Pursuant to Decree No. 57/2002/NĐ-CP dated June 3, 2002 of the Government detailing the implementation of the Ordinance on Fees and Charges;
Pursuant to Decree No. 24/2006/NĐ-CP dated March 6, 2006 of the Government amending and supplementing some articles of Decree No. 57/2002/NĐ-CP dated June 3, 2002 of the Government detailing the implementation of the Ordinance on Fees and Charges;
Pursuant to the Decree No. 118/2008/NĐ-CP dated November 27, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
Pursuant to Decree No. 109/2007/NĐ-CP dated June 26, 2007 of the Government on converting state-owned enterprises with 100% state capital into joint-stock companies;
Pursuant to Decree No. 14/2007/NĐ-CP dated January 19, 2007 of the Government detailing the implementation of certain provisions of the Securities Law;

The Ministry of Finance stipulates the level of collection, collection system, payment, management, and use of auction fees as follows:
Article 1: Scope and objects of application
1. Auction fees for selling shares prescribed in this Circular apply to the sale of shares at the Stock Exchange, Securities Trading Center, and other organizations permitted to organize the auction of shares in accordance with the law.
2. The object paying the auction fee for selling shares is enterprises, organizations, and individuals holding shares that are sold through auctions as prescribed by law.
3. Units authorized to collect auction fees for selling shares include: Stock Exchanges, Securities Trading Centers, and other organizations permitted to organize the auction of shares in accordance with the law.
Article 2: Level of auction fees for selling shares
1. The level of auction fees for selling shares applied at Stock Exchanges and Securities Trading Centers is 0.3% of the actual total value of shares sold, but not exceeding 300 million VND per auction of shares.
2. The level of auction fees for selling shares applied at organizations permitted to organize the auction of shares in accordance with the law shall be agreed upon by the parties involved, but the collection rate shall not exceed 0.3% of the actual total value of shares sold.
Article 3: Collection, payment, management, and use of auction fees for selling shares:
1. Fees from the activity of auctioning shares shall be collected in Vietnamese dong. Companies registering to auction shares have the responsibility to pay the entire auction fee according to regulations to the Stock Exchange, Securities Trading Center, and other organizations permitted to organize the auction of shares after completing the auction round.
2. Auction fees collected are not part of the State budget. The unit collecting fees has the obligation to pay taxes on the collected fees in accordance with the law and has the right to manage and use the collected funds after paying taxes in accordance with the law.
Article 4. Organization of Implementation
1. This Circular takes effect 45 days from the date of signature.
2. Other contents related to the collection, payment, management, and use, and publicizing the collection system not specified in this Circular shall be implemented in accordance with the guidance provided in Circular No. 63/2002/TT-BTC dated July 24, 2002 of the Ministry of Finance guiding the implementation of legal provisions on fees and charges, and Circular No. 45/2006/TT-BTC dated May 25, 2006 of the Ministry of Finance amending and supplementing Circular No. 63/2002/TT-BTC and Circular No. 60/2007/TT-BTC dated June 14, 2007 guiding the implementation of certain provisions of the Tax Administration Law and guiding the implementation of Decree No. 85/2007/NĐ-CP dated May 25, 2007 of the Government detailing the implementation of certain provisions of the Tax Administration Law.
3. During the implementation process, if there are any difficulties, organizations and individuals are requested to promptly report to the Ministry of Finance for research and supplementary guidance.
