Decree No. 76/2024/NĐ-CP amends and supplements certain provisions of Decree No. 20/2021/NĐ-CP dated March 15, 2021, of the Government on social assistance policies for beneficiaries of social protection.

AMENDING AND SUPPLEMENTING CERTAIN PROVISIONS OF THE GOVERNMENTAL DECREE NO. 20/2021/NĐ-CP DATED MARCH 15, 2021 ON SOCIAL ASSISTANCE POLICIES FOR SOCIAL AID RECIPIENTS PROVIDING REGULATIONS ON SOCIAL ASSISTANCE POLICIES FOR SOCIAL AID RECIPIENTS

Article 1. Amending and supplementing certain provisions of the Governmental Decree No. 20/2021/NĐ-CP dated March 15, 2021 on social assistance policies for social aid recipients

3. Amending and supplementing Clause 5 of Article 4 as follows:

"2. The standard amount of social assistance applied from July 1, 2024 is 500,000 VND/month.

Depending on the budget balance capacity, the rate of consumer price increase, and the living conditions of social aid recipients, the competent authority shall consider and adjust the standard amount of social assistance accordingly; ensuring parity with other policy recipients."

4. Supplementing Clause 6 after Clause 5 of Article 4 as follows:

"3. In cases where local economic and social conditions permit, the People's Committee of the province shall submit to the Provincial People's Council for decision:

a) A higher standard amount of social assistance and social assistance level than those prescribed in this Decree;

b) Other disadvantaged groups not specified in this Decree who are eligible for social assistance policies.".

Article 2. Implementation clause

1. This Decree takes effect from July 1, 2024.

2. Social assistance regimes and policies stipulated in Clause 1, Article 6; Clause 2, Article 11; Clause 1, Article 13; Clauses 1 and 2, Article 14; Clause 1, Article 19; Clauses 1 and 2, Article 20; Clauses 1 and 3, Article 25 and related provisions of the Governmental Decree No. 20/2021/NĐ-CP dated March 15, 2021 on social assistance policies for social aid recipients shall apply the standard amount of social assistance stipulated in Clause 1, Article 1 of this Decree from July 1, 2024.

3. Social aid recipients currently enjoying social assistance regimes and policies under the Governmental Decree No. 20/2021/NĐ-CP dated March 15, 2021 on social assistance policies for social aid recipients shall be adjusted to enjoy social assistance regimes and policies according to the standard amount of social assistance stipulated in this Decree from July 1, 2024.

4. The Chairman of the People's Committee at the district level shall direct relevant agencies to review the list of current social aid recipients and decide to pay benefits according to the standard amount of social assistance stipulated in this Decree from July 1, 2024.

5. Heads of social assistance facilities and social organizations shall report to the competent authorities to ensure funding and organize the implementation of care and support services according to the standard amount of social assistance stipulated in this Decree from July 1, 2024.

Article 3. Responsibility for Implementation

The Minister of Labor, Invalids and Social Affairs, ministers, heads of ministerial-level agencies, heads of government agencies, Chairmen of provincial and centrally-administered city People's Committees are responsible for implementing this Decree.
