On specific tasks, powers, and organizational structure

of the National Ethnic Council and the Committees of the National Assembly

THE STANDING COMMITTEE OF THE NATIONAL ASSEMBLY

On the basis of the Constitution of the Socialist Republic of Vietnam;

Pursuant to the Law on the Organization of the National Assembly No. 57/2014/QH13 has been amended and supplemented with some articles pursuant to Law No. 65/2020/QH14 and Law No. 62/2025/QH15;

Pursuant to Resolution No. 178/2025/QH15 dated February 18, 2025 of the National Assembly regarding the organization of National Assembly agencies;

RESOLUTION:

PART I

GENERAL PROVISIONS

Article 1. The National Ethnic Council and the Committees of the National Assembly

1. The National Ethnic Council and the Committees of the National Assembly are agencies of the National Assembly, established and dissolved by the National Assembly.

2. The National Ethnic Council and the Committees of the National Assembly have functions, tasks, and powers as prescribed by the Constitution, the Law on the Organization of the National Assembly, this Resolution, and other relevant laws.

3. The term of office of the National Ethnic Council and the Committees of the National Assembly corresponds to the term of the National Assembly.

Article 2. Organizational Structure of the National Ethnic Council and the Committees of the National Assembly

1. The National Ethnic Council consists of the Chairperson, Vice-Chairpersons, members who are full-time National Assembly deputies working at the National Ethnic Council, and members who are part-time National Assembly deputies working at the National Ethnic Council.

The Committee of the National Assembly consists of the Chairman, Vice-Chairmen, members who are full-time National Assembly deputies working at the Committee, and members who are part-time National Assembly deputies working at the Committee.

2. The Standing Body of the National Ethnic Council includes the Chairperson, Vice-Chairpersons, and full-time National Assembly deputies working at the National Ethnic Council. The Standing Body of the Committee of the National Assembly includes the Chairman, Vice-Chairmen, and full-time National Assembly deputies working at the Committee.

3. The specialized departments of the National Ethnic Council and the Committees of the National Assembly are administrative organizations with the function of researching, advising, assisting, and organizing services for the activities of the Council, the Committee, the Standing Body of the Council, and the Standing Body of the Committee.

Article 3. Principles of Operation

1. The National Ethnic Council and the Committees of the National Assembly operate under a collective system combined with the emphasis on the responsibility of the Standing Body of the Council, the Standing Body of the Committee, and the role of leadership by the Chairperson of the Council and the Chairman of the Committee.

2. Decisions of the National Ethnic Council and the Committees of the National Assembly must be approved by more than half of the total number of members voting. Voting by the National Ethnic Council and the Committees of the National Assembly can be conducted directly, online, or through other appropriate methods as stipulated by the Council and the Committee.

3. Activities of the National Ethnic Council and the Committees of the National Assembly must comply with the Constitution and laws, be transparent and democratic, ensure the leadership and guidance of the Party, the National Assembly, the Standing Committee of the National Assembly, and the Chairperson of the National Assembly, Deputy Chairpersons of the National Assembly assigned to oversee; ensure the management of the Chairperson of the National Ethnic Council and the Chairman of the Committee of the National Assembly; enhance and promote the responsibility of the Standing Body of the Council and the Standing Body of the Committee in performing the duties of the permanent body.

Article 4. Plenary Sessions of the National Ethnic Council and the Committees of the National Assembly

1. The National Ethnic Council and the Committees of the National Assembly organize plenary sessions to review draft laws, ordinances, resolutions, reports, projects, and other proposals submitted to the National Assembly and the Standing Committee of the National Assembly; consider and decide on other issues within their tasks and powers.

Plenary sessions of the National Ethnic Council and the Committees of the National Assembly must have more than half of the total number of members of the Council and the Committee present.

2. Members of the National Ethnic Council and the Committees of the National Assembly are responsible for attending the Council and Committee meetings as summoned by the Chairperson of the Council and the Chairman of the Committee; discussing and voting on issues considered at the meeting; if unable to attend the meeting, they must provide a valid reason, report it, and obtain the approval of the Chairperson of the Council and the Chairman of the Committee.

3. The Chairperson of the National Assembly and Deputy Chairpersons of the National Assembly have the right to attend and make guiding statements at the meetings of the Council and the Committee.

4. The National Ethnic Council and the Committees of the National Assembly may invite non-member National Assembly deputies, representatives of relevant agencies and organizations, and experts to participate in the activities of the Council and the Committee. Relevant agencies and organizations are responsible for creating conditions for those invited to participate in the activities of the Council and the Committee.

5. When the National Ethnic Council discusses ethnic policies, the Chairperson of the National Ethnic Council may invite representatives of ethnic groups that do not have representatives in the current term of the National Assembly to attend as People's Council deputies.

Chapter II

SPECIFIC TASKS AND POWERS OF

THE NATIONAL ETHNIC COUNCIL AND THE COMMITTEES OF THE NATIONAL ASSEMBLY

Article 5. Specific tasks and powers of the National Ethnic Council

1. Review draft laws, ordinances, resolutions of the National Assembly and the Standing Committee of the National Assembly within the ethnic affairs domain and other reports, projects, programs entrusted by the National Assembly and the Standing Committee of the National Assembly.

2. Review the implementation of ethnic policies in draft laws, ordinances, and resolutions of the National Assembly and the Standing Committee of the National Assembly before they are submitted to the National Assembly and the Standing Committee of the National Assembly.

3. Supervise the enforcement of the Constitution, laws, resolutions of the National Assembly, ordinances, and resolutions of the Standing Committee of the National Assembly; supervise the activities of the Government, Ministries, and agencies at the ministerial level within the Council's jurisdiction; supervise the implementation of ethnic policies, economic and social development programs and plans in mountainous areas and among ethnic minority groups.

4. Supervise regulatory legal documents of the Government, Prime Minister, Ministers, and heads of agencies at the ministerial level within the Council's jurisdiction.

5. Study and make recommendations to the National Assembly on ethnic affairs; recommend issues related to the implementation of state ethnic policies, organizational and operational matters of relevant agencies, and other issues related to ethnic affairs.

6. Submit draft laws and resolutions to the National Assembly, draft ordinances and resolutions to the Standing Committee of the National Assembly within the Council's jurisdiction.

7. Have the responsibility to participate in opinions on the issuance of regulations implementing ethnic policies by the Government.

8. Perform other tasks assigned by the National Assembly and the Standing Committee of the National Assembly.

Article 6. Specific tasks and powers of the Legal and Judicial Committee

1. Review draft laws, ordinances, and resolutions of the National Assembly and the Standing Committee of the National Assembly within the domains of state organization, administration, civil, criminal, judicial proceedings, execution of sentences, preventive measures, judicial assistance, anti-corruption, anti-neglect, mutual legal assistance, extradition, transfer of persons serving prison sentences, and other reports, projects, programs entrusted by the National Assembly and the Standing Committee of the National Assembly.

2. Chair the review of petitions from the National Ethnic Council, Committees of the National Assembly, proposals from the State President, the Government, the Supreme People's Court, the Supreme People's Procuracy, the Central Committee of the Vietnam Fatherland Front, central agencies of member organizations of the Front, or National Assembly deputies regarding documents suspected of violating the Constitution.

3. Chair the evaluation of projects on the establishment and abolition of Ministries, agencies at the ministerial level, and other agencies established by the National Assembly; review proposals on the establishment, dissolution of people's courts, military courts, people's procuracies, military procuracies, security investigation agencies of military regions and equivalent units, criminal investigation agencies of military regions and equivalent units, regional criminal investigation agencies; review proposals on the establishment, dissolution, merger, division of administrative units, adjustment of administrative boundaries, and renaming of administrative units; review the Chief Justice of the Supreme People's Court's proposal on approving the appointment, dismissal, and removal of Supreme People's Court judges; review the State President's proposal on amnesty.

4. Supervise the enforcement of the Constitution, laws, resolutions of the National Assembly, ordinances, and resolutions of the Standing Committee of the National Assembly; supervise the activities of the Government, Ministries, agencies at the ministerial level, the Supreme People's Court, and the Supreme People's Procuracy within the Committee's jurisdiction; supervise the detection and handling of acts of corruption and neglect.

5. Supervise regulatory legal documents of the Government, Prime Minister, Ministers, heads of agencies at the ministerial level, the Chief Justice of the Supreme People's Court, the Procurator General of the Supreme People's Procuracy, and the Supreme People's Court Bench within the Committee's jurisdiction.

6. Recommend issues related to improving the state organizational structure, administrative, civil, criminal, judicial proceedings, execution of sentences, preventive measures, judicial assistance, anti-corruption, anti-neglect, mutual legal assistance, extradition, transfer of persons serving prison sentences, protection of the Constitution and laws, ensuring the unity of the legal system, and other issues within the Committee's jurisdiction.

7. Submit draft laws and resolutions to the National Assembly, draft ordinances and resolutions to the Standing Committee of the National Assembly within the Committee's jurisdiction.

8. Perform other tasks assigned by the National Assembly and the Standing Committee of the National Assembly.

Article 7. Specific tasks and powers of the Economic and Financial Committee

1. Review draft laws, ordinances, resolutions of the National Assembly and the Standing Committee of the National Assembly within the economic and financial management areas, including monetary policy, state budget, land, banking, business operations, state auditing, and other projects assigned by the National Assembly and the Standing Committee of the National Assembly.

2. Lead the review of fundamental national financial policies, monetary policies, state budgets, programs, projects, plans regarding socio-economic development goals, indicators, basic policies, and tasks, and other reports, projects, and proposals under its jurisdiction or assigned by the National Assembly and the Standing Committee of the National Assembly.

3. Supervise the implementation of the Constitution, laws, resolutions of the National Assembly, ordinances, and resolutions of the Standing Committee of the National Assembly; supervise the activities of the Government, Ministries, agencies at the ministerial level, the Supreme People's Court, the Supreme People's Procuracy, and the State Audit Office in implementing the state budget estimates, programs, projects, plans regarding socio-economic development goals, indicators, basic policies, and tasks, the implementation of economic and financial policies, monetary policies, state budget policies, and other contents within the Committee’s jurisdiction.

4. Supervise regulatory legal documents of the Government, Prime Minister, Ministers, heads of agencies at the ministerial level, President of the Supreme People's Court, Prosecutor General of the Supreme People's Procuracy, and Chief Auditor of the State Audit Office within the Committee’s jurisdiction.

5. Propose issues related to economic and financial management, monetary policy, state budget, land, banking, business operations, state auditing, organizational and operational issues of relevant agencies, and other issues within the Committee’s jurisdiction.

6. Submit draft laws and resolutions to the National Assembly, draft ordinances and resolutions to the Standing Committee of the National Assembly on matters within the Committee’s jurisdiction.

7. Perform other tasks assigned by the National Assembly and the Standing Committee of the National Assembly.

Article 8. Specific tasks and powers of the Defense, Security, and Foreign Affairs Committee

1. Review draft laws, ordinances, resolutions of the National Assembly and the Standing Committee of the National Assembly within the defense, security, public order, safety, foreign affairs areas, and other reports, projects, and proposals under its jurisdiction or assigned by the National Assembly and the Standing Committee of the National Assembly.

2. Review the requirements for defense and security in draft laws, ordinances, and resolutions before submitting them to the National Assembly and the Standing Committee of the National Assembly; review fundamental foreign policy policies; lead the review of international treaties within the authority to approve, decide to join or terminate their effect granted to the National Assembly; review the Prime Minister's proposal on the approval of the appointment and dismissal of special envoys of the Socialist Republic of Vietnam.

3. Supervise the implementation of the Constitution, laws, resolutions of the National Assembly, ordinances, and resolutions of the Standing Committee of the National Assembly; supervise the activities of the Government, Ministries, agencies at the ministerial level in fulfilling defense and security tasks, foreign policy, the integration of economy with defense and security, and defense and security with the economy in strategic planning, planning, policies, projects, programs for socio-economic development, and on each specific area; supervise the signing, joining, and implementation of international treaties and agreements; supervise the implementation of policies towards overseas Vietnamese and foreigners residing in Vietnam and other contents within the Committee’s jurisdiction.

4. Supervise regulatory legal documents of the Government, Prime Minister, Ministers, heads of agencies at the ministerial level within the Committee’s jurisdiction.

5. Propose issues related to defense, security, public order, safety, foreign policy of the State, relations with parliaments of other countries, world and regional inter-parliamentary organizations, organizational and operational issues of relevant agencies, and other issues within the Committee’s jurisdiction.

6. Submit draft laws and resolutions to the National Assembly, draft ordinances and resolutions to the Standing Committee of the National Assembly on matters within the Committee’s jurisdiction.

7. Serve as the main agency in diplomatic relations with parliaments of other countries and world and regional inter-parliamentary organizations of which the National Assembly of Vietnam is a member; maintain relations with foreign affairs committees of parliaments of other countries.

8. Perform other tasks assigned by the National Assembly and the Standing Committee of the National Assembly.

Article 9. Specific tasks and powers of the Committee on Culture, Social Affairs

1. Review draft laws, ordinances, resolutions of the National Assembly and the Standing Committee of the National Assembly in the fields of culture, belief, religion, education, information, communication, tourism, sports, labor, employment, health, population, social security, gender equality, commendation and reward, prevention and control of social evils, elderly people, youth, children, and other reports, projects, plans entrusted by the National Assembly and the Standing Committee of the National Assembly.

2. Review the integration of gender equality issues in draft laws, ordinances, and resolutions before they are submitted to the National Assembly and the Standing Committee of the National Assembly.

3. Supervise the implementation of the Constitution, laws, resolutions of the National Assembly, ordinances, and resolutions of the Standing Committee of the National Assembly; supervise the activities of the Government and Ministries, agencies equivalent to ministries in implementing policies related to culture, religion, education, information, communication, tourism, sports, labor, employment, health, population, social security, gender equality, commendation and reward, prevention and control of social evils; supervise the implementation of policies for elderly people, youth, children, and other matters within the Committee's jurisdiction.

4. Supervise regulatory legal documents of the Government, Prime Minister, Ministers, heads of agencies at the ministerial level within the Committee’s jurisdiction.

5. Propose issues related to policies in the fields of culture, belief, religion, education, information, communication, tourism, sports, labor, employment, health, population, social security, gender equality, commendation and reward, prevention and control of social evils, policies for elderly people, youth, children, organizational and operational issues of relevant agencies, and other issues within the Committee's jurisdiction.

6. Submit draft laws and resolutions to the National Assembly, draft ordinances and resolutions to the Standing Committee of the National Assembly on matters within the Committee’s jurisdiction.

7. Perform other tasks assigned by the National Assembly and the Standing Committee of the National Assembly.

Article 10. Specific tasks and powers of the Committee on Science, Technology, and Environment

1. Review draft laws, ordinances, and resolutions of the National Assembly and the Standing Committee of the National Assembly in the fields of science, technology, innovation, digital transformation, natural resources (excluding land), environment, climate change response for sustainable development, and other reports, projects, plans entrusted by the National Assembly and the Standing Committee of the National Assembly.

2. Supervise the implementation of the Constitution, laws, resolutions of the National Assembly, ordinances, and resolutions of the Standing Committee of the National Assembly; supervise the activities of the Government and Ministries, agencies equivalent to ministries within the Committee's jurisdiction.

3. Supervise regulatory legal documents of the Government, Prime Minister, Ministers, heads of agencies equivalent to ministries within the Committee's jurisdiction.

4. Propose issues related to science, technology, innovation, digital transformation, natural resources (excluding land), environmental protection, climate change response for sustainable development, organizational and operational issues of relevant agencies, and other issues within the Committee's jurisdiction.

5. Submit draft laws and resolutions to the National Assembly, draft ordinances and resolutions to the Standing Committee of the National Assembly in the fields under the Committee's jurisdiction.

6. Perform other tasks assigned by the National Assembly and the Standing Committee of the National Assembly.

Article 11. Specific tasks and powers of the Committee on Representative Work

1. Review draft laws, ordinances, and resolutions of the National Assembly and the Standing Committee of the National Assembly on elections of National Assembly deputies, People's Council deputies, trust votes, and confidence votes for persons elected to positions by the National Assembly and People's Councils, approval, and other draft projects entrusted by the National Assembly and the Standing Committee of the National Assembly.

2. Review proposals, plans, projects on the structure and number of members of the Government; dissolution of provincial People's Councils; the number of staff positions, systems, and policies for cadres, civil servants, and public officials under the authority of the Standing Committee of the National Assembly, and other reports, projects, plans entrusted by the National Assembly and the Standing Committee of the National Assembly.

3. Supervise the implementation of the Constitution, laws, resolutions of the National Assembly, ordinances, and resolutions of the Standing Committee of the National Assembly; supervise the activities of the Government and Ministries, agencies equivalent to ministries within the Committee's jurisdiction.

4. Supervise regulatory legal documents of the Government, Prime Minister, Ministers, heads of agencies at the ministerial level within the Committee’s jurisdiction.

5. Propose issues related to election organization work; cadre work; organizational and operational issues of National Assembly agencies, National Assembly Delegation groups, and National Assembly deputies; systems, policies, and other guarantee conditions for National Assembly deputies and People's Council deputies, and other issues within the Committee's jurisdiction.

6. Submit draft laws and resolutions to the National Assembly, draft ordinances and resolutions to the Standing Committee of the National Assembly on matters within the Committee’s jurisdiction.

7. Perform other tasks assigned by the National Assembly and the Standing Committee of the National Assembly.

Article 12. Specific tasks and powers of the Committee on Petitions and Oversight

1. Review draft laws, ordinances, resolutions of the National Assembly and the Standing Committee of the National Assembly concerning referenda, grassroots democracy, citizen reception, complaints resolution, denunciation handling, citizens' suggestions and reflections, oversight activities, and other reports, projects, and plans within its jurisdiction or assigned by the National Assembly and the Standing Committee of the National Assembly.

2. Chair the review of reports from the Government, the Supreme People's Court, the Supreme People's Procuracy, and the State Audit Agency on the implementation of the National Assembly's resolutions and the Standing Committee's resolutions on specialized oversight and interpellation.

3. Supervise the enforcement of the Constitution, laws, National Assembly resolutions, ordinances, and Standing Committee resolutions; oversee the activities of the Government, Ministries, agencies at ministerial level, the Supreme People's Court, the Supreme People's Procuracy, and the State Audit Agency within the Committee's jurisdiction; chair the supervision of citizens' complaints, denunciations, suggestions, and reflections submitted to the National Assembly, the Standing Committee of the National Assembly, and the National Assembly's agencies.

5. Supervise normative legal documents of the Government, the Prime Minister, Ministers and Heads of agencies at ministerial level, the President of the Supreme People's Court, the Prosecutor General of the Supreme People's Procuracy, and the Auditor General within the Committee's jurisdiction.

6. Propose issues related to the organization and enhancement of the effectiveness of the National Assembly's oversight activities, the resolution of citizens' complaints, denunciations, suggestions, and reflections, necessary measures to protect citizens' legitimate rights and interests, organizational and operational issues of relevant agencies, and other matters within the Committee's jurisdiction.

7. Submit draft laws and resolutions to the National Assembly, draft ordinances and resolutions to the Standing Committee of the National Assembly within the Committee's jurisdiction.

8. Perform other tasks assigned by the National Assembly and the Standing Committee of the National Assembly.

Article 13. Responsibilities for participating in reviews and coordination between the Ethnic Councils and Committees of the National Assembly

Within their respective tasks and powers, the Ethnic Councils and Committees of the National Assembly shall have the following responsibilities:

1. Participate in reviewing contents related to the fields under the jurisdiction of the Ethnic Councils and Committees in reports, projects, and plans reviewed by other National Assembly agencies.

2. Supervise the implementation of legislative orientation tasks during the National Assembly's term, anti-corruption work, thrift promotion, waste prevention, and the resolution of citizens' complaints, denunciations, suggestions, and reflections within the fields under the jurisdiction of the Councils and Committees.

3. Participate with the Committee on Legal Affairs and Justice in reviewing petitions regarding documents suspected of violating the Constitution; proposals for establishing, abolishing Ministries, agencies at ministerial level, and other agencies established by the National Assembly.

4. Participate with the Economic and Finance Committee in reviewing programs, projects, and plans on national socio-economic development goals, indicators, policies, and basic tasks; the implementation of national socio-economic development goals, indicators, policies, and basic tasks; fundamental national financial and monetary policies; state budget matters.

5. Participate with the Committee on National Defense and Security and Foreign Affairs in reviewing international treaties within the National Assembly's approval authority, decisions to join or terminate the effect of such treaties.

6. Participate with the Committee on Petitions and Oversight in reviewing reports from the Government, the Supreme People's Court, the Supreme People's Procuracy, and the State Audit Agency on the implementation of the National Assembly's resolutions and the Standing Committee's resolutions on specialized oversight and interpellation.

Chapter III

STANDING COMMITTEE OF THE ETHNIC COUNCIL, STANDING COMMITTEE OF THE COMMITTEES OF THE NATIONAL ASSEMBLY

Article 14. The Standing Committee of the National Assembly's Ethnic Council and the Standing Committee of the National Assembly's Committees

1. The Standing Committee of the National Assembly's Ethnic Council and the Standing Committee of the National Assembly's Committees assist the Council and Committees in handling regular tasks of the Council and Committees during periods between sessions of the Council and Committees, and perform other tasks assigned by the National Assembly's Standing Committee and the leadership of the National Assembly.

2. The Standing Committee of the National Assembly's Ethnic Council and the Standing Committee of the National Assembly's Committees operate under a collective system, deciding by majority combined with the management role of the Chairperson of the Council and the Head of the Committee.

When deciding matters within the authority of the Standing Committee of the National Assembly's Ethnic Council and the Standing Committee of the National Assembly's Committees, the Standing Committee decides collectively by majority vote; other opinions are recorded and reflected in the Standing Committee's documents.

Article 15. Tasks and powers of the Standing Committee of the National Assembly's Ethnic Council and the Standing Committee of the National Assembly's Committees in performing the duties of permanent agencies

1. Proposing the program and plan of activities of the National Assembly's Ethnic Council and Committees for the Council and Committees to consider and decide, and organizing the implementation of the program and plan of activities, decisions, and conclusions of the Council and Committees.

2. Preparing content and materials to serve the activities of the Council and Committees; providing necessary information and materials for members of the Council and Committees. Based on the results of the Council and Committee meetings, preparing preliminary review reports and other reports of the Council and Committees to be submitted to the National Assembly and the National Assembly's Standing Committee.

3. Preliminarily reviewing draft laws, resolutions, reports, projects, and proposals when it is not possible to organize a meeting for review by the Council and Committees; participating in coordinating with the agency submitting the project during the process of receiving, explaining, and revising the project before submitting it to the National Assembly's Standing Committee for consideration prior to submission to the National Assembly. Participating in reviewing the content within the responsibility of the Council and Committees in reports, projects, and proposals mainly reviewed by other National Assembly Committees, except in cases where the project has many important contents and differing opinions, which the Standing Committee considers necessary to submit to the Council and Committees for a review meeting. The Standing Committee of the Legal Affairs and Justice Committees is responsible for participating in reviewing the constitutionality, legality, and consistency of the legal system in draft laws, ordinances, and resolutions before they are submitted to the National Assembly and the National Assembly's Standing Committee.

4. Organizing the implementation of the guidance, coordination, and cooperation of the National Assembly's Standing Committee regarding the activities of the Council and Committees; preparing opinions on the contents in the agenda of the National Assembly's Standing Committee meeting when invited to attend; participating in the activities of other Councils and Committees and related agencies and organizations.

5. Organizing inspection delegations and working groups of the Council and Committees.

6. Deciding on the establishment of permanent subcommittees or specific ones for each task or project to study and prepare advisory content on issues within the jurisdiction of the Council and Committees. The head of the subcommittee must be a member of the Council and Committees, other members do not necessarily have to be members of the Council and Committees or National Assembly deputies.

7. Receiving and processing complaints, denunciations, and reflections from citizens sent to the National Assembly's Ethnic Council and Committees.

8. Directly directing the professional work of the specialized department.

9. Regularly reporting to the Council and Committees on the activities of the Standing Committee of the Council and the Standing Committee of the Committees.

10. Cooperating with the Standing Committee of the Deputies' Work Committee in personnel work and ensuring the regime and policies for National Assembly deputies who are members of the Standing Committee of the National Assembly's Ethnic Council and the Standing Committee of the National Assembly's Committees. Before the end of the term, proposing the structure and number of members for the next term's Council and Committees and reporting to the National Assembly's Standing Committee.

11. Cooperating with the Secretary-General of the National Assembly - the Head of the National Assembly Office in advising and serving National Assembly sessions and National Assembly's Standing Committee meetings.

12. Handling urgent matters of the Council and Committees and reporting to the Council and Committees at the nearest session.

Article 16. Duties and powers of the Standing Committee of the National Assembly's Ethnic Council and the Standing Committees of the National Assembly's Committees in assisting the National Assembly and the National Assembly's Standing Committee as assigned

In addition to the duties and powers stipulated in Article 15 of this Resolution, the Standing Committee of the National Assembly's Ethnic Council and the Standing Committees of the National Assembly's Committees shall perform the following duties and powers as assigned by the National Assembly's Standing Committee, the Chairman, and Vice Chairmen of the National Assembly:

1. The Standing Committee of the Legal Affairs and Justice Committee shall be responsible for advising and assisting the National Assembly's Standing Committee in drafting the Legislative Orientation for the term of the National Assembly, issuing and adjusting plans to implement the Legislative Orientation for the term of the National Assembly, deciding, adjusting, and organizing the implementation of the annual legislative program of the National Assembly;

2. The Standing Committee of the National Defense, Security, and Foreign Affairs Committee shall be responsible for advising and assisting the Chairman of the National Assembly and the National Assembly's Standing Committee in performing the tasks of representing the National Assembly of Vietnam in participating in foreign activities with parliaments of other countries; coordinating the activities of the National Assembly of Vietnam within various frameworks and mechanisms of inter-parliamentary cooperation;

3. The Standing Committee of the Deputies' Work Committee shall be responsible for advising and assisting the National Assembly's Standing Committee in performing the following tasks:

a) Ensuring files and organizing procedures and processes for the National Assembly to elect, remove from office, dismiss, approve nominations for appointment, removal from office, dismissal, and other procedures related to personnel work involving individuals holding positions within state agencies under the authority to examine and decide on by the National Assembly;

b) Taking the lead and coordinating with the Chairman of the National Assembly's Ethnic Council and the Heads of the National Assembly's Committees in submitting to the National Assembly's Standing Committee for decision on the number, approval of lists, and termination of duties for Deputy Chairpersons of the Councils, Deputy Heads of Committees, Members who are full-time National Assembly deputies working at the Councils and Committees, and Members who are part-time National Assembly deputies working at the Councils and Committees;

Ensuring files and organizing procedures and processes for submission to the National Assembly's Standing Committee for examination and decision on approving, appointing, dismissing, and terminating duties for other positions under the authority of the National Assembly's Standing Committee;

c) Implementing personnel management work for full-time National Assembly deputies, the performance of deputy duties, benefits, policies, and other guarantee conditions for National Assembly deputies; ensuring the exercise of immunity rights of National Assembly deputies, temporary suspension, termination of deputy duties, rewards, disciplinary actions, and other personnel-related procedures concerning National Assembly deputies;

d) Taking the lead in advising and assisting the National Assembly's Standing Committee in exercising powers as prescribed by laws on elections, guiding election work, supervising the election of National Assembly deputies and People's Council deputies;

đ) Taking the lead in advising and implementing supervision and guidance on the operation of People's Councils;

e) Organizing training and capacity building for National Assembly deputies; enhancing knowledge and skills for the operation of People's Council deputies. Advising and assisting the National Assembly's Standing Committee in organizing meetings to exchange experiences in the operation of People's Councils and Standing Committees of People's Councils;

g) Implementing procedures and ensuring benefits for full-time National Assembly deputies at the central level and cadres under the management authority of the National Assembly's Standing Committee who have retired or transferred jobs;

4. The Standing Committee of the Petitions and Oversight Committee shall be responsible for advising and assisting the National Assembly's Standing Committee in performing the following tasks:

a) Taking the lead in drafting the annual oversight program of the National Assembly and the National Assembly's Standing Committee, planning the implementation of the annual oversight program of the National Assembly and the National Assembly's Standing Committee, and coordinating oversight activities of the National Assembly's agencies;

b) Taking the lead and coordinating with the Standing Committee of the National Assembly's Ethnic Council, other Standing Committees of the National Assembly, Delegations of National Assembly deputies, and National Assembly deputies in proposing content and organizing question-and-answer sessions during National Assembly sessions and meetings of the National Assembly's Standing Committee; monitoring, urging, and summarizing written responses to questions from those being questioned;

c) Receiving, processing complaints, petitions, suggestions, and reflections sent to the National Assembly and the National Assembly's Standing Committee by citizens; organizing the reception of citizens by the National Assembly and its agencies, and representatives of the National Assembly's agencies regularly receiving citizens at the central reception center and the reception locations of the National Assembly;

d) Summarizing, categorizing, and transferring citizen suggestions received through the activities of National Assembly deputies' meetings with voters and supervising the resolution and response to citizen suggestions by competent state agencies, the adoption of citizen suggestions and public opinions into draft laws, ordinances, and resolutions;

đ) Taking the lead in advising on organizing referendums according to decisions of the National Assembly;

e) Summarizing the results of oversight activities and petition work of the National Assembly's Ethnic Council, National Assembly's Committees, Delegations of National Assembly deputies, and National Assembly deputies, periodically reporting to the National Assembly and the National Assembly's Standing Committee as prescribed;

Chapter IV
CHAIRMAN OF THE NATIONAL ASSEMBLY'S ETHNIC COUNCIL, HEADS OF NATIONAL ASSEMBLY'S COMMITTEES AND OTHER MEMBERS OF THE NATIONAL ASSEMBLY'S ETHNIC COUNCIL AND NATIONAL ASSEMBLY'S COMMITTEES

Article 17. Chairman of the National Assembly's Ethnic Council, Head of the National Assembly's Committee

1. The Chairman of the National Assembly's Ethnic Council, Head of the National Assembly's Committee shall be responsible for managing the work of the Ethnic Council, the Committee, the Standing Committee of the Council, and the Standing Committee of the Committee; convening and chairing sessions of the Council, the Committee, the Standing Committee of the Council, and the Standing Committee of the Committee, and performing the following tasks and powers:

a) Coordinating with the Standing Committee of the Representative Work Committee to propose to the National Assembly's Standing Committee to decide on the number, approve the list, and terminate the positions of Vice Chairmen and Members who are full-time National Assembly representatives working at the Ethnic Council and Members who are part-time National Assembly representatives working at the Ethnic Council; Deputy Heads and Members who are full-time National Assembly representatives working at the Committee and Members who are part-time National Assembly representatives working at the Committee;

b) Maintaining regular contact with members of the Council and the Committee;

c) Participating in sessions of the National Assembly's Standing Committee; the Chairman of the Ethnic Council may be invited to participate in Government sessions discussing the implementation of ethnic policies;

d) Representing the Council and the Committee in maintaining contact with relevant agencies and organizations;

đ) Directly guiding the activities of the specialized department of the Council and the Committee;

e) Deciding on the recruitment, transfer, assignment, rotation, training, development, planning, evaluation, classification, commendation, reward, discipline of civil servants; appointing, reappointing, removing, dismissing, accepting resignation, terminating leadership and management positions of Department Heads, Deputy Department Heads, and equivalent positions in the specialized department; temporarily suspending the work of the Head of the specialized department under direct jurisdiction;

g) Deciding on the use of funds to serve the activities of the Council and the Committee;

h) Cooperating with the Secretary-General of the National Assembly - Head of the National Assembly's Office in implementing the system and policies for civil servants of the specialized department of the Council and the Committee; organizing administrative, archival, security, and reception services to support the activities of the Council and the Committee; managing funds and assets; ensuring material infrastructure and other conditions necessary for the activities of the Council and the Committee;

i) Performing other tasks and powers assigned by the National Assembly's Standing Committee.

2. The Chairman of the National Assembly's Ethnic Council, Head of the National Assembly's Committee shall organize collective discussions with Vice Chairmen of the Council and Deputy Heads of the Committee regarding the implementation of tasks specified in points e, g, and h of Clause 1 of this Article before making decisions and shall be responsible for their decisions.

Article 18. Vice Chairman of the National Assembly's Ethnic Council, Deputy Head of the National Assembly's Committee

The Vice Chairman of the National Assembly's Ethnic Council, Deputy Head of the National Assembly's Committee shall have the following tasks and powers:

1. Assisting the Chairman of the Council, Head of the Committee in managing the work of the Council, the Committee, the Standing Committee of the Council, and the Standing Committee of the Committee according to the division of labor by the Chairman and the Head; participating in the implementation of the tasks and powers of the Standing Committee of the Council and the Standing Committee of the Committee; participating in collective discussions on the implementation of tasks as stipulated in Clause 2 of Article 17 of this Resolution; directly guiding the professional work of the specialized department on matters within the scope of their division of labor; researching and proposing to the Chairman of the Council, the Head of the Committee, and the Standing Committee of the Council and the Standing Committee of the Committee on issues within the scope of their division of labor and issues within the field of responsibility of the Council and the Committee;

2. Being authorized by the Chairman of the Council, the Head of the Committee to perform the tasks and powers of the Chairman of the National Assembly's Ethnic Council, Head of the National Assembly's Committee when the Chairman of the National Assembly's Ethnic Council, Head of the National Assembly's Committee is absent;

3. Performing other tasks and powers according to the division of labor by the Standing Committee of the Council, the Standing Committee of the Committee, the Chairman of the Council, and the Head of the Committee.

Article 19. Members who are National Assembly deputies working on a full-time basis at the Ethnic Council and Committees of the National Assembly

Members who are National Assembly deputies working on a full-time basis at the Ethnic Council and Committees of the National Assembly shall perform the following tasks and powers:

1. Participate in and carry out the tasks and powers of the Standing Body of the Council, the Standing Body of the Committee, and the tasks and powers prescribed in Article 20 of this Resolution;

2. Directly study, draft, and participate in directing the specialized department to research and prepare opinions on draft laws, ordinances, resolutions, and other contents within their assigned scope for reporting to the Council, Committee, Standing Body of the Council, and Standing Body of the Committee;

3. Perform other tasks and powers according to the assignment of the Standing Body of the Council, Standing Body of the Committee, Chairperson of the Council, Head of the Committee, or Deputy Chairperson of the Council, Deputy Head of the Committee.

Article 20. Members who are National Assembly deputies working concurrently at the Ethnic Council and Committees of the National Assembly

Members who are National Assembly deputies working concurrently at the Ethnic Council and Committees of the National Assembly shall perform the following tasks and powers:

1. Proactively study and propose to the Chairperson of the Council, Head of the Committee, Standing Body of the Council, and Standing Body of the Committee on issues within the tasks and powers of the Council and Committee;

2. Fully participate in the activities of the Council and Committee when requested; coordinate and support the Standing Body of the Council and Standing Body of the Committee in implementing activities at the local level, workplace, and as a representative; provide information on the economic and social situation in the locality and field of work to contribute to enhancing the effectiveness of the Council and Committee's operations;

3. Performing other tasks and powers according to the division of labor by the Standing Committee of the Council, the Standing Committee of the Committee, the Chairman of the Council, and the Head of the Committee.

Article 21. Suspension of duties and removal from office for Vice-Chairpersons of the Ethnic Council and Deputy Heads of Committees of the National Assembly and Members who are National Assembly deputies working on a full-time basis at the Ethnic Council and Committees of the National Assembly

1. The Chairman of the National Assembly decides to suspend duties for Vice-Chairpersons of the Ethnic Council and Deputy Heads of Committees of the National Assembly; the Chairperson of the Ethnic Council and the Head of the Committee decide to suspend duties for Members who are National Assembly deputies working on a full-time basis at the Council and Committee in cases as prescribed by the competent authority.

2. The Standing Committee of the National Assembly decides to remove from office Vice-Chairpersons of the Ethnic Council and Deputy Heads of Committees of the National Assembly, Members who are National Assembly deputies working on a full-time basis at the Council and Committee in the following cases:

a) Being transferred or rotated to another agency, organization, or unit, or being assigned or reassigned to another job;

b) Belonging to a case where they cannot hold a related position after being transferred or rotated to another agency, organization, or unit, or being assigned or reassigned to another job as prescribed by law or by the competent authority;

c) Due to health reasons or other reasons that prevent them from continuing to perform their duties.

Chapter V
SPECIALIZED DEPARTMENTS AND THE ENSURING OF CONDITIONS FOR OPERATIONS

 OF THE ETHNIC COUNCIL AND COMMITTEES OF THE NATIONAL ASSEMBLY

Article 22. Specialized Departments of the Ethnic Council and Committees of the National Assembly

1. The specialized departments include:

a) Department of Ethnic Affairs under the Ethnic Council;

b) Department of Law and Justice under the Committee for Law and Justice;

c) Department of Economy and Finance under the Committee for Economy and Finance;

d) Department of Defense, Security, and Foreign Relations under the Committee for Defense, Security, and Foreign Relations;

đ) Department of Culture and Social Affairs under the Committee for Culture and Social Affairs;

e) Department of Science, Technology, and Environment under the Committee for Science, Technology, and Environment;

g) Department of Representative Work under the Committee for Representative Work;

h) Department of Petitions and Oversight under the Committee for Petitions and Oversight.

2. The specialized departments shall comply with the leadership and direct guidance of the Chairperson of the Council, Head of the Committee, Deputy Chairperson of the Council, Deputy Head of the Committee, and Members who are National Assembly deputies working on a full-time basis at the Council and Committee.

Article 23. Organizational Structure of the Professional Department

1. The Professional Department consists of a Director, Deputy Directors, and civil servants.

2. The Professional Department operates under the head system combined with the specialist system.

3. The number of Deputy Directors of the Professional Department shall be considered and decided by the Standing Committee of the National Assembly upon the proposal of the Chairman of the National Ethnic Council and the Head of the National Assembly's Committee.

Article 24. Duties and Authorities of the Professional Department

1. To study, advise, and organize support for the National Ethnic Council and the National Assembly's Committee to perform their tasks and authorities as stipulated in Chapter II of this Resolution.

2. To study, advise, and organize support for the Standing Body of the Council and the Standing Body of the Committee to perform their tasks and authorities as stipulated in Chapter III of this Resolution.

3. To study, advise, and organize support for the Chairman of the Council, the Head of the Committee, and other members of the Council and the Committee to perform their tasks and authorities as stipulated in Chapter IV of this Resolution.

4. In addition to the duties and authorities specified in Clauses 1, 2, and 3 of this Article, the Professional Department shall perform the following duties and authorities:

a) To monitor, compile, evaluate the implementation of assigned tasks, report periodically on a weekly and monthly basis to the Chairman of the Council, the Head of the Committee, the Standing Body of the Council, and the Standing Body of the Committee according to the Working Regulations of the Council and the Committee and relevant regulations;

b) To coordinate with related units of the National Assembly Office in receiving, processing, issuing, updating, utilizing, and managing documents, information, and databases on the National Assembly's Electronic Information Portal, the internal information system of the National Assembly; storing documents, materials, publications for management and utilization purposes; managing files, documents, and archiving according to the law;

c) To coordinate with related units of the National Assembly Office in implementing policies and procedures for cadres and civil servants, performing personnel-related business operations, managing and utilizing the files and resumes of civil servants of the Professional Department of the Council and the Committee according to the law;

d) To coordinate with related units of the National Assembly Office in preparing budget estimates, executing payment procedures, and finalizing accounts for funds serving the activities of the Council and the Committee according to the law; implementing activities using funds according to the directives of the Standing Body of the Council, the Standing Body of the Committee, the Chairman of the Council, and the Head of the Committee according to the law; reporting on budget preparation and fund usage to the Chairman of the Council and the Head of the Committee;

đ) To coordinate with related units of the National Assembly Office in managing and utilizing assets allocated for the activities of the Council and the Committee, the Standing Body of the Council, the Standing Body of the Committee, and the Professional Department of the Council and the Committee;

e) To coordinate with other Professional Departments of the Council and the Committee, the National Assembly Office in advising and organizing support for joint activities of the National Assembly, the Standing Committee of the National Assembly, the National Ethnic Council, the National Assembly's Committee, the Standing Body of the Council, the Standing Body of the Committee, the Secretary-General of the National Assembly - Head of the National Assembly Office;

g) Other duties and authorities assigned by the Chairman of the National Ethnic Council, the Head of the National Assembly's Committee, the Vice-Chairman of the Council, the Deputy Head of the Committee, the Standing Body of the Council, the Standing Body of the Committee.

Article 25. Responsibilities of the National Assembly Office in Ensuring Conditions for the Operation of the National Ethnic Council and Committees of the National Assembly

1. The National Assembly Office shall be responsible for ensuring conditions for the operation of the National Ethnic Council and Committees of the National Assembly and shall have the following tasks and powers:

a) Organizing administrative work, management, reception, international cooperation, information, digital transformation, and other conditions to serve the operations of the National Ethnic Council, Committees of the National Assembly, Standing Committees of the Council, Standing Committees of the Committees, and specialized departments of the Council and Committees;

b) Performing budgetary unit tasks for state funds allocated to the National Ethnic Council and Committees of the National Assembly; implementing financial management procedures for funds allocated to the National Ethnic Council and Committees of the National Assembly within the operational budget of the National Assembly; implementing asset management procedures for assets provided to the National Ethnic Council, Committees of the National Assembly, Standing Committees of the Council, Standing Committees of the Committees, and specialized departments according to the provisions of the law;

c) Coordinating with the Chairman of the National Ethnic Council and the Chairperson of the Committees of the National Assembly to organize the implementation of regulations and policies for civil servants, and performing personnel management procedures for civil servants of specialized departments of the Council and Committees;

d) Ensuring material infrastructure and other conditions for the operations of the National Ethnic Council, Committees of the National Assembly, Standing Committees of the Council, Standing Committees of the Committees, and specialized departments of the Council and Committees.

2. The National Assembly Office shall take the lead and coordinate with the Standing Committee of the National Ethnic Council and the Standing Committees of the Committees of the National Assembly to draft and submit to the Standing Committee of the National Assembly for promulgation regulations on managing civil servants at specialized departments of the Council and Committees and on ensuring conditions for the operations of the National Ethnic Council and Committees of the National Assembly.

Chapter VI
IMPLEMENTING PROVISIONS

Article 26. Implementation Provisions

1. This Resolution shall take effect from February 18, 2025.

2. The Representative Work Committee and the Social Affairs Committee under the Standing Committee of the National Assembly shall cease operations from the date this Resolution takes effect.

3. The Resolution No. 1156/2016/UBTVQH13 dated March 17, 2016 of the Standing Committee of the National Assembly on the functions, tasks, powers, and organizational structure of the Social Affairs Committee and the Resolution No. 21/2022/UBTVQH15 dated July 11, 2022 of the Standing Committee of the National Assembly on the position, functions, tasks, powers, and organizational structure of the Representative Work Committee shall become invalid from the date this Resolution takes effect.

4. The National Ethnic Council and Committees of the National Assembly, based on this Resolution, the Model Rules of Procedure of the National Ethnic Council and Committees of the National Assembly issued by the Standing Committee of the National Assembly, and other relevant legal provisions, shall develop appropriate Rules of Procedure in accordance with their specific tasks, powers, characteristics, and circumstances.
