

1. Objectives

a) Assessing the results of organizing construction, training, and activities of the militia and self-defense force;

b) Enhancing awareness, combat readiness, combat capability, and support for combat; coordinated activities of the militia and self-defense force with other forces in national security protection, ensuring social order and safety, and civil defense at localities, agencies, and organizations.

2. Requirements

a) The content of the competition and sports meeting must be consistent with the program, closely aligned with the situation and tasks of each locality, agency, and organization; organized according to the classification level as stipulated in this Circular and guided by competent authorities;

b) Adequate preparation, strict, scientific, effective, safe, and economical organization.

3. Organization, time of the competition and sports meeting

a) The Ministry of National Defense organizes a nationwide competition and sports meeting for the militia and self-defense force once every five years;

b) Military regions, general departments, military branches, arms, corps, groups, and corporations organize competition and sports meetings for the militia and self-defense force under their jurisdiction once every five years;

c) Localities organize competition and sports meetings for the militia and self-defense force under their jurisdiction twice every five years;

d) Based on the situation and requirements of national defense tasks, central ministries and agencies organize competition and sports meetings for self-defense forces under their jurisdiction at least once every five years.

4. Contents are decided by the organizing body of the competition and sports meeting.

Article 9. Objectives, requirements, contents, organization, methods, and time of exercises

1. Objectives, requirements, contents, organization, and methods are decided by the organizing body of the exercise.

2. Time

a) A defensive combat exercise at the commune level during the term of the Party Congress must be organized at least once; the duration of the exercise must be at least one day and night;

b) Civil defense exercises at the commune level are decided by the Chairman of the People's Committee of the district.

Article 10. List and classification of material and equipment guarantees

1. The list of basic materials and equipment guaranteed for training, reinforcement, instruction, competition, sports meeting, and exercise of the militia and self-defense force as prescribed in Appendix V attached to this Circular.

2. Classification of guarantees

a) The Ministry of National Defense guarantees materials (political education materials and laws issued by the Political General Department; military training materials issued by the General Staff Department); models, teaching aids, military weapons, explosives, real grenades, live ammunition, materials, equipment, and specialized means for training, reinforcement, instruction, competition, sports meeting, and exercise of the militia and self-defense force;

b) The organizing body of training, reinforcement, instruction, competition, sports meeting, and exercise guarantees training materials not covered by point a of this clause for the militia and self-defense force under their jurisdiction.

Chapter III

IMPLEMENTING PROVISIONS

Article 11. Effectiveness and responsibility for implementation

1. This Circular takes effect from August 1, 2020, and replaces Circular No. 02/2016/TT-BQP dated January 8, 2016, issued by the Minister of National Defense on the training program, instruction, and organization of competition and sports meeting, and exercise of the militia and self-defense force, and any provisions contrary to this Circular.

2. The Chief of General Staff, heads of agencies, units, organizations, localities, and individuals concerned are responsible for implementing this Circular./.
