RESOLUTION OF THE NATIONAL ASSEMBLY
APPROVING THE PROTOCOL ON ACCESSION TO THE AGREEMENT ESTABLISHING THE WORLD TRADE ORGANIZATION (WTO) OF THE SOCIALIST REPUBLIC OF VIET NAM
Pursuant to Article 84 of the Constitution of the Socialist Republic of Viet Nam 1992, as amended and supplemented by Resolution No. 51/2001/QH10 dated December 25, 2001 of the 10th National Assembly, 10th Session;

Pursuant to the Law on the Conclusion, Accession and Implementation of International Treaties;
On the proposal of the President of the State at the Report to the National Assembly No. 05 TTr/CTN dated November 16, 2006 on the approval of the Protocol on Accession to the Agreement Establishing the World Trade Organization of the Socialist Republic of Viet Nam;
After considering the Report to the National Assembly No. 155/TTr-CP dated November 22, 2006 of the Government, the Report on Examination No. 2410/UBDT dated November 27, 2006 of the Foreign Affairs Committee of the National Assembly, and based on the opinions of the National Assembly deputies,
1. Approves the Protocol on Accession to the Agreement Establishing the World Trade Organization of the Socialist Republic of Viet Nam signed on November 7, 2006 in Geneva, Switzerland (hereinafter referred to as the Protocol).
RESOLUTION:
2. Directly apply Vietnam's commitments recorded in the Appendix attached to this Resolution and other Vietnam's commitments with the World Trade Organization specified clearly and in detail in the Protocol, the Appendices attached, and the Report of the Working Group on Vietnam's Accession to the Agreement Establishing the World Trade Organization.
In cases where provisions of Vietnamese law are inconsistent with the provisions of the Agreement Establishing the World Trade Organization, the Protocol, and the attached documents, the provisions of the Agreement Establishing the World Trade Organization, the Protocol, and the attached documents shall be applied.
3. The Government, the Supreme People's Court, and the Supreme People's Procuracy within their respective functions and powers shall have the responsibility:
a) To review Vietnam's commitments with the World Trade Organization specified clearly and in detail in the Protocol, the Appendices attached, and the Report of the Working Group on Vietnam's Accession to the Agreement Establishing the World Trade Organization but not recorded in the Appendix attached to this Resolution for direct application and report to the Standing Committee of the National Assembly;
b) To review regulatory legal documents to submit to the National Assembly, the Standing Committee of the National Assembly for amendment, supplementation, or promulgation anew; amend, supplement, or promulgate anew regulatory legal documents within their authority in accordance with Vietnam's commitments with the World Trade Organization;
c) Based on an assessment of opportunities and challenges, advantages and difficulties, and the impacts of Vietnam's accession to the World Trade Organization, develop specific programs and action plans and organize the implementation of Vietnam's commitments with the World Trade Organization to serve the country's economic and social development and promote deeper integration into the global economy.
4. The Government shall carry out diplomatic procedures regarding the approval of the Protocol on Accession to the Agreement Establishing the World Trade Organization of the Socialist Republic of Viet Nam.
5. The Government shall coordinate with the Central Committee of the Vietnam Fatherland Front and instruct relevant agencies and organizations at central and local levels to effectively implement information dissemination work to create unity in understanding and action among the people nationwide and overseas compatriots regarding Vietnam's accession to the World Trade Organization.
6. The Standing Committee of the National Assembly, the National Ethnic Council, the Committees of the National Assembly, the Delegations of National Assembly deputies, and National Assembly deputies within their respective functions and powers shall supervise the implementation of this Resolution.
This Resolution was adopted by the 10th Session of the 11th National Assembly of the Socialist Republic of Viet Nam on November 29, 2006.
