Pursuant to the Law on Organization of the Government dated June 19, 2015; the Law Amending and Supplementing Certain Provisions of the Law on Organization of the Government and the Law on Organization of Local Administration dated November 22, 2019;
Pursuant to Ordinance 2020/UBTVQH14 on Preferential Treatment for Persons Who Have Rendered Meritorious Service to the Revolution dated December 9, 2020;
Decree No. 07/2021/NĐ-CP
The Government promulgates this Decree stipulating the levels of allowances, subsidies, and preferential benefits for persons who have rendered meritorious service to the revolution.
PART I
GENERAL PROVISIONS
This Decree stipulates the levels of allowances, subsidies, and preferential benefits for persons who have rendered meritorious service to the revolution and their dependents, provided from the central budget, implementing the Ordinance on Preferential Treatment for Persons Who Have Rendered Meritorious Service to the Revolution, allocated in the annual regular state budget of the Ministry of Labor, Invalids, and Social Affairs.
Article 2. Applicability
The subjects to which this Decree applies are as prescribed in Article 2 of Ordinance No. 02/2020/UBTVQH14 dated December 9, 2020 of the Standing Committee of the National Assembly of the Fourteenth Term on Preferential Treatment for Persons Who Have Rendered Meritorious Service to the Revolution.
Chapter II
LEVELS OF ALLOWANCES AND SUBSIDIES
1. The standard allowance level for persons who have rendered meritorious service to the revolution is 1,624,000 VND (hereinafter referred to as the standard level).
2. The standard level prescribed in Clause 1 of this Article serves as the basis for calculating the levels of allowances, subsidies, and preferential benefits for persons who have rendered meritorious service to the revolution and their dependents. The levels prescribed according to the standard in this Decree shall be adjusted when the standard level is adjusted.
1. The monthly levels of allowances and subsidies for persons who have rendered meritorious service to the revolution and their dependents are specified in Appendix I attached hereto.
2. The monthly levels of allowances for persons who have rendered meritorious service to the revolution and those treated as such are specified in Appendix II attached hereto.
3. The monthly levels of allowances for persons classified as Class B disabled veterans are specified in Appendix III attached hereto.
4. The one-time levels of allowances for persons who have rendered meritorious service to the revolution and their dependents are specified in Appendix IV attached hereto.
Chapter III
PREFERENTIAL BENEFITS FOR PERSONS WHO HAVE RENDERED MERITORIOUS SERVICE TO THE REVOLUTION
Article 5. Health Insurance
Implement health insurance contributions in accordance with the laws on health insurance for persons who have rendered meritorious service to the revolution, their dependents, and those serving them, as stipulated in the Ordinance on Preferential Treatment for Persons Who Have Rendered Meritorious Service to the Revolution.
1. Home-based rehabilitation and health recovery: The expenditure level is 0.9 times the standard level per person per occasion and is directly paid to the beneficiary.
2. Concentrated rehabilitation and health recovery: The expenditure level is 1.8 times the standard level per person per occasion. The contents of the expenditure include:
a) Food during the rehabilitation period;
b) Essential medicines;
c) Gifts for the beneficiary;
d) Other expenditures directly serving the beneficiary during the rehabilitation period (maximum expenditure level is 15% of the concentrated rehabilitation and health recovery expenditure level), including: face towels, soap, toothbrushes, toothpaste, sightseeing, photography, health counseling, functional recovery, books, cultural, artistic, and sports activities, and other expenditures serving the beneficiary during rehabilitation.
Article 7. Support for assistive devices, orthopedic equipment, and necessary rehabilitation facilities
Clause 1. The level of support for purchasing assistive devices, orthopedic equipment, and necessary rehabilitation facilities is specified in Appendix V attached to this Decree.
Clause 2. Financial support for travel and meals for beneficiaries when obtaining assistive devices, orthopedic equipment (once every fiscal year) or undergoing rehabilitation treatment as prescribed by provincial-level hospitals or higher. The support amount is 5,000 VND per 1 km per person based on the distance from their residence to the nearest medical facility qualified to provide orthopedic equipment, but not exceeding 1,400,000 VND per person per fiscal year.
Article 8. Educational benefits at educational institutions within the national education system up to university level
Clause 1. The level of scholarship for attending preschool education institutions: 0.2 times the standard rate per beneficiary per year.
Clause 2. The level of scholarship for attending general secondary schools, continuing education centers, preparatory universities, specialized schools, and classes for persons with disabilities: 0.4 times the standard rate per beneficiary per year.
Clause 3. The level of scholarship for attending boarding schools for ethnic minorities, vocational training institutions, and universities: 0.4 times the standard rate per beneficiary per year.
Article 9. Support for visiting烈士墓地
第1款 支持烈属或祭扫烈士每年一次的交通和伙食费用(最多3人)。
第2款 支持交通和伙食费用的计算方式为:从居住地到烈士墓地的距离,每公里每人3000元。
Article 10. Support for relocating remains of martyrs
Clause 1. The relatives of martyrs, those authorized by the relatives of martyrs, or those who worship martyrs will be supported financially once when relocating the remains of martyrs:
Subparagraph a. The level of support for exhuming the remains of martyrs is 4,000,000 VND per set of remains.
Subparagraph b. The level of support for travel and meals (maximum 3 people) based on the distance from their residence to the location of the martyr's grave: 3,000 VND per 1 km per person.
Clause 2. If the relatives of martyrs or those who worship martyrs do not wish to bury the remains of martyrs in a martyrs' cemetery, they will be supported financially once for building a martyr's grave. The level of support is 10 million VND per grave.
Article 11. Support for Martyr Graves Maintenance and Commemorative Projects
Clause 1. Support for constructing new graves for martyrs including memorial stones: maximum 10 million VND per grave (not linked to projects for building or upgrading cemeteries); support for renovating, upgrading, repairing graves for martyrs including memorial stones: maximum 70% of the construction cost.
Clause 2. Support for renovating, upgrading, repairing, and maintaining martyrs' cemeteries according to approved project plans or technical and economic reports by competent authorities.
Clause 3. Support for renovating, upgrading, repairing, and maintaining monuments, temples, and houses commemorating martyrs: the central budget supports a maximum of 15 billion VND for provincial-level projects; 10 billion VND for district-level projects; and 2 billion VND for commune-level projects, where the central government supports localities according to the principle:
Subparagraph a. No support from the central budget for localities that can balance their budgets independently.
Subparagraph b. Support up to 50% of the total value of the project approved by competent authorities for localities with a certain ratio of budget allocation to the central government.
Subparagraph c. Support up to 70% of the total value of the project approved by competent authorities for localities unable to balance their budgets independently; for mountainous provinces and the Central Highlands, support up to 100% of the total value of the project approved by competent authorities.
Article 12. Determining the identity of烈士遗骸
1. Sampling of烈士遗骸with incomplete information:
a) Excavation, exhumation, and reburial after sampling烈士遗骸, cost: 1,000,000 VND/per grave;
b) Renting screens and tarpaulins; purchasing sampling equipment, gloves, alcohol, spirits, materials, and other expenses: to be settled based on actual costs;
Organizations and units organizing the collection of烈士亲属biological samples shall implement expenditure items according to point b, Clause 1 of this Article; supporting individuals eligible for biological sample collection: support level 500,000 VND/per person.
a) Method: Ordering service;
b) Order price: The Minister of Finance shall promulgate the maximum unit price for DNA testing services of烈士遗骸and烈士亲属biological samples. Based on actual conditions, the Minister of Labor, Invalids, and Social Affairs shall determine the implementation price for ordering DNA testing services of烈士遗骸and烈士亲属biological samples, ensuring it does not exceed the maximum price set by the Minister of Finance;
c) Ordering plan: The Minister of Labor, Invalids, and Social Affairs shall approve the ordering plan for DNA testing services of烈士遗骸and烈士亲属biological samples in accordance with actual conditions.
5. Determining the identity of烈士遗骸with incomplete information using empirical methods: Cost 3,000,000 VND/per verified piece of information about烈士遗骸for organizations and individuals providing accurate information about烈士遗骸.
6. Completing烈士墓including the gravestone inscribed with the烈士name in the烈士cemetery after the completion of DNA testing:
a) Excavation, returning the sampled烈士遗骸with test results, and repairing the grave cover: cost 1,000,000 VND/per grave;
b) Renting screens, tarpaulins, and other expenses: to be settled based on actual costs.
8. Organizing the announcement ceremony of烈士遗骸identity results:
a) Organizing the announcement ceremony of烈士遗骸identity results: Content and cost according to current regulations on organizing conferences;
b) Supporting烈士亲属or family members of烈士to attend the DNA test result announcement ceremony: Subsidy for food, accommodation, and travel expenses according to current travel expense regulations (maximum subsidy for two people). In cases where烈士亲属attend from two DNA test results or more at the same announcement ceremony location, the subsidy will be calculated as attending one DNA test result announcement ceremony.
9. Database on烈士:
a) Building, purchasing, upgrading, integrating, operating, and maintaining a烈士database system,烈士graves,烈士cemeteries,烈士亲属,烈士DNA,烈士亲属DNA, synchronized nationwide: to be implemented according to projects approved by the Minister of Labor, Invalids, and Social Affairs;
b) Investigating, collecting, updating information, maintaining, and establishing a烈士database, developing a system for providing information on烈士,烈士亲属,烈士DNA,烈士亲属DNA,烈士graves, and烈士cemeteries.
10. Other tasks serving the work of determining the identity of烈士遗骸:
a) Purchasing specialized equipment, materials, and means to ensure the work of determining the identity of烈士遗骸;
b) Repairing, maintaining, and servicing equipment and means to serve the work of determining the identity of烈士遗骸;
c) Training and enhancing the professional skills of personnel engaged in the work of determining the identity of烈士遗骸;
d) Cooperation expenses with domestic and foreign organizations and individuals in technical support, experience, and resources for determining the identity of烈士遗骸;
đ) Other tasks to be settled based on actual costs according to current regulations.
Article 13. Other preferential regimes
1. Funeral allowance: the expenditure level as prescribed by the law on social insurance regarding funeral allowance.
2. Worship allowance for烈士: 1,400,000 VND/per烈士/per year.
3. Additional food expenses for holidays and Tet for war invalids, veterans, persons enjoying benefits equivalent to war invalids, and Class B war invalids with a disability rate of 81% or higher: The expenditure level is 200,000 VND/per person/per day; the number of days for additional food expenses is the holiday and Tet days as stipulated by the Labor Code, July 27 and December 22 each year.
4. Subjects who have made contributions to the revolution and are currently being cared for at care facilities under the Ministry of Labor, Invalids, and Social Affairs shall be supported with medicine, treatment, and health recovery services for the subjects:
b) Treatment support at medical facilities to cover costs for treatment, medication, chemicals, medical supplies, technical services, and other related costs not covered by the health insurance fund shall be reimbursed based on actual invoices and receipts.
8. Staff working at care facilities who serve contributors to the revolution during their treatment at medical facilities, disability assessment, and visits home shall be reimbursed travel expenses according to current regulations.
9. Support for welcoming relatives of contributors to the revolution visiting contributors to the revolution being cared for at care facilities (Maximum support: three people/per subject/per visit, two visits/per year, three days/per visit): Implemented according to the current domestic hospitality expense levels and ensuring legal invoices and receipts.
10. Support for material infrastructure serving the care, convalescence, and reception of contributors to the revolution:
b) Support for purchasing equipment, means, tools, and utensils up to a maximum of 15 million VND/per subject/year and not more than 1.5 billion VND/year for care facilities; up to a maximum of 25 million VND/per convalescence bed/year and not more than 2.5 billion VND for convalescent and reception facilities for contributors to the revolution.
a) Gifts from Party and State leaders, National Assembly, Chairman of the Central Committee of the Vietnam Fatherland Front:
b) Gifts from leaders of Ministries and central agencies:
Level of gifts for groups: Cash is 5,000,000 VND/group; tangible gifts are worth 500,000 VND/group.
Level of gifts for families and individuals: Cash is 500,000 VND/family or individual; tangible gifts are worth 150,000 VND/family or individual.
Level of gifts for groups: Cash is 3,000,000 VND/group; tangible gifts are worth 500,000 VND/group.
Level of gifts for families and individuals: Cash is 500,000 VND/family or individual; tangible gifts are worth 150,000 VND/family or individual.
12. Welcoming delegations of contributors to the revolution and relatives of contributors to the revolution organized by provincial People's Committees or Departments of Labor, Invalids, and Social Affairs to visit central agencies:
a) Organizing welcoming activities: Expenditure level is 150,000 VND/person (including staff accompanying the delegation and welcoming staff) to ensure memorial photo sessions, drinking water, fruits, fresh flowers, and other expenses;
b) Gifts for contributors to the revolution and relatives: Expenditure level is 500,000 VND/person;
c) In cases where meals are invited for close relations with the delegation of contributors to the revolution: implemented according to current domestic hospitality expense regulations.
Chapter IV
IMPLEMENTATION AND EFFECTIVE PROVISIONS
Article 14. Implementation Organization
1. The Ministry of Labor, Invalids, and Social Affairs shall take the lead and coordinate with the Ministry of Information and Communications and relevant ministries and agencies to organize propaganda on the work of contributors to the revolution.
2. The Ministry of Labor, Invalids, and Social Affairs shall take the lead and coordinate with the Ministry of Finance to guide the implementation of allowances, subsidies, and preferential regimes for contributors to the revolution to ensure correct recipients, full coverage, timely payment, and compliance with current regulations.
3. The Ministry of Labor, Invalids, and Social Affairs shall authorize the Departments of Labor, Invalids, and Social Affairs to implement the central budget tasks at the local level.
Article 15. Effective Date
1. This Decree takes effect from September 15, 2021.
2. The regimes stipulated in Articles 4, 5, and 12 of this Decree shall be implemented from July 1, 2021.
3. The provisions set forth in Articles 6, 7, 8, 9, 10, 11, and 13 of this Decree shall take effect from January 1, 2022.
The corresponding regimes stipulated in this clause currently implemented pursuant to Decree No. 58/2019/NĐ-CP dated July 1, 2019 of the Government on the levels of allowances and preferential subsidies for persons who have rendered meritorious service to the revolution, Decree No. 31/2013/NĐ-CP dated April 9, 2013 of the Government detailing and guiding the implementation of certain provisions of the Ordinance on Preferential Treatment for Persons Who Have Rendered Meritorious Service to the Revolution, and other documents shall continue to be implemented until December 31, 2021.
4. Decree No. 58/2019/NĐ-CP dated July 1, 2019 of the Government on the levels of allowances and preferential subsidies for persons who have rendered meritorious service to the revolution shall cease to be enforced from the date this Decree takes effect, except for the regimes provided for in Clause 3 of this Article.
5. Persons who were injured and fall under one of the cases prescribed in Article 23 of Resolution No. 02/2020/UBTVQH14 dated December 9, 2020 of the Standing Committee of the National Assembly on Preferential Treatment for Persons Who Have Rendered Meritorious Service to the Revolution, with a disability rate of 5% to 20%, shall be entitled to a one-time preferential allowance as prescribed in Appendix VI attached to this Decree.
Article 16. Responsibility for Implementation
The Minister of Labor, Invalids and Social Affairs, ministers, heads of ministerial-level agencies, heads of government agencies, Chairpersons of provincial People's Committees directly under the central government shall be responsible for implementing this Decree.
