THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT

Pursuant to Decree No. 01/2008/NĐ-CP dated January 3, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to Decree No. 113/2003/NĐ-CP dated October 7, 2003 of the Government on management of fertilizer production, business, and Decree No. 191/2007/NĐ-CP dated December 31, 2007 of the Government amending and supplementing certain articles of Decree No. 113/2003/NĐ-CP dated October 7, 2003 of the Government on management of fertilizer production and business;

Pursuant to Decree No. 179/2004/NĐ-CP dated October 21, 2004 of the Government on state management of product quality;

Pursuant to Decision No. 36/2007/QĐ-BNN dated April 24, 2007 of the Minister of Agriculture and Rural Development on regulations for fertilizer production, business, and use;

Based on the proposal of the Director of the Crop Production Department.

DECISION:

Article 1. Attached hereto is the Supplementary List of Fertilizers Permitted for Production, Business, and Use in Vietnam, including 64 types, divided into:

1. Mineral fertilizers 02 types;

2. Micronutrient fertilizers 02 types;

3. Organic biological fertilizers 09 types;

4. Organic mineral fertilizers 09 types;

5. Microbial fertilizers 01 type;

6. Foliar fertilizers 41 types;

Article 2. Organizations and individuals permitted to produce, trade, and use the types of fertilizers listed in this Supplementary List must meet the conditions stipulated in Article 5 of Decree No. 113/2003/NĐ-CP dated October 7, 2003 of the Government on management of fertilizer production and business and Clause 4 of Article 1 of Decree No. 191/2007/NĐ-CP dated December 31, 2007 of the Government amending and supplementing certain articles of Decree No. 113/2003/NĐ-CP dated October 7, 2003 of the Government on management of fertilizer production and business.

Article 3. This Decision shall take effect fifteen days from the date of publication in the Official Gazette. The following types of fertilizers will be removed from the list of fertilizers permitted for production, business, and use in Vietnam from the date this Decision takes effect:

1. MAP fertilizer with serial number 8, page 3 of Decision No. 40/2004/QĐ-BNN dated August 19, 2004 of the Minister of Agriculture and Rural Development on issuing the List of Fertilizers Permitted for Production, Business, and Use in Vietnam.

2. Foliar fertilizer with serial number 190, page 26 of Decision No. 55/2006/QĐ-BNN dated July 7, 2006 of the Minister of Agriculture and Rural Development on issuing the Supplementary List of Fertilizers Permitted for Production, Business, and Use in Vietnam.

3. Organic biological fertilizer with serial number 4, page 4 of Decision No. 102/2007/QĐ-BNN dated December 11, 2007 of the Ministry of Agriculture and Rural Development on issuing the Supplementary List of Fertilizers Permitted for Production, Business, and Use in Vietnam.

4. Micronutrient fertilizers with serial numbers 3, 8, 12, 13, page 2; Organic mineral fertilizers with serial numbers 38, 39, 40, 41, 42, 43, page 7; serial number 44, page 8; Organic biological fertilizers with serial numbers 15, 16, 17, page 9; Foliar fertilizers with serial number 2, page 10; serial numbers 95, 96, page 16 of Decision No. 59/2008/QĐ-BNN dated May 9, 2008 of the Ministry of Agriculture and Rural Development on issuing the Supplementary List of Fertilizers Permitted for Production, Business, and Use in Vietnam.

Article 4. The Heads of the Ministry's Office, the Director of the Crop Production Department, the Head of the Science, Technology, and Environment Department, the Directors of Provincial Departments of Agriculture and Rural Development under the Central Government, the Heads of units, organizations, and individuals related to fertilizer production, business, and use in Vietnam are responsible for implementing this Decision./.
