Pursuant to Decision No. 22/TTg dated January 11, 1997 of the Prime Minister approving the Feasibility Study Project of the Forestry Area and Management of Upstream Protective Forests in Thanh Hoa, Quang Tri, Phu Yen, and Gia Lai provinces; Pursuant to Decision No. 112/2001/QĐ-BTC dated November 9, 2001 of the Ministry of Finance promulgating expenditure standards applicable to projects using ODA loan funds;A At the proposal of the Director of the Department of Finance and Accounting,

Pursuant to Decision No. 22/TTg dated January 11, 1997 of the Prime Minister approving the Preliminary Feasibility Study Project of the Forestry Area and Management of Upstream Protective Forests;

The Ministry of Agriculture and Rural Development stipulates the following expenditure standards for the Project of the Forestry Area and Management of Upstream Protective Forests: A A. SALARY AND ALLOWANCE REGIME

I. CENTRAL AND PROVINCIAL PROJECT MANAGEMENT BOARDS 1. Salary and insurance regime: This Decision takes effect from the date of signature. All previous documents contrary to this Decision shall be abolished.

1.1. For civil servants within the administrative establishment of state agencies who are transferred to work long-term at the project management board shall continue to receive their original salary (as before transferring to the project) according to Decree No. 25/CP dated May 23, 1998 of the Government on temporary regulations on the new salary system for civil servants, administrative officials, and armed forces personnel. 1.2. For part-time or temporarily assigned staff working for the project shall receive their salary paid by the dispatching agency.

In case the former agency does not pay the salary to part-time or temporarily assigned staff, the project management board will pay the salary according to the current state regulations. 1.3. Wages of hired labor under the employment contract of the project management board (applicable to contracts lasting 12 months or more).

For hired labor performing project-specific tasks, wages shall be paid in accordance with the principle that they are equivalent to the wages of state employees trained and having the same level of expertise and job responsibilities, based on the rank coefficient prescribed in Decree No. 25/CP and accompanying guidance documents. 1.4. Non-state employees selected and agreed upon by the Central Project Director and Provincial Project Director to be hired as contractual workers shall have their wages paid according to the terms of their employment contracts for specific tasks, as follows:

Administrative staff: VND 410,000 per person per month (22 working days/40 hours per week). Drivers: VND 460,000 per person per month (22 working days/40 hours per week).

Technical specialists: VND 900,000 per person per month (22 working days/40 hours per week).

 

(The above individuals are not entitled to project salary allowances, nor will the project contribute to social insurance, health insurance, union fees, etc.).

The number of state employees in full-time positions, part-time positions, temporarily assigned positions, and contractual workers must comply with the provisions in the project documentation, and any additional hires must be approved by ADB and the Ministry of Agriculture and Rural Development.

1.5. Social insurance and health insurance for state employees, civil servants, and hired labor under long-term employment contracts shall be applied according to current regulations.

2. Project Allowance Regime: 2.1. The target group includes state employees who are transferred, temporarily assigned to participate in management throughout the project period as mentioned in points 1.2 and 1.3 (excluding foreign experts hired and workers under point 1.4) shall receive project salary allowances. 2.2. For employees with contractual positions involving project-specific expertise, their wages shall be equivalent to those of civil servants trained and possessing the corresponding level of expertise and job responsibilities, based on the rank coefficient stipulated in Decree No. 25/CP and accompanying guiding documents. at present, according to the scale factor specified in Decree No. 25/CP and the accompanying guiding documents.

1.4. Individuals not included in the state's permanent staff, selected and agreed upon by the Central Project Management Board Director and the Provincial Project Management Board Director, shall be paid wages for work performed through time-limited labor contracts, with the following wage rates:

The number of staff within the permanent establishment, including full-time, part-time, seconded, and contractual employees, must comply with the project documentation. Any additional personnel beyond the documentation must be approved by ADB and the Ministryof Agriculture and Rural Development.

1.5. Social insurance and health insurance benefits for staff hired under long-term contract terms shall be applied according to current regulations.

2. Project Allowances:

2.1. Staff members from the state's permanent establishment who are transferred, seconded to participate in management throughout the project period as mentioned in Sections 1.1 , 1.2 and 1.3 (excluding foreign experts and employees under Section 1.4) shall be entitled to project allowances.

Directors of central and provincial projects: Shall be entitled to allowances up to 100% of the basic salary (as defined in Decree No. 25/CP dated May 23, 1993), depending on the extent of兼任或专职的程度。

II. COUNTY AND COMMUNE PROJECT MANAGEMENT BOARDS

1. County Project Management Board.

The Director and Deputy Director of the project working on a part-time basis shall not receive wages but only allowances from the project's budget.

Staff working full-time at the project, with transfer or recruitment decisions made by the competent authority, and long-term contractual staff shall receive wages (based on the scale factor stipulated in Decree No. 25/CP) and project allowances.

The allowance level for staff under the County Management Board shall range from 40% to 60% of the basic wage, decided by the Provincial Project Management Board Director.

The number of members receiving wages and project allowances shall comply with Document No. 2452/BNN-TCCB but shall not exceed 8 people per County Project Management Board.

2.Organizations and individuals wishing to publish and disseminate works abroad shall comply with the provisions of Government Decree No. 72/2000/NĐ-CP dated December 5, 2000 on publishing and disseminating works abroad. implementation of commune sub-projects.

Members of the Teamimplementing commune sub-projects shall only receive allowances as follows:

Credit organizations on leader up to 120,000 VND/month.

B. EXPENSES FOR ORGANIZING MEETINGS, SEMINARS, TRAININGS, AND CONCENTRATED TRAININGS WITHIN THE COUNTRY

Based on Circular No. 78/2001/TT-BTC dated September 28, 2001, issued by the Ministry of Finance, the project may pay allowances to participants attending domestic training sessions, seminars, and conferences listed in the annual plan approved by the project (excluding regular meetings).

Items subject to expenditure: a) Meal and incidental expenses allowance: For training classes, seminars, and conferences held in Vietnam, the maximum is as follows:

Central level: 80,000 VND/person/day.

Provincial level: 60,000 VND/person/day.

District level: 40,000 VND/person/day.

Commune level: 20,000 VND/person/day.

Conferences and seminars organized by the Project Management Board will cover 100% of meal and incidental expenses allowances for all organizing staff, attendees, and lecturers from the project's funds.

The conference and seminar organizing body must clearly inform the attendees about the benefits they are entitled to in the invitation letter.

b) Travel and accommodation expenses: Follow Section C - Travel Expenses Regulations.

c) Office supplies expenses:

Central level: Not exceeding 40,000 VND/person/class. Provincial level: Not exceeding 30,000 VND/person/class.

District level: Not exceeding 20,000 VND/person/class.

Commune level: Not exceeding 10,000 VND/person/class.

d) Printing costs: Reimbursed based on actual reasonable expenses but not exceeding the approved budget.

e) Lecturer fees:

Lecturer fees shall be determined by the Project Director based on factors such as lecturer qualifications, lecture content, and location, but shall not exceed the following ceiling:

Lecturers who are professors, associate professors, senior officials at the Ministerial level, Deputy Ministers, Heads, Deputy Heads of Central Ministries, Secretaries, Deputy Secretaries, Chairpersons, Deputy Chairpersons of provinces and centrally-administered cities, and equivalent positions: 100,000 VND/hour.

For other lecturers:

Central level: Maximum 80,000 VND/hour.

Provincial level: Maximum 60,000 VND/hour. District level: Maximum 30,000 VND/hour.

Commune level: Maximum 20,000 VND/hour.

(The above ceiling includes both lecturer fees and preparation costs.)

When traveling, lecturers shall be reimbursed travel expenses according to Section C - Travel Expenses Regulations.

f) Interpreting fees (if applicable): As specified in Section D.

g) Hall rental fees:

Based on actual reasonable expenses but not exceeding the following maximum:

Central level: 1,000,000 VND/day. Provincial level: Not exceeding 30,000 VND/person/class.

Provincial level: 500,000 VND/day.

District and Commune level: 300,000 VND/day.

h) Water expenses:

Reimbursed based on actual expenses but not exceeding the following:

Central and Provincial level: 15,000 VND/person/day.

District and Commune level: 10,000 VND/person/day.

C. TRAVEL EXPENSES AND FIELD WORK ALLOWANCES

Transportation expenses: Uniformly applied according to Circular No. 94/1998/TT-BTC dated June 30, 1999, issued by the Ministry of Finance, which stipulates travel expense regulations for state officials on business trips.

In special cases where air travel is required, the Project Management Board Director may approve project guest staff to travel using project funds.

On routes without public transportation, staff must travel by personal vehicle or rented motorcycle, and reimbursement shall be based on guidelines issued by the Department of Transport and the Department of Finance and Price Control of each locality.

Regular fieldwork travel expenses: Applied to project staff who frequently travel and conduct transactions with related agencies (treasury, bureau, department, institute, office, ministry, etc.) and shall be reimbursed a maximum travel expense allowance of 100,000 VND/person/month.

Project management board staff shall not regularly travel by taxi on routes with public transportation available. 2. Travel expense allowances and field work allowances.

Traveling outside the province to plains and midland provinces entitles staff to a daily allowance of 30,000 VND/person/day.

Traveling outside the province to mountainous, island, border, and remote areas entitles staff to a daily allowance of 50,000 VND/person/day. Traveling within the province to project sites (at least 20 km away) entitles staff to a daily field work allowance of 40,000 VND/person/day.Those receiving field work allowances shall not be reimbursed travel expense allowances according to the national regulations. 3. Renting accommodation expenses at the destination:

Project management board staff traveling on business shall be reimbursed accommodation expenses at the place of work. The accommodation rental fee shall be reimbursed based on actual invoices but shall not exceed the following:

a) In centrally-administered cities: 110,000 VND/day/person. b) In other provinces and cities: 70,000 VND/day/person.

In cases where project management board staff travel alone

Traveling to other provinces in plains and midlands areas entitles one to a daily allowance of VND 30,000/person/day.

Traveling to other provinces in mountainous, island, border, and remote areas entitles one to a daily allowance of VND 50,000/person/day.

Traveling within the province to the project site (a minimum distance of 20 km or more) entitles one to a field allowance of VND 40,000/person/day.

Those receiving field allowances are not eligible for travel expense subsidies according to state regulations.

3. Payment for accommodation expenses at the place of assignment:

Project management board staff traveling on business shall be reimbursed for accommodation expenses at the place of assignment. The reimbursement for room rental expenses shall be based on actual invoices but shall not exceed the following amounts:

a) In centrally administered cities: VND 110,000/person/day.

b) In other provinces and cities: VND 70,000/person/day.

When project management board staff travel alone or in cases where the work team has an odd number of individuals of different genders and must rent separate rooms, the payment level shall not exceed the following rates:

c) In centrally-administered cities: 180,000 dong/day/person.

d) In the remaining provinces and cities: 110,000 dong/day/person.

e) In cases where officials on business trips must stay in rural areas without hotels or guesthouses, they will be reimbursed at a fixed rate of 30,000 dong/person/day, but this requires confirmation from the local authority or government office where the work is being conducted.

All the above travel expense allowances shall not exceed the total amount approved by the Ministry of Agriculture and Rural Development according to the plan for each year or project period.

D. EXPENSES FOR TRANSLATION SERVICES

1. Oral Translation:

Ordinary oral translation: not exceeding 70,000 dong/hour, equivalent to no more than 560,000 dong/day/person working 8 hours. The rental period shall not exceed 10 days per month.

Rush oral translation: not exceeding 150,000 dong/hour, equivalent to no more than 1,200,000 dong/day/person working 8 hours. The rental period shall not exceed 10 days/month.

If fieldwork is involved, additional travel expenses will be calculated according to the project's regulations.

2. Expenses for Written Translation Services.

2.1. Translation from foreign languages into Vietnamese:

Maximum: 35,000 dong/page of 300 words.

2.2. Translation from Vietnamese into foreign languages:

Maximum: 40,000 dong/page of 300 words.

The standards set forth in points 1 and 2 of Part D shall only apply when it is necessary for the Management Board to hire external services, and shall not apply to interpreters or translators who are staff members of the Management Board.

E. EXPENSES FOR OVERSEAS STUDY AND RESEARCH TRIPS

Participants and invited guests shall enjoy the following benefits:

Meals: 80,000 dong/person/day.

Accommodation: paid according to point 3 of Part C. Provincial level: Not exceeding 30,000 VND/person/class.

Travel expenses according to point 1 of Part C.- Travel allowance or car rental: paid under a lump-sum contract.

(The study tour program must be included in the pre-approved plan).

F. EXPENSES FOR RESEARCH, TRAINING, AND SURVEY ABROAD

All overseas research, survey, and training programs must be approved in advance by the leadership of the Ministry of Agriculture and Rural Development:

1. Training Program Costs: Any training fees (if applicable) must be submitted for approval by the Ministry of Agriculture and Rural Development.

2. Allowances:

Daily living allowances, meal expenses, accommodation, travel expenses, etc., shall be implemented according to Circular No. 45/1999/TT-BTC dated May 4, 1999, and Circular No. 108/1999/TT-BTC dated September 4, 1999, issued by the Ministry of Finance regarding travel allowances for officials and civil servants on short-term overseas assignments.

3. Settlement of Accounts for Overseas Delegations: Delegations for overseas study tours and training must complete settlement with the Project Office within 15 days upon return, to settle accounts with the supervising ministry and the Ministry of Finance. Special cases will be settled with ADB.

G. EXPENSES FOR THE OPERATIONAL COSTS OF THE MANAGEMENT BOARD AT THE COUNTY LEVEL AND IMPLEMENTATION GROUPS AT THE COMMUNE LEVEL

For counties and communes that have feasibility studies or development plans for small projects approved by competent authorities, operational costs are calculated as follows:

1. County Project Management Board:

Travel allowances for county project management boards are applied according to the standards set out in point C.

Travel allowances, but the monthly expenditure on travel allowances shall not exceed 20 days/month/Board.

Other expenses: stationery, office equipment purchases, fuel, etc., according to the annual approved budget plan, with a maximum allocation of no more than 2,000,000 dong/month/Board.

Operational costs for the management board and implementation groups shall not exceed a maximum of 500,000 dong/group/month.

2.Organizations and individuals wishing to publish and disseminate works abroad shall comply with the provisions of Government Decree No. 72/2000/NĐ-CP dated December 5, 2000 on publishing and disseminating works abroad. implementation of commune sub-projects.

All expenditures of the county project management board and implementation groups must be supported by full documentation as required by the state.

The operational costs of the county project management board and implementation groups are included in the annual budget estimate of the provincial project management board approved by the Ministry of Agriculture and Rural Development.

For any costs incurred prior to the issuance of this guidance, the project shall be reimbursed according to Decision No. 112/2001/QĐ-BTC dated November 9, 2001 issued by the Ministry Ministry of Finance.

During implementation, if there are any issues, they should be reported to the National Project Management Board for timely resolution./.
